GST Registration and Filing Requirements for Indian Startups

When does a startup need GST registration? Do not decide from turnover alone. Start with the startup’s PAN-based aggregate turnover and the states in which it makes supplies, then check whether its activities fall into a compulsory-registration category or an exemption. Certain inter-State taxable supplies and other listed activities can require registration even when turnover is low.

Once liability arises, section 25(1) of the Central Goods and Services Tax Act, 2017 generally gives 30 days to apply. After registration, the startup normally reports outward supplies in GSTR-1 and files the applicable payment return; eligible businesses can use QRMP to file key returns quarterly while still paying tax monthly. Due dates are ordinary portal dates and can change through government notifications.

What the GST decision actually involves

GST registration is a legal obligation tied to the business’s supplies, location and statutory status. A startup may also choose voluntary registration for commercial reasons, but voluntary registration creates the ongoing return and record-keeping duties of a registered person. The first question is therefore not “Is our revenue below the headline threshold?” It is “Has this PAN become liable in any state or under any compulsory category?”

Aggregate turnover is assessed on a PAN basis rather than by treating each founder, product line or office as an unrelated business. The practical review should map every supply made by entities using that PAN, identify where those supplies are made, and then apply the current threshold and notification rules. The applicable threshold can depend on the nature of the supplies and the state; a goods-only threshold should never be treated as universal without checking the notification for the relevant state and business.

When does an Indian startup need GST registration?

1. Check aggregate turnover, but do not stop there

Turnover is the starting screen in the ordinary registration framework. Compare the PAN-based aggregate turnover with the threshold that applies to the startup’s supply mix and state. Because thresholds and conditions can differ, preserve the calculation and the notification relied on for the conclusion. A startup operating in several states should perform the analysis for each state in which it is liable, not just at its headquarters.

2. Test compulsory-registration categories

Section 24 of the CGST Act lists categories that can require registration independently of the ordinary threshold test. The list includes persons making inter-State taxable supplies and several other specified activities. Exemptions and later amendments can change how a particular transaction is treated, so “we are below the threshold” is not a safe answer where a statutory category may apply.

Review the exact transaction rather than relying on a label such as “online seller,” “marketplace business” or “service company.” Inter-State supplies, e-commerce arrangements, reverse-charge situations and other special categories can have their own rules or exemptions. The legal result depends on the supply, the parties, the state and the notification in force for that fact pattern.

3. Confirm the state and registration unit

GST registration is state or Union-territory specific. Section 25(1) requires a person liable under section 22 or 24 to apply in every state or Union territory in which that liability exists. A startup with offices, warehouses or taxable supplies connected with more than one state should therefore make a state-by-state map before filing. One registration does not automatically settle obligations in every other state.

4. Check exemptions and special notifications

The CGST Act’s compulsory categories are subject to exemptions and changes notified by the government. The same commercial model can produce different outcomes after an exemption or amendment. Before concluding that registration is mandatory, check the current Central Board of Indirect Taxes and Customs (CBIC) text and notifications, and the GST Portal guidance for the live period.

Do I need GST if my turnover is below the threshold?

Possibly. A low turnover figure can support a threshold-based exemption only after the startup confirms that no compulsory-registration category applies and that the relevant state and supply conditions are satisfied. Inter-State taxable supplies and other listed activities can override a threshold-only conclusion, while an exemption may remove a requirement that would otherwise appear to apply.

Use this short decision sequence:

  1. Calculate PAN-based aggregate turnover. Include the startup’s relevant supplies across the businesses using that PAN, rather than reviewing one bank account or one state in isolation.
  2. List every supply type and destination. Separate taxable, exempt and other supplies and identify inter-State transactions, marketplace or e-commerce activity, exports, reverse-charge involvement and special categories.
  3. Apply the state-specific threshold and notification. Do not use a goods-only threshold as a nationwide rule without verifying the current notification.
  4. Test section 24 categories. If a compulsory category applies, the threshold may not protect the startup.
  5. Document the conclusion. Keep the turnover working, transaction map and notification or professional advice supporting the decision.

