Canadian obligations depend on the province or territory, whether the practice is commercial, where clients and data are located, the transactions performed, and any U.S. relationships. PIPEDA may govern commercial or cross-border activity, while a substantially similar provincial privacy or health-information law may govern in-province work. A therapist with U.S. clients, a U.S. platform, or a U.S. contracting organization needs a fact-specific analysis rather than a blanket answer.
What HIPAA and PIPEDA actually regulate
HIPAA and PIPEDA are not equivalent laws and neither is a universal answer for every Canadian counselling practice. They start with different jurisdictional questions.

| Question | HIPAA (United States) | Canadian privacy framework |
|---|---|---|
| Who is regulated? | HIPAA covered entities and their business associates. | Organizations and professionals covered by the applicable federal or provincial privacy or health-information statute. |
| What triggers coverage? | For a health-care provider, transmitting health information electronically in connection with a transaction for which U.S. federal standards have been adopted. | Often the nature of the organization, commercial activity, health-information role, province, and data movement. The precise trigger varies by statute. |
| Where does it operate? | U.S. federal jurisdiction, including covered relationships that can involve organizations outside the United States. | Provincial and federal jurisdiction. PIPEDA can apply to commercial interprovincial or international flows; substantially similar provincial laws can apply to in-province activity. |
| How are vendors handled? | A vendor handling protected health information for a covered entity can be a business associate and generally needs a written agreement plus safeguards. | Vendor duties depend on the applicable Canadian statute, the therapist’s role, the contract, and the data flow. |
| Are psychotherapy notes special? | Yes. Separately maintained psychotherapy notes receive special disclosure and access treatment. | There is no single Canada-wide rule that reproduces HIPAA’s psychotherapy-note category. Provincial access and record rules must be checked. |
The same practice can therefore have different obligations for different activities. A local appointment, an electronic claim sent through a standardized U.S. transaction, and a disclosure to an out-of-province service provider may not be governed by the same law.

Does HIPAA apply to a therapist in Canada?
Location alone does not answer the question. The U.S. Department of Health and Human Services (HHS) says the HIPAA Rules apply to covered entities and business associates. Covered entities include health plans, health-care clearinghouses, and health-care providers that transmit health information electronically in connection with a transaction for which HHS has adopted a standard. The examples of providers include psychologists, but the electronic covered-transaction condition still matters.

The covered-entity threshold
A Canadian therapist is not automatically a HIPAA covered entity merely because the therapist is a psychologist, counsellor, psychotherapist, or other mental-health professional, or because the practice uses electronic records. The relevant question is whether the provider conducts one of HIPAA’s standardized electronic transactions, such as a transaction type adopted under the U.S. administrative-simplification rules.
Electronic storage by itself is not the same as transmitting information in a covered transaction. A practice that keeps digital progress notes, uses an online calendar, or emails a client has not, on those facts alone, established HIPAA covered-entity status. Conversely, a practice that conducts a qualifying electronic transaction may have HIPAA duties even if it operates outside the United States. The precise transaction, parties, and contractual structure must be examined.
Business associates can create a separate HIPAA relationship
HIPAA also reaches business associates. A business associate is a person or organization that performs certain functions or services involving protected health information on behalf of a covered entity. A covered entity engaging a business associate generally needs a written contract or other arrangement requiring the associate to safeguard protected health information and meet applicable HIPAA obligations.

For a Canadian therapist, the practical issue is often the direction of the relationship. If the therapist is working for a HIPAA covered organization, or a vendor is handling protected health information for a covered entity through the therapist’s work, contractual HIPAA duties may arise even though the therapist practices in Canada. A platform’s marketing description or server location is not enough to decide whether the platform is a business associate. The service, the parties, the data handled, and the contract matter.
U.S. clients and U.S. platforms do not produce an automatic answer
Seeing a client who lives in the United States, using a U.S.-based video or record platform, or receiving payment from a U.S. organization may create a U.S. connection. None of those facts alone proves that HIPAA applies, and none proves that it does not. The HHS definitions establish the federal framework but do not resolve every cross-border combination involving Canadian providers, U.S. clients, platforms, insurers, employers, or referral organizations.
Ask whether the practice transmits information in a HIPAA-standard transaction, whether it is acting for a covered entity, whether a vendor is acting as a business associate, and what the contracts say. Also consider other U.S. laws, professional rules, and the law of the client’s location; those issues are separate from the HIPAA determination.

