GST summons, inspection and arrest: how the powers differ and what taxpayers should expect

A GST summons, an inspection or search, and an arrest are different legal powers. A summons under section 70 seeks a person’s attendance, evidence or records; section 67 permits inspection and, under separate conditions, search and seizure; arrest under section 69 is tied to specified section 132 offences and a Commissioner’s authorization. Receiving one step does not automatically authorize the others.

This guide explains what each document can require, which officer must authorize it, what to check immediately, and which safeguards apply under the central GST framework in India. State-GST practice, later amendments and the facts of a particular case can change the analysis.

Start by identifying the power being used

Read the heading and statutory section before responding. The practical consequences depend on whether you have received a summons, an inspection authorization or notice, a search authorization, a seizure order, or an arrest-related document.

Power Primary provision Purpose Who authorizes it What the taxpayer may be required to do Immediate legal consequence
Summons Section 70 Obtain evidence, documents or other things in an inquiry Proper officer issuing the summons Attend at the stated time and place, answer questions and produce specified material The inquiry is treated as a judicial proceeding for the purposes identified in section 70(2)
Inspection Section 67(1) Inspect specified business or other covered premises when statutory “reasons to believe” grounds exist Proper officer not below Joint Commissioner rank gives written authorization to another central tax officer Provide access to the places and records covered by the authorization Access and inspection; it is not, by itself, a search-and-seizure or arrest order
Search and seizure Section 67(2) Find and secure goods, books, documents or things believed to be secreted and relevant to proceedings Qualifying officer with reasons to believe, acting personally or authorizing another central tax officer in writing Permit the authorized search; identify and preserve items taken Items may be seized under the statutory procedure, with inventories and receipts where the relevant subsection applies
Arrest Section 69 read with section 132 Take a person into custody for specified GST offences Commissioner, by an order authorizing a central tax officer Submit to custody and the criminal process; the person must be informed of the grounds Production before a Magistrate within 24 hours in the specified case, subject to the applicable offence and bail category

These powers can arise in the same investigation, but none should be treated as an automatic escalation of another. A summons does not itself authorize a premises search or arrest, and an inspection does not itself prove that arrest conditions exist.

GST summons under section 70

What a summons can require

Section 70(1) permits the proper officer to summon a person whose attendance is considered necessary to give evidence or produce a document or another thing in an inquiry. The recipient may be an individual, an employee, an officer of a company or another person who is believed to hold relevant information. The document should identify the issuing authority, the statutory provision, the appearance date and place, and the records or subject matter sought.

Section 70(2) treats the inquiry as a “judicial proceeding” for the purposes of the penal-code provisions named there. That classification does not turn every answer into proof of liability, but it means that ignoring the process or making a knowingly false response can have consequences under laws referenced by the section.

Why a summons is not a demand for tax payment

A summons is an evidence-gathering instrument. It is not, by itself, an assessment order, a recovery notice, a search authorization or an arrest order. A tax dispute, audit or investigation may generate several different documents; each must be answered according to its own legal basis and deadline.

How to respond safely

  1. Authenticate and read the document. Note the office, officer, section, date, appearance location, reference number, requested records and stated inquiry.
  2. Preserve relevant material. Keep the original accounting files, invoices, e-way records, contracts, emails and electronic ledgers in their existing form. Do not delete, overwrite or back-date anything.
  3. Prepare a controlled production set. Index copies, retain a duplicate and record which file answers which request. If an item does not exist or is held by another person, state that accurately rather than guessing.
  4. Plan attendance. If the date, location or scope creates a genuine difficulty, contact the issuing office promptly and request an adjustment. A request is not an automatic exemption, so obtain confirmation of any changed arrangement.
  5. Obtain case-specific advice. A tax professional or lawyer can help identify privilege, relevance, personal exposure and the safest way to give a statement. Do not assume that paying an amount or agreeing with an officer resolves the investigation.

