Short answer: High 5’s sweepstakes rules currently do not list Illinois as a restricted state, but that is the operator’s eligibility position—not approval by Illinois regulators. What High 5’s rules say about Illinois
High 5 Entertainment, LLC identifies itself as the company behind High 5 Casino. Its Terms of Use and Sweepstakes Official Rules were updated June 26, 2026. In version 43.0 of the rules, Illinois is not among the states excluded from the sweepstakes. High 5’s help page also says it checks a player’s device location and blocks play in restricted states; its listed restrictions omit Illinois.

That means High 5’s published rules indicate that Illinois residents may be eligible for Sweeps Play under the operator’s stated policy. It does not mean Illinois has licensed or approved the service. An account’s location check can still determine whether access is available, and the operator’s rules and state list may change.
What the rules require
- Participants must be at least 21 years old.
- The rules state: “NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.”
- High 5’s Terms of Use describe the service as not offering “real money gambling.” This is the company’s contractual characterization, not an independent regulatory finding.
Why Illinois regulators take a different view
In a February 5, 2026 announcement, the IGB said it had coordinated with the Illinois Attorney General’s Office to issue more than 60 cease-and-desist letters to entities it said were operating illegal online casino and sweepstakes platforms. The agency said recipients were directed to block Illinois residents or stop offering prizes, and warned that failure to comply could expose operators to civil or criminal penalties.

The IGB’s stated position is that gambling in Illinois must fall within an authorized, licensed category, and that internet sites allowing gambling without the required license violate state law. The agency’s release describes the enforcement group and its legal rationale; it does not name High 5 in the release text. A trade report published February 6, 2026, specifically identified High 5 as a recipient of a notice. That specific attribution comes from the trade report.
The key distinction is between an operator allowing or listing a state and the regulator accepting that the offering is lawful. The IGB’s enforcement position applies even if a platform’s own rules do not exclude Illinois.

What the court case did—and did not—decide
In Collins v. High 5 Entertainment, LLC, an Illinois resident alleged, among other claims, violations of the Illinois Loss Recovery Act and Consumer Fraud Act. On May 22, 2026, the U.S. District Court for the Northern District of Illinois ordered the dispute to arbitration and stayed the case. That procedural order did not decide the merits of the allegations or resolve High 5’s legality in Illinois.

What Illinois residents can do
- Check High 5’s current rules and restrictions. Confirm the latest state list and age requirements directly with the operator rather than relying on an older page or account access alone.
- Check the regulator’s current information. The IGB’s position and enforcement actions are separate from High 5’s eligibility statements; review current IGB notices for updates.
- Do not treat access as legal clearance. Being able to open a site, create an account, or pass a location check does not establish regulatory approval.
- For regulated gambling, verify the exact category and license. The IGB identifies licensed riverboat or land-based casinos, racetracks with organizational gaming licenses, sportsbooks licensed under the Sports Wagering Act, and licensed video gaming locations. Confirm that a particular operator and product are authorized before using them.
Bottom line on High 5 in Illinois
High 5’s June 2026 rules indicate that Illinois is not excluded from its sweepstakes play, while Illinois regulators have asserted that unlicensed online casino and sweepstakes offerings that award value violate state law. High 5 was named in a contemporaneous trade report as a notice recipient, but the reviewed court order did not decide the legal merits. The evidence therefore supports neither a claim that Illinois has approved High 5 nor a definitive conclusion that a court has resolved its legality in the state.
