Healthcare Data Breach FAQ: What Patients Should Check and Do

If you receive a healthcare data breach notice, first verify who sent it, what information it says was involved, and what protective steps the organization recommends. The notice should explain the incident, describe the data categories affected, summarize the organization’s response, and provide contact information. The next steps depend on the information exposed; not every breach involves Social Security numbers, financial details, or account credentials.

For U.S. HIPAA-covered organizations, affected people generally must be notified without unreasonable delay and no later than 60 days after the organization discovers a breach of unsecured protected health information. That deadline is different from the organization’s deadline to report a breach to the federal government and from the time limit for a patient to complain to the HHS Office for Civil Rights (OCR).

What should I do after a healthcare data breach?

Use the notice as your starting point, not as proof that every kind of information about you was exposed. Read it carefully, verify that it is genuine through a contact channel you locate independently, and match each recommended action to the data and accounts involved. If the notice is vague or you cannot tell whether you are affected, contact the organization using a verified phone number, website, or other known channel and ask for clarification.

  1. Confirm the sender. Check which provider, health plan, business associate, or app says it experienced the incident. If the message includes a link or phone number you are unsure about, do not rely on that contact detail alone; independently locate the organization’s official contact information and ask whether the notice is authentic.
  2. Establish whether your information was involved. A notice may cover a broad group, but it may not say whether a particular person’s records were accessed. Ask the organization whether you are among the affected individuals if the notice does not make that clear.
  3. Identify the exposed information. Note the categories named in the notice, such as medical or insurance information, contact details, or other identifying information. Do not assume the incident included a Social Security number, payment-card number, password, or every record the organization holds about you.
  4. Record the relevant dates and scope. Look for when the incident occurred, when it was discovered, what time period or systems are described, and whether the notice identifies particular records. The date of discovery matters to the federal HIPAA notification clock; it need not be the same as the incident date.
  5. Follow the notice’s protective guidance. If the organization offers a service or suggests an action, read the terms and eligibility details before deciding. If credentials for an account may have been exposed, consider the account-specific steps the organization recommends; do not change unrelated passwords simply because a healthcare breach occurred.
  6. Keep the notice and your follow-up notes. Save the communication and write down whom you contacted, when you contacted them, and what they said. This gives you a clear record if you need to ask a follow-up question or make a complaint.

These are ways to interpret a notice, not a universal remedy checklist. The appropriate response depends on the exposed data and the notice’s specific instructions. A credit freeze, password change, or monitoring service may be relevant in some cases and unnecessary in others; the fact of a healthcare breach alone does not establish that any one of those steps is right for every patient.

What should I check in a healthcare breach letter?

HHS says an individual notice should include, to the extent possible, a brief description of the breach; the types of information involved; steps affected people should take to protect themselves; what the organization is doing to investigate, mitigate harm, and prevent further breaches; and contact information for the covered entity or business associate, as applicable. Use those elements to assess whether the letter gives you enough information to act.

  • Incident description: Does the notice explain what happened in a way that helps you understand the nature of the exposure? It may describe a cybersecurity incident, unauthorized access, or another event. The notice may not answer every technical question, but you should be able to identify the organization and the broad incident being discussed.
  • Information involved: Look for specific categories rather than assuming that all information was exposed. If the notice uses broad terms such as “personal information” or “health information,” ask what those terms mean for your records and whether any account credentials or financial identifiers were included.
  • People, dates, and records in scope: Check whether the letter says which people or records were affected, the relevant time period, or the systems involved. If it does not establish whether you personally were affected, ask the organization directly.
  • Protective steps: Find the actions the organization recommends and any service it offers. For a monitoring offer, check who qualifies, the enrollment deadline, how long the service lasts, what monitoring or recovery help is included, and whether there is a cost after any free period. A service offer is not, by itself, evidence that every recipient needs paid monitoring.
  • Investigation and mitigation: Look for what the organization says it is doing to investigate the incident and reduce potential harm. Its notice should also describe efforts to prevent further breaches, to the extent possible.
  • Contact details: Confirm that a phone number, postal address, or other contact method is usable. If you need more detail, ask a focused question and keep a record of the response.

If a key point is missing or unclear, ask the organization to explain it rather than filling in the gaps yourself. Useful questions include: “Was my information involved?”, “Which categories of information were affected?”, “What period or records are included?”, “What should I do based on those categories?”, and “What are the eligibility and enrollment terms for the service described in the notice?” You can also ask when the organization discovered the breach and what steps it is taking to investigate and address it.

Which breach deadline applies?

There is more than one clock. A deadline for notifying affected individuals is not the same as the covered organization’s reporting deadline to HHS, and neither is the same as a patient’s time limit for filing an OCR complaint.

