How autism-informed forensic interviews differ from standard police interviews

Autism-informed interviewing is not a separate interrogation script. It keeps the forensic goals of an ordinary police interview—an accurate, non-leading account and a fair test of evidence—but changes how officers prepare, phrase questions, pace the conversation and manage the setting. The adjustments are individualized: an autistic diagnosis alone does not tell an interviewer what a particular child or adult can understand, remember or communicate.

The distinction matters most when comparing roles. Guidance for autistic child witnesses, autistic adult witnesses and autistic suspects is not interchangeable. Witness interviews generally seek a person’s account of an event; suspect interviews may add legal cautions, strategic disclosure of evidence and pressure that can change how a person responds.

What changes, and what does not

A standard, well-run child forensic interview is already structured. The National Institute of Child Health and Human Development (NICHD) approach uses introductory ground rules, rapport building, a substantive free-recall phase and a sequence from open prompts to more focused questions. Children are told they may say “I don’t remember,” “I don’t know” or “I don’t understand,” and may correct the interviewer. Training is required; reading a protocol aloud does not by itself produce a reliable interview.

Autism-informed practice changes the fit between that structure and the individual. The interviewer may obtain information about communication, sensory processing and support needs before the interview; define the event more clearly; allow longer pauses; and modify the room. Open, non-leading questioning remains the aim. The change is not permission to suggest answers or to replace free recall with a checklist of yes-or-no questions.

Interview dimension Standard practice Autism-informed emphasis
Question scope Begin with broad free recall, then clarify with focused prompts. Keep free recall, but give usable parameters—such as one event, place and time—and identify the kinds of detail needed without supplying the answer.
Preparation Review the allegation, protocol and available evidence. Also learn the person’s communication strengths, limitations, sensory triggers, language, supports and ways of indicating uncertainty.
Pacing Use the protocol’s sequence and normal conversational pauses. Allow additional processing time, avoid rapid follow-ups and check whether a question was understood before repeating it.
Environment Use a private, suitable interview room. Reduce distracting noise, lighting and movement where practical; allow safe self-regulatory behavior, including stimming, and consider a familiar setting.
Role and age Apply procedures appropriate to a child, adult witness or suspect. Do not transfer witness adaptations or findings automatically to suspects, whose interviews can involve strategic evidence disclosure and different legal pressures.
Safeguards Follow the jurisdiction’s rules on recording, legal advice and support. Use functional assessment and individualized support rather than assuming needs from diagnosis alone.
Evidence base Use validated protocols and trained interviewers. Apply promising autism-specific approaches cautiously; no single adaptation is right for every autistic person.

How a child witness interview is adapted

1. Prepare around the individual child

The Office of Juvenile Justice and Delinquency Prevention (OJJDP) overview on autistic children recommends gathering information before the interview from caregivers, professionals or records. The purpose is practical: identify how this child communicates, what language and concepts are familiar, what competencies and limitations may affect an account, and what conditions make participation easier.

  • Find out whether the child uses spoken language, an augmentative system, drawing, gesture or another reliable mode.
  • Identify sensory differences, likely distractions, fatigue, anxiety triggers and calming strategies.
  • Establish how the child signals “I do not know,” “I do not remember,” confusion or a need for a break.
  • Separate useful background from coaching. A caregiver’s information should guide access and communication, not supply the child’s story.

This preparation also helps the interviewer distinguish an unusual movement, gaze pattern or response delay from evidence that the child is refusing to cooperate. Behavior that is irrelevant to the account should not become a reason to interrupt or discipline the child.

2. Make the room and routine workable

Minimize avoidable noise, visual clutter, harsh lighting, interruptions and unfamiliar people. Explain who is present, what will happen, where recording equipment is and how the child can request a pause. A familiar location can help when practical and when it does not compromise privacy or security. Allowing harmless self-regulatory behavior, such as stimming, can reduce sensory distress and preserve attention; it is not a credibility test.

An anonymous autistic adult quoted in University of Bath guidance described the practical effect: “I know my environment and am not having to contend with sensory distress, which would prevent good communication.” The quotation identifies no named speaker. It illustrates why an apparently minor room change can affect whether a person can process and answer questions.

3. Retain ground rules and free recall

Use the same protective ground rules as in a strong child interview: the child can say “I don’t know,” “I don’t remember” or “I don’t understand,” and can correct the interviewer. Build rapport without rehearsing the allegation, then invite the child’s account with an open prompt. Follow the NICHD sequence, moving to focused questions only after the child has had a genuine opportunity to give free recall.

OJJDP guidance specifically emphasizes open-ended questions, keeping the child on topic and ignoring irrelevant behavior. “Open-ended” does not require an infinitely broad invitation. If “Tell me everything that happened” produces silence or an unfocused answer, the interviewer can define the target event and still leave the content to the child.

4. Define the event without leading

For some autistic people, a very broad prompt creates an executive and language problem: which day, which part of the day, which location and which details count? University of Bath guidance for autistic adults recommends setting parameters such as a particular event, time and place, then stating the categories of information needed—who, what, when, where and how. The interviewer should not insert a suspected action into the question.

For example, “Tell me what happened yesterday in the park between 2pm and 3pm. Start with who was there, then describe what you noticed and what happened next” gives a manageable frame while preserving narrative choice. “Did John touch you in the park?” supplies the disputed act and invites a yes-or-no answer; it is not an equivalent adaptation.

