GST rates on clothes in India: 2025 rate change, CBIC FAQ conflict and answers for shoppers and retailers

Short answer: The GST Council’s September 2025 rate-change release places apparel in Chapters 61 and 62 at 5% when the sale value is up to ₹2,500 per piece and 18% above ₹2,500. However, the CBIC garment FAQ and goods-rate table still show the older 5% up to ₹1,000 and 12% above ₹1,000 structure. Because the operative Gazette notification and effective date for the newer bands were not verified, do not treat either figure in isolation as a safe answer for an invoice.

For a purchase or sale, identify the product’s tariff heading, determine the transaction value per piece, and check the notification effective on the supply date. Small retailers should reconcile the GST Council release with the operative notification before charging tax or filing a return.

Why the GST rate on clothes is currently confusing

Two official sources give different apparel thresholds. A GST Council-hosted Press Information Bureau release from September 2025 lists clothing in Chapters 61 and 62 at 5% up to ₹2,500 per piece and 18% above ₹2,500. The CBIC GST Rates FAQ and the CBIC goods-rate table reviewed still describe 5% up to ₹1,000 and 12% above ₹1,000.

The newer release is the latest relevant rate position located, but the implementing Gazette notification and its effective date were not established. The older CBIC FAQ therefore cannot be used to silently replace the later release, while the later release should not be presented as definitively operative without checking the notification. The legally applicable rate depends on the notification in force on the date of supply and the correct classification of the item.

What “clothes” covers—and what it does not

GST classification does not begin with the retail label “clothes.” It begins with the tariff heading and the product’s construction. Chapter 61 covers knitted or crocheted apparel. Chapter 62 covers apparel that is not knitted or crocheted. The September 2025 release applies the ₹2,500 bands to apparel and clothing accessories in those chapters, subject to the schedule’s wording.

Textile goods outside those chapters may follow different entries. The same release separately refers to made-up textile articles and sets in Chapter 63, with specified exceptions and corresponding value bands. That reference does not mean every textile article, furnishing, accessory or piece of fabric automatically receives the garment rate.

Fabric, sarees and dhotis can also fall under headings different from a stitched garment. Fibre, weaving method, grammage where relevant, and whether the material is knitted or woven can change the classification. A product description such as “cotton saree” is useful but may not by itself establish the HSN heading.

How a retailer should determine the rate

  1. Describe the item precisely. Record whether it is a finished garment, an accessory, a saree, a dhoti, a fabric cut or another made-up textile article. Note the fibre and whether the textile is knitted, crocheted or woven.
  2. Identify the tariff heading. Use the applicable HSN entry rather than searching only for the word “clothes.” Chapters 61 and 62 distinguish knitted or crocheted garments from other garments; sarees, dhotis and fabrics can use headings in Chapter 50, 52 or 54, among others.
  3. Determine the per-piece transaction value. The CBIC FAQ explains “sale value” as transaction value rather than a printed retail sale price. Apply the legally operative wording for the supply being invoiced, including any rules that affect valuation.
  4. Check the supply date. Find the rate notification and effective date applicable on that date. A press release, FAQ or rate table can describe a policy position but cannot substitute for the operative notification when the sources conflict.
  5. Apply the rate and retain the basis. Keep the HSN, product description, taxable value, rate notification reference and invoice calculation together. If construction or classification is uncertain, obtain professional advice before filing.

Ready-made garments under the September 2025 rate position

The September 2025 release lists apparel and clothing accessories in Chapter 61 (knitted or crocheted) and Chapter 62 (not knitted or crocheted) in two value bands:

Per-piece sale value Rate listed in the September 2025 release Qualification
Up to ₹2,500 5% Applies to the listed Chapter 61 and Chapter 62 apparel entries; verify that the item is actually covered and that the notification is effective
Above ₹2,500 18% Applies to the listed apparel entries; verify the operative notification and classification

These are per-piece bands. They are not a blanket rate for every textile sold by weight, length or set. The schedule’s treatment of Chapter 63 made-up articles also contains specified exceptions, so a retailer should not extend the apparel table to every household or textile product.

Conditional calculation examples

If the September 2025 schedule has been brought into force for the relevant item and the quoted amounts are exclusive of GST, a ₹2,000 taxable sale in the 5% band would produce ₹100 GST, for a total of ₹2,100. A ₹3,000 taxable sale in the 18% band would produce ₹540 GST, for a total of ₹3,540. These examples demonstrate the arithmetic only; they do not establish that the newer bands were operative on a particular invoice date, nor do they settle whether a displayed consumer price is tax-inclusive.

What the older CBIC FAQ says about sale value

The CBIC FAQ uses “sale value” to mean transaction value, not retail sale price. Its example says a wholesaler’s ₹950-per-piece supply falls in the lower old band, while a retailer’s ₹1,100 sale falls in the higher old band. Those figures explain how the FAQ viewed the transaction stage: the value is considered for the supply being made by that supplier.

That valuation explanation remains useful as guidance on the concept, but the FAQ’s ₹1,000 threshold and 5%/12% rates are older wording in light of the later September 2025 release. Do not copy the FAQ examples into a current invoice without checking the applicable notification and rate.

