H-1B and L-1 are temporary U.S. employment classifications built around different eligibility tests. H-1B eligibility starts with a qualifying specialty-occupation job and a worker whose education or equivalent preparation matches that specialty. L-1 eligibility starts with a qualifying multinational-company relationship, the employee’s prior qualifying employment abroad, and a transfer into a U.S. managerial, executive, or specialized-knowledge position. An employer and employee must therefore examine the job, corporate structure, and work history before deciding which category may fit.
H-1B vs. L-1 visa: what is the difference?
The central distinction is what creates eligibility:
As an Amazon Associate I earn from qualifying purchases.
- H-1B: the U.S. position must be a specialty occupation requiring highly specialized knowledge and normally a bachelor’s degree or equivalent in a specific specialty; the worker must meet the specialty’s qualification standard.
- L-1: the U.S. employer and a foreign related organization must have a qualifying corporate relationship, the worker must have qualifying prior service abroad, and the U.S. assignment must be managerial, executive, or based on specialized knowledge.
Neither classification is a general substitute for the other. A software position may look like an H-1B specialty occupation, for example, but an L-1 transfer is possible only if the employee worked for a qualifying related company abroad and the corporate and role requirements are documented. Conversely, a company may have a highly qualified foreign employee but no qualifying multinational relationship, making L-1 unavailable even when the U.S. job would satisfy the H-1B specialty-occupation test.
Quick comparison of H-1B and L-1
| Question | H-1B | L-1 |
|---|---|---|
| What creates eligibility? | A qualifying specialty-occupation position and a worker who meets that specialty’s education or equivalent qualification. | A qualifying relationship between U.S. and foreign organizations, qualifying prior employment abroad, and an eligible U.S. transfer role. |
| Who files? | The U.S. employer files the required labor and immigration paperwork for the offered job. | The qualifying U.S. organization files for an employee of the related foreign organization, or uses an approved blanket route when eligible. |
| Core government filing sequence | A Labor Condition Application (LCA) with the Department of Labor, followed by an H-1B petition with U.S. Citizenship and Immigration Services (USCIS). | A USCIS petition supported by corporate-relationship, business-activity, prior-employment, and proposed-role evidence. |
| What must the employer prove? | The specialty nature of the job, required wage and work details, and the worker’s suitability for that specialty. | The multinational relationship, ongoing business activity, the employee’s qualifying service abroad, and a qualifying U.S. assignment. |
| Distinct subcategories | One H-1B framework centered on the specialty occupation and worker qualifications. | L-1A for executives or managers; L-1B for employees with specialized knowledge. |
| Special routes | Cap applicability, exemptions, registration, filing windows, and other procedures must be checked under current rules. | New-office and blanket-petition routes have additional requirements and should not be treated as universal conditions. |
This table is a practical framework, not an eligibility determination. Current forms, fees, filing windows, cap treatment, and documentary standards can change, so an employer should verify them with current USCIS and Department of Labor instructions for the specific case.

H-1B eligibility requirements
The job must be a specialty occupation
USCIS describes a specialty occupation as work requiring highly specialized knowledge and a bachelor’s degree or equivalent in the relevant specialty. A position can meet the standard in several ways. Evidence may show that a degree in a specific specialty is normally a minimum entry requirement, or that the job’s specialized and complex duties are associated with such a degree.
The job description should therefore do more than use a technical title. It should identify the actual duties, the knowledge needed to perform them, and why those duties ordinarily require a degree in a specific field. A generic statement that a position is “professional” is weaker than a detailed explanation connecting each major duty to the specialty-level knowledge required.
The worker must meet the specialty’s qualification route
The beneficiary must qualify for the offered specialty occupation. USCIS materials identify routes that can include:
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute- a qualifying U.S. bachelor’s degree or higher in the relevant specialty;
- an equivalent foreign degree;
- a required professional license; or
- an accepted combination of education, training, and experience that is equivalent to the required degree.
The correct route depends on the occupation and the evidence available. A degree in an unrelated field does not automatically satisfy a specialty requirement merely because the worker has performed similar tasks; the employer must explain the relationship between the person’s preparation and the offered specialty.
The employer must complete the LCA and petition process
The employer process described by USCIS begins with an LCA filed with the Department of Labor and continues with an H-1B petition to USCIS. The LCA identifies the job, salary, period of employment, and geographic location. By filing it, the employer attests that it will pay the greater of the actual wage paid to comparable employees or the prevailing wage for the occupation and location, as applicable under the governing rules.
The LCA is not the immigration petition itself. It addresses labor-condition attestations, while the USCIS petition must establish that the position and worker satisfy the H-1B requirements. Employers should retain the supporting wage, worksite, and job-duty records required by current Department of Labor and USCIS procedures.