If facts are close to a threshold or involve several states, export, e-commerce or reverse charge, obtain advice from a qualified GST practitioner before relying on non-registration.

What is the GST registration time limit after crossing the threshold?

The general statutory window is 30 days from the date the person becomes liable. Section 25(1) of the CGST Act states: “Every person who is liable to be registered under section 22 or section 24 shall apply for registration in every such State or Union territory in which he so liable within thirty days from the date on which he becomes liable to registration, in such manner and subject to such conditions as may be prescribed.” This wording is displayed in CBIC-hosted CGST Act material; verify the currently amended text when filing.

The timing affects the effective date. GST Portal guidance says that, for the normal taxpayer route, an application made within the 30-day period results in an effective registration date matching the date liability arose. If the application is late, the effective date is the date registration is granted. That difference can affect the period for which invoices, tax collection and returns must be brought into compliance.

PAN is mandatory for the normal taxpayer route. Treat the 30-day period as a filing deadline, not as a grace period during which taxable supplies can be ignored. Start the application as soon as the liability event is identified and retain evidence of when the application was submitted.

Which GST returns does a startup file?

GSTR-1: outward supplies

GSTR-1 is the statement of outward supplies. GST Portal guidance says covered normal and casual registered taxpayers generally file it even when there was no business activity in the period. A nil period therefore still needs the appropriate nil filing rather than being silently skipped.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The ordinary portal dates are:

Filing frequency Ordinary GSTR-1 due date Qualification
Monthly 11th of the succeeding month Portal guidance date; a government extension can change the date for a particular period.
Quarterly 13th after the quarter ends Portal guidance date; confirm the live return tile and any notification.

GSTR-3B and tax payment

GSTR-3B is the summary return through which the registered taxpayer reports the period’s liability and pays the amount due. The exact filing and payment date depends on the filing frequency and the applicable notification. A nil GSTR-3B still follows the portal’s nil-return process; the GST Portal displays the relevant due date in the return tiles, so check the period-specific date rather than relying on a permanent calendar assumption.

Nil periods are still filing periods

“No sales” does not automatically mean “no return.” GSTR-1 guidance covers nil periods, and the portal provides a nil GSTR-3B workflow. Before marking a period nil, confirm that there were no reportable outward supplies, tax liability, reverse-charge exposure or other activity requiring a different treatment.

Can a small startup file GST returns quarterly?

Eligible taxpayers can opt for the QRMP (Quarterly Return with Monthly Payment) scheme. The GST Portal FAQ describes an aggregate annual turnover ceiling of ₹5 crore, together with other prerequisites including having filed the last due GSTR-3B. Eligibility and the opt-in window should be checked on the portal for the relevant period.

QRMP changes the filing frequency, not the cash-payment cadence. GSTR-1 and GSTR-3B are filed quarterly, while tax dues are paid monthly through a challan. A startup that chooses QRMP must therefore maintain a monthly process for calculating and paying tax even though the formal returns are quarterly.

Decision factor Monthly filing QRMP
Eligibility Use the normal route, subject to the taxpayer’s registration and return category. Eligible taxpayers, including the portal FAQ’s aggregate annual turnover ceiling of ₹5 crore and stated filing prerequisites.
GSTR-1 frequency Monthly. Quarterly.
GSTR-3B frequency Monthly. Quarterly.
Tax payment Follow the monthly return and payment process. Pay tax monthly through challan; quarterly returns do not remove this requirement.
Earlier invoice visibility Invoices are reported through the regular monthly process. Optional IFF can report specified invoices in the first two months of a quarter.
Dates Use the portal’s monthly due dates and check extensions. Use the portal’s QRMP dates, opt-in timing and any extensions for the live period.

