The Goods and Services Tax Appellate Tribunal (GSTAT) has ordered the Indian Railway Catering and Tourism Corporation (IRCTC) to deposit ₹50,41,44,461—about ₹50.41 crore—in consumer-welfare funds for allegedly failing to pass on the 2017 GST reduction on Rail Neer bottled water. The special bench of GSTAT’s Delhi Principal Bench issued the order on 14 October 2026, covering supplies made from 1 July 2017 to 31 May 2020.
Why IRCTC is being asked to pay ₹50.41 crore
Rail Neer is bottled drinking water produced by IRCTC for sale on trains and at railway stations. IRCTC’s 2024–25 annual report records that the product’s tax burden changed on 1 July 2017 from an effective 24%—12.5% central excise with 45% abatement plus 12.5% VAT—to 18% GST.

The anti-profiteering investigation alleged that IRCTC did not pass the resulting tax saving to consumers. The allegation focused on Rail Neer continuing to carry a maximum retail price (MRP) of ₹15 after the GST change. The Directorate General of Anti-Profiteering (DGAP) report dated 11 June 2021 calculated the alleged benefit that had not been transferred. IRCTC’s annual report describes a National Anti-Profiteering Authority notice for ₹5,041.44 lakh, or approximately ₹50,41,44,000.
GSTAT accepted the DGAP findings and set the amount payable at ₹50,41,44,461. The calculation relates to the specified period and is not a finding about every Rail Neer sale made after May 2020.

What IRCTC argued
IRCTC’s defence relied on how Rail Neer was distributed and priced:
- The Railway Ministry fixed the ₹15 MRP, so IRCTC could not independently reduce the retail price printed or charged to passengers.
- IRCTC said it supplied water to railway departments and to units operated by licensees rather than selling every bottle directly to passengers.
- It argued that Rail Neer was already priced below competing bottled-water brands.
- It cited increases in production and other costs, as well as the subsidised nature of the supply, to justify retaining its pricing.
These arguments treated the controlled retail price and IRCTC’s role as a government-owned supplier as central to the dispute.

How GSTAT treated the ₹15 MRP issue
The tribunal distinguished between the final retail MRP and IRCTC’s transfer price. Its key finding was that IRCTC could set the price at which it supplied Rail Neer to railway departments and licensee-operated units. Therefore, even if the Railway Ministry controlled the ₹15 MRP, IRCTC could reduce its transfer price so that the GST benefit flowed through the distribution chain to consumers.
In the tribunal’s reasoning, control over the printed or administered retail price did not remove IRCTC’s obligation under Section 171 of the Central Goods and Services Tax Act, 2017. Section 171 requires a reduction in tax to be passed on through a commensurate reduction in prices.

GSTAT also rejected the suggestion that government ownership or subsidised supply created an exemption from the anti-profiteering requirement. It further held that Rail Neer supplied on premium trains was not complimentary: although passengers might not receive a separate invoice for the bottle, its cost was included in the ticket fare.

Where the money will go and when IRCTC must deposit it
IRCTC must deposit the assessed amount within one month of the order. The money is to be divided equally between the Central Consumer Welfare Fund and the consumer-welfare funds of the relevant states.

Interest at 18% a year runs from 28 June 2019 until the date of deposit. The order also contemplates a penalty of 10%. However, that penalty will not apply if IRCTC deposits the full profiteered amount plus the applicable interest within 30 days.
The one-month deposit direction and the 30-day condition for avoiding the penalty are separate timing requirements stated in the order reporting. Missing the payment condition can therefore expose IRCTC to the additional 10% penalty contemplated by GSTAT.
What the order establishes—and what remains unknown
The order establishes GSTAT’s conclusion that the tax reduction should have been passed on through IRCTC’s transfer pricing, despite the Railway Ministry’s role in fixing the ₹15 MRP. It also fixes the amount, the covered period, the interest rate and the destination of the funds.

What this means for passengers
The case concerns historical supplies made between July 2017 and May 2020. It does not by itself announce a new Rail Neer MRP for passengers today. Its practical significance is the tribunal’s interpretation that a supplier can be responsible for passing on a tax benefit through its wholesale or transfer price even when another public authority controls the final retail price.
