How Coast Guards Handle Fishing-Vessel Encounters in Disputed Waters

There is no single international script for a coast guard encountering a fishing vessel in disputed waters. What officers may do depends on the maritime zone, whether the vessel is fishing or merely transiting, the laws and authority the state claims to apply, and any bilateral or provisional arrangements between the states. An encounter may involve monitoring and communication, followed by a boarding or other enforcement action if applicable law authorizes it; an arrest is not automatic.

Why the location and the vessel’s activity matter

“Disputed waters” is not a single legal category. A vessel may be in an area where two states claim overlapping maritime zones, near a boundary whose location has not been agreed, or in waters whose status the states contest. The legal analysis also changes depending on whether the boat is fishing, suspected of breaching a fisheries rule, or simply navigating.

In an exclusive economic zone (EEZ), the UN Convention on the Law of the Sea (UNCLOS) gives the coastal state sovereign rights over natural resources, including their conservation and management. Other states retain navigation and related freedoms, subject to the Convention, and both sides must have due regard for the other’s rights. An EEZ is therefore not the same as territorial waters, and the fact that a vessel is present in an EEZ does not by itself establish that it is fishing unlawfully.

Situation What determines the response
Fishing in an EEZ Whether the coastal state’s fisheries law applies, whether it is consistent with UNCLOS, and whether the vessel’s conduct violates that law. UNCLOS Article 73 permits fisheries-enforcement measures within those limits.
Navigation through an EEZ Navigation freedoms remain relevant. The coastal state’s resource rights do not, by themselves, turn every transit into a fisheries violation.
Overlapping or undelimited claims The states’ claims, any applicable agreement or provisional arrangement, domestic law, and the conduct alleged. A disputed boundary does not supply a universal encounter procedure or, by itself, settle which state may lawfully enforce its rules at a particular location.

Can a coast guard board a fishing boat in a disputed EEZ?

Potentially, if the coastal state has authority under applicable law to enforce a fisheries rule there. Under UNCLOS Article 73, a state may take measures including boarding, inspection, arrest, and judicial proceedings to enforce fisheries laws adopted consistently with the Convention. That is a defined fisheries-enforcement power, not blanket permission to board any foreign vessel anywhere an EEZ claim is disputed.

Article 73 also sets safeguards: a foreign vessel arrested or detained must be released promptly on reasonable bond or other security, and the flag state must be notified promptly of the arrest or detention and any penalties imposed. Those requirements belong in any account of the enforcement power, alongside the possible boarding or arrest.

Where claims overlap, UNCLOS Article 74 calls on opposite or adjacent states to seek an agreed delimitation that achieves an equitable solution. Pending agreement, they are to make every effort to enter practical provisional arrangements and avoid jeopardizing or hampering a final agreement. Such arrangements do not prejudice the eventual boundary. This does not mean enforcement is categorically barred in every disputed area; the relevant agreement, local law, and circumstances must be examined.

What may happen during an encounter

The available official examples show practices that vary by country rather than a global checklist. Monitoring, communication, and coordination may precede a check or enforcement action. The exact authority and procedure depend on the state and the location.

Detection, monitoring, and coordination

The Indian Coast Guard describes surveillance, intelligence gathering, information sharing, and coordination with other agencies as part of its coastal-security work. Its account also describes routine boardings to check fishers’ identity cards and vessel-registration documents. That is evidence of Indian practice within its stated remit, not a procedure that applies to every international boundary dispute.

The U.S. Coast Guard identifies fisheries enforcement and monitoring compliance with international living-marine-resource regimes among its missions. That establishes a responsibility, but does not prescribe a particular sequence for an encounter in disputed waters.

Contacting or signaling a vessel

Canada’s Coastal Fisheries Protection Regulations list several ways to signal fishing vessels: flags, flashing lights, sound signals, hand signals, voice (with or without a loudhailer), radiotelegraphy, and radiotelephony. The listed methods are a Canadian regulatory example, not a universal communications protocol.

Boarding, inspection, or escalation

If officers proceed to a boarding or inspection, the basis is the applicable authority—not simply the existence of a coast guard presence. Canada’s regulations also prescribe safeguards in defined cases involving foreign fishing vessels: specified force may be used only after considering less violent means and being unable to make the vessel stop by those means; the provisions include warnings and an opportunity to stop. These detailed rules should not be generalized to other countries.

A report of an arrest or detention should be checked against the applicable law and treaty obligations, including UNCLOS Article 73 where it governs. Do not treat an inspection, an arrest, and a conviction as interchangeable events.

What happens when a fishing vessel crosses a disputed maritime boundary?

Crossing a line shown on a chart or claimed by one state does not, by itself, answer which state has jurisdiction. The line might represent an agreed boundary, one side’s claim, or a provisional operating arrangement. The vessel’s activity matters too: alleged fishing in breach of a coastal state’s rules raises a different issue from transit through an EEZ.

States may set out practical expectations in bilateral arrangements. For example, the Canada–United States fisheries agreement calls for each party to take measures consistent with international law so that its nationals, residents, and vessels do not violate the other party’s fisheries laws in the other party’s waters and zones. It also says each party will endeavor to inform fishers operating near maritime boundaries about expected enforcement practices.

The agreement expressly preserves each party’s position on the location of any disputed maritime boundary and the legal status of waters or zones it claims. It is an example of how states can manage expectations without resolving a boundary—not a rule that applies to other regions.

How to assess a reported encounter

For a specific incident, the most useful questions are factual and jurisdiction-specific:

  • Where was the vessel? Identify the coordinates and determine whether the area is territorial waters, an EEZ, an overlapping claim, or another zone. A claim on a map is not proof that both states accept the same boundary.
  • What was the vessel doing? Distinguish active fishing or an alleged fisheries violation from ordinary navigation.
  • What authority was invoked? Check the relevant domestic fisheries law, treaty obligations, and any bilateral or provisional arrangement.
  • What action is documented? Separate monitoring or signaling from a boarding, inspection, arrest, detention, release, or later legal proceeding.
  • What do the parties say? Compare official accounts from the enforcing state and the vessel’s flag state or other claimant. A coast guard statement describes that agency’s account; it does not alone settle a disputed boundary or competing legal claims.

Without a named incident, location, and applicable agreement, it is not possible to determine which state has the lawful right to enforce fisheries rules at a particular point. The sound general answer is narrower: coast guards may monitor and communicate with fishing vessels, and may inspect or take further enforcement measures where applicable law authorizes them, subject to the relevant treaty safeguards and arrangements.
