H-1B vs. O-1 Visa: Eligibility, Costs, and Which Is a Better Fit

H-1B and O-1 visas solve different eligibility questions. H-1B is built around a qualifying specialty-occupation job and an employer’s petition; O-1 is built around a person’s record of extraordinary ability or achievement and work in that area. The better fit depends on the position, the worker’s evidence, who can petition, whether an H-1B cap process applies, and the filing’s current costs. Neither route is universally easier, cheaper, or faster.

How H-1B and O-1 eligibility differ

Question H-1B O-1
What is the central test? Whether the offered position qualifies as a specialty occupation and the beneficiary meets its requirements, as documented by the petitioner. Whether the beneficiary meets the applicable extraordinary ability or achievement standard and will continue working in that area.
Who petitions? A qualifying employer files the petition. A U.S. employer or agent files under the applicable requirements.
Can an annual cap affect the case? Many cases are cap-subject, but cap-exempt circumstances and the advanced-degree exemption can change the filing path. The H-1B annual cap process is not the O-1 eligibility test.
What evidence is central? Evidence about the position, its requirements, and the beneficiary’s qualifications. Extensive evidence of the beneficiary’s record, assessed under the applicable O-1 category.

USCIS describes these as separate classifications with different standards. Both use Form I-129, but that shared petition form does not make their eligibility tests interchangeable.

What an H-1B case must establish

The ordinary H-1B comparison focuses on the job: the position must meet the specialty-occupation standard, and the employer must document both the role and the beneficiary’s qualifications. USCIS also recognizes certain other statutory H-1B categories, but they are outside the usual specialty-occupation comparison.

When the cap process matters

Many H-1B petitions are subject to an annual cap process involving registration and selection. For covered cap filings, USCIS’s filing checklist requires a valid registration selection notice and compliance with the applicable filing window. Do not assume every H-1B applicant enters a lottery: some cases may be cap-exempt, and an advanced-degree exemption may apply in qualifying circumstances. Whether either path applies depends on the specific petitioner and case.

What an O-1 case must establish

O-1A: sciences, education, business, or athletics

For O-1A, USCIS requires sustained national or international acclaim, achievements recognized through extensive documentation, and a plan to continue work in the person’s area of extraordinary ability. The initial evidence route may be a major, internationally recognized award, or evidence under at least three applicable evidentiary categories. Meeting three categories is not an automatic approval: USCIS evaluates the complete record against the standard.

O-1B: arts and motion-picture or television work

O-1B has separate standards for people in the arts and in motion-picture or television work. The O-1A criteria should not be treated as a checklist that applies identically to O-1B cases; the applicable category and evidence standard need to be assessed for the work involved.

Petition documents

O-1 filings generally include a written contract or a summary of an oral agreement, along with an advisory opinion from an appropriate peer group or expert. USCIS describes exceptions, including certain cases where no appropriate peer group exists or where a qualifying arts readmission is involved. An employer or agent must also be able to file under the applicable requirements and support the proposed work.

How to compare H-1B and O-1 costs

There is no reliable single all-in price to quote for either route from the available fee information. Both use Form I-129, and the government filing amount depends on the classification, petitioner characteristics, and fee rules in effect when the case is filed. USCIS’s fee schedule and the current form instructions are the references to check for an actual filing; an incorrect fee can result in rejection.

The H-1B supplement to Form I-129 lists selected additional fees, including ACWIA amounts of $750 or $1,500 in specified circumstances, exemptions, and a $500 fraud-prevention fee for specified petitions. Those selected figures are not a complete fee calculation or a current all-in total. Do not use them alone to compare H-1B and O-1 costs.

Build a case-specific budget by separating government filing fees from any optional processing charge, legal fees, employer-side costs, and filings for dependents. The exact amounts and applicability of those components must be checked for the filing date; they are not established as a complete comparison here.

Decision area H-1B case to assess O-1 case to assess
Work and eligibility Does the offered position qualify as a specialty occupation, and can the petitioner document it? Does the person meet the relevant extraordinary ability or achievement standard, and will the proposed work continue in that area?
Evidence Do the job requirements and the beneficiary’s qualifications fit the H-1B requirements? Is there strong, field-recognized evidence under the applicable criteria, or a qualifying major award?
Petitioner Is there a qualifying employer, and does cap-subject or cap-exempt treatment apply? Can a U.S. employer or agent file and support the proposed work and required documentation?
Timing Does the annual registration and cap process apply, and what filing window governs? What petition timing and evidence preparation are needed for this case?
Cost Which current I-129 and applicable H-1B fees apply to this petitioner and filing? Which current I-129 and applicable O-class fees apply to this filing?

If the central uncertainty is whether the job qualifies, focus first on the H-1B position and documentation. If it is whether the person’s record meets the relevant standard, focus on the O-1 category and the quality of the evidence. Then confirm the petitioner, timing path, and current fee calculation before treating either route as viable.

What to verify before filing

  • Confirm the current USCIS eligibility guidance and the correct O-1 category for the work.
  • Check whether the H-1B filing is cap-subject, cap-exempt, or potentially eligible for the advanced-degree exemption, and follow the applicable registration and filing-window rules.
  • Use the current Form I-129 instructions and USCIS fee schedule to calculate the filing’s required fees and payment method.
  • For O-1, confirm the contract or agreement documentation and whether an advisory opinion is required or an exception applies.

Immigration requirements, forms, fees, and filing procedures can change. The comparison above is general information, not an assessment of an individual case; consult current USCIS materials and qualified immigration counsel for case-specific advice.
