How Banks and Property Firms Screen Transactions for Sanctions and Money-Laundering Risks

Banks and property businesses do not rely on a single name search. They use a layered, risk-based process: identify the customer and everyone relevant to the deal, establish who ultimately owns or controls each entity, understand the transaction and source of funds, screen for sanctions exposure, investigate possible matches, and escalate concerns under the rules that apply in the relevant jurisdiction.

A name appearing on a sanctions list is a lead for investigation, not automatic proof of a breach or money laundering. The legal duties, timing and depth of checks vary by role, transaction and country. A bank’s program is not identical to a letting agent’s, broker’s or title company’s process.

What the screening process is designed to detect

Sanctions controls and anti-money-laundering (AML) controls overlap operationally but answer different legal questions.

  • Sanctions screening looks for prohibited dealings or exposure involving designated people, companies, vessels, governments or territories, including indirect ownership or control where the applicable sanctions regime covers it.
  • AML due diligence and monitoring seek to understand who is involved, who ultimately benefits, where the money came from, whether the transaction makes sense, and whether activity appears suspicious.

A bank may use one technology platform to support both programs, but a sanctions alert is not itself an AML finding, and an unusual source of funds is not automatically a sanctions violation. The outcome depends on the facts, the applicable law and the institution’s documented controls.

How banks screen a transaction, step by step

1. Identify the customer and every relevant party

The process starts at onboarding or when a transaction is initiated. A bank collects identifying information for the account holder, beneficial owners, directors, authorised signatories, counterparties and people acting on behalf of a customer. In a property deal, relevant parties can also include a buyer, seller, borrower, lender, guarantor, trustee, special-purpose company and intermediary.

For a company or trust, the visible contracting party may not be the person who owns or controls it. FATF’s Risk-based Approach Guidance for the Real Estate Sector, published 26 July 2022, describes access to information about the true beneficial owner of a real-estate transaction as an effective customer-due-diligence measure. The guidance also warns that it does not incorporate the 2025 revisions to Recommendation 1, so local implementation must be checked separately.

2. Establish ownership and control through layers

Investigators map the ownership chain rather than stopping at the first company name. They may review corporate registers, constitutional documents, trust information, powers of attorney, shareholder arrangements and reliable identification documents. The question is not only who holds shares, but who can direct decisions, appoint managers, move funds or benefit from the property.

Layered companies, nominee arrangements, unexplained changes in ownership and a refusal to provide ordinary ownership records increase the need for clarification. They are risk indicators, not proof of criminal conduct. A legitimate investment fund, family office or cross-border group can also have several entities, provided the structure and purpose can be explained and documented.

3. Understand the transaction and the source of funds

The institution examines the price, financing, counterparties, intended use of the property, payment route and commercial rationale. It asks how the customer accumulated the money and how the funds moved into the transaction. Depending on the risk, supporting evidence can include bank statements, audited accounts, sale agreements, loan documents, tax records, inheritance documents or financial statements for a business.

FATF case studies identify complex loans or credit, corporate vehicles and the use of non-financial professionals as recurring real-estate laundering techniques. FinCEN’s 2017 advisory similarly describes high-value property, opaque entities and cash purchases without financing as vulnerabilities. A cash purchase is not illegal, and a financed purchase is not automatically safe; the features determine how much scrutiny is reasonable.

4. Screen names and assess indirect sanctions exposure

Sanctions systems compare customer and counterparty data with applicable government and international sanctions information. Banks commonly screen during customer onboarding and continue screening as lists, ownership information or customer details change. A 10 April 2026 Federal Register analysis describes sanctions compliance as generally risk-based and technology-enabled, with diligence intended to identify indirect or layered exposure. That description is an account of common industry practice, not a universal legal checklist for every institution.

Good screening uses more than a name. Analysts consider date of birth, nationality, address, registration number, aliases, transliteration, ownership percentages, control rights and links to known intermediaries. They also examine whether a non-listed company is owned or controlled by a designated person under the relevant regime. Different sanctions programs apply different ownership, control and geographic rules, so an institution must apply the rule that governs the transaction rather than a generic global assumption.

5. Investigate and resolve potential matches

Automated screening produces potential matches. An analyst compares the available identifiers and gathers additional information to decide whether the alert is a false positive, an unresolved similarity or a confirmed match requiring action. The reviewed sources do not establish one universal matching score, algorithm or resolution deadline, and institutions should not treat a software score as a legal conclusion.

Possible outcomes include documenting a false-positive rationale, requesting information from the customer, placing a transaction on hold while facts are checked, obtaining specialist sanctions advice, rejecting or exiting the relationship, or escalating to a compliance officer. Records should show what was checked, which identifiers were compared, who approved the decision and why.

6. Monitor, escalate and report where required

Risk does not end when an account is opened or a property contract is signed. Banks commonly rescreen customers and monitor transactions for activity inconsistent with the customer profile. A sudden transfer from an unrelated company, rapid movement through multiple accounts, unexplained third-party funding or a last-minute change in beneficial ownership can prompt a renewed review.

Reporting duties depend on jurisdiction, business type and the activity observed. FinCEN’s 2017 advisory describes Bank Secrecy Act obligations for relevant financial institutions and encourages certain real-estate professionals to file suspicious-activity reports voluntarily. That 2017 document is historical guidance, not a complete statement of current law for every role. Institutions must follow the rules and reporting channels that apply to them and avoid alerting a customer when law prohibits disclosure.

Why property transactions receive particular attention

Real estate combines high values, complicated ownership structures and transactions that can appear commercially ordinary even when funds are not. FATF’s real-estate work says case-derived indicators can help institutions and property participants perform due diligence and risk analysis on new and existing clients.

