“GST department appeal” can mean two different things: a taxpayer’s first appeal against an adjudicating authority’s order under section 107, or a department-initiated application to the GST Appellate Tribunal (GSTAT) under section 112(3). A taxpayer’s own GSTAT appeal is a separate, later route under section 112. The initiator, starting order and baseline deadline differ.
What is the difference between a GST appeal and a GSTAT appeal?
Under the Central Goods and Services Tax (CGST) framework, section 107 provides the first appeal to the prescribed Appellate Authority against an adjudicating authority’s decision or order. GSTAT is the tribunal tier: section 112 covers appeals against qualifying orders of an Appellate Authority under section 107 or a Revisional Authority under section 108.

The department has its own route to GSTAT. Under section 112(3), the Commissioner may review the record of a qualifying Appellate or Revisional Authority order and direct a subordinate officer to apply to the Tribunal. That is not the taxpayer’s section 112 appeal under another name.

| Route | Starting order | Who initiates it | Forum | Baseline period in the cited official material |
|---|---|---|---|---|
| Taxpayer’s first appeal, section 107 | Decision or order of an adjudicating authority | An aggrieved person | Prescribed Appellate Authority | Three months from communication of the decision or order, as described in a CBIC circular |
| Taxpayer’s GSTAT appeal, section 112 | Qualifying Appellate Authority or Revisional Authority order | An aggrieved person | GSTAT | Three months from communication of the relevant order as the ordinary baseline reflected in the GST Council’s statutory extract |
| Department’s GSTAT application, section 112(3) | Qualifying Appellate or Revisional Authority order selected for departmental review | The Commissioner reviews the record and directs a subordinate officer to apply | GSTAT | Six months from the date the relevant order is passed as the baseline in the statutory extract |
These are baseline periods, not a complete limitation calculation for an individual case. The competent Appellate Authority for a section 107 appeal depends on the rank of the officer who made the original decision. Transitional provisions, amendments and notifications can also affect the section 112 deadline.

How does the department appeal to GSTAT?
- Review the order: The Commissioner calls for and examines the record of an Appellate or Revisional Authority order.
- Direct an application: If the department decides to challenge the order, the Commissioner directs a subordinate officer to apply to GSTAT under section 112(3).
- File at the Tribunal: The directed officer makes the department’s application through the Tribunal’s filing process. This route follows departmental review; it is not the department acting as an aggrieved taxpayer under section 112(1).
The statutory extract gives six months from the date the relevant order is passed as the departmental route’s baseline. Check the current enacted text and any applicable notification before calculating a live deadline.
What are the GST appeal deadlines?
First appeal under section 107
The CBIC circular describes a three-month period from communication of the adjudicating authority’s decision or order. The particular Appellate Authority is determined by the original decision maker’s rank.

Taxpayer’s GSTAT appeal under section 112

Specified backlog cohort and the 31 July 2026 date
A Ministry of Finance release dated 30 June 2026 and a notice on the official GSTAT portal reported an extension of the due date to 31 July 2026 for the specified backlog cohort of appeals under section 112(1) read with section 112(3). That date had passed by 4 October 2026. It should not be treated as an open deadline or as applying to every GSTAT case. For a live matter, confirm the order’s communication date, whether it falls within the notified cohort, the operative Gazette notification and any later order or relief.

The official GSTAT portal provides electronic filing and lists the GSTAT Procedure Rules 2025. An older rules copy located for procedural details identifies Form GST APL-05 for a Tribunal appeal and APL-06 for cross-objections; another rules extract identifies APL-01 for a first appeal to the Appellate Authority. Because those rules copies may not reflect every current requirement, use the applicable current rules and portal instructions rather than relying on form names alone as a filing checklist.

The available official material does not establish a definitive current checklist for every filing, including current fee calculations or the availability of condonation in a particular case. The cited 2017 rules extract and older CBIC FAQ are not sufficient by themselves to settle those points. Check current rules, enacted amendments and applicable notifications; for an active dispute, obtain case-specific professional advice.