Choose QRMP when quarterly return preparation reduces administrative effort without harming customers’ need for timely invoice data. Stay on monthly filing when the startup has frequent B2B invoicing, changing tax positions or a process that already supports monthly reconciliation.

What is the Invoice Furnishing Facility?

The Invoice Furnishing Facility (IFF) is an optional QRMP feature for reporting specified invoices during the first two months of a quarter. It is designed to pass invoice information and associated credit to recipients earlier than the quarterly return cycle. IFF does not replace the quarterly GSTR-1 for the rest of the period; it is an early-reporting route for the invoices covered by the facility.

Before opting in, ask whether major B2B customers need earlier invoice visibility for their own reconciliations. If they do, assign an owner to prepare IFF data during each of the first two months and reconcile it with the quarter-end GSTR-1.

How can a startup prepare and submit GSTR-1?

GST Portal guidance identifies three preparation routes:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Online preparation: enter and submit the return in the GST Portal.
  • Offline utility: prepare data using the portal’s offline tool and upload it for filing.
  • GST Suvidha Provider application: use a third-party application that connects with the GST system, after confirming the provider’s current features, security and suitability.

The route does not change the legal responsibility for accurate data, timely filing or payment. Establish controls for invoice numbering, customer GSTINs, place of supply, tax rates, credit notes, amendments and reconciliation to the accounting records. Keep an approval step before submission and save the filed acknowledgment and working papers.

A practical compliance calendar for founders

At the point liability is identified

  • Record the date and event that created liability.
  • Map every state or Union territory in which the startup is liable.
  • Check the threshold, compulsory categories and exemptions that apply to the exact supplies.
  • Start the application immediately and track the 30-day deadline.

Every month

  • Close the sales register and identify taxable, exempt and inter-State supplies.
  • Reconcile invoices, credit notes and amendments to the accounting system.
  • Prepare GSTR-1 if the startup is a monthly filer, or prepare monthly QRMP payment data if it is quarterly.
  • Check the GST Portal for the live due date and any extension before payment or submission.

Every quarter for QRMP taxpayers

  • Confirm that eligibility and the opt-in remain valid.
  • Pay each month’s tax through challan; do not wait for the quarterly return.
  • Decide whether IFF is needed for B2B customers in the first two months.
  • File the quarterly GSTR-1 and GSTR-3B and reconcile them to the monthly payments.

Common mistakes and how to avoid them

Relying on turnover alone

A threshold calculation that ignores inter-State taxable supplies or another section 24 category can produce an incorrect non-registration decision. Add a compulsory-category review to the turnover worksheet.

Treating one state’s answer as the whole answer

Registration liability is examined in each state or Union territory where it arises. Maintain a state matrix for offices, warehouses and supplies instead of assuming the head-office registration covers all activity.

Assuming QRMP means quarterly payments

QRMP requires monthly tax payments through challan. Set recurring monthly ownership and cash planning even though GSTR-1 and GSTR-3B are filed quarterly.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Missing a nil return

GSTR-1 guidance covers nil periods, and the portal supplies a nil GSTR-3B workflow. Review the return tiles each period and file the correct nil or non-nil return.

Using stale due dates

The 11th, 13th and other dates are ordinary portal guidance, not immutable deadlines. Government notifications can extend a particular period. Check the live GST Portal before every filing.

Bottom line for an Indian startup

Make the registration decision in this order: PAN-based aggregate turnover, states of supply, compulsory-registration categories, exemptions and current notifications. If liability arises, apply within 30 days so the effective date is not pushed to the grant date. After registration, file GSTR-1 for outward supplies and the applicable GSTR-3B, including nil returns when required. QRMP can reduce return frequency for eligible taxpayers up to the portal’s stated ₹5 crore aggregate annual turnover ceiling, but it still requires monthly tax payments. Keep the transaction map and filing calendar current, and obtain professional advice when the facts involve multiple states, e-commerce, exports, reverse charge or a close threshold call.
