1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesAct quickly, but do not pay or concede a GST demand merely because a notice has arrived. Download the notice and every annexure, identify the exact legal provision and tax period, reconcile each amount to your records, and file a point-by-point, evidence-indexed response through the current GST Portal route. If an order is later communicated against the company, calculate the appeal period from that communication date and arrange the required pre-deposit and company digital signature without waiting for recovery action.
The notice, its statutory basis, the relevant tax period and the current law control the strategy. A deadline or defence that applies to one demand route or year may not apply to another.

What a GST demand notice means for your company
A demand notice is the tax department’s formal statement of an alleged liability. Depending on the provision invoked, it may allege short payment of tax, an erroneous refund, wrongly claimed input tax credit (ITC), or another contravention. The notice may also allege fraud, wilful misstatement, suppression or a different specified basis. Those classifications affect the procedure, evidence and limitation rules, so a reply copied from another case is unsafe.

Read the notice, annexures and electronic summary together. The Central Goods and Services Tax Act and Rules set out different demand routes; the CBIC-hosted Act page available online contains legacy text and is not a complete current consolidation. Check amendments and the law applicable to the particular tax period before relying on a section, deadline or consequence: CBIC CGST Act.

First response: preserve records and secure the deadline
Download a complete case file
Use the GST Portal to download the notice and all attachments rather than relying on an email notification alone. Preserve the original file names and a read-only copy. Export or screenshot the relevant portal page showing the communication date and any acknowledgement number. If an attachment is missing or unreadable, note that fact immediately and request access through the channel specified in the notice; do not silently assume that an informal email extends the deadline.
Create a deadline and authority log
Enter the reply and hearing dates in a shared calendar with reminders before the last working day. Confirm who will approve factual admissions, who will settle the legal position, and who can use the company’s digital signature. A tax team should also identify a backup signatory in case the primary signatory is unavailable.
Preserve the business evidence
Place the relevant accounting and transactional data under a litigation hold. Depending on the allegation, useful records can include returns, invoices, purchase and sales ledgers, contracts, payment proofs, e-way or delivery records, reconciliations, credit-note records and correspondence with suppliers or customers. These are practical examples, not a universal statutory checklist; select records that prove or disprove each allegation.

Classify the notice before writing anything
Do not begin with a general denial. First map the notice to the statutory route and factual issue. Confirm the exact provision and subsection, the tax period, the type of tax and whether the department is alleging an intentional act. A demand for an erroneous refund is not answered in the same way as an ITC dispute, and a notice for one financial year cannot automatically borrow a limitation rule from another.
Use a notice classification sheet
| Question | What to record | Why it matters |
|---|---|---|
| Provision | CGST, SGST/UTGST or IGST section and subsection | Determines the demand route, available explanations and statutory limits. |
| Period | Month, quarter or financial year covered | Amendments and limitation rules can differ by tax period. |
| Allegation | Short payment, refund, ITC or other conduct | Sets the factual documents and legal response required. |
| Intent | Fraud, wilful misstatement, suppression or no such assertion | May change the applicable procedure and consequences. |
| Components | Tax, interest, penalty and other amounts | Each component needs its own reconciliation and objection. |
| Authority | Issuing officer and jurisdiction | Helps verify competence, hearing arrangements and filing route. |
Compare the notice’s narrative with its annexure and electronic summary. If an amount in the table does not reconcile to the narrative, identify the discrepancy expressly and ask the officer to provide the computation or correct the record.
Build the issue-by-issue reconciliation
Create a working schedule before drafting the legal reply. One row should represent one allegation, period and amount, not an entire notice. Reconcile the officer’s figure to returns and the general ledger, then classify the result as admitted, disputed or requiring further reconciliation.
| Column | Entry to prepare |
|---|---|
| Department allegation | Quote or accurately paraphrase the specific point and identify the period. |
| Amount | Tax, interest, penalty and any other component shown by the department. |
| Company facts | What happened, when, and which transaction or return explains it. |
| Legal position | Applicable provision, rule, notification or interpretation, verified for the period. |
| Evidence | Attachment name, page or file reference and the fact it proves. |
| Status | Admitted, disputed, already paid or pending reconciliation, with the reason. |
Explain a numerical difference instead of asserting that the demand is “incorrect.” For example, distinguish a timing difference from an omitted supply, identify a duplicate invoice, or show how a credit note was reported. Where the records do not yet establish the answer, say what is being reconciled and provide the expected date for a supplementary submission only if the procedure permits it.

Draft and file the GST reply
Use the applicable portal form
For covered demand proceedings, the GST Rules provide for an electronic DRC-01 summary associated with the show-cause notice and identify DRC-06 as the taxpayer’s representation or reply. The form labels and filing path should be checked against the live portal because the GSTN forms guide available here is dated 2019: CBIC CGST Rules and GST Portal forms guide.
Use a predictable pleading structure
- Heading and authority: state the notice number, date, tax period, GSTIN, legal provision and issuing officer.
- Preliminary facts: identify the service date and briefly describe the business and transactions relevant to the allegations.
- Issue-by-issue reply: use numbered headings matching the notice. State what is admitted and disputed; do not leave the officer to infer your position.
- Factual explanation: set out the transaction sequence, return reporting and payment or credit trail.
- Legal submission: connect the facts to the provision and explain why the proposed tax, interest or penalty does or does not follow.
- Computation: show your calculation and identify any amount already paid or accepted.
- Relief requested: ask for withdrawal or reduction of the disputed demand, correction of arithmetic, credit for payments, and any other relief legally available.
- Verification and index: sign through the required company process and attach a numbered index with page or file references.
The reply should be self-contained. A spreadsheet can support the explanation, but it should not replace a narrative that tells the officer what each attachment proves. Use consistent invoice, return and ledger identifiers, and explain any redactions or unavailable records.
Submit and preserve proof
Upload through the route specified in the notice, complete the portal submission, and download the acknowledgement. Retain the final filed PDF or data export, the attachment index, upload timestamp and any error message. If the portal rejects a file, record the error, reduce file size or change the permitted format as appropriate, and use the official help or alternative filing instruction in the notice before the deadline. Do not treat an unsent draft as a reply.
Prepare for a personal hearing and the order
Check the hearing requirement
Read the notice for a hearing date, video or in-person method, venue, and any requirement to request a hearing. Prepare a short speaking note that follows the written reply: jurisdiction and period, disputed computation, decisive documents, and the exact relief sought. Bring the filed reply and an indexed bundle so that every answer can be tied to a page.