Cap and timing questions require a current check
Whether a case is subject to the regular H-1B cap, an advanced-degree allocation, or an exemption affects registration and filing timing. The available materials do not establish current cap dates, exemption categories, or filing windows. Those details should be confirmed from the current USCIS and Department of Labor guidance before an employer promises a start date or selects a filing strategy.
L-1 eligibility requirements
A qualifying multinational relationship is essential
L-1 classification is for an intracompany transfer. USCIS recognizes a transfer from a qualifying foreign office to a U.S. office when the organizations have the required parent, branch, affiliate, or subsidiary relationship. The relationship must be documented through corporate records rather than inferred from common branding or a business partnership.
The organization must conduct business as an employer in the United States and in at least one other country and must intend to continue doing so during the employee’s stay. “Doing business” is evaluated as regular, systematic, and continuous provision of goods or services; a paper entity with no meaningful operations is not the same as an operating foreign office.
The employee needs qualifying prior service abroad
For a non-new-office petition, the employee generally must have worked full-time for the petitioner or a qualifying related organization for at least one of the three years preceding the relevant filing or admission event, in a qualifying capacity. Payroll records, employment letters, organizational charts, and descriptions of the foreign duties help establish this history.
The foreign and U.S. jobs do not have to be identical. A worker can move into a different qualifying capacity in the United States, provided the proposed role itself meets the L-1A or L-1B standard and the prior service requirement is satisfied.

L-1A covers executives and managers. The petition should explain the employee’s authority, reporting structure, responsibility for an essential function or organizational component, and the proportion of time devoted to qualifying managerial or executive duties. A senior-sounding title alone does not establish that the day-to-day work is managerial or executive.

L-1B covers an employee with specialized knowledge. The employer should identify the company-specific products, services, research, equipment, techniques, or procedures the employee understands and explain why that knowledge is advanced or uncommon within the organization or industry. A general occupation or ordinary familiarity with a company’s routine processes is not automatically specialized knowledge.
Employer evidence for a standard L-1 petition
For a non-new-office case, USCIS identifies several evidence categories. A well-organized filing typically addresses each one separately:
- Corporate relationship: documents showing the U.S. and foreign entities are a parent, branch, affiliate, or subsidiary, such as ownership records, organizational charts, and formation documents.
- Business activity: proof that the organization operates as an employer in the United States and at least one other country and will continue that activity during the requested stay.
- Foreign employment: evidence that the employee worked full-time for the petitioner or a qualifying related organization for at least one of the last three years in a qualifying capacity.
- Proposed U.S. position: a detailed duty breakdown showing that the role is primarily managerial or executive for L-1A, or requires specialized knowledge for L-1B.
- Ability to employ the worker: organizational, payroll, financial, and operational records supporting the offered position.
The petition should tell one consistent story: how the entities are related, what the foreign employee did, what the U.S. organization needs, and why the proposed assignment falls within the chosen subcategory.
New-office L-1 petitions
A new-office petition is a narrow L-1 route for an organization that is opening a qualifying U.S. operation. USCIS calls for evidence addressing the proposed office’s nature, organizational structure, financial plans, investment, and ability to pay the employee. The business must secure sufficient physical premises; a mailing address or unsupported plan may not establish an operating office.
Initial approval for an individual new-office petition is limited to no more than one year. An extension requires evidence that the operation has developed as represented and can support the continuing qualifying role. This one-year limitation applies to the new-office situation and should not be generalized to every L-1 petition.
New-office filing checklist
- Lease or other evidence of sufficient physical premises.
- A business plan describing services, customers, staffing, and organizational structure.
- Evidence of investment and available funding.
- Financial projections and a credible plan to pay the employee.
- A proposed position description showing why the role is managerial, executive, or specialized-knowledge work.
Blanket L petitions
A blanket L petition is advance approval for a qualifying organization, not approval of a particular beneficiary. The employee still needs an individual transfer supported by the organization’s approved blanket documentation and evidence that the employee and role meet L-1 requirements.

USCIS guidance lists organization-level conditions that can support the blanket route. The organization must have three or more domestic and foreign branches, subsidiaries, or affiliates and meet at least one of these thresholds:
Free tools Windows power users keep installed

| Blanket-petition threshold | Qualification described by USCIS |
|---|---|
| Prior approvals | At least 10 approved L manager, executive, or specialized-knowledge petitions during the previous 12 months. |
| U.S. sales | At least $25 million in combined annual sales by U.S. subsidiaries or affiliates. |
| U.S. workforce | At least 1,000 employees in the United States. |
These are criteria for the blanket route, not universal requirements for an individual L-1 case. A company that does not qualify for a blanket petition may still evaluate an individual L-1 petition if it can prove the underlying relationship, employment history, and role requirements.