Action General timing in the HHS materials Whose deadline it is
Notify affected individuals about a breach of unsecured protected health information Without unreasonable delay and no later than 60 days after discovery The covered organization’s notification obligation
Report a breach affecting 500 or more individuals to the HHS Secretary Without unreasonable delay and within 60 days after discovery The organization’s reporting obligation
Report a breach affecting fewer than 500 individuals to the HHS Secretary Within 60 days after the end of the calendar year in which the breach was discovered The organization’s reporting obligation
File a HIPAA complaint with OCR Generally within 180 days of when the person knew of the alleged violation; OCR may extend the period for good cause The patient’s complaint timing

The 60-day notice rule is measured from discovery, not necessarily from the date the incident began. The smaller-breach annual reporting rule applies to the organization’s report to HHS; it does not give a patient extra time to raise a concern. If you believe a regulated organization violated HIPAA or Part 2, the complaint window is generally measured from when you knew of the alleged violation.

Does HIPAA cover health apps?

Not necessarily. HIPAA applies to regulated covered entities and their business associates, not to every company that collects or stores health-related information. HHS describes covered entities as including many healthcare providers, health plans, and healthcare clearinghouses. Business associates may also be subject to HIPAA requirements in connection with services they provide to covered entities.

Certain consumer health record vendors, related entities, and third-party service providers that are not covered by HIPAA may instead fall under the Federal Trade Commission’s Health Breach Notification Rule. That means a breach involving a health app may follow a different regulatory route from a breach at a hospital or health plan. The fact that an app holds sensitive medical information does not, by itself, establish that HIPAA applies to the app.

To work out where to direct a concern, identify which organization actually holds or manages the data and what role it had. A hospital’s notice about its records is different from an app’s notice about information collected directly from users. If a provider or insurer used an outside service provider, the notice may identify a business associate or another involved organization. Ask the organization that sent the notice which entity was responsible for the information and which regulator’s rules it believes apply.

Do not assume that the OCR complaint route is available for every health-app dispute. OCR handles complaints about suspected violations by organizations regulated under the relevant rules. For certain consumer health-record businesses outside HIPAA, FTC rules may be more relevant. Which rules apply depends on the organization and its relationship to the information; a patient’s notice and the facts of the incident control the practical next step.

How do I report a HIPAA violation?

If you believe a regulated organization violated HIPAA or Part 2, you can review the HHS OCR complaint process. A HIPAA complaint generally must be filed in writing within 180 days of when you knew about the alleged violation. OCR may extend the period for good cause. The organization must be one regulated by the rules; not every company with health information is.

  1. Identify the organization. Use the name on the notice and determine whether it is a provider, health plan, clearinghouse, business associate, or another organization. If you are unsure, ask the organization what role it had in the incident.
  2. Describe the alleged conduct. Explain what happened, when you learned about it, and why you believe the organization’s conduct may have violated HIPAA or Part 2. Include the notice or relevant correspondence if it helps clarify the issue.
  3. Check the timing. Note when you knew of the alleged violation and do not mistake the organization’s breach-reporting deadlines for your own complaint period. The general OCR filing window is 180 days from when you knew, with possible extension for good cause.
  4. Use OCR’s current instructions. Review the complaint instructions and filing options published by HHS OCR before submitting, since the agency’s procedures and contact information can change.

A complaint describes a concern for OCR to review; it is not a substitute for asking the organization whether your own information was involved or what the notice’s instructions mean. If the organization is not regulated by HIPAA or Part 2, OCR may not be the appropriate route. Verify the organization and applicable rules before relying on a particular complaint path.

What do breach statistics tell patients?

National figures help show that healthcare breaches can affect many people, but they do not predict what happened in an individual incident or what information it involved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • HHS OCR reported that approximately 190 million individuals were impacted by the Change Healthcare cybersecurity incident, based on information Change Healthcare provided to OCR on January 24, 2025. This is a dated figure for that particular incident, not a current total or a typical breach size.
  • HHS OCR’s annual report published in 2026 says the HIPAA Breach Web Portal received 742 breach reports in calendar year 2024. That number is reports received, not affected individuals; it should not be treated as a count of separate events without considering the report’s definitions.

For a patient deciding what to do, the contents of the specific notice matter more than a national total. A large number of people affected does not tell you whether your records were included, and a smaller incident can still involve information that merits a direct question to the organization.

What if the notice is incomplete or I cannot verify it?

Do not infer that a notice is genuine merely because it uses a healthcare organization’s name, or that it is false merely because it does not answer every question. Verify the communication through a contact channel you find independently. Ask whether the organization sent it, whether you are included, what types of information were involved, and where to obtain the complete instructions.

If the organization confirms the notice but cannot immediately answer a question, note what it has confirmed and what remains unresolved. Keep the notice and any response together. If the uncertainty concerns a possible violation by an organization subject to HIPAA or Part 2, review OCR’s complaint instructions and the filing window rather than waiting on an unrelated deadline.

This is general U.S. information about federal notification and complaint rules, not a determination about a specific breach or an analysis of state-specific laws. A particular notice may involve additional facts or instructions not addressed here.
