Yes, a college may use student information in an AI system, but it cannot treat FERPA-protected records as unrestricted training material. In the United States, personally identifiable information from education records generally requires the student’s signed consent before disclosure. Narrow exceptions can permit use by a properly supervised school official or contractor, for a study, an audit or evaluation, legal compliance, or an emergency. Your rights usually include inspecting records, seeking correction of inaccurate or misleading information, controlling most disclosures, and filing a federal complaint—not a general right to erase every data point.
What “student data in AI” can include
College AI projects range from low-risk administrative assistance to systems that influence advising, financial aid, discipline, admissions, or student support. An institution might deploy a natural-language financial-aid assistant, an advising tool that summarizes meetings, an early-alert model that flags possible disengagement, or software that helps staff draft communications. The technology may be supplied by a college, a public agency, or a private vendor.

- Enrollment, course-registration, attendance, grades, academic progress, and transcript information.
- Advising notes, support tickets, counseling-related communications, or other interactions with college staff.
- Financial-aid, billing, household, or scholarship information.
- Disability or health information, when the service is involved in accommodations or support.
- Behavioral signals, including login patterns, engagement events, clicks, submissions, or residence-hall activity.
- Derived material: risk scores, recommendations, classifications, summaries, embeddings, prompts, logs, and generated profiles.
Whether FERPA governs a particular item depends on the legal definition of an education record and whether the record is maintained by or for the institution. A college’s possession of data does not automatically make every data point a FERPA education record, and FERPA is not a complete code for artificial-intelligence privacy.

How FERPA’s disclosure rule applies
The Family Educational Rights and Privacy Act (FERPA) starts with consent. The Department of Education’s regulation, 34 C.F.R. § 99.30, says: “The parent or eligible student shall provide a signed and dated written consent before an educational agency or institution discloses personally identifiable information from the student’s education records, except as provided in § 99.31.” A valid consent identifies the records to be disclosed, states the purpose, and names the recipient or class of recipients.
Sending identifiable records to an AI provider is a disclosure when the provider receives the information outside the institution. The college therefore needs either the student’s written consent or a documented exception. A vague statement that an AI tool “improves services” is not, by itself, a blanket authorization.
The school-official or institutional-service route
A vendor may be treated as a school official performing an institutional service that the college would otherwise use employees to perform. The institution must retain direct control over the use and maintenance of the records. The provider may use the information only for the legitimate institutional purpose, may not make unauthorized redisclosures, and must follow the college’s requirements for security, retention, and destruction. Contracts should spell out those limits rather than relying on a general commercial privacy policy.

Other FERPA exceptions
Depending on the facts, an AI project could fit an exception for a study conducted for developing or validating predictive tests or improving instruction; an audit or evaluation of education programs; compliance with a judicial order or lawfully issued subpoena; or a health or safety emergency. Each exception has conditions. For example, a study or audit must be tied to the permitted purpose, and an emergency disclosure must be limited to the circumstances that threaten health or safety. A college should document the exception and the information shared.
Who controls the rights after you enroll
At a postsecondary institution, the student is normally the “eligible student” and FERPA rights transfer to that student at age 18 or upon attendance at a college, whichever comes first. This transfer happens even if the student is younger than 18 when attending college. The institution’s annual FERPA notice should explain its procedures and categories of records.
Parents do not automatically retain the right to inspect a college student’s records. A college may disclose records without the student’s consent in limited circumstances, including when the student is an IRS tax dependent, when a health or safety emergency exists, or for certain alcohol or drug violations involving a student who is under 21. Those permissions are exceptions, not a return of general parental control.

Your FERPA rights when AI is involved
| Right | What it means for an AI system | Important limit |
|---|---|---|
| Inspect and review | You can request education records maintained by the college or on its behalf, which may include an AI-generated report if the institution keeps it as a record. | A transient prompt, technical log, or vendor-held copy may not be an education record unless the college maintains it as one; ask how the institution classifies it. |
| Request amendment | You can challenge information in an education record that is inaccurate or misleading, including an erroneous human-entered fact or a retained AI-generated statement. | FERPA is not a general right to rewrite an opinion, prediction, or policy judgment simply because you disagree with it. |
| Consent to disclosure | Most disclosures of personally identifiable information require your signed, dated consent identifying the records, purpose, and recipient. | Specific exceptions in § 99.31 can permit disclosure without consent. |
| File a complaint | You may complain to the U.S. Department of Education’s Student Privacy Policy Office if you believe FERPA rights were violated. | The office evaluates FERPA compliance; it does not guarantee deletion, a changed grade, or a particular algorithmic outcome. |
A college generally must respond to an access request within 45 days. The response can be an opportunity to inspect the record or a copy when circumstances make inspection impractical. Ask for the underlying record, not only a dashboard label: the prompt, generated narrative, score, recommendation, date, and source fields may be stored separately.
When an AI output becomes an education record
An output is more likely to be an education record when the college maintains it and uses it in connection with a student. A generated advising summary saved to the student’s file, a retained risk classification used by a case manager, or an AI-drafted disciplinary report that becomes part of an official file may fall within FERPA’s record framework. A calculation performed temporarily and discarded before it is maintained may be treated differently.
Ask the institution four concrete questions: Is the output saved? Where is it saved? Who can see it? Is it used to make or support a decision about me? The answers determine whether an access or amendment request can reach the material and whether human review is needed before an adverse action.

