AI content licensing is not one universal permission slip. It is a set of negotiated or statutory rules that define which works may be copied, processed, distributed, retrieved, or used to generate outputs; who controls the relevant rights; where the use occurs; and whether credit, disclosure, or payment is required. Training a model on source works and owning copyright in an AI-assisted output are separate legal questions.
What AI content licensing actually covers
A license is permission for specified uses of specified works. In an AI context, the permission may cover copying files into a training corpus, processing them during model training, making a dataset available to another party, using works for retrieval or inference, or incorporating protected material into a product. A grant for one of these activities should not be read as permission for every other activity.

The parties, territory, term, model or product, and rights included all matter. A creator may own copyright but have assigned or licensed relevant rights to a publisher, employer, agent, or collective management organisation. Before signing or reserving rights, check the original agreement and the chain of title. The person who made a work is not necessarily the person entitled to license a particular AI use.
There is no global rule answering whether a particular work may be used for training without permission. The result depends on the jurisdiction, the work, the rights involved, the way the work is copied or processed, and any contract that governs access. The UK government’s consultation describes the issue as disputed and its proposed rights-reservation model as a policy option, not settled enacted law.

Training data and AI outputs are different legal questions
Training-input permission
Training generally involves collecting or accessing works, making copies, converting or analysing them, and retaining data in a pipeline. Each step can raise different copyright, database, contract, privacy, or confidentiality questions. A license can authorise those steps, limit them to a named model, prohibit redistribution, or require deletion when the term ends.
Output ownership
Whether an output can receive copyright protection is a separate inquiry from whether the input works were licensed. In its January 29, 2025 Part 2 report, the U.S. Copyright Office concluded that generative-AI outputs can be protected only when a human author determines sufficient expressive elements. The Office says this can include creative arrangements or modifications by a person, while merely writing prompts is not enough. That conclusion does not establish that a model’s training corpus was lawfully obtained.
The Office also said existing copyright principles are flexible enough to apply to new technology. That statement addresses how copyright doctrine can operate, not whether every training practice is permitted or whether creators must be paid.

Four mechanisms people often confuse

Keeping these mechanisms separate prevents a common mistake: assuming that a credit requirement guarantees payment, or that transparency proves permission. A contract can combine all four, but each term still needs its own scope and enforcement provisions.

How a licensing deal can be structured
Direct agreement with an AI developer
A creator or rights owner can grant a developer permission for defined works and uses. The agreement should identify the files or catalogue, the model and versions covered, permitted training and evaluation activities, retention and deletion rules, territory, term, sublicensing, security, reporting, and remedies if the developer exceeds the grant.
Publisher or intermediary licensing
A publisher, agency, or other intermediary may aggregate works and negotiate with a developer. This can simplify administration, but the rights owner must confirm that the intermediary’s mandate actually includes AI training, retrieval, or inference. Payment and reporting then depend on the intermediary’s agreement and distribution rules.
Collective management
Collective management organisations can license member works on a blanket basis and may be efficient for large repertoires. The UK consultation describes this route, while also making clear that inclusion depends on the organisation’s mandate and each creator’s existing agreements. A creator should ask which rights are covered, how non-members or reservations are treated, how usage is measured, and when distributions are made.
Machine-readable licensing terms
Really Simple Licensing (RSL) describes machine-readable terms that can include attribution, pay-per-crawl, and pay-per-inference conditions. Those are possible contractual options, not evidence of a universal industry price or an automatic obligation on every AI provider. A machine-readable signal is useful only if the relevant legal framework recognises it, the developer can detect it, and the parties have agreed how compliance and payment work.

Rights reservation in the EU and UK
European Union
Article 4(3) of the Copyright in the Digital Single Market Directive provides a mechanism for rights holders to reserve rights from the text-and-data-mining exception. A reservation can preserve the ability to license relevant uses, subject to the directive and national implementation. The Council of the European Union describes this as a rights-management mechanism rather than a promise of remuneration.
Under the EU AI Act, providers of general-purpose AI models must put in place a policy to comply with Union copyright law and related rights, identify and respect rights reservations, and publish a sufficiently detailed summary of training content. The European Commission says these obligations applied from August 2, 2025, with full enforcement from August 2, 2026. The duties do not require payment to every creator simply because a work appears in a training summary.
United Kingdom
The UK Department for Science, Innovation and Technology consultation, published in December 2024 and updated March 19, 2026, discusses a proposed text-and-data-mining exception paired with rights reservation and transparency. Under the proposal, training could be allowed for works whose rights have not been reserved, while reserved works could be licensed for payment. The consultation is not an enacted rule. It records disagreement between developers and rights holders and notes that litigation is underway; definitive case-law resolution could take years.