5. Pace for processing and check meaning

Allow a longer pause after each question than ordinary conversation might require. Do not treat delayed eye contact, a flat tone or a pause as proof of dishonesty. Ask one thing at a time, avoid stacking clauses and check whether a repeated question is understood rather than merely saying it louder or faster. If the child uses an alternative communication system, allow the time and equipment needed to use it consistently.

Autistic adult witnesses: clearer tasks, not narrower answers

Adult witnesses may have strong factual memories but find an unbounded conversational task difficult. The University of Bath guidance, prepared by Dr Katie Maras from work supporting autistic adults in interviews, recommends tailoring the approach rather than assuming a uniform autistic communication style.

Use a bounded invitation

Replace an unfocused opening such as “tell me everything that happened” with a defined episode: identify the relevant date or time window, location and people, then invite the person to describe the event in their own words. State that details about who, what, when, where and how are useful. This clarifies the task without converting it into a forced-choice or yes-or-no interrogation.

Keep the account open and non-leading

After the initial account, use prompts that ask for elaboration—“What happened after that?” or “Where were you when you noticed this?”—and avoid embedding the proposition being tested. If a witness interprets a question literally, rephrase it plainly instead of treating the literal answer as evasive. Offer a pause or short break when processing load, anxiety or sensory strain is building.

Consider topic-box interviewing

Witness-Aimed First Account (WAFA) breaks an event into smaller “topic boxes” and explores each in turn. The National Autistic Society’s 2022 explainer describes early findings in which autistic and non-autistic participants produced more detailed and accurate recall with this approach than with a standard best-practice interview. Those findings are promising, not a declaration that WAFA is universally adopted or a settled replacement for trained forensic interviewing. An officer should use it only within the applicable policy, training and recording requirements.

Why suspect interviews require a separate analysis

A suspect interview is not simply a witness interview with a different label. Investigators may provide evidence gradually, test accounts against known facts, observe reactions and apply legal caution procedures. Those strategic choices and pressures can interact with communication, suggestibility, anxiety and processing in ways that witness-interview studies do not establish.

The National Autistic Society article dated October 19, 2022 stated that, at that time, it found no published research on how autistic people fare under those suspect-interview demands. That is a dated assessment of the literature described by the article, not proof that no later study exists and not evidence that a witness technique is safe to transfer into an interrogation.

England and Wales: PACE Code H example

In England and Wales, PACE Code H sets procedures for vulnerable suspects and the role of an appropriate adult. Its urgent-interview provision permits questioning without the appropriate adult only under specified conditions. A superintendent must authorize the step, and the interview must stop once enough information has been obtained to avert the listed consequences. This is a jurisdiction-specific rule, not a global standard.

The code’s healthcare-assessment guidance also directs decision-makers to consider functional ability rather than relying on a diagnosis alone. In practice, that means asking what support this suspect needs to understand the caution, obtain legal advice, communicate and participate—not assuming that every autistic suspect has the same capacity or difficulty.

What the evidence can and cannot show

Structured child interviewing has a baseline

The NIJ CrimeSolutions profile posted February 9, 2012 described one 2008 Salt Lake City study of 1,280 alleged child victims. Cases using the NICHD protocol had charges filed in 52.0 percent of cases, compared with 40.7 percent in pre-protocol cases. The profile labels the evidence “Promising,” says it is based on one study and is no longer being updated. These are case-processing outcomes, not measurements of statement accuracy, and they do not prove that the protocol caused the difference across other settings.

Autism-specific methods remain developing

There is a sound rationale for adapting communication and sensory conditions, but individual variation is substantial. WAFA’s early results should be read as an indication worth further evaluation, not as a universal police standard. The absence of an autism-specific result for one role—especially suspects—cannot be filled by borrowing evidence from another role.

Practical checklist for interviewers

  • Before: review the allegation and protocol; obtain relevant communication, sensory and functional information; arrange an appropriate room, interpreter or communication aid; identify who may support the person and under what legal rule.
  • Opening: explain roles, recording, breaks and ground rules; confirm that “I don’t know,” “I don’t remember,” “I don’t understand” and corrections are acceptable.
  • Questioning: invite free recall; if a broad invitation is unworkable, bound the event by time and place and name the detail categories required without suggesting an answer.
  • Pacing: ask one question at a time, wait, and check comprehension. Do not equate eye contact, vocal tone, movement or delay with credibility.
  • Environment: reduce noise, lighting and interruptions; permit harmless self-regulation; offer breaks before overload becomes a communication failure.
  • Closure: ask what has been missed, clarify ambiguities with non-leading prompts, explain next steps and document the adaptations used and why.

Common errors to avoid

  • Treating autism as a single communication profile and applying a preset “autism script.”
  • Replacing open questions with a run of leading yes-or-no questions because the person needs clearer parameters.
  • Interrupting, repeating rapidly or moving on before processing time has elapsed.
  • Suppressing stimming or focusing on gaze, facial expression and body language as if they were universal credibility signals.
  • Assuming caregiver answers are a substitute for the child’s account or allowing background information to coach the interview.
  • Applying witness findings directly to suspects, or treating PACE Code H as applicable outside England and Wales.

Bottom line

The best comparison is not “standard interviews are flexible and autism-informed interviews are structured.” Both can be structured. Autism-informed practice adds an individualized layer: prepare for the person’s communication and sensory profile, define the event clearly enough to make the task answerable, allow processing time, preserve free and non-leading recall, and use the legal safeguards for that person’s age and role. For suspects, the evidence and safeguards must be analyzed separately rather than inferred from witness work.
