In U.S. federal elections, a bitcoin donation to a political committee is treated as a contribution—not as a loophole around campaign-finance rules. The committee values it at market value when received, and ordinary limits, source restrictions, refund duties and reporting obligations still apply. The Federal Election Commission’s published operational instructions discussed here are specifically for bitcoin; they do not establish the rules for every token or for state and local elections.
Can you donate bitcoin to a U.S. federal campaign?
Yes. The Federal Election Commission (FEC) says the Federal Election Campaign Act treats a contribution as a gift or other thing of value made to influence a federal election. In Advisory Opinion 2014-02, the Commission concluded that bitcoins are “money or anything of value” under the Act. A political committee may receive bitcoin and keep it in a bitcoin wallet until it liquidates it, subject to the same campaign-finance obligations that apply to other contributions. The FEC’s bitcoin contribution guidance is the direct source for that treatment.

The key distinction is between the asset’s form and the contribution’s legal character. Sending bitcoin does not make a contribution exempt from a limit, acceptable from a prohibited source, or compliant merely because the transfer is made through a wallet. The donor, recipient committee and election still matter.
What rules apply to a crypto donation?
For federal elections, the crypto label does not replace the ordinary analysis. A committee must consider who supplied the value, which committee received it, which election it is for, how much the contribution is worth, and whether it must be returned. The FEC’s instructions specifically explain bitcoin handling. They should not be read as a blanket determination for every cryptocurrency, custody arrangement or intermediary.

Limits depend on the donor, recipient and election
Contribution limits are not one universal amount for all crypto donations. They depend on the contributor, the recipient and the election cycle. For 2025–2026, the FEC’s chart lists a limit of $3,500 per election for an individual contributing to a candidate committee. That figure is not a general cap for every recipient or contributor type. Check the FEC’s current contribution-limit chart and identify the applicable election before relying on a number; cycle-specific limits can change.
For a candidate committee, “per election” matters: a contribution limit is tied to an election, not simply to a donor’s total bitcoin sent over time. Other recipients, such as political action committees (PACs) and party committees, have separate limits. The cited chart and the recipient-specific rules should be consulted rather than applying the candidate-committee figure to them.
Prohibited sources remain prohibited
Federal law bars contributions from certain sources, including foreign nationals, corporate treasuries, labor organizations and federal government contractors, subject to the distinctions and exceptions described in FEC guidance. Contributions made in another person’s name are also prohibited. The FEC’s page on who can and can’t contribute sets out the source rules and relevant distinctions.

A wallet address or the technical path of a transfer does not, by itself, establish that the beneficial source is eligible. Nor does pseudonymous transfer activity make an otherwise prohibited contribution permissible. If the committee receives a prohibited, excessive or otherwise unlawful contribution, the FEC says it must return or refund it; holding the bitcoin in a wallet does not remove that duty.
How does a committee value bitcoin?
The committee values bitcoin at its market value when it receives the contribution. That receipt-time value is the relevant valuation in the FEC’s bitcoin guidance; it is not determined by the later price when the committee sells or transfers the bitcoin. The committee also tracks the quantity received and whether the bitcoin was liquidated, using the FEC’s recommended memo notation.
Receipt and liquidation are therefore distinct events. A committee may keep bitcoin in a wallet rather than immediately liquidate it, but custody does not suspend contribution limits, source review, refund requirements or reporting. The FEC’s instructions describe the initial receipt and reporting entries; they do not turn wallet storage into a compliance exception.