| Evidence question | H-1B focus | L-1 focus |
|---|---|---|
| Why is the job eligible? | Its duties are specialized and normally associated with a degree in a specific specialty. | Its duties are primarily managerial, executive, or based on qualifying specialized knowledge. |
| Why is the worker eligible? | The worker has the required degree, equivalent foreign education, license, or accepted education-and-experience combination. | The worker completed the required qualifying full-time service abroad for the related organization. |
| What company records matter most? | Job description, wage and worksite information, and records supporting the LCA and petition. | Ownership and affiliation records, proof of operations in both countries, foreign employment records, and U.S. organizational evidence. |
| What is the main mismatch risk? | The title or degree does not match the actual specialty duties. | The entities are not legally related, the foreign service is insufficient, or the U.S. role is not truly qualifying. |
Dependents and family considerations
USCIS states that an L-1 worker may be accompanied or followed by a spouse and unmarried children under 21 in L-2 status. Spouses admitted in L-2S status are employment-authorized incident to status for Form I-9 purposes. Employers and families should confirm the current admission notation, acceptable documentation, and any updating procedures before relying on that authorization in a particular case.
The available materials do not establish a complete, current comparison of H-4 dependent status or H-4 employment authorization. An H-1B family should obtain current USCIS guidance for its exact relationship, admission category, and work-authorization question rather than assuming the L-2S rule applies to H-4 dependents.
How to choose the framework: a practical decision process
- Map the entities. Determine whether the U.S. employer and foreign employer have a documented parent, branch, affiliate, or subsidiary relationship. If not, L-1 is not the appropriate starting point.
- Review the employee’s work history. For L-1, confirm at least one year of qualifying full-time service abroad within the relevant three-year period. If that history is absent, focus on other categories, including whether an H-1B specialty-occupation case is possible.
- Analyze the U.S. duties. Decide whether the role is primarily managerial or executive, requires company-specific specialized knowledge, or instead is a specialty occupation tied to a specific degree.
- Match the worker’s preparation. For H-1B, connect the worker’s degree, license, or equivalent experience to the specialty. For L-1, document the employee’s foreign role and the knowledge or authority carried into the U.S. position.
- Check procedural constraints. Confirm current H-1B cap and registration rules, L-1 filing procedures, fees, forms, requested dates, and any consular or change-of-status requirements.
- Build the evidence record before filing. Resolve inconsistencies in titles, dates, ownership percentages, work locations, salary information, and organizational charts before submitting the petition.
Common pitfalls and how to prevent them
Using a title instead of analyzing duties
“Manager,” “director,” “engineer,” or “specialist” is not itself a legal test. Write the duty description first, identify the required knowledge or authority, and then select the classification that fits the facts.

A vendor, contractor, investor, or informal business partner is not automatically a qualifying parent, branch, affiliate, or subsidiary. Use corporate records to establish the relationship and keep ownership information consistent throughout the filing.
Best Value
Ignoring the worksite and wage details in an H-1B case
The LCA identifies the job, salary, employment period, and geographic location. A petition that describes a different location, salary, or set of duties can create avoidable problems. Confirm the actual work arrangement under current Department of Labor rules.
Treating blanket approval as beneficiary approval
Blanket approval concerns the organization. Each worker still must qualify and must be assigned to a qualifying role. Maintain a separate employee-specific record for the transfer.
Overlooking the new-office limit
A new-office L-1 approval is initially limited to no more than one year. Plan early for the evidence needed to show that the U.S. operation has become viable before seeking an extension.

Promising a result from an incomplete record
Cap availability, filing windows, forms, fees, stay periods, and dependent procedures can change. Employers should verify current agency instructions and obtain individualized legal advice where the facts are uncertain.
Questions that still require case-specific verification
- Is the proposed H-1B position subject to a cap, exempt, or eligible for a particular allocation?
- What registration or filing window applies on the intended start date?
- Does the employee’s degree or experience satisfy the specific specialty occupation?
- Do the foreign and U.S. entities meet the current legal definition of a qualifying relationship?
- Does the foreign employment fall within the required period and qualifying capacity?
- Is the U.S. assignment genuinely managerial, executive, or specialized-knowledge work?
- Are the new-office, blanket, consular-processing, or change-of-status rules relevant to this filing?
Because these answers depend on current agency rules and the evidence in an individual case, this comparison is educational information rather than a legal determination.
Bottom line: which visa is the better fit?
Choose the framework that matches the facts, not the one with the more attractive-sounding label. H-1B is centered on a specialty-occupation job, the required degree or equivalent preparation, and the LCA-and-petition process. L-1 is centered on a qualifying multinational relationship, the employee’s prior service abroad, and a U.S. role that is managerial, executive, or based on specialized knowledge. New-office and blanket L-1 options are specialized routes, while H-1B cap and timing rules must be checked under the current year’s procedures. A careful duties analysis and a consistent employer evidence record are the best starting points for deciding which classification to evaluate.