Statements and evidentiary significance

Section 136 addresses when a signed statement made in response to a section 70 summons may be relevant in a prosecution. It does not make every statement automatically admissible in every circumstance. Read the statement before signing, correct factual errors, distinguish personal knowledge from information supplied by others, and keep a copy of what was signed. If a question is unclear, ask for it to be repeated or rephrased; do not fill gaps with speculation.

CBIC guidance on using summons

CBIC Instruction No. 03/2022-23, dated 17 August 2022, tells field officers to use summons judiciously. It raises concerns about routine summonses to top senior officials and requests for statutory records already available on the GST portal, and asks officers to consider whether a letter requesting information would suffice. The instruction guides officers; it does not give a recipient permission to ignore a valid summons. The practical response is to comply carefully while pointing out duplication or an unworkable request through the issuing office or counsel.

Inspection under section 67(1)

Threshold and authorization

Inspection is a distinct power. A proper officer not below the rank of Joint Commissioner may, when the statutory “reasons to believe” conditions are met, authorize another central tax officer in writing to inspect specified places of business or other covered places. The grounds concern suspected suppression or contravention intended to evade tax, or goods and records connected with possible evasion in transport, a warehouse or another place covered by the provision.

Check the written authorization: it should identify the place and the legal basis. An officer’s request to look around a premises is not the same thing as a section 67(1) authorization. Conversely, an inspection authorization does not automatically confer the broader search-and-seizure power in section 67(2).

What to do during an inspection

  • Designate one responsible employee to accompany the officers and one person to maintain a contemporaneous log.
  • Provide reasonable access to the areas and records within the authorization, while asking that any request outside its scope be identified and documented.
  • Keep business operations orderly. Do not obstruct, hide or move goods, books or devices.
  • Record the names and designations of officers, arrival and departure times, locations visited and documents or data copied.
  • Ask for written acknowledgment of material handed over. If anything is taken, list it and request the applicable inventory or receipt.

Search and seizure under section 67(2)

How it differs from inspection

Section 67(2) requires a separate factual threshold: the qualifying officer must have reasons to believe that goods liable to confiscation, or documents, books or things useful or relevant to proceedings under the Act, are secreted in a place. The officer may conduct the search and seizure or authorize another central tax officer in writing. “Secretion” and relevance are statutory concepts applied to the facts; a general suspicion or a routine inspection should not be described as equivalent to a search order.

Forms and records

The CGST Rules provide for authorization in FORM GST INS-01 and an order of seizure in FORM GST INS-02. Forms and rule text can change, so verify the current version before relying on a form number in a live matter. Section 67 also addresses inventory and the application of search-and-seizure procedure. Under section 67(11), when specified accounts or documents produced before an officer are seized under that subsection, the provision expressly contemplates written reasons and a receipt.

Protecting the record of what was seized

  1. Ask to see the authorization and identify the premises and categories of items covered.
  2. Have an employee or adviser observe the listing of devices, files, goods and serial numbers where practicable.
  3. Request an inventory or receipt for every physical item, account or document taken under the applicable provision.
  4. Record the condition of electronic devices and whether an image, copy or original was taken.
  5. Do not alter, conceal, destroy or remotely wipe data. Preserve backups and access logs.
  6. After the officers leave, write a same-day chronology and secure a duplicate of every acknowledgment.

The exact safeguards depend on the subsection used and the circumstances. A receipt under one provision should not be assumed to answer every issue arising from a different seizure.

Arrest under section 69, read with section 132

When the power exists

Arrest is separate from summons, inspection and search. Under section 69(1), the Commissioner may, where there are reasons to believe that a person committed specified offences in section 132, authorize a central tax officer to arrest that person by order. The offence, its statutory ingredients and the applicable punishment matter. A tax disagreement, unpaid demand or ongoing inquiry does not automatically satisfy the arrest conditions.

