To appeal a GST penalty order in India, first identify the order and the date it was communicated, then file FORM GST APL-01 within the applicable Section 107 period, complete the certified-copy process under Rule 108, and preserve the final APL-02 acknowledgement. Your grounds should answer the findings in the order one by one, using the notice, reply, hearing record, transaction evidence and the governing provision. A rejection of a Section 128A waiver application in FORM GST SPL-07 follows a narrower route: the appeal concerns whether the waiver applies, not whether the original demand was correct.
This checklist is framed around the CGST framework. SGST and UTGST provisions, notifications, portal instructions and amendments can change the calculation or procedure for a particular order, so verify the operative law before filing.

1. Confirm what you are appealing
Section 107 permits a person aggrieved by a decision or order of an adjudicating authority to appeal to the prescribed Appellate Authority. A penalty appeal normally challenges an adjudication order that determines tax, interest or penalty after a show-cause notice. Do not calculate time from the date printed on the order until you have checked when it was actually communicated to you and what the applicable rules say.
Record the operative facts
- Identify the authority, order number, tax period and GSTIN.
- Obtain the complete order, including annexures, computation sheets and relied-upon documents.
- Record the date and method of communication shown in the portal, email, physical service or other valid channel.
- Separate tax, interest, penalty and any other components in the demand.
- Check whether the order is under CGST, SGST, UTGST or a combination, because the relevant appellate authority and law may differ.
A penalty-only dispute is not automatically treated the same as a dispute involving tax. The pre-deposit rule, recovery position and appeal jurisdiction must be checked against the exact composition of the demand.
2. Calculate the appeal deadline correctly
The Section 107 text hosted by the Central Board of Indirect Taxes and Customs (CBIC) states an ordinary period of three months from communication of the decision or order. It also permits a further period of up to one month where sufficient cause prevented timely filing. That hosted text is not presented as a current consolidated edition, so confirm amendments, notifications, court directions and order-specific extensions before relying on the calculation.
Deadline worksheet
- Write down the legally relevant communication date, not merely the order date.
- Count the ordinary three-month period under the version of Section 107 applicable to the matter.
- Mark the last day for a condonation request, if the law still allows up to one additional month.
- Check whether a government notification, judicial order or portal instruction changes the filing window.
- Submit as early as possible and retain evidence of the submission time.
A condonation request is not an automatic extension. If filing is late, explain the specific event that caused the delay, give dates, attach supporting proof and request admission within the statutory limits. Waiting for a response to an informal representation generally does not replace filing the appeal.
3. File FORM GST APL-01 and complete Rule 108 formalities
FORM GST APL-01 is the first-appeal form. Complete the verification, signature, grounds and relief fields that apply to your case, and upload the order and relevant material through the currently applicable filing route. Follow the portal’s current instructions for digital signature or electronic verification.

