Yes, a GST notice made available on the common portal can be legally served even if no paper copy reaches you. Section 169 of the Central Goods and Services Tax (CGST) Act lists portal availability alongside hand delivery, registered or speed post, courier, email, newspaper publication and certain forms of affixture. Service is generally tied to the statutory act of tendering, publishing or affixing the communication—not simply to when you personally happen to read it.
The practical issue is proving what was served, where it was placed, and which deadline applies to that particular notice. Download the complete document and attachments, record the portal location and timestamps, preserve any physical-delivery evidence, identify the statutory section and form, and calculate the earliest defensible response date. A later paper copy does not automatically cancel an earlier portal service or restart every limitation period.

What makes a GST notice legally served?
Section 169 of the CGST Act recognises several alternative ways for a GST communication to be served. The listed modes include:
The Tool Desk
Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →- hand delivery to the taxpayer or an authorised person;
- registered post, speed post or an approved courier with acknowledgement;
- email sent to the registered email address or an address later amended in the GST records;
- making the communication available on the common GST portal;
- publication in a newspaper where the statutory conditions require it; and
- when the earlier modes are impracticable, affixing the communication at the last known business or residence address or on the authority’s notice board.
The Act’s deemed-service concept focuses on the prescribed act: tendering the communication, publishing it or affixing it in the required manner. It does not make personal awareness the only test. Consequently, “I never received a hard copy” is not, by itself, a complete answer to a portal notice.

That does not mean every upload is immune from challenge. The location, accessibility, completeness and identification of the communication can matter. If a notice is difficult to discover or cannot be matched to the underlying allegations and statutory provision, preserve evidence of that problem and obtain professional advice quickly.
Portal notice versus physical notice at a glance
| Issue | Portal delivery | Physical delivery |
|---|---|---|
| Recognised service mode | Making the communication available on the common GST portal is expressly listed in section 169. | Hand delivery, registered post, speed post or courier with acknowledgement are expressly listed modes. |
| Primary proof | Downloaded PDF, notice number or RFN, upload date and time, portal menu heading, screenshots, account history and related email or SMS alerts. | Original envelope, postal or courier tracking, acknowledgement card, delivery date, recipient details and a scan of every page. |
| Accessibility question | Was the notice placed under a reasonably discoverable heading, and could the complete document and attachments be opened? | Was it tendered to the correct person or address, and does the delivered packet contain every page and attachment? |
| Deadline | Depends on the notice type and the legally relevant service or communication event; an upload does not create one universal GST clock. | Depends on the notice type and the legally relevant service or communication event; delivery of paper does not automatically replace an earlier valid portal service. |
| Reply evidence | Portal filing acknowledgement, ARN, filed PDF and screenshots showing successful submission. | Portal or prescribed-channel acknowledgement plus proof of dispatch or delivery if a paper reply is permitted. |
The table describes evidence to preserve, not a rule that one channel always outranks the other. If the same notice appears through more than one route, record each date and explain the difference in your file.
Why the portal location can become a legal issue
The Delhi High Court’s accessibility ruling
In Neeraj Kumar (Trade Name M/s ABM Pneumatics and Hydraulic Seals) v Proper Officer SGST Ward-19 Zone-2, decided on 11 July 2024, the Delhi High Court considered a notice that had been uploaded under “Additional Notices and Orders” and was not easily accessible. The court recorded that it was not prepared to accept the argument that such uploading automatically satisfied section 169. The order referred to the court’s earlier reasoning—“We are unable to accept the contention of the learned counsel”—and noted that the portal had subsequently been redesigned to place “View Notices” and “View Additional Notices” under one heading.

The adjudication order was set aside and the taxpayer was allowed two weeks to respond. This is a fact-specific decision, not a blanket declaration that every portal upload is invalid. Its practical lesson is narrower and important: preserve evidence showing exactly where the notice appeared, whether the heading was reasonably discoverable, when it became available, and whether the document could actually be opened and understood.
What the ruling does not establish
- It does not say that every portal notice needs a paper duplicate.
- It does not create a universal rule that a later physical copy restarts the limitation period.
- It does not decide every dispute about email alerts, SMS messages, portal downtime or an employee’s failure to monitor the account.
- It does not replace the need to read the specific notice, its statutory section and the deadline printed in it.
If you rely on an accessibility objection, make it concrete. Identify the menu heading, the date you searched, the screen or error encountered, the missing attachment, and the point at which the notice became discoverable. General statements that “the portal was confusing” are weaker than contemporaneous screenshots and an activity log.
What to download and record immediately
Do not wait for a paper copy before preserving the portal record. Create a dated evidence folder for the GSTIN and notice. Include:

- The complete notice. Download the PDF and every attachment, not only the first-page summary.
- Identification details. Record the notice number or RFN, tax period, statutory section, amount, issuing officer, issue date and any DIN or other reference shown.
- The portal location. Capture the page displaying the notice, the exact heading, the list of available documents and the account identity.
- Time evidence. Save screenshots showing the upload or availability timestamp, where displayed, and record the time zone or system clock used for your note.
- Account history. Preserve relevant portal-history entries and download logs. If the portal permits a print view, save that as a separate PDF.
- Alerts. Keep GST email and SMS alerts, including headers or message details that show the destination address and date.
- Integrity copies. Keep an unedited original and a working copy. Do not rename away the original notice number or overwrite files during annotation.
A screenshot is supporting evidence, not a substitute for the official document. If the PDF is corrupt, incomplete or password-protected, record the failure, try the portal download again, and notify the proper channel or adviser rather than assuming that a blank or partial file is the whole notice.
How to preserve proof of a physical notice
For a paper delivery, keep the entire packet in the condition in which it arrived. Scan both sides of the envelope before discarding anything. Preserve:
- the envelope, postal label, barcode and tracking number;
- registered-post, speed-post or courier tracking history;
- the acknowledgement card or electronic delivery confirmation;
- the delivery date, time and location where shown;
- the name, signature and relationship of the recipient;
- every page, annexure and calculation sheet; and
- an internal note explaining when the authorised tax team first received or opened it.
If the packet contains fewer pages than the notice refers to, or an attachment is unreadable, note that immediately and seek a complete copy through the prescribed channel. Do not silently reconstruct missing pages from an unofficial source.
Check the electronic summary against the full notice
DRC-01 for a show-cause notice
CBIC’s 23 November 2023 instruction requires the proper officer to serve the summary of a show-cause notice in FORM GST DRC-01 electronically on the portal. Rule 142 materials identify DRC-01 as the electronic summary for a section 73 or section 74 notice. Treat the summary as an index to the case, not as a replacement for the full notice. Read the allegations, computation, period, proposed tax, interest, penalty and requested action in the complete document.
DRC-07 for an order
The same instruction requires the summary of an order to be uploaded in FORM GST DRC-07. Match DRC-07 to the underlying order before deciding whether to pay, seek rectification or appeal. A mismatch in amount, tax period, section, officer or reference number should be escalated promptly and documented.

Which deadline applies?
There is no single “GST notice reply period.” The clock depends on the document and the statutory provision. Use the notice’s own instructions together with the Act and rules, and calculate the earliest arguable deadline from the legally relevant service or communication event.
Section 73: non-fraud demand
For a section 73 demand on a non-fraud basis, the Act provides a route to pay tax and interest within thirty days of issue of the show-cause notice. The stated consequence is that no penalty is payable and proceedings are deemed concluded. This is a notice-specific statutory consequence, not a general thirty-day period for every GST communication. Check the exact wording, applicable amendments and payment instructions before relying on it.
Section 74: fraud, wilful misstatement or suppression
Section 74 concerns allegations of fraud, wilful misstatement or suppression and has a different allegation and penalty framework. Do not copy a section 73 payment or reply assumption into a section 74 case. The section number, allegations and relief available must be analysed separately.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesASMT-10 scrutiny notice
For an ASMT-10 scrutiny notice, CBIC’s rules page states that the notice must specify a period not exceeding fifteen days from service for the registered person’s explanation, normally filed in FORM GST ASMT-11. Count the period for that document from its legally relevant service event and follow the filing instructions in the notice.
Appeal under section 107
Section 107(1) provides three months from communication of an adjudication decision or order to file an appeal. Section 107(4) allows a further month where sufficient cause prevented timely filing. The additional month is not an automatic extension; document the cause and comply with the appeal procedure.
Hearing dates and other procedural periods
A notice may specify a personal-hearing date or a different period under the applicable provision. Calendar the earliest date that could reasonably apply, including a hearing date that falls before your internal response target. If the law permits an extension, request it in writing before the deadline and continue preparing the reply; do not wait for a later paper copy to start work.