  • Ownership is hidden behind several companies, trusts or jurisdictions without a clear business reason.
  • The buyer or seller cannot explain who ultimately benefits from the property.
  • A cash or non-financed purchase is unusually large for the customer’s known profile.
  • Funds arrive from unrelated third parties or move through several accounts without a clear purpose.
  • Loans, guarantees or credit arrangements are unusually complex or repeatedly amended.
  • The price, rental yield or intended use does not make commercial sense in context.
  • Intermediaries resist providing identification, ownership records or source-of-funds evidence.
  • A transaction changes direction shortly before completion, including a new buyer, payer or beneficial owner.

These indicators guide proportionate questions; none proves laundering. FinCEN’s advisory used luxury property bought through shell companies, particularly cash purchases without financing, as an example of how illegal proceeds can be concealed. It also cited an estimated $315 million in assets in a specific 1MDB-related forfeiture case. That figure describes one historical case and is not a measure of how common laundering is in the property sector.

How roles and timing change the checks

Participant Typical focus When checks occur Important qualification
Bank or other covered financial institution Customer identity, beneficial ownership, source of funds, sanctions exposure and transaction monitoring Onboarding, payment or lending review, and ongoing monitoring Exact duties depend on the institution, products and jurisdiction
Property company or developer Buyer, seller, investor and funding structure; ownership and commercial rationale Instruction or reservation, contract and completion, with reassessment when facts change May rely on regulated professionals but remains responsible for its own risk controls
Broker or estate agent Parties to the deal, instructions, payment arrangements and unusual behavior Onboarding and transaction milestones Reporting and verification duties differ by country and licence status
Escrow, title or closing professional Parties controlling funds, payment instructions and settlement documents Before accepting or releasing funds and when instructions change Role-specific AML obligations may apply under local law
UK letting agent Whether proposed dealings would breach financial-sanctions prohibitions When taking instructions, arranging a letting or handling rent or deposits OFSI says legislation does not require screening every landlord and tenant against a sanctions register

What UK letting agents must and do not have to do

The UK Office of Financial Sanctions Implementation (OFSI) says the term letting agency work can cover commercial as well as residential activity. A business label is not decisive: activity that meets the legislative definition can make a firm subject to the relevant requirements.

OFSI’s financial-sanctions FAQ, with the relevant answer added 12 March 2025, states that there is no legislative requirement for letting agents to screen all landlords and tenants against a sanctions register. That does not give an agent permission to ignore sanctions. The prohibition on dealing with funds owned, held or controlled by a designated person, or making funds available to one, still applies.

An agent may use screening software to help identify possible exposure, but the tool does not replace judgement. The agent should understand who is paying rent or a deposit, who controls a corporate landlord or tenant, and whether the proposed arrangement would make funds or economic resources available to a designated person. If a potential match or ownership concern cannot be resolved, the matter should be escalated through the firm’s compliance process and, where required, to OFSI or another competent authority.

Current U.S. Residential Real Estate Rule status

FinCEN’s Residential Real Estate Frequently Asked Questions, issued 18 May 2026, says a federal district court vacated the Residential Real Estate Rule on 19 March 2026. While that court order remains in force, the rule has no legal effect: reporting persons are not currently required to file Real Estate Reports with FinCEN and are not subject to liability for failing to file during that period.

The Department of Justice is appealing. The status can therefore change through further court action. Anyone handling a U.S. residential real-estate closing should check FinCEN’s current FAQ and obtain role-specific legal advice rather than relying on an older implementation calendar or a general internet summary.

This temporary non-filing position does not eliminate other obligations. Banks and covered financial institutions still have applicable Bank Secrecy Act duties, and a professional’s responsibilities depend on whether the person is a lender, broker, escrow agent, title insurer, attorney or another participant. FinCEN’s 2017 advisory identified brokers, escrow agents, title insurers and other closing professionals as possible participants and encouraged certain real-estate professionals to report suspicious transactions voluntarily; it should not be treated as a substitute for current advice.

How to make a screening program reliable

Use a risk-based information request

Ask for information that answers a defined risk question. A simple owner-occupied purchase by a well-documented individual may need less evidence than a high-value cash acquisition through several overseas companies. Excessive, irrelevant requests create delays without improving detection; insufficient requests leave material gaps.

Keep sanctions and AML decisions distinct

Record whether an alert concerns a possible designated person, unclear beneficial ownership, unexplained funds, suspicious behavior or several issues at once. This separation helps the right specialist decide what action and reporting rule applies.

Govern software instead of outsourcing judgement

Sanctions-screening software and AML transaction-monitoring tools can automate list updates, rescreening and case management. They still require accurate input data, sensible matching settings, trained reviewers, documented escalation paths and periodic testing. A tool cannot determine whether two people with similar names are the same person or whether a complicated ownership chain gives someone control.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Document decisions and revisit them

Keep the identity evidence, ownership chart, source-of-funds explanation, screening results, analyst reasoning and approval trail together. Revisit the assessment when sanctions lists change, ownership changes, a payment route changes or transaction behavior no longer fits the original explanation.

What a customer can expect when a transaction is delayed

A legitimate customer may still face questions because screening systems generate false positives and because institutions must investigate indirect exposure. Provide consistent identity details, explain name variations and transliterations, identify every beneficial owner, and supply a coherent explanation for the money and payment route. Ask which document or relationship needs clarification, but do not expect a bank or agent to reveal confidential alert thresholds or prohibited disclosures.

The practical standard is a documented, proportionate explanation. A clear ownership structure and verifiable source of funds can resolve many alerts; an unexplained controller, inconsistent documents or unexplained third-party payment can lead to enhanced due diligence, a pause, refusal or a report under the applicable law.
