In India, an NBFC that qualifies as a financial institution under the relevant GST rules generally has up to 45 days from the date of supply to issue an invoice for a taxable service. CBIC also permits a compliant consolidated monthly statement, invoice or advice. Whether a particular service is taxable, exempt or subject to reverse charge—and whether the NBFC must register—depends on the transaction and the supplier’s registration facts, not simply on the customer being a bank. This article reflects the official material available as of 7 October 2026.

Does an NBFC have to charge GST when it invoices a bank?

Not automatically. The fact that the supplier is an NBFC and the customer is a bank does not, by itself, establish the GST treatment. First identify what the NBFC supplies and what the payment represents. CBIC’s GST Sectoral FAQs distinguish interest or discount for extending loans, advances or deposits from additional amounts collected for services: charges over and above the interest or discount, such as administrative or entry charges, are described as taxable consideration.

That distinction does not establish a universal rate or decide every fee’s treatment. For the actual transaction, check the service description and contract against the current exemption and rate notifications, the supplier’s and recipient’s GST status and locations, and any applicable reverse-charge entry. CBIC’s Central Tax (Rate) Notifications index is a starting point; the underlying notification and amendments must be checked for the specific service.

Interest or discount versus a separate fee

  • Interest or discount: The FAQ treats consideration represented by interest or discount for extending loans, advances or deposits differently from separate service charges.
  • Additional charges: A processing, administrative, entry, documentation or similar charge should not be treated as exempt merely because it relates to a loan. CBIC’s FAQ describes amounts collected over and above interest or discount as taxable consideration.
  • Invoice discounting: The FAQ also describes documentation fees and similar fees in invoice-discounting contexts as taxable. Apply the current rules to the specific service and agreement rather than assuming all financial-service charges share one treatment.

Does the NBFC need GST registration?

Registration cannot be decided from the customer’s identity alone. Being an NBFC does not, on the information addressed here, establish that registration is compulsory for every transaction; nor does invoicing a bank settle the question. The relevant registration provisions must be applied to the NBFC’s circumstances.

Before preparing the invoice, establish which GST registration of the supplier is making the supply and assess the applicable provisions against facts such as aggregate turnover, the legal entity and its places of business, the locations from which the service is supplied, whether supplies are inter-State, and whether a compulsory-registration rule or exemption applies. The 45-day invoice rule discussed below concerns covered financial institutions; it does not resolve the separate registration analysis.

How long does an NBFC have to issue a service invoice?

Under Rule 47 of the CGST Rules, a covered banking company, financial institution or NBFC generally has 45 days from the date of supply to issue an invoice for a taxable service. This is the special period for the covered class, rather than the ordinary 30-day period for services. Confirm that the supplier falls within the rule and calculate the period from the relevant date of supply.

Rule 47 provides a separate timing option for certain taxable supplies between distinct persons under section 25 or Schedule I: the invoice may be issued before or when the supply is recorded in the supplier’s books, or before the end of the quarter in which the supply is made. This qualification is limited to the specified distinct-person circumstances; it should not be treated as a general extension for all NBFC invoices.

Can an NBFC issue one consolidated monthly GST invoice?

Yes. CBIC’s GST Sectoral FAQs say a covered financial institution may issue a consolidated statement, invoice or advice at month-end covering the month’s charges and GST. The monthly document is still an invoice or document in lieu for GST purposes; it is not permission to send an informal statement that omits required particulars.

Under Rule 54(2), as explained in the FAQ, the covered institution’s document need not be serially numbered and need not state the recipient’s address. It must have an identification number, which does not have to be part of a serial sequence, and retain the other applicable particulars under Rule 46. The issuer should report the document details with the recipient’s GSTIN as applicable so the recipient can match the document to its credit records.

Which document should the NBFC issue?

Section 31 of the CGST Act sets out the relevant document types. A registered supplier should use the document that matches the supply’s tax character:

  • Exempt service: Issue a bill of supply, as applicable under section 31.
  • Specified reverse-charge case: The registered recipient may have self-invoicing and payment-voucher obligations. Those duties apply only where the relevant reverse-charge provisions require them; the fact that one party is an NBFC or a bank does not create a general reverse-charge rule.

Keep the service classification, tax treatment, invoice particulars and GSTIN reporting consistent. A consolidated monthly document must still meet the applicable documentation and reporting requirements.

When might reverse charge apply?

There is no general reverse-charge answer for all services an NBFC provides to a bank. The official material includes a reverse-charge reference for a recovery agent’s service to an NBFC, as well as section 31 duties for recipients in specified reverse-charge cases. Those examples do not establish that an NBFC’s own service to a bank is covered.

For a particular transaction, identify the actual supplier and recipient, describe the service precisely, confirm their locations and status, and check the current notification entry. If reverse charge applies, verify which party must pay GST and what invoice, self-invoice or payment-voucher documents are required.

Can an NBFC use the 50% input tax credit method?

Rule 38 of the CGST Rules describes an optional method under section 17(4) for an eligible banking company or financial institution, including a qualifying NBFC engaged in accepting deposits or extending loans or advances. Under that method, the institution excludes input tax attributable to non-business use and blocked credits under section 17(5), allows specified credits, and takes 50% of the remaining input tax.

This is not an automatic entitlement for every entity commonly called an NBFC. Eligibility depends on the institution’s activities and the rule’s conditions. An eligible NBFC should compare the method with the ordinary input-tax-credit approach using its own credit profile before electing it.

How should an NBFC treat penal charges?

CBIC Circular No. 245/02/2025-GST, dated 28 January 2025, addresses GST on penal charges levied by regulated entities, including NBFCs, following RBI instructions to discontinue penal interest for non-compliance with loan terms. The circular states that the relevant RBI instructions took effect on 1 January 2024.

The circular’s stated scope excludes credit cards, external commercial borrowings, trade credits and structured obligations covered by product-specific directions. A charge’s label alone is not enough to determine its treatment: consult the full circular and the applicable RBI direction for the product and charge in question.

Transaction checklist before issuing the invoice

  1. Identify the supplier registration. Determine which legal entity and GST registration is making the supply and whether registration is required under the provisions applicable to its facts.
  2. Describe the supply and payment. Separate interest or discount from any processing, administrative, documentation or other fee, and match the description to the contract.
  3. Determine the tax treatment. Check the current exemption and rate notification, supplier and recipient locations and status, and whether a specific reverse-charge entry applies.
  4. Choose the correct document. Use a tax invoice for a taxable service or a bill of supply for an exempt service, as applicable; check whether a specified reverse-charge case creates recipient-side documentation duties.
  5. Apply the timing and format rules. For a covered financial institution, generally issue within 45 days of supply. If using a consolidated monthly document, include its identification number and all other applicable particulars, and report recipient GSTIN details as applicable.
  6. Review input tax credit separately. If the NBFC may qualify for the section 17(4) method, assess the Rule 38 conditions and the effect on its credit position before making an election.