Keep a hearing record
Record the date, participants, documents handed over and questions left unanswered. After the hearing, preserve any permitted written follow-up and proof of submission. Do not introduce a new factual theory casually; if a material correction is necessary, put it in a dated written submission and identify the supporting record.
Obtain the complete order
If the decision is adverse, download the full order and its electronic DRC-07 summary, and record the communication date. The CGST Rules identify DRC-07 as the electronic summary of an order and treat the order summary as the notice for recovery: CGST Rules. Check whether the order addresses every ground, adopts a computation different from the notice, or creates a new allegation. Those differences can affect the appeal grounds and any application for correction available under the applicable law.

Calculate the appeal period from communication
The GST Portal’s FAQ for an appeal against a demand order states that an appeal is filed within three months from communication of the order. It also states that sufficient cause may support condonation for up to one additional month. Treat those figures as the portal FAQ’s guidance, verify the current statute and any notified relief for the relevant period, and calculate the last date from the documented communication date rather than from the order’s signing date: GST Portal appeal FAQ.

The same FAQ states that a minimum pre-deposit of 10% of disputed tax is payable before filing and that a company or LLP must use a digital signature certificate (DSC). Confirm the exact disputed-tax calculation, payment method, authorised signatory and current portal validation before submitting. A payment made against the wrong head or amount can create a second reconciliation problem.
Best Value
File through the Appellate Authority application
Use the portal’s application for appeal to the Appellate Authority, upload the order and grounds, complete the payment step, sign with the company’s DSC and save the acknowledgement. State each error separately: unsupported factual finding, incorrect reconciliation, wrong legal provision, failure to consider evidence, arithmetic error, or an unlawful interest or penalty computation. Attach the earlier reply and key records, but explain why the order is wrong rather than merely repeating the notice-stage submission.
Distinguish filing from admission
Do not assume that preparing an appeal, uploading a draft or making an unlinked payment automatically stops recovery. The portal FAQ describes the balance disputed amount as non-recoverable once the appeal is admitted. Monitor the application for admission and preserve the status record; until then, obtain advice on any recovery communication and available protective steps.
Make sure payments are credited to the right demand
A portal advisory warns that a payment made through DRC-03 may not automatically link to the demand ID, while the “Payment towards Demand” functionality is intended to adjust payment against that ID. Before paying again, compare the electronic liability ledger, payment reference, demand ID and amount already deposited. Keep the challan, acknowledgement and allocation screen, and raise a portal issue promptly if the credit is missing: GST Portal pre-deposit advisory.

Notice-stage representation, voluntary payment and post-order appeal are not interchangeable. Use the following decision frame before approving a course of action.
| Option | Procedural stage | Best fit | Critical checks |
|---|---|---|---|
| Reasoned notice reply | Show-cause notice before adjudication | The company disputes facts, law or computation and has records to explain them. | Exact provision, reply deadline, indexed evidence, hearing request and authorised filing. |
| Payment or agreed amount | Before or during proceedings, where legally permitted | A clearly admitted liability, corrected error or commercial decision to reduce exposure. | Correct demand ID, tax-period allocation, interest and penalty treatment, and whether payment affects the right to contest the balance. |
| Appeal | After an adverse adjudication order | The order remains disputed after the reply and hearing. | Communication date, limitation, pre-deposit, DSC, grounds and admission status. |
For each option, obtain approval from the company’s tax and finance decision-makers. A cash decision should account for admitted tax, payments already made, the required pre-deposit and the portal’s treatment of any remaining liability; a legal decision should account for evidence gaps and the exact provision.
Common mistakes and practical fixes
- Using a generic section or deadline: return to the notice’s exact subsection and tax period, then verify current amendments.
- Replying only to the summary: read every annexure and reconcile the officer’s computation to source records.
- Making a bare denial: provide a transaction narrative, calculation and attachment reference for every disputed issue.
- Uploading without proof: retain the final acknowledgement and all files, not just a local draft.
- Ignoring a hearing: confirm attendance or request an available alternative in writing and preserve the response.
- Missing the order communication date: save the DRC-07 and portal message as soon as the order appears.
- Assuming an appeal automatically stays recovery: monitor whether the appeal is admitted and seek case-specific advice on recovery communications.
- Paying through an unlinked route: verify that the payment is allocated to the demand ID before treating the liability as reduced.
- Letting a non-authorised person sign: confirm the company’s approval chain and DSC well before submission.
When professional advice is warranted
Obtain advice from a GST practitioner, chartered accountant or tax-litigation lawyer when several tax periods or registrations are involved, the notice alleges fraud or suppression, the issue turns on a contested legal interpretation, records are incomplete, or an appeal deadline is close. Give the adviser the complete downloaded case file, reconciliation schedule, payment history, prior correspondence and a dated limitation calculation. Professional advice does not replace the company’s responsibility to verify the facts and approve any admission.
