How Brazil’s President and Congress Share Power

Brazil divides federal power between a president who leads the executive and a two-house National Congress that makes laws, reviews presidential actions and oversees public finances. The president can propose legislation, veto bills and issue constitutionally limited provisional measures with force of law, but those powers do not replace Congress’s role in debating, approving and reviewing legislation.

Who does what in Brazil’s federal government?

Brazil is a federal presidential republic. The president heads the federal executive, appoints and dismisses ministers, and administers government. The National Congress exercises federal legislative power through two houses: the Chamber of Deputies and the Federal Senate. The Constitution describes the Union’s powers as “independent and harmonious among themselves.” (Brazilian Constitution, Article 2)

That division is not a strict separation from one another’s work. The president participates in lawmaking, while Congress has responsibilities involving legislation, budgets, nominations and oversight. The Constitution establishes the formal rules; it does not guarantee that a president can secure congressional support for a particular proposal.

How does an ordinary bill become law?

Congress debates and votes on federal legislation. The president can introduce bills in the cases specified by the Constitution, and participates in the process by sanctioning and promulgating approved legislation or vetoing a bill in whole or in part. A veto is a check on legislation, not a final presidential decision: the Constitution provides for Congress to consider it. (Brazilian Constitution, legislative provisions)

The precise voting threshold and procedural deadlines depend on the constitutional procedure in force. Because amendments can change those details, consult the current consolidated constitutional text before relying on a specific number or deadline.

Can Brazil’s president make laws by decree?

Not through an unrestricted general power to legislate by decree. The president may issue a medida provisória, or provisional measure, which has force of law but is subject to constitutional restrictions and congressional consideration. It is an executive route for measures with immediate legal effect, paired with legislative review—not a substitute for Congress’s lawmaking authority. (Brazilian Constitution, Article 62)

The Constitution sets rules for the measure’s subject matter and its consideration by Congress. Its deadlines and procedural effects are technical and should be checked in the current consolidated text rather than treated as a blanket presidential power.

Who controls the federal budget?

The president submits the federal planning and budget proposals to Congress, including the multi-year plan, the budget-guidelines bill and the annual budget proposal. Congress considers them through both houses, with a mixed committee of deputies and senators examining the proposals and monitoring budget execution. The executive therefore has a central role in proposing and carrying out the budget, while Congress retains roles in consideration, authorization, amendment and oversight under constitutional and statutory rules. (Chamber of Deputies, budget process)

How do nominations and oversight act as checks?

The president appoints ministers and nominates some senior officials, but the Constitution requires Senate approval for specified appointments. This makes confirmation a Senate responsibility rather than a power shared identically by both congressional houses. Congress also examines the president’s annual accounts and has other constitutional accountability functions. (Brazilian Constitution)

What the constitutional division does—and does not—tell you

The rules identify who can propose, deliberate, approve, veto, confirm or oversee. They do not establish whether a president has a dependable majority, how parties will negotiate over a bill, or how budget bargaining will unfold in a given congressional session. Those are changing political conditions, not permanent features of the constitutional design.

For a current account of political leverage, seat totals and coalition support need to be dated to the relevant session. The formal arrangement alone cannot show whether a president will win a legislative vote.