Do Canadian therapists have to follow PIPEDA?
PIPEDA is Canada’s federal private-sector privacy law. It applies to personal information handled in commercial activity in circumstances defined by federal law, including certain interprovincial and international data flows. The Office of the Privacy Commissioner of Canada describes private-practice health providers as engaged in commercial activity, unless substantially similar provincial legislation applies. That is useful general federal guidance, not a province-by-province ruling for every therapist, counsellor, clinic, nonprofit, or professional structure.

A fee-for-service private practice will commonly raise the commercial-activity question. The analysis still depends on the organization and the activity. A therapist should identify whether the practice is a sole proprietorship, partnership, corporation, clinic, employer-sponsored service, nonprofit, or part of a public system, then check the statute that governs that structure.
PIPEDA can remain relevant when information moves across a provincial or national border. For example, a practice governed by a provincial law for local collection and use may still have a PIPEDA issue when it discloses personal information to a service provider in another province or country. The federal commissioner explains that one part of an organization’s activity can be governed by provincial law while another part, such as a disclosure across provincial borders, can be subject to PIPEDA.
Substantially similar provincial laws
The federal commissioner identifies Alberta, British Columbia, and Quebec as having substantially similar private-sector privacy statutes. Organizations covered by those statutes are generally exempt from PIPEDA for in-province collection, use, or disclosure. The commissioner also identifies substantially similar provincial health-information statutes in New Brunswick, Newfoundland and Labrador, Nova Scotia, and Ontario.
| Jurisdiction identified by the federal commissioner | Type of substantially similar law | Practical implication |
|---|---|---|
| Alberta | Private-sector privacy | In-province private-sector activity may generally fall under the provincial statute instead of PIPEDA. |
| British Columbia | Private-sector privacy | Check the provincial law for in-province activity and assess federal rules for cross-border activity. |
| Quebec | Private-sector privacy | Check the provincial private-sector regime; do not assume PIPEDA is the only applicable law. |
| New Brunswick | Health information | Health-information activities may be governed by the provincial health statute. |
| Newfoundland and Labrador | Health information | Health-information activities may be governed by the provincial health statute. |
| Nova Scotia | Health information | Health-information activities may be governed by the provincial health statute. |
| Ontario | Health information | Health-information activities may be governed by the provincial health statute. |
This list does not mean every therapist in a listed province has the same legal status. Whether a particular professional is a health-information custodian, an organization covered by a private-sector law, or another regulated actor depends on the province, the service, and the arrangement. Territories and provinces not listed above require their own analysis rather than an assumption that PIPEDA or a neighbouring province’s statute controls.
More than one law can apply
“Provincial law applies” and “PIPEDA applies” are not always mutually exclusive. The federal guidance explains that different parts of an organization’s activity may fall under different regimes, and where more than one law applies, the organization must comply with both. Map the activity rather than assigning one label to the entire practice.
Psychotherapy notes versus ordinary clinical notes
HIPAA’s special treatment of psychotherapy notes is narrow. HHS defines psychotherapy notes as notes recorded by a mental-health professional that document or analyze conversations during a counselling session and are maintained separately from the rest of the medical record.