Rule 108 requires submission of a certified copy of the decision or order and supporting documents in the prescribed sequence. The CBIC rule text states: “For the provisions of this rule, the appeal shall be treated as filed only when the final acknowledgement, indicating the appeal number, is issued.” The rule describes a seven-day step for furnishing the certified order and supporting documents; the date treatment can depend on whether that step is completed within the required period.
- Submit APL-01 with the grounds, verification and initial documents.
- Save the provisional acknowledgement immediately.
- Submit the certified copy of the appealed order and supporting documents in the manner and time specified by Rule 108 and current portal instructions.
- Check that the authority has issued the final APL-02 acknowledgement with the appeal number.
- Store the provisional acknowledgement, certified-copy receipt, upload confirmation and APL-02 together.
Do not assume that an upload confirmation alone proves the appeal has been filed. Verify the final appeal number and resolve any portal deficiency notice promptly.
4. Build the document file before writing grounds
The following is a practical preparation list. Whether an item is mandatory in every appeal depends on the order, the rule and the filing channel; include material that directly supports a ground rather than uploading an unindexed archive.
Core procedural documents
- Complete adjudication order with every annexure and computation.
- Proof of communication and a deadline calculation sheet.
- FORM GST APL-01, verification and signed authorisation where applicable.
- Certified copy supplied for the Rule 108 process.
- Show-cause notice, statement of grounds and relied-upon documents.
- Your written reply, written submissions and any additional reply.
- Hearing notices, attendance details, written hearing notes and the hearing record, if available.
Commercial and accounting evidence
- Invoices, e-way bills, delivery records and contracts relevant to the disputed transactions.
- Returns, electronic liability ledgers, cash ledgers and general ledgers.
- Reconciliations tying the disputed figures to books and GST returns.
- Payment challans, bank evidence and correspondence with the department.
- Any document that tests the factual finding, such as proof of reversal, correction or disclosure.
Appeal-control records
- A chronology linking notice, reply, hearing, order, communication and filing.
- A calculation separating admitted amounts from each disputed component.
- Evidence of any required payment or pre-deposit, after checking the current rule.
- Provisional acknowledgement, certified-document submission proof and final APL-02.
Use a numbered index and refer to document numbers in each ground. This lets the authority test the allegation without searching through unrelated files.
5. Draft grounds that answer the order, not a generic template
There is no universal ground that cancels every GST penalty. Start with the exact finding and build a short chain: finding, contrary evidence or legal rule, error or prejudice, and relief requested. Section 107 allows an additional ground to be admitted under a statutory condition, but that possibility is not a reason to file incomplete grounds.
Ground 1: mismatch between notice and order
Compare the penalty provision, facts and period in the show-cause notice with the final order. If the order relies on a different allegation or provision, identify the paragraph in each document and explain how the change affected your opportunity to respond. Ask for relief that follows from the procedural and statutory error supported by the record.
Ground 2: statutory conditions are not established
List each condition required by the cited penalty provision and show where the order fails to establish it. Distinguish an admitted filing or payment fact from an inference about intent, suppression, wrongful availment or other statutory element. Attach the transaction record that addresses the missing condition.
Ground 3: material submissions were ignored
Identify a specific reply, reconciliation, invoice, payment record or hearing submission that the order does not address. Explain why it could change the result. A bare statement that “all documents were ignored” is weaker than a paragraph-by-paragraph reference to the record.

Reperform the penalty calculation from the governing provision and show the disputed line. Check the tax period, number of days, turnover base, number of returns, adjustments and payments used. Separate a challenge to the legal rate from a challenge to the underlying figures.

