Healthcare Data Breach FAQs: What Information May Be Exposed and What to Do

A healthcare data breach does not expose the same information in every incident. Your notice—or confirmation from the organization involved—is the reliable source for what data was affected and what steps apply to you. Read it carefully, verify the organization’s contact details independently, and watch for unfamiliar medical bills, insurance claims, prescriptions, or debt.

What information may be exposed in a healthcare data breach?

It depends on the incident. A notice should describe the types of information involved, to the extent possible; do not assume that a particular category was exposed unless your notice or the organization confirms it. Possible identity details include your name, Social Security number, health insurance account number, or Medicare number. Information about care, prescriptions, medical devices, or insurance claims may also be involved.

Medical identity theft occurs when someone uses personal information to obtain care or prescriptions, buy medical devices, or submit claims to an insurer. The Federal Trade Commission (FTC) explains this in its medical identity theft guidance.

What should I do after receiving a healthcare breach notice?

1. Read the notice and verify how to contact the organization

Look for the incident description, information involved, protective steps, the organization’s response, and contact details. Those are among the elements HHS says individual notices should include to the extent possible. Contact the organization through a channel you verify independently: use a website you already know is genuine, or find its official number from trusted records or its official website. Do not share medical information with someone who unexpectedly contacts you by phone, email, or text.

These can be signs that someone is using your medical information.

3. Respond to suspicious services or claims

If you find activity you do not recognize, contact your insurer’s fraud department and the providers where the information may have been used. Ask for relevant records, review them, and report inaccuracies to the providers in writing. Keep copies of your communications and any records you receive.

What does the organization have to do?

Under HIPAA’s Breach Notification Rule, covered entities and business associates generally must notify people after a breach of unsecured protected health information, subject to the rule’s definitions and exceptions. An impermissible use or disclosure is generally presumed to be a breach unless the regulated organization demonstrates a low probability that the information was compromised through a risk assessment.

HHS says affected individuals must be notified without unreasonable delay and no later than 60 days after discovery. The notice should explain the breach, the types of information involved, steps individuals can take, the organization’s investigation and mitigation, and contact information. HHS’s Breach Notification Rule guidance sets out these requirements.

The organization also has a separate reporting obligation to HHS. Breaches affecting 500 or more people must be reported without unreasonable delay and within 60 days of discovery. For incidents affecting fewer than 500 people, reporting is due within 60 days after the end of the calendar year in which the breach was discovered; an organization may report sooner. These are deadlines for the organization, not a personal deadline for you. Details are in HHS’s breach reporting guidance.

Does HIPAA cover every health app or service?

No. HIPAA applies to covered entities such as health plans, certain health care providers, and health care clearinghouses, as well as business associates in specified circumstances. The FTC’s Health Breach Notification Rule covers certain personal health record vendors, related entities, and third-party service providers that are not covered by HIPAA. Which rule applies depends on the organization and how it handles the data. HHS explains the distinction in its guidance on consumer health information and HIPAA and FTC rules.

How do I report a possible HIPAA privacy or security violation?

If you believe a HIPAA or Part 2 rule was violated, you can submit a complaint to the HHS Office for Civil Rights (OCR). HHS says complaints generally should be filed within 180 days of when you knew of the violation; OCR may extend the period for good cause. See HHS’s complaint process for instructions.