Do not export either EU or UK mechanisms to another country without checking local law. A reservation format, exception, or disclosure duty that works in one jurisdiction may have no equivalent elsewhere.

Do AI companies have to pay creators?
There is no universal answer. Payment may arise from a direct contract, a publisher or collective arrangement, or a future statutory scheme. The cited materials establish possible routes but no standard AI-training licence fee, royalty percentage, per-work tariff, or guaranteed payment for every creator.
A payment clause should state what triggers money and how it is calculated. Common structures include:
- Fixed fee: a one-time amount for a defined catalogue, model, territory, and term.
- Usage-based payment: a fee tied to crawls, training runs, requests, inferences, revenue, or another measurable event.
- Collective distribution: money pooled and allocated under an organisation’s rules.
- Hybrid terms: an upfront amount plus usage reporting or a later revenue share.
- No-payment permission: a licence that grants specified rights without remuneration, if the rights holder knowingly agrees and the contract permits it.
Reporting and audit rights are crucial when compensation depends on usage. Specify the data to be supplied, reporting frequency, retention period, audit costs, underpayment interest, and the remedy for missing or unreliable records.

Not as a universal rule established by the cited sources. Attribution can be negotiated in a licence or required by a particular legal instrument. Training a model on thousands or millions of works also raises practical questions about what a meaningful credit would identify: the original creator, a publisher, a dataset, or a collective.
EU transparency obligations require a sufficiently detailed public summary of training content for covered general-purpose AI models. That summary is not necessarily a complete list of works or a credit line displayed alongside every generated image, paragraph, or song. A contract can require a more specific credit, but the format, placement, exceptions, and enforcement should be written down.
Can you stop an AI system from using your work?
Sometimes, but control depends on ownership, prior grants, access conditions, and the law where the use occurs.
- Confirm who controls the rights. Review publishing, employment, assignment, agency, and collective-management agreements. A prior grant may prevent you from reserving or licensing the same rights yourself.
- Identify the exact use. Distinguish web crawling, dataset distribution, model training, retrieval, inference, and output use. A reservation aimed at one activity may not address another.
- Check the applicable jurisdiction. Determine where the work was accessed, copied, processed, and offered, and which exception or contract law applies.
- Use the recognised reservation method. Where a legal framework supports machine-readable or contractual reservations, follow its technical and notice requirements. A generic statement on a website may not satisfy a particular rule.
- Contact the actual operator or rights administrator. Ask what data was collected, whether the work is retained, and what removal or licensing process exists. Keep dated records of notices and responses.
- Escalate with specialist advice. If the work is commercially important or a dispute is active, obtain advice in the relevant jurisdiction before sending a demand or signing a release.
A reservation is not the same as guaranteed removal. Existing contracts, statutory exceptions, jurisdictional limits, and evidentiary issues can affect the outcome.

Do not accept “AI use” as a sufficient description. Ask the counterparty to map every permitted operation to a right, a work category, and a product.
Practical checklists for each side
For creators and rights holders
- Inventory works, registrations, metadata, and co-owners.
- Locate assignments and licences that may give a publisher or collective control.
- Decide whether training, retrieval, inference, and output uses should be treated differently.
- Set attribution, disclosure, payment, audit, deletion, and termination requirements separately.
- Record reservations using the method recognised in the relevant jurisdiction.
- Define whether improvements, fine-tuned models, and future model versions are included.
For developers and publishers
- Document provenance, permissions, reservations, and exclusions for each data source.
- Maintain a copyright-compliance policy and a process for handling notices.
- Separate public transparency summaries from confidential work-level records.
- Measure usage in a way that supports any agreed payment formula.
- Check sublicensing, affiliate access, retention, security, and deletion obligations.
- Assess whether outputs may reproduce protected expression and define response procedures.
What the current evidence shows—and does not show
The U.S. Copyright Office says it reviewed more than 10,000 responsive comments for its AI report. That is a count of comments, not creators, works, licences, or consensus. A 2025 Council of the European Union report says 14 member states reported no awareness of national AI-copyright litigation and five reported litigation. Those responses are not a complete global case census or a legal ruling.
The most defensible conclusion is therefore limited: licensing routes exist, rights reservations may matter under particular laws, and EU transparency and compliance duties now apply on a stated timetable. The sources do not establish a universal entitlement to payment, a universal training opt-out, or a work-by-work attribution requirement. Because laws, enforcement, and market practices are changing, verify the applicable rule and effective date before relying on any reservation, contract, or compliance claim.
