Data-center tax incentives can lower the upfront cost of an AI infrastructure project by exempting eligible purchases—such as construction materials, servers, software, or other equipment—from specified taxes. Some programs also offer property-tax relief. They do not automatically discount every project expense, and the available evidence does not establish a universal percentage reduction in total construction cost. The actual benefit depends on the site, eligible spending, project qualifications, and the rules in force when purchases are made.

Where the savings come from

A sales- or use-tax exemption reduces tax on purchases that meet a program’s rules. A property-tax abatement can reduce specified property-tax costs instead. Each program defines its own tax and purchase categories: eligibility for servers, for example, does not necessarily mean that labor, land, utility interconnection, or electricity also qualifies.

Texas illustrates why the tax level matters. Under the state’s ordinary qualified-data-center route, eligible purchases are temporarily exempt from the 6.25% state sales tax, but local sales and use taxes remain due. On $1 million of purchases that qualify for the state exemption, the state-tax component would be $62,500 before considering local taxes. That is an illustration of the tax rate applied to eligible purchases—not a prediction of total project savings.

To estimate a project’s benefit, separate eligible purchases from the rest of the budget and apply only the tax treatment confirmed for each category and location. Do not apply an exemption rate to total facility cost: a program’s restricted tax base does not support that kind of blanket estimate.

How selected state programs differ

These official examples show different benefit types and qualification rules; they are not a complete state-by-state inventory or a ranking of which location offers the greatest net value.

Jurisdiction and program Benefit described Entry conditions or duration Timing or compliance detail
Texas: ordinary qualified-data-center route Exemption for necessary and essential qualifying purchases from the 6.25% state sales tax; local sales and use taxes remain due. At least 100,000 square feet; a capital-investment commitment of at least $200 million over five years; and at least 20 qualifying jobs in the county. Certification and registration are required, as is an exemption certificate for covered purchases. Source: Texas Comptroller’s qualified-data-center guidance.
Texas: qualifying large data-center projects Exemption for qualifying projects. Up to 20 years, with the duration dependent on capital investment. Investment and job creation are reviewed after five years. Source: Texas Comptroller’s large-data-center-project guidance.
Minnesota A 35-year exemption for enterprise IT equipment and software used to operate qualified data centers. New data centers must have at least 25,000 square feet and invest at least $30 million within 48 months, as well as meet specified facility characteristics. Electricity purchases stopped qualifying beginning July 1, 2025. Source: Minnesota Department of Revenue’s data-center guidance.
Massachusetts Exemption covering eligible expenditures. Project-specific qualification details are not stated here. Source: Massachusetts program guidance. Cost-accounting reports must document actual eligible expenditures.
Alabama: Chapter 9B Sales-tax and property-tax abatements for eligible projects; the program page describes a longer potential property-tax abatement period for data-processing centers, subject to conditions. Specific thresholds and the length of that potential period are not stated here. Source: Alabama Chapter 9B program page. Confirm the applicable conditions and approved terms for the project.
Illinois Program-specific data-center incentives; the particular eligible cost base is not stated here. Current eligibility terms are not stated here. Source: Illinois Department of Commerce and Economic Opportunity program page. The department says it stopped processing applications beginning July 1, 2026. Illinois regulatory text also describes qualifying-use requirements: property converted to nonexempt use or moved to a nonqualified location can become taxable.

What to check before counting an incentive in a project budget

  1. Identify the exact site and tax jurisdiction. State exemptions and local sales or property taxes can differ. Obtain the terms that apply to the specific city, county, and property, including any local agreement.
  2. Break out the eligible purchases. Classify construction materials, servers, enterprise IT equipment, software, electricity, and property separately. Do not assume that one category’s treatment applies to another.
  3. Test the project against entry conditions. Check minimum floor area, investment timing, job commitments, facility characteristics, location, and certification requirements. A project that misses a threshold may not qualify.
  4. Check whether the program is open and when benefits apply. Confirm application deadlines, sunset dates, start dates, and whether rules have changed. Minnesota’s electricity exclusion and Illinois’s application cutoff show that previously relevant terms may no longer apply.
  5. Account for continuing obligations. Include reporting, audits, use restrictions, and possible recapture in the model. Massachusetts requires a report of actual eligible expenditures; Illinois describes circumstances in which property can become taxable after a change in use or location.
  6. Model the tax benefit against the purchase schedule. Estimate taxes avoided only on qualifying spend, in the relevant periods, and subtract any taxes or costs that remain. Compare that result with the project’s total costs without presenting it as a general construction-cost discount.

These checks matter because incentives can be conditional, time-limited, or tied to continuing use. A project model should reflect the terms approved for that project, rather than treating a headline exemption as guaranteed cash savings.

What published figures do—and do not—show

Georgia’s Department of Audits and Accounts reported $34.6 million in FY 2025 tax revenue from data-center construction and $6.9 million from data-center operations in a December 2025 summary. Those are reported tax-revenue amounts, not estimates of tax savings granted to projects or a calculation of net public benefit.

A 2026 Alaska Legislature document says 38 states offer dedicated data-center incentives. That is a dated count from that document, not a current, complete inventory and not evidence that programs have equal value. Neither figure establishes how much an individual AI project will save.

Why no single savings percentage applies

The programs above cover different purchases or taxes, impose different thresholds and time limits, and attach different compliance conditions. A project’s eligible purchase mix and local tax treatment also matter. Without a defined location, spending schedule, and applicable local assumptions, a fair comparison of net savings cannot be calculated from the program descriptions alone. No national statistic or directly comparable project-level estimate establishes a percentage reduction in total AI data-center construction cost.