How do campaigns report bitcoin donations?
The FEC describes a bitcoin receipt as an in-kind-style contribution for reporting. The committee discloses the contribution and reports the bitcoins as a disbursement using offsetting entries. While the bitcoins are held outside the committee’s depository, those entries leave reported cash on hand unchanged. The accounting presentation reflects that the committee received a valuable asset without receiving cash in its depository.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsForm 3X reporting lines for PACs and party committees
For PACs and party committees filing Form 3X, the Schedule A line depends on the contributor type. The FEC specifies these lines:
| Contributor to the PAC or party committee | Form 3X Schedule A line specified by the FEC |
|---|---|
| Individual | 11(a) |
| Party committee | 11(b) |
| Another type of political committee | 11(c) |
The FEC recommends adding a memo notation with the number of bitcoins received and whether they were liquidated. These exact line instructions are for PACs and party committees using Form 3X; do not assume they describe the form or reporting line for every committee type. A committee should use the reporting guide that applies to its own filing.

What should a donor check before sending bitcoin?
A donor should establish the legal context before making the transfer rather than assuming that an available wallet address means a contribution is acceptable. The practical checks below follow from the federal rules; they are not a substitute for a committee’s compliance procedures or fact-specific legal advice.
- Confirm the election and jurisdiction. Determine whether the intended recipient is participating in a federal election. The federal bitcoin guidance does not resolve state or local rules.
- Identify the recipient committee. A candidate committee, PAC and party committee can have different applicable limits and reporting treatment. Do not apply the candidate figure to a different recipient.
- Check who is providing the value. Confirm that the actual source is not prohibited and that the contribution is not being made in another person’s name. A transfer mechanism does not establish source eligibility.
- Check the applicable limit and election. Consult the live FEC chart for the cycle and recipient, and consider the donor type. The $3,500 figure applies to an individual’s contribution to a candidate committee per election for 2025–2026, not to all crypto contributions.
- Use the committee’s stated process and retain your own transaction details. The cited FEC guidance explains how the committee reports bitcoin; it does not specify a universal donor-facing wallet or transaction process. Follow the recipient’s instructions and keep a record of what was sent and when.
- Ask for clarification when the facts are unusual. If the asset is not bitcoin, a third party is involved, or source eligibility is unclear, do not infer a definitive answer from the bitcoin example. Seek authoritative guidance before proceeding.
Can a campaign keep a crypto donation in a wallet?
For bitcoin, the FEC says a political committee can hold received bitcoins in a bitcoin wallet until liquidation. That answers the custody question, but not whether the contribution may lawfully be accepted. The committee still has to value the receipt at the market value when received, report it as instructed, and return or refund it if it is prohibited, excessive or otherwise unlawful.

The reporting guidance describes the initial receipt, offsetting entries and a memo notation for quantity and liquidation status. It does not support a broader claim that every token, exchange account or custody setup is treated identically. It also does not establish that holding an asset indefinitely changes its original contribution value or compliance status.
Do the bitcoin rules apply to other tokens or to state elections?
Not on the basis of the cited FEC instructions alone. The operational guidance discussed here concerns bitcoin and federal campaign-finance rules. The FEC’s conclusion about bitcoin in Advisory Opinion 2014-02 should not be presented as a ruling that every cryptocurrency or token has the same treatment under every fact pattern.
Likewise, federal rules do not settle whether a state or local candidate may accept a particular cryptocurrency, what limits apply there, or how a jurisdiction requires the donation to be reported. Those questions depend on the relevant jurisdiction’s law. Do not turn the federal bitcoin explanation into a nationwide rule for state and local campaigns.

What the FEC guidance does—and does not—settle
The FEC’s bitcoin page is the clearest operational source for federal committees accepting and reporting bitcoin. Its instructions explain receipt-time valuation, the possibility of holding bitcoin, the in-kind-style reporting treatment and specified Form 3X lines for PACs and party committees. The federal contribution-limit and source-restriction pages supply the related rules that still apply.
An advisory opinion is tied to the facts presented in the request. The FEC explains that advisory opinions do not replace the law or change its meaning; protections apply to the requestor’s activity, or activity materially indistinguishable from it, when undertaken in good faith. See the Commission’s pages on the advisory opinion process and advisory opinions. A novel token, intermediary, custody arrangement or disputed source may require a fact-specific determination rather than an assumption based on the bitcoin guidance.