Ground 5: hearing or reasoned-order defect
Set out the notice date, response date, hearing date and any request for adjournment or additional material. If the required opportunity was not provided, explain the concrete prejudice. The Appellate Authority is expected to state points for determination, its decision and reasons; identify the unanswered issue rather than relying on a general allegation of violation.
State precise relief
For each ground, request the outcome that matches the error: annulment of the penalty, deletion of a component, recalculation under the correct provision, or another legally available modification. State whether any tax or interest component is admitted and keep that position consistent with the payment record.
6. Understand payment, pre-deposit and recovery
The Section 107(6) text cited by CBIC describes payment of admitted dues and a prescribed percentage of the remaining disputed tax, after which recovery of the balance is stayed. The available hosted text does not establish the current consolidated percentage, cap, amendments or how the rule applies in every penalty-only appeal.
Do not use a universal rupee formula or assume that a percentage applies directly to a penalty. Before paying, verify:
- the operative CGST, SGST or UTGST provision and current notifications;
- whether the demand contains disputed tax, interest, penalty or a mixture;
- the current percentage and any monetary cap;
- which admitted amount must be paid in full;
- how the portal records the payment and links it to the appeal.
Keep the challan, ledger entry and payment reference with the appeal file. If recovery action continues after the required payment, use the acknowledgement and payment evidence when seeking correction or protection from the appropriate authority.
7. Special branch: appeal against FORM GST SPL-07 waiver rejection
Section 128A creates a distinct issue where an application for waiver of interest or penalty is rejected in FORM GST SPL-07. CBIC Circular No. 238/32/2024-GST explains that the rejection can be appealed under Section 107 within the applicable period.
Rank #4
What this appeal decides
The question is whether the statutory waiver applies to the applicant’s facts and payments. It is not a second opportunity to argue every factual or legal issue in the original notice, statement or adjudication order. Frame the grounds around eligibility, qualifying period, payment conditions, documentation and the reason given for rejection.
Documents for the SPL-07 file
- SPL-07 and the complete waiver application.
- Proof of tax payment and records showing when payment was made.
- Correspondence or deficiency notices concerning the waiver application.
- The original order only to the extent needed to establish the waiver context.
- A calculation showing which interest or penalty amount the waiver would cover.
The circular notes that pre-deposit may depend on whether relevant tax dues already paid satisfy Section 107(6). Confirm that point against the current law and the exact demand before submitting APL-01.
8. Ordinary merits appeal versus SPL-07 appeal
| Issue | Ordinary penalty-order appeal | SPL-07 waiver-rejection appeal |
|---|---|---|
| Order challenged | Adjudication decision imposing or confirming a demand or penalty. | Rejection of a Section 128A waiver application in FORM GST SPL-07. |
| Main question | Whether the findings, legal basis, procedure or calculation support the demand. | Whether the statutory waiver applies to the applicant’s facts and payments. |
| Deadline | Section 107 period measured from communication, subject to any permitted condonation and current extensions. | Applicable Section 107 period measured from communication of SPL-07, verified under current law. |
| Evidence focus | Notice, reply, hearing record, transaction evidence and penalty calculation. | Waiver application, SPL-07 reasons, eligibility evidence and payment records. |
| Payment issue | Check admitted dues and the current disputed-tax pre-deposit rule; do not assume a penalty-only formula. | Check whether relevant tax dues already paid satisfy the applicable Section 107(6) condition. |
| Filing evidence | APL-01, Rule 108 certified-copy process and final APL-02. | The same APL-01 and acknowledgement sequence, with SPL-07 attached. |
9. What happens after filing
The Appellate Authority must provide an opportunity of hearing. It may confirm, modify or annul the order after any further inquiry it considers necessary. A disposal order should state the points for determination, the decision and the reasons.
Prepare for the hearing
- Bring a one-page chronology and a ground-by-ground index.
- Know the exact paragraph, document and calculation behind every submission.
- Be ready to distinguish admitted facts from disputed facts.
- Answer questions about payment, pre-deposit and the relief requested.
- Submit a concise written note if the authority permits or requests one.
Monitor the portal and official communications after the hearing. Preserve hearing notices, adjournment orders, written submissions and the final appellate order.
10. Common failure points and fixes
Using the order date instead of communication date
Fix: preserve the actual communication record and calculate from the legally relevant date after checking the current rule.

Stopping at provisional acknowledgement
Fix: complete the certified-copy step, then verify that APL-02 with an appeal number has issued.
Best Value
Uploading an unstructured document bundle
Fix: create an index, chronology and document references tied to each ground.
Arguing only that the penalty is harsh
Fix: test the statutory conditions, notice-to-order consistency, evidence, calculation and procedure; then request a legally available remedy.
Using an outdated pre-deposit percentage
Fix: check the current consolidated provision, notifications, portal calculation and demand composition before payment.
Turning an SPL-07 appeal into a merits appeal
Fix: focus on waiver applicability and the reasons for rejection, while attaching only the original-order material needed to establish eligibility.
11. Final filing checklist
- Order and communication proof identified.
- Correct appellate authority and applicable CGST, SGST or UTGST law confirmed.
- Three-month ordinary period and any condonable period checked against current law.
- APL-01 completed, verified and signed.
- Grounds tied to findings, evidence, statutory provisions and precise relief.
- Notice, reply, hearing record and relevant transaction documents indexed.
- Admitted and disputed amounts separated.
- Current pre-deposit requirement verified before payment.
- Certified copy and supporting documents submitted under Rule 108.
- Provisional acknowledgement, submission proof and final APL-02 appeal number preserved.
- If applicable, SPL-07, waiver application and payment evidence attached, with grounds limited to waiver applicability.
Because deadlines and payment rules can change, have a qualified GST professional review a deadline-sensitive or high-value appeal before submission. Professional assistance is not a statutory prerequisite, but a missed limitation period, defective certified-copy filing or misclassified demand can affect the case before the merits are examined.