Sarees, dhotis and fabric cuts: classification examples

The CBIC FAQ does not treat every saree or dhoti as a generic ready-made garment. It gives examples based on the material and tariff heading:

Product example in the CBIC FAQ Heading shown Rate stated in that FAQ Important limitation
Silk woven saree 5007 5% Classification example from the older FAQ; confirm the current entry and notification
Cotton woven saree or dhoti 5208 or 5209, according to the stated grammage distinction 5% The correct heading depends on the product characteristics described in the tariff
Man-made filament-yarn saree or dhoti 5407 or 5408 5% Fibre and construction matter; do not generalize to all synthetic garments
Specified fabrics sold as cut pieces Heading depends on the fabric 5% The FAQ says specified fabrics can retain the fabric treatment when sold as cut pieces

The 5% figures in this table are the rates stated by the older CBIC FAQ. They are not proof that every saree, dhoti or fabric cut currently has a 5% rate, and they do not override a later or differently worded notification. A cut piece of fabric is not automatically a stitched garment simply because a customer intends to use it for clothing.

What shoppers should check on an apparel invoice

  • Product description: It should identify the item clearly enough to support the HSN classification, rather than merely saying “clothes.”
  • Taxable value and GST rate: Check whether the price shown is before GST or includes GST, and make sure the tax line matches the seller’s stated basis.
  • Per-piece treatment: Where a value threshold applies, confirm how the seller determined the value for each piece and whether the item is covered by the relevant chapter.
  • Invoice date: The rate can depend on the notification effective on the date of supply. A current-looking FAQ is not a substitute for that check.
  • Classification questions: For sarees, dhotis, fabric and accessories, ask which HSN heading the seller used if the rate appears unexpected.

Consumers do not need to calculate a retailer’s classification from scratch, but an invoice with a clear description and separate GST line makes an error easier to identify. If a seller cites the old ₹1,000 threshold, ask whether the invoice is relying on the older CBIC FAQ or on the notification effective for that date.

Common mistakes and how to correct them

Using the word “clothes” as the HSN basis

A shirt, a knitted top, a woven trouser, a silk saree and a length of cotton fabric are not interchangeable tax entries. Correct the mistake by recording the construction, fibre and finished form before selecting the heading.

Presenting ₹1,000 as the current universal threshold

The ₹1,000 threshold comes from the older CBIC FAQ and table reviewed. Label it as historical FAQ wording and check the later rate-change notification instead of applying it automatically.

Treating the September 2025 release as self-executing

A press release communicates the announced rate position. It does not, by itself, establish the effective date for every invoice. Confirm the Gazette notification and its commencement provision before changing billing software or tax returns.

Applying the garment rate to fabric or Chapter 63 goods

The apparel bands are tied to specified headings and value conditions. Check the separate textile schedule entry and its exceptions for made-up articles, sets and fabrics.

Ignoring the supply date

Rates can change between purchase orders, dispatches and invoices. Keep a dated copy of the notification relied upon and make the invoice, accounting record and return consistent with that date.

Small-retailer implementation checklist

  1. Create an item master with the product description, fibre, construction, HSN heading and unit of sale.
  2. Separate finished apparel from sarees, dhotis, fabric cuts, accessories and other textile articles.
  3. Record the transaction value per piece for each invoice line and document whether prices are tax-inclusive or exclusive.
  4. Check the GST Council’s September 2025 rate position against the operative Gazette notification for the supply date.
  5. Update billing rules only after confirming the effective date; do not overwrite historical invoices merely because a later rate was announced.
  6. Test an invoice below and above the applicable threshold, including rounding and tax-inclusive pricing where used.
  7. Retain the classification reasoning and notification reference with purchase and sales records.
  8. Escalate uncertain fibre, grammage, set or mixed-product classifications to a qualified tax professional.

How to verify the legally operative rate

Start with the GST Council’s rate-notification directory and locate the notification that implements the apparel change. Read the schedule, commencement clause, chapter headings, value wording and any exceptions. Then compare the notification date with the invoice or supply date. If the directory or a FAQ still shows a different rate, rely on the legally effective notification and obtain professional advice where the conflict cannot be resolved from the published text.

The materials reviewed here did not establish the Gazette notification or effective date for the newer ₹2,500 bands. That is why a retailer should not make a permanent pricing or return decision from the September 2025 release alone. The same verification is prudent for a shopper disputing a tax line: ask the seller which notification was effective on the transaction date and which heading was used.

Questions shoppers and retailers still ask

Is every item priced below ₹2,500 taxed at 5%?

No. The ₹2,500 bands in the September 2025 release are tied to specified apparel entries in Chapters 61 and 62, with related but separately worded Chapter 63 provisions. Classification and the operative notification still control.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is the ₹1,000 threshold still valid?

It appears in the CBIC FAQ and goods-rate table reviewed, but those materials reflect the older structure. Do not call it current without checking the notification effective for the supply date.

Does the printed MRP decide the rate?

The CBIC FAQ explains sale value as transaction value rather than retail sale price. Apply that valuation guidance together with the current legal wording and the actual supplier-to-customer transaction.

Are sarees and dhotis always classified as garments in Chapters 61 or 62?

No. The FAQ gives separate examples for silk, cotton and man-made filament woven products under headings 5007, 5208/5209 and 5407/5408. Fibre and construction determine the heading.

Can a retailer rely on a GST calculator to choose the HSN?

A calculator can assist with arithmetic, but it does not establish legal classification or the effective notification. The retailer remains responsible for the heading, rate and records.