Safeguards after arrest

Section 69 requires the arrested person to be informed of the grounds of arrest and, in the specified case, produced before a Magistrate within 24 hours. It also distinguishes bail treatment for different offence categories and gives the Deputy Commissioner or Assistant Commissioner specified bail-related powers for a non-cognizable and bailable offence. Because the classification controls the procedure, do not assume that every GST offence is bailable in the same way or that every arrest follows the same route.

CBIC Instruction No. 02/2022-23, dated 17 August 2022, directs the Commissioner to record consideration of the nature of the offence, the person’s role and the available evidence. It discusses criminal-procedure and arrest-memo safeguards. The instruction reproduces the Supreme Court’s caution that an officer should not compel arrest merely because statutory conditions can be invoked where the person has cooperated and there is no reason to believe the person will abscond or disobey a summons:

“If the Investigating Officer has no reason to believe that the accused will abscond or disobey summons and has, in fact, throughout cooperated with the investigation we fail to appreciate why there should be a compulsion on the officer to arrest the accused.”

This is a passage quoted by CBIC from a Supreme Court decision; the full judgment and its factual context control its application.

Written grounds and recent judicial developments

The Supreme Court’s decision in Radhika Agarwal v. Union of India (2025) addresses GST investigative powers and safeguards. CBIC Instruction No. 01/2025 is reported to require that grounds of arrest be explained and furnished in writing as an annexure to the arrest memo. Because the available copy was hosted by a state tax department and live instructions can change, verify the authoritative instruction and judgment when dealing with an actual arrest or litigation.

If arrest is threatened or has occurred

  • Obtain prompt criminal-tax advice and identify the alleged section 132 offence.
  • Ask for the authorizing order, arrest memo and written grounds, and note the exact time of custody.
  • Track the 24-hour production requirement in the applicable case.
  • Determine whether the alleged offence is cognizable or non-cognizable and bailable or non-bailable under the current law.
  • Preserve every communication and do not sign a factual statement that you have not read or understood.

Authenticating a GST communication

Check the basics

Compare the document with the GST registration and contact details on record. Verify the issuing office, officer’s designation, statutory section, date, reference number, place, requested appearance or access, and attachments. A genuine-looking letter can still be outside an officer’s authority; the relevant question is whether the stated power has the required statutory grounds and written authorization.

DIN and prescribed formats

For specified CBIC communications, check the electronically generated Document Identification Number (DIN) and the prescribed format. CBIC Circular No. 128/47/2019-GST states that specified communications without a DIN are invalid unless an exception applies. The circular’s scope and exceptions must be checked before concluding that any paper or unsigned communication is void. Record the DIN and verify it through the official channel applicable to the communication.

A practical response checklist

  1. Classify the document: summons, inspection, search, seizure or arrest.
  2. Map the authority: section 70, section 67(1), section 67(2), or section 69 read with section 132.
  3. Check authorization: confirm the officer’s rank, written order and specified place, records or offence.
  4. Preserve evidence: lock down relevant accounting, inventory and digital records without altering them.
  5. Create a log: note requests, answers, copies, items seized, names and times.
  6. Respond accurately: comply with lawful requests, identify uncertainty and avoid speculation.
  7. Escalate promptly: obtain qualified advice when privilege, personal exposure, seizure or arrest is involved.

What changed, and what has not, as of October 2026

A PIB FAQ posted on 9 October 2026 says the GST Council recommended removing GST arrest provisions and raising the prosecution threshold, along with other changes. Those are recommendations or proposals in that publication, not proof that Parliament has enacted and commenced an amendment. Until the relevant Gazette notifications and commencement provisions are verified, section 69 and the connected section 132 framework should not be reported as abolished.

The central framework described here also does not establish every state-GST procedure, every amendment after the underlying CBIC Act webpage, or the validity of an individual notice. For a live matter, use the law and instructions in force on the date of the document and have the actual authorization, grounds and records reviewed.
