GST Proper Officer and Jurisdiction: Who Can Issue and Adjudicate a Notice?

A GST notice’s validity cannot be judged from an officer’s title or the state where the notice was issued alone. Check the statutory power invoked, who issued the notice, who is to adjudicate it, and the appointment, assignment or notification authorising that officer for this kind of case. The issuing officer and adjudicating officer may be different, particularly in cases handled by the Directorate General of GST Intelligence (DGGI).

Who is the proper officer under GST?

A “proper officer” is an officer entrusted with the particular function under the GST law. The designation on a notice does not, by itself, show that the officer has authority to exercise every power under the Act. Authority depends on the statutory function and the appointment, assignment, delegation or notification that applies to the proceeding.

Start with the notice itself: identify the provision invoked, the issuing formation and signatory, and any officer named to adjudicate the matter. Then check the relevant assignment or notification. The CGST Act, 2017 sets out the statutory framework; CBIC’s circulars explain assignment arrangements for certain DGGI cases.

What is the difference between a section 73 and section 74 notice?

Sections 73 and 74 address specified demands for unpaid or short-paid tax, erroneous refunds, and input tax credit wrongly availed or utilised. The key distinction is whether the case rests on the fraud-related grounds stated in section 74. Read the allegations and the tax period in the actual notice; the section number alone does not establish whether those grounds are made out.

Applicable procedure Apply the statutory text relevant to the proceeding and tax period Apply the statutory text relevant to the proceeding and tax period

The provisions set different processes and consequences. Section 74 is not simply an alternative to use because a proposed demand is large. The Act’s text for sections 73 and 74 is available in the official CGST Act.

Can DGGI issue a GST notice and another officer adjudicate it?

Yes. CBIC Circular 169/01/2022-GST states that Central Tax officers of Audit Commissionerates and DGGI exercise powers to issue show-cause notices. The circular distinguishes adjudication arrangements according to the case; the notice issuer need not be the officer who decides it.

Qualifying DGGI case involving multiple commissionerates or noticees under the 2024 amendment Specified Additional or Joint Commissioners have all-India jurisdiction for adjudication under the arrangement in Circular 239/33/2024-GST.

The 2024 circular, dated 4 December 2024, addresses DGGI notices to multiple noticees whose principal places of business fall under multiple Central Tax Commissionerates, and multiple notices on the same issue to multiple noticees having the same PAN. It describes allocation by the relevant commissioners, with a criterion linked to the principal place of business of the noticee with the highest tax demand. The circular states that Notification 27/2024-Central Tax took effect on 1 December 2024. These are defined categories, not a rule that DGGI cases in general are adjudicated anywhere in India by any officer. See Circular 239/33/2024-GST and Circular 169/01/2022-GST.

Can an officer outside my state issue a GST notice?

The state in which an officer is based does not, by itself, answer whether that officer is authorised for a particular proceeding. CBIC’s DGGI guidance provides for notices issued by DGGI and sets adjudication arrangements that can differ from the notice-issuing formation, including an all-India arrangement for qualifying cases. That does not mean every officer outside your state can issue or decide every GST notice.

CBIC’s sectoral FAQ says a registered person has one tax administration office—Central or State—for practical purposes and describes cross-empowerment. That broad administrative arrangement does not settle the authority question for every notice; check the statutory power and the notice-specific assignment or notification. See the CBIC GST Sectoral FAQs.

How do I check the jurisdiction of a GST officer?

  1. Make an identity record: note the notice number and date, issuing formation and signatory, statutory provisions cited, tax period, named noticees and GSTINs.
  2. Distinguish the roles: record separately who issued or investigated the case and who is identified to adjudicate it.
  3. Classify the case: determine whether the notice concerns one executive Central Tax Commissionerate or whether the stated DGGI facts may fall within the multi-commissionerate or multiple-noticee arrangement.
  4. Match the legal instrument: check the relevant CBIC circular and notification against the notice’s category, date and named officers. If the notice relies on a case-specific appointment, match the noticee, notice and adjudicating authority to that notification’s table.
  5. Review the allegations: compare the facts pleaded with the section invoked and the applicable statutory grounds for the tax period.
  6. Calendar the response: follow the service details, response requirements and hearing instructions in the notice, and preserve the notice and proof of service.

Notification 31/2024-Central Tax, dated 13 December 2024, illustrates a separate, case-specific appointment: its table names particular noticees, notices and adjudicating authorities. It is not a general appointment covering all taxpayers. The notification is available from CBIC.

What safeguards apply during adjudication?

Section 75 of the CGST Act sets general rules for determination. Among them, it requires a hearing when requested in writing or when an adverse decision is contemplated; requires the order to state relevant facts and the basis for the decision; and limits the amount and grounds confirmed to those specified in the notice.

This is the text of section 75(4) of the CGST Act, 2017. The Act also provides that an adjudication order cannot confirm an amount greater than, or on grounds different from, those in the notice.

Can an order demand more tax than the show-cause notice?

Section 75 restricts confirmation to the amount and grounds specified in the notice. Compare the order with the notice on both points: a difference in the figure or the legal and factual basis may raise a question under that provision. The full documents and applicable law are needed to assess an individual case.

What a jurisdiction check cannot establish by itself

Finding an assignment or notification that appears relevant does not decide every issue about a notice. A case-specific assessment may also require the full notice and order, the relevant tax period, service record, and applicable legal instruments. This general explanation does not determine whether an individual notice is valid or whether a limitation period has been met.
