Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteThe deciding factor is the relationship between the job and the employer—not the applicant’s nationality. H-1B is usually the route when a U.S. employer offers a qualifying specialty-occupation job. L-1 is usually the route when a multinational transfers an employee who has worked for a qualifying related foreign entity. An Indian IT employee cannot choose between them based only on a software job title, salary, or perceived approval odds.
For families, the difference can be significant: a spouse admitted in qualifying L-2S status is employment-authorized incident to status, while an H-4 spouse generally needs separate USCIS employment authorization under specified conditions. The sections below show how to test eligibility, prepare evidence, avoid common errors, and distinguish petition approval from a visa and admission.

Start with the one-question test
Ask whether the proposed move is a direct U.S. hire or an internal multinational transfer.
Recommended Free Tools
- Direct U.S. hire: If a U.S. employer is offering a role that qualifies as a specialty occupation and the worker meets that role’s requirements, H-1B may fit.
- Internal transfer: If the worker has been employed abroad by the same organization or a qualifying related entity and will move to a related U.S. office, L-1 may fit.
- Neither fact pattern: IT experience alone does not create L-1 eligibility, and a U.S. job title alone does not establish H-1B eligibility. The employer, duties, education, corporate records, and work history must support the category.
H-1B and L-1 are temporary classifications. USCIS adjudicates the petition, the Department of State issues a visa to an eligible traveler outside the United States, and U.S. Customs and Border Protection decides admission at the port of entry. A petition approval is therefore not itself a visa or a guarantee of entry.

How H-1B eligibility works
The specialty-occupation test
The Department of Labor describes the core standard this way: A specialty occupation requires the theoretical and practical application of a body of specialized knowledge and a bachelor’s degree or the equivalent in the specific specialty.
The employer must show that the offered position requires that level of specialized knowledge and that the worker meets the position’s education or equivalent requirement. See the U.S. Department of Labor H-1B program guidance.
“Software engineer,” “developer,” “data analyst,” or another familiar IT title does not prove the test. Adjudicators look at the position’s actual duties, the knowledge those duties require, the employer’s business, and the connection between the required specialty and the worker’s degree or equivalent credentials. A general computer-related degree may not answer every specialty question; the job description and the specific academic field must align.
The cap, registration, and selection
The general statutory numerical limits are 65,000 H-1B visas plus a separate 20,000 exemption for qualifying U.S. advanced-degree holders. A cap-subject employer normally submits an electronic registration before filing a cap petition, and USCIS must select the registration before the employer can proceed with that cap case. These numbers are annual limits, not an individual’s probability of selection.

Some employers and petitions are exempt from the cap. Whether an institution, affiliated organization, current worker, or particular employment arrangement qualifies depends on the facts. Do not assume that an employer is cap-exempt because it works with a university or because the employee has previously held H-1B status. Ask the employer to identify the legal basis for any exemption.
Registration dates, fees, selection mechanics, and filing logistics can change by fiscal year. The USCIS FY2025 registration materials are historical process guidance; they should not be reused as current dates or fees. Check the current USCIS and DOL instructions before an employer submits anything.
What the employer must establish
The sponsoring U.S. employer must present a real position, a qualifying employer-employee relationship, and evidence that the work will be performed under the terms of the petition. The case should connect the duty descriptions to the specialty requirement and to the employee’s education or equivalent background. A generic template that lists technologies without explaining the work, level of responsibility, and required academic discipline leaves avoidable questions.
The employee’s Indian nationality neither creates a preference nor changes the specialty-occupation standard. The same job, degree, and employer evidence would be evaluated under the same H-1B rules for a worker of another nationality.
H-1B preparation checklist
- A detailed description of day-to-day duties, required knowledge, tools, and decision-making responsibility.
- The employer’s explanation of why the role requires a specific specialty and degree level.
- Degree certificates, transcripts, and any required equivalency evidence for a foreign qualification.
- Evidence of the offered employment and the work location or locations covered by the petition.
- Confirmation of whether the case is cap-subject, registered and selected, or legally cap-exempt.
- A record of prior U.S. immigration time so the employer can assess the six-year calculation and any statutory exception.
How L-1 eligibility works
The qualifying organization relationship
L-1 is an intra-company transfer classification, not a general visa for experienced IT professionals. USCIS requires a qualifying relationship between the foreign and U.S. organizations—such as a parent, branch, subsidiary, or affiliate—and evidence that the organizations conduct business as required. The relationship must be real and documented through ownership, control, organizational, and operational records.

