GST Summons Rights in India: When You Must Appear and What Questions You Can Decline to Answer

If you receive a GST summons in India, treat it as a formal communication and promptly check what it requires. Failure to appear before a central tax officer when summoned to give evidence or produce a document in an inquiry may attract a penalty of up to ₹25,000; that is a possible maximum, not an automatic penalty. The available official material does not establish a general right to refuse particular questions or a categorical right to have an advocate present during questioning. If you cannot comply as written or an answer may expose you to criminal liability, consult a qualified Indian GST or tax lawyer before responding.

What a GST summons requires

A summons is not the same as an informal request to call an officer back. Check the document itself for the issuing authority, stated purpose, date and time, place or mode of appearance, and any documents it asks you to produce. Also note your role in the inquiry: you may be a taxpayer, employee, director, or third party, and that context can affect the advice you need.

CBIC’s consolidated statutory database states that a person who fails to appear before a central tax officer when summoned to give evidence or produce a document in an inquiry may face a penalty extending to ₹25,000. This supports taking an issued summons seriously, but it does not mean the maximum applies automatically or settle what should happen in every case. The available material does not reproduce the full current text of section 70, the applicable procedural rules, or the complete summons form.

How to check whether the communication is genuine

DGGI’s official public-services page describes verification using a DIN, an eOffice Issue Number, or a GSTN RFN, depending on the issuing platform and type of communication. It references CBIC Circular No. 249/06/2025-GST and Circular No. 252/09/2025-GST. Use the official verification facility appropriate to the identifier shown on your document; the page does not establish that every GST summons carries all three identifiers.

  • Do not rely only on an unsolicited call, payment demand, or link in an unverified message.
  • Check the identifier using the official verification route and compare the result with the communication you received.
  • If you cannot verify it, contact the relevant tax office through independently confirmed official contact details rather than replying to suspicious contact information.

What to do before the appearance date

  1. Read the summons closely. Record the issuing authority, purpose, date, time, place or permitted mode, requested evidence, and any identifier.
  2. Organize relevant records. Identify what has been requested and whether you can produce it. Do not alter, destroy, or guess at records; if the scope is unclear, ask your lawyer how to seek clarification.
  3. Get advice if you cannot attend or comply. Contact a qualified Indian GST or tax lawyer promptly about a documented response, a request to reschedule, or an objection. Do not assume an extension will be granted.
  4. Discuss sensitive questions in advance. If a response could expose you to criminal liability, or you are unsure of the facts, obtain legal advice before answering, refusing, or signing a statement.

Can you decline to answer particular questions?

The official materials described here do not establish a general list of questions a summoned person may refuse, or settle the scope of protection against compelled self-incrimination in a GST inquiry. A person’s role and the facts may matter. Do not assume that a question can be refused merely because it feels irrelevant, uncomfortable, or incriminating; equally, do not treat this article as a reason to make an uncertain admission.

As a cautious approach, answer truthfully to the extent you understand and have been advised to answer. If a question is unclear, ask for clarification. If you do not know an answer or need to check records, do not guess or speculate. Before refusing a question, making an admission, or signing a statement, seek advice from a lawyer familiar with the inquiry and your circumstances.

Can an advocate sit in during questioning?

The available official material does not establish a general entitlement to have an advocate present during questioning, and it does not settle the issue with a definitive current rule. Do not assume either that counsel must be allowed in the room or that their presence is categorically barred. Ask your lawyer to check the current law and any directions applicable to your particular inquiry before the appearance.

Does a defect make the summons invalid?

CBIC’s consolidated Act database describes section 160 as protecting a proceeding, including a summons, from invalidity solely because of a mistake, defect, or omission when it is in substance and effect in conformity with the Act’s intent, purpose, and requirements. It also says service cannot be called into question if the communication has already been acted upon or the service issue was not raised in earlier proceedings.

That is not a blanket rule that every summons is valid or that every objection fails. The authority, wording, service, statutory purpose, and procedural setting may matter. If you believe there is a serious defect, obtain advice promptly rather than ignoring the document or acting on the assumption that the defect settles the issue.

What to take to a lawyer for advice

  • The summons and any envelope, email, or message through which it arrived.
  • The verification result and the identifier shown, if any.
  • A short timeline of relevant events and your role in the matter.
  • The records requested and any questions or documents that could create legal exposure.
  • Any communication with the tax authority, including a request to clarify or reschedule.