What is excluded from the HIPAA category
The definition excludes information such as medication details, session times, treatment modalities, test results, and summaries of diagnosis, functional status, treatment plans, symptoms, prognosis, or progress when those materials are maintained in the medical record. A progress note, treatment-plan entry, or SOAP note is therefore not automatically a separately protected psychotherapy note simply because it concerns therapy.
The separation requirement matters. A therapist cannot turn an ordinary chart into a special psychotherapy-note file merely by calling every entry a private note. The content, purpose, and manner in which the material is maintained determine whether the HIPAA category is relevant.
Disclosure and authorization under HIPAA
With limited exceptions, disclosure of qualifying psychotherapy notes requires the individual’s authorization. That rule is different from the rules for ordinary protected health information in the designated record set. A therapist should identify which material is a separately maintained psychotherapy note and which material is part of the ordinary clinical record before responding to a request or disclosure demand.
Access rights under HIPAA
HIPAA’s access right generally covers protected health information in a designated record set, including ordinary clinical case notes such as SOAP notes. Separately maintained psychotherapy notes are generally excluded from that access right, although the underlying protected health information recorded elsewhere in the chart remains subject to the applicable access rules.
Do not project this U.S. distinction onto Canadian practice. Canadian access rights, exceptions, retention duties, and rules for professional records come from the applicable provincial or federal regime. A therapist in Ontario, Quebec, Alberta, or another jurisdiction must consult that jurisdiction’s statute and regulator before refusing access to a note or separating records for that purpose.
Safety-related disclosures
HHS guidance says a HIPAA-covered entity may disclose protected health information, including psychotherapy notes, when it has a good-faith belief that disclosure is necessary to prevent or lessen a serious and imminent threat to health or safety and the recipient can help mitigate the threat. The disclosure must also be consistent with applicable law and ethical standards.

That is a HIPAA rule, not a universal Canadian permission. A Canadian therapist facing a threat-to-safety situation must apply the provincial privacy statute, professional obligations, consent rules, and any applicable duty to protect or report. Document the facts supporting the decision and obtain urgent legal or regulatory advice when time and circumstances permit.
A fact-check process for your own practice
Use this sequence to identify the issues that need a jurisdiction-specific answer. It is a planning checklist, not a substitute for legal advice.
- Identify the practice location. Record the province or territory where you practise, where the business is organized, and whether you work from more than one location.
- Identify your professional and organizational role. Determine whether you are a private practitioner, employee, contractor, clinic operator, health-information custodian, or service provider for another organization.
- Map client locations. Note where clients are physically located when services are delivered, including clients who travel or live temporarily in another province or country.
- List every information flow. Include intake, scheduling, telehealth, clinical documentation, billing, insurance claims, referrals, supervision, storage, backups, transcription, email, messaging, and destruction.
- Check for HIPAA-standard transactions. Ask whether the practice transmits health information electronically in a transaction for which HHS has adopted a standard. Do not treat electronic recordkeeping alone as the answer.
- Check U.S. relationships. Identify U.S. insurers, employers, clinics, platforms, or other organizations that receive information or direct the work. Determine whether the therapist is acting for a HIPAA covered entity or whether a vendor is acting for one.
- Classify vendors and contracts. For each service provider, identify what information it handles, on whose behalf, where it operates, and whether the contract contains required privacy and security terms. Under HIPAA, a covered entity’s business-associate relationship generally requires a written agreement.
- Assign the Canadian regime by activity. Check the provincial private-sector or health-information statute, then assess whether PIPEDA applies to commercial interprovincial or international activity. If two regimes apply, plan to meet both.
- Separate record types. Distinguish the ordinary clinical record from any separately maintained psychotherapy notes. Labeling and storage should match the legal category you are relying on.
- Confirm access and disclosure procedures. Identify who receives access requests, how identity is verified, what records are searched, and which exceptions or authorizations the applicable law permits.
Practical privacy controls for a private practice
Once the governing laws are identified, translate them into written procedures. These controls do not replace a statute-specific compliance review, but they expose gaps that are easy to miss.
Build a data-flow inventory
Write down where information enters the practice, where it is stored, who can see it, and where it leaves. Include paper notes, local devices, cloud systems, backups, text messages, video sessions, payment processors, accountants, supervisors, and referral partners. Mark every transfer that crosses a provincial or national border.