USCIS explains that L classifications allow a U.S. employer to transfer an executive, manager, or professional employee with specialized knowledge from an affiliated foreign office to a U.S. office. The relevant USCIS L-status guidance uses that description for employer and work-authorization purposes.
The one-year foreign-employment requirement
The employee generally must have worked full-time for at least one qualifying year during the preceding three years for the petitioner or a qualifying related organization outside the United States. The employer should be able to document the exact dates, employing entity, work location, full-time nature of the employment, and duties performed.
Short assignments, contractors, payroll gaps, or work for an entity that is not actually part of the qualifying corporate group can complicate the calculation. The fact that two companies share a brand, client, or technology platform does not by itself establish the required relationship.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesChoosing L-1A or L-1B
L-1A is for executive or managerial capacity. The proposed U.S. duties must be primarily managerial or executive, rather than ordinary hands-on production work with a managerial title. The organization should explain reporting lines, authority, budget or personnel responsibility, and the decisions the employee will make.
L-1B is for specialized knowledge. The petition should explain what knowledge the employee has about the organization’s products, services, research, systems, techniques, or procedures; how that knowledge was developed; why it is uncommon or advanced within the organization or industry; and how the U.S. assignment will use it. A long tenure or senior-sounding title is not a substitute for a specific specialized-knowledge explanation.
An employee can move from one L capacity to another in appropriate circumstances, so the proposed U.S. duties—not the current foreign title alone—must be analyzed.
Evidence and blanket petitions
USCIS identifies evidence such as entity records, organizational charts, personnel information, detailed duty descriptions, and explanations of specialized knowledge. A qualifying organization may use a blanket petition when it meets the applicable organizational criteria, but a blanket petition does not waive the beneficiary’s one-year foreign employment or L-1A/L-1B role requirements.
There is no H-1B-style annual cap registration for L-1. That removes one procedural hurdle, but it does not make L-1 an easier or faster option. The corporate relationship, qualifying employment, and U.S. duties remain essential.

Which route fits common Indian IT situations?
| Situation | Likely issue to analyze first | Why |
|---|---|---|
| An Indian employee receives an offer from an unrelated U.S. technology company. | H-1B specialty occupation and cap status. | There may be no qualifying multinational relationship for L-1. |
| An employee of an Indian office will join the company’s U.S. subsidiary. | L-1 relationship, one-year foreign employment, and L-1A or L-1B duties. | The transfer theory may fit, but ownership and job evidence must be proven. |
| A worker has an advanced U.S. degree and a cap-subject offer. | H-1B registration and the advanced-degree exemption. | The 20,000 exemption is a statutory category, not a guarantee of selection. |
| A consultant has worked on a client account but not for a related foreign entity. | Whether there is any qualifying L-1 employment at all. | Client familiarity does not replace employment by the qualifying organization. |
| A spouse needs to work soon after arrival. | H-4 authorization conditions versus L-2S incident authorization. | Family employment consequences may affect the practical choice when both principal routes are genuinely available. |
Stay limits, extensions, and the visa-versus-status distinction
The usual category ceilings are different:
| Classification | General maximum | Important qualification |
|---|---|---|
| H-1B | Generally six years. | Statutory exceptions can allow additional time in circumstances such as certain employment-based permanent-residence processes. |
| L-1A | Up to seven years. | The limit covers the qualifying L-1A period; prior time in certain other classifications can affect calculations. |
| L-1B | Up to five years. | The limit is a category maximum, not a promise that every approval grants the full period. |
The statutory L-1 rules appear in 8 U.S.C. § 1184. Department of State guidance discusses the general six-year H-1B limit and exceptions in its H-visa guidance.
A visa stamp is a travel document used to request admission; it is not the same as the authorized period of stay granted by CBP. The admission record controls how long the person may remain after entry. A visa can expire while the person is lawfully present, and a valid visa does not guarantee admission. Plan extensions and travel using the individual admission record and current agency instructions.
Spouse and family work authorization
L-2S spouses
A qualifying spouse admitted in L-2S status is considered employment-authorized incident to status. USCIS explains the relevant evidence and notation in its L nonimmigrant status guidance. The spouse should check the admission notation and maintain the documents needed for Form I-9 verification.
H-4 spouses
An H-4 spouse is not automatically authorized to work merely because the principal worker holds H-1B status. The spouse generally must obtain USCIS employment authorization under qualifying conditions, or independently hold another work-authorized status. The Department of State’s H-visa guidance describes this limitation. Do not begin employment until the applicable authorization is in place.
Because H-4 eligibility and employment authorization are conditional, neither “every H-4 spouse can work” nor “no H-4 spouse can work” is accurate. The principal worker’s immigration history and the family’s specific documentation matter.
India reciprocity and dependent visa validity
The Department of State’s India reciprocity schedule states that derivative H-4 and L-2 visa validity may not exceed the principal applicant’s visa validity. This is a rule about visa validity for travel, not the authorized stay granted at admission. Check the current schedule and each family member’s admission record rather than assuming that every dependent receives the same end date.
A practical preparation plan
If the case is an H-1B possibility
- Map the job duties. Write what the employee will actually do, the specialized knowledge required, the tools or systems involved, and the level of independent judgment.
- Match the specialty. Identify the specific degree field or equivalent preparation the position requires and explain why a general degree is not enough if the duties demand a narrower discipline.
- Check cap status. Ask whether the employer is cap-subject, whether the registration has been selected for the applicable fiscal year, or what cap-exemption basis applies.
- Assemble education evidence. Collect degree records, transcripts, and any credential-equivalency material needed for a foreign qualification.
- Review prior U.S. time. Calculate prior H or L stays and investigate any statutory exception before promising a start date or total period.
- Separate the agencies. After petition adjudication, determine whether visa issuance through the Department of State is required and remember that CBP makes the admission decision.
If the case is an L-1 possibility
- Document the corporate chain. Gather ownership, control, incorporation, organizational, and active-business records linking the foreign and U.S. entities.
- Prove the foreign year. Record the employee’s full-time dates, payroll entity, work location, and duties for at least one qualifying year in the relevant three-year period.
- Define the U.S. capacity. Decide whether the proposed work is primarily L-1A managerial or executive work or L-1B specialized-knowledge work.
- Build duty evidence. For L-1A, show reporting lines, authority, and management responsibilities. For L-1B, describe the specialized knowledge, how it was acquired, and how the U.S. assignment will use it.
- Check filing structure. Determine whether the organization has a qualifying blanket petition or must pursue an individual petition; a blanket route still requires beneficiary-specific proof.
- Plan admission and family documents. Coordinate the principal and dependent applications, confirm the correct status notation, and use the admission records to track authorized stay.