What a responsible college–vendor arrangement should contain
Before records leave the college, the institution should be able to describe the complete data lifecycle. Use this checklist when questioning a registrar, privacy office, disability-services office, financial-aid office, or vendor contact:
- Fields: List every input, including metadata, free-text notes, uploaded documents, and identifiers. Confirm whether prompts, logs, embeddings, and outputs are retained.
- Purpose: State the specific institutional service. “AI improvement” without a defined service is too broad to evaluate.
- FERPA role: Identify whether the provider is a school official, a study or audit contractor, or another recipient relying on an exception.
- Use limits: Prohibit advertising, unrelated product development, sale, profiling for other customers, and unauthorized redisclosure.
- Access: Identify vendor personnel and college roles that can view raw records or generated profiles. Require least-privilege access and maintain disclosure logs.
- Security and location: Document safeguards, incident response, subcontractors, and the countries or regions where data are stored or processed.
- Retention and deletion: Set a schedule for prompts, backups, logs, embeddings, and outputs, and require deletion or return when the institutional purpose ends, subject to documented legal retention.
- Accuracy and review: Require a qualified person to verify material facts before an output affects advising, aid, discipline, admissions, accommodations, or another high-impact decision.
- Student process: Explain how a student can obtain the record, contest an error, request a hearing where applicable, and learn the result of the review.
A contract alone does not make a disclosure lawful. The college remains responsible for choosing an appropriate exception, supervising the provider, and giving the notices required by FERPA and other applicable laws.
How to ask your college what an AI system knows
- Start with the office responsible for the service. Contact the registrar for academic records, financial aid for aid tools, disability or health services for accommodation systems, and the privacy or information-security office for institution-wide platforms.
- Describe the system precisely. Name the application, your role in it, approximate dates, and the decision or communication you received. Ask whether your data were sent to a third-party processor.
- Make a FERPA access request. Request inspection of education records relating to the system, including retained inputs, generated profiles, recommendations, and human notes that incorporate the output. The institution generally has 45 days to respond.
- Request the data map and legal basis. Ask what fields enter the service, the purpose, the applicable FERPA exception or consent form, the vendor’s retention and deletion terms, and the categories of people with access.
- Challenge factual errors. Identify the exact statement, explain why it is inaccurate or misleading, and provide supporting documentation. Follow the college’s amendment procedure; if it denies the request, ask about its hearing process and how your statement of disagreement will be attached.
- Escalate a suspected violation. Keep copies of requests and responses. If the institution disclosed protected information without consent or failed to honor FERPA procedures, consider a complaint to the Student Privacy Policy Office.
How to compare two college AI systems
Marketing claims such as “secure” or “privacy-first” do not answer the operational questions. Compare systems using the same evidence:
Best Value
| Comparison area | Questions to put to each institution |
|---|---|
| Data minimization | Does the tool need identifiable grades or full advising notes, or can it operate on a smaller, de-identified set? |
| FERPA basis | Which exception or consent form authorizes the disclosure, and who documents that determination? |
| Notice and choice | Where is the annual FERPA notice, and when are students told that an AI service is being used? |
| Vendor retention | How long are prompts, logs, embeddings, backups, and outputs kept, and how is deletion verified? |
| Redisclosure | Can the provider use data for its own model training, advertising, or other customers? What contract clause forbids it? |
| Security and logging | Which roles can access records, are accesses logged, and how are incidents reported? |
| Human review | Who checks an output before it influences aid, discipline, admissions, advising, or accommodations? |
| Accuracy and appeal | Can a student see the information used, correct factual errors, and obtain a human reconsideration? |
| Record status | Does the institution maintain the output as an education record, and where can the student inspect it? |
Limits of FERPA and other laws
FERPA addresses education records held by educational institutions and certain parties acting for them. It does not provide a universal right to delete data, prohibit every automated decision, or determine every question about health, disability, employment, consumer privacy, cybersecurity, or public records. State consumer-privacy statutes, disability and health-record rules, employment law, procurement terms, and college policy may impose additional duties. A health-related AI service may also involve rules outside FERPA, depending on who provides the care and how the information is maintained.
For that reason, ask the college which policy governs the particular system and whether another law supplies additional rights. Treat a FERPA response as one part of the explanation, not proof that every privacy concern has been resolved.
Quick Recap
What students should remember
- College enrollment usually makes you the FERPA rights-holder, not your parent.
- Consent is the starting point for disclosing identifiable education-record information, with defined exceptions.
- A vendor handling records for the college must be limited to the institutional purpose, barred from unauthorized redisclosure, and subject to security, retention, and deletion controls.
- You can seek access to maintained records, request amendment of inaccurate or misleading information, and complain to the Department of Education.
- Ask for the data fields, legal basis, retention schedule, access logs, human-review process, and record location before assuming an AI decision is unreviewable.