Do not rely on a generic terms-of-service page to answer whether a provider is acting as your service provider, a separate organization, or a HIPAA business associate. The contract should identify the parties, permitted uses, safeguards, incident contacts, return or deletion expectations, and subcontracting arrangements required by the applicable law. For a HIPAA covered entity, the business-associate arrangement must address the associate’s obligations to safeguard protected health information.
Keep records intelligible and access-ready
Maintain ordinary clinical documentation in a way that allows a lawful access request to be located and answered. If you keep separately maintained psychotherapy notes, document the separation consistently and understand that the HIPAA access exclusion is not automatically recognized by Canadian law.
Best Value
Train anyone with access
Reception staff, contractors, students, supervisors, and technical support personnel may encounter personal health information. Training should cover authentication, minimum necessary access where applicable, secure communication, misdirected messages, use of personal devices, and escalation of suspected incidents. The exact training and breach duties depend on the governing regime.
Review cross-border choices before adopting them
Before selecting a U.S.-based platform or sending records to an out-of-country service provider, identify the destination, contractual chain, applicable provincial restrictions, consent requirements, and security controls. A vendor’s country of incorporation is only one fact; the location of stored data, support access, subcontractors, and onward disclosures may also matter.
How common scenarios should be analyzed
Solo therapist serving local clients from a Canadian office
Start with the province’s private-sector and health-information rules. If the practice is commercial, PIPEDA may be relevant unless a substantially similar provincial law governs the in-province activity. Digital records alone do not establish HIPAA coverage. Review the actual billing and transmission processes before reaching a conclusion.
Ontario therapist using a U.S. cloud record service
Ontario’s substantially similar health-information regime may govern the therapist’s health-information duties, while the cross-border disclosure and the vendor contract require separate review. The service’s U.S. location does not automatically make the therapist a HIPAA covered entity. Determine whether the service is handling information for a HIPAA covered organization or merely providing technology to the Canadian practice.
Canadian therapist treating a client who is in the United States
Record the client’s physical location during treatment, the contracting party, payment route, insurer involvement, and platform. Ask whether any qualifying HIPAA transaction occurs and whether the therapist is working for a covered entity. Also check Canadian provincial rules and any professional requirements applicable to delivering care across borders. The available federal definitions do not settle this fact pattern without those details.
Canadian clinic contracted by a U.S. health organization
The contract and the clinic’s functions may create a business-associate or other HIPAA relationship. Review the data elements received, the services performed, subcontractors, permitted disclosures, and security obligations. Do not assume that Canadian privacy compliance replaces contractual HIPAA duties, or that a HIPAA contract eliminates Canadian requirements.
Mistakes that create avoidable risk
- “We are in Canada, so HIPAA can never apply.” U.S. transactions and covered-entity relationships can change the analysis.
- “All electronic records are HIPAA records.” HIPAA’s provider threshold turns on covered electronic transactions, not digitization alone.
- “PIPEDA covers every Canadian therapist.” Provincial private-sector and health-information statutes can govern, and the therapist’s role matters.
- “One law covers the entire business.” Local handling and cross-border disclosures may be subject to different regimes, sometimes simultaneously.
- “Every therapy note is a psychotherapy note.” HIPAA’s category requires separate maintenance and excludes many ordinary clinical details.
- “The HIPAA access exception applies in Canada.” Canadian access duties must be checked under the applicable provincial or federal law.
- “A vendor’s privacy page is enough.” The parties, functions, data flows, and written contract determine the relationship and obligations.
When to obtain professional advice
Obtain advice from the relevant provincial privacy or health-information regulator, professional college, or a qualified privacy lawyer when you are adding a cross-border platform, serving clients in another country, receiving U.S. insurer or employer referrals, responding to a disputed access request, separating psychotherapy notes, investigating a disclosure, or deciding whether a serious-threat disclosure is permitted.
Bring a concise fact sheet: practice and client locations, organizational structure, professional designation, transaction types, vendor list, contract terms, records involved, and the intended disclosure. Those details allow an adviser to analyze the actual law instead of offering a misleading yes-or-no answer.
The practical bottom line
HIPAA is a U.S. federal regime triggered by covered entities, business associates, and defined activities—not by the mere fact that a Canadian therapist uses electronic records. PIPEDA is a federal commercial and cross-border framework, while substantially similar provincial private-sector or health-information laws can govern local work. The right answer depends on the practice’s province, role, transactions, clients, vendors, contracts, and data flows. Treat psychotherapy notes and ordinary clinical notes as distinct HIPAA categories only when the HIPAA definition fits, and never assume that distinction controls Canadian access rights. For any cross-border or disputed situation, confirm the result with the applicable regulator or qualified legal adviser.