Assuming any two offices are related companies
Problem: Using shared customers, a common product, or a vendor relationship as proof of an L-1 qualifying organization.
Correction: Trace ownership or control and provide entity records. If the companies are not parent, branch, subsidiary, or affiliate organizations under the applicable rules, L-1 may not fit.
Counting client work as qualifying foreign employment
Problem: Treating time assigned to a client as time employed by a qualifying foreign entity when payroll and corporate records show otherwise.
Correction: Verify the legal employer, full-time dates, and organizational relationship. Client familiarity can support a narrative but cannot replace the required employment.
Assuming no lottery means no H-1B issue
Problem: Concluding that every H-1B case requires selection, or that an exemption can be assumed.
Correction: Have the employer classify the petition as cap-subject or identify the specific cap-exempt basis, then use the current fiscal-year USCIS instructions.

What the available statistics can—and cannot—tell you
The 65,000 regular H-1B limit and 20,000 advanced-degree exemption are statutory annual numbers. They do not predict an individual’s selection chance, approval chance, or ability to obtain a visa. The USCIS FY2024 H-1B characteristics report contains administrative data, including prior-status information, but it is not a head-to-head success-rate comparison for Indian IT employees and its self-reported fields have limitations.
There is no verified figure here for a current Indian applicant’s selection probability, L-1 approval probability, processing time, or consular interview wait. A decision based on an unattributed percentage is less reliable than a case-specific review of the job, entity relationship, work history, and family needs.
When case-specific legal help is worthwhile
Consider a U.S. business-immigration attorney or qualified law firm when the corporate ownership chain is complex, the employee’s foreign payroll history has gaps, the job mixes hands-on technical work with management, a degree does not clearly match the specialty, prior H/L time is substantial, or a spouse’s work plans are important. Employer immigration staff may also need counsel when deciding whether a petition is cap-exempt, whether a blanket L petition applies, or how to document specialized knowledge.
Professional assistance is optional, not a guarantee of approval. Give counsel the precise U.S. job description, organization charts, ownership records, foreign payroll and employment dates, education documents, prior U.S. immigration history, and family facts. Those records—not nationality, marketing language, or a familiar title—drive the category analysis.
Bottom line for an Indian IT employee
Choose the legal theory that matches the facts. H-1B is the potential fit for a qualifying U.S. specialty-occupation offer, subject in many cases to registration and selection. L-1 is the potential fit for a documented transfer from a qualifying foreign organization to a related U.S. entity after the required foreign employment, with L-1A and L-1B duties analyzed separately. If both routes appear possible, compare cap exposure, evidence burden, maximum stay, prior U.S. time, and the family’s work-authorization needs. Verify current agency rules before filing, and treat petition approval, visa issuance, and admission as separate steps.