How to calculate the service date when both channels are used
When a notice appears on the portal and later arrives by post, create a chronology with separate entries for issue, portal availability, email or SMS alert, physical tender or delivery, first discovery and reply submission. Do not collapse these into one “received” date.
- Identify the statutory provision and the event from which that provision measures time.
- Record every evidenced service event, including portal availability and physical tender or delivery.
- Use the earliest defensible deadline for internal planning while obtaining advice on any disputed service event.
- If the portal record is inaccessible, incomplete or ambiguous, preserve the defect and raise it promptly rather than assuming the later paper date controls.
- Submit a protective reply or seek an extension where the applicable procedure allows it.
No official rule establishes that a later physical copy automatically overrides an earlier portal notice or resets every deadline. The outcome depends on the document, the statutory service requirements and the facts showing what was made available or tendered.
Filing a reply and proving that it was timely
- Use the prescribed channel. File through the GST portal form or other channel specified in the notice. A reply sent only by ordinary email may not satisfy the procedural requirement.
- Attach a structured response. Identify the notice number, tax period, section, point-by-point reply, documents relied on and the relief requested.
- Submit before the internal cut-off. Leave time for portal latency, authentication problems, attachment-size limits and an unsuccessful submission.
- Capture the acknowledgement. Save the acknowledgement reference number (ARN), filed PDF, submission date and time, and the confirmation screen.
- Preserve the final record. Keep the exact attachments submitted and a copy of any later clarification, hearing notice or officer communication.
If the portal fails during filing, capture the error, date and time, browser or device details and any support-ticket number. Retry through the prescribed route, but do not delete the failed-attempt evidence. Where permitted, send a contemporaneous written explanation through the officer’s designated channel and attach proof of the portal failure.
Common mistakes and how to avoid them
Waiting for a hard copy
Because portal availability is a recognised service mode, waiting for paper can consume the response period. Monitor the portal and alerts assigned to the GST account and begin document review as soon as a notice appears.
Saving only DRC-01 or DRC-07
A summary can omit the factual narrative, annexures or calculation detail needed for a proper reply. Download the complete notice or order and reconcile every figure.
Assuming the first login date controls
Personal discovery is useful evidence, but deemed service can turn on tendering, publication, affixing or portal availability under the applicable rule. Record the first-login date without treating it as automatically decisive.
Best Value
Ignoring the menu heading
A notice buried under an unexpected heading may raise an accessibility issue, particularly in light of the Delhi High Court’s 11 July 2024 decision. Preserve the heading and navigation path instead of merely asserting that no notice was visible.
Using the wrong statutory clock
Thirty days for a section 73 payment consequence, up to fifteen days for an ASMT-10 explanation and three months for a section 107 appeal are different rules. Never apply one period generically to another document.
Replying without an ARN
An unacknowledged draft or email does not prove a completed portal filing. Obtain and retain the ARN and the filed copy.

A practical evidence checklist
- Notice PDF and every attachment downloaded immediately.
- Notice number or RFN, statutory section, tax period, amount, officer and DIN recorded.
- Portal page, heading, availability timestamp and account history captured.
- Email and SMS alerts preserved with dates and destination details.
- Physical envelope, tracking, acknowledgement, delivery details and complete scan retained.
- Separate chronology created for issue, each service channel, discovery and reply.
- DRC-01 or DRC-07 matched to the full notice or order.
- Applicable deadline, hearing date and internal filing cut-off calendared.
- Reply filed through the prescribed form or channel.
- ARN, filed PDF, attachments, screenshots and any error logs retained.
When to obtain professional help
Obtain India GST counsel or a qualified tax professional promptly when the communication involves a demand, cancellation, recovery action, fraud or suppression allegations, an adjudication order, an appeal deadline, a disputed service date or an inaccessible portal record. Bring the complete chronology and evidence folder, not just a screenshot of the first page.
A professional can assess whether the service mode complied with section 169, whether a notice-specific period has expired, whether an extension or protective filing is available, and what remedy is appropriate. Preserve the right to respond while that review is underway; an argument about defective service is safer when supported by a timely, documented response than when raised for the first time after an order.
Bottom line for portal and paper notices
A GST portal notice can be valid without a hard copy because portal availability is expressly recognised under section 169. The decisive practical questions are what was made available, how discoverable and complete it was, what evidence proves the event, and which statutory clock applies to that document. Physical delivery provides a different evidence trail; it does not automatically supersede an earlier portal service or restart every deadline. Download, document, reconcile, calendar and file—then seek advice quickly if accessibility or service is genuinely disputed.
