How Businesses Can Assess Currency and Payment Risks in Sanctioned Markets

Before entering a transaction connected to a sanctioned market, assess three separate questions: whether it is legally permitted under every applicable sanctions regime, whether the banks and intermediaries will execute the payment, and whether the currency can be obtained, converted and settled on workable terms. Passing one check does not answer the others. Use the process below before signing a contract or committing funds, then recheck the relevant facts before payment.

Separate legal permission, payment execution and currency risk

Question What to establish What a positive answer does not establish
Is the transaction permitted? Whether the parties, goods or services, funds, conduct and route comply with each applicable sanctions regime, or are covered by a valid exception or licence. That a bank will accept the customer or process the payment.
Will the payment execute? Whether each bank and intermediary on the proposed route is willing and able to process it, and what information it requires. That the transaction is legally permitted or that the quoted currency terms will hold.
Can the currency be obtained and settled on acceptable terms? Availability, conversion quote and spread, fees, liquidity, settlement timing, and restrictions or contingencies relevant to the specific currency pair and transaction. That the underlying transaction or payment route is lawful.

Sanctions rules are specific to jurisdiction and regime. A country’s status alone does not decide whether every transaction involving it is prohibited. The UK Office of Financial Sanctions Implementation (OFSI) says UK rules apply to people in UK territory and to UK persons and entities established under UK law operating abroad. Other legal connections may make other regimes relevant too. Assess them separately rather than assuming one country’s licence or guidance resolves the others.

This is a decision framework, not a country-specific legal opinion or currency forecast. The official sanctions guidance discussed here does not provide comparative exchange-rate, convertibility or payment-delay data for particular markets. Obtain current, transaction-specific information before making a decision.

Build a complete picture of the transaction

Start with a written description of the transaction and the business’s legal footprint. Include the commercial purpose, expected payment route and each party or service involved, not just the buyer and seller named on the contract.

  • Identify the payer and payee, their beneficial owners and controllers, and relevant agents, contractors, project participants and other counterparties.
  • Describe the goods or services, their origin and destination, and any relevant geographic or thematic restrictions.
  • Record the currency, amount, payment purpose, expected payment date and expected settlement mechanism.
  • List the business entities and people involved, where they are established or operating, and all proposed banks, payment providers and intermediaries.
  • Identify each plausible sanctions jurisdiction connected to those people, entities, activities and financial institutions.

Do not consider only geographic restrictions. The UK has both trade and financial sanctions, and OFSI notes that a thematic regime may matter even when the business is not operating in a geographically sanctioned jurisdiction. A transaction may also need more than one licence if separate restrictions apply.

Screen parties and investigate potential matches

Check the current sanctions lists and applicable restrictions for each relevant party and indirect participant. Look beyond a name match: investigate ownership and control, and assess whether an agent, bank, vessel, contractor or other project participant creates exposure. Keep a dated record of the lists checked, identifying information considered, findings and decision rationale. Lists and guidance change, so an old check is not a substitute for a current one.

For a potential match involving U.S. sanctions, the U.S. Treasury’s Office of Foreign Assets Control (OFAC) guidance describes reviewing available identifying information, following the organization’s risk-based procedures, checking for an applicable authorization or exemption, and determining whether the relevant rules require blocking property or rejecting a transaction. Those treatments are not interchangeable, and U.S. procedures should not be applied as a substitute for the rules of another jurisdiction.

Map the payment route before making a commitment

Draw the intended path from payer to beneficiary, showing every bank, correspondent, payment service provider, conversion point and settlement mechanism. Include entities that may handle or hold funds along the way. In high-risk locations, OFSI advises checking every point in the payment chain and the people involved on the ground.

Speak with the proposed bank before agreeing the contract. Ask whether it is willing to process this specific transaction through the proposed route and what compliance information and supporting documents it will require. OFSI warns that a bank may require information about a business’s compliance approach before processing payment. A bank’s willingness is an operational answer, not a legal determination.

Do not assume that changing the route resolves a restriction. If a licence applies, compare the planned route and transaction with its actual terms. OFSI specifically warns that conduct outside a licence—including using a different payment route or exceeding a payment cap—may breach financial sanctions.

Assess currency availability and execution economics

Evaluate the actual currency pair, transaction size and time horizon through the proposed lawful route. Ask the bank or provider for current, transaction-specific terms and record when they were quoted. Recheck close to execution because market conditions can change.

  • Availability: Can the required currency be sourced and transferred through the proposed route?
  • Conversion: What exchange rate and spread are quoted, and how long is the quote valid?
  • Costs: What fees apply at each conversion, transfer and settlement stage?
  • Timing and liquidity: What settlement timetable is expected, and are there liquidity constraints or likely delays?
  • Restrictions: Are there controls on conversion, transfer or repatriation that affect the planned use of funds?
  • Contingencies: What happens if a bank or correspondent declines, delays or returns the funds, or the currency is unavailable?

Keep provider estimates separate from the legal assessment. A provider may indicate that it can process a payment without determining that the transaction is lawful; legal permission does not oblige a bank to accept the customer or execute the route. The official sanctions sources covered here do not establish exchange-rate forecasts or country-specific currency availability, so do not treat a general sanctions assessment as evidence of FX conditions.

Resolve restrictions, exceptions and licences

If a party, bank, fund, service or part of the transaction may be restricted, pause the decision and consult the specific regime and current rules that apply. Establish whether an exception covers the facts or whether a licence is needed. OFSI advises businesses that may be dealing with a designated person to contact it, consider an application and consider independent legal advice.

If relying on a licence, verify that it is current and covers the exact parties, transaction, route, amounts, dates and reporting conditions. Do not infer permission beyond the licence’s wording. OFSI says not to assume it agrees with a holder’s interpretation before it responds; action outside licence terms may lead to enforcement.

For a UK financial-sanctions breach, OFSI’s importer and exporter guidance, updated 28 January 2026, states a maximum consequence of up to seven years in prison and/or a monetary penalty. That figure describes the stated UK consequence in that guidance; it should not be generalized to other jurisdictions or offences.

Compare routes and providers consistently

If more than one route or provider is available, compare the same factors for each and keep supporting evidence with the decision:

  • Legal scope: Which jurisdictions, parties, ownership or control issues, services and restrictions are implicated? Is an exception or licence relied on?
  • Chain transparency: Are all banks, intermediaries, local agents, conversion points and the final beneficiary disclosed?
  • Bank acceptance: Has each relevant bank confirmed willingness to process, and are its information requirements understood before contract commitment?
  • Currency execution: Are availability, quote, spread, fees and settlement timing documented for the specific transaction?
  • Resilience: Is there another lawful route, and what is the plan for delay, return, currency shortage or provider withdrawal?
  • Controls and evidence: Are screening, escalation, approval, recordkeeping and pre-payment rechecks assigned to named roles?

OFAC’s September 2022 instant-payment guidance says cross-border instant payment systems generally present more sanctions exposure than the domestic systems described in that document. It also says each institution’s controls should reflect its own risk assessment. This is a compliance consideration, not a blanket recommendation for or against instant payments.

Investigate red flags rather than treating them as proof

OFSI importer and exporter guidance identifies complex payment methods and complex ownership structures as reasons for added attention. A National Crime Agency report also describes third-party open-account payments and complex corporate structures as indicators that warrant careful review. Consider whether the structure has a credible commercial rationale and whether purported arm’s-length dealings are supported by the facts. A red flag calls for investigation and escalation; on its own, it does not establish that a sanctions violation occurred.

Monitor the transaction and preserve the decision record

Sanctions lists, regimes, licences, bank policies and currency availability can change between contract and settlement. Assign responsibility for re-screening before payment and at relevant milestones, and retain the information and approvals supporting the decision. If the route, parties, amount, currency or other material facts change, reassess rather than relying on the original approval.

In the OFAC process described in its current FAQ page checked 4 October 2026, actions to block or reject a transaction due to OFAC sanctions must be reported within 10 business days, subject to the referenced regulations. Confirm the current reporting rules for the applicable jurisdiction before relying on that timing elsewhere.

Sources and currency of guidance

The UK guidance cited here includes OFSI’s financial sanctions guidance for importers and exporters, updated 28 January 2026, and UK financial sanctions general guidance, updated 12 May 2026. The instant-payment guidance is from OFAC and dates to September 2022. Regulations, lists and guidance can change; verify the current materials and the transaction’s legal position at the point of decision.
