For a seafarer who is genuinely an employee, salary for work in the course of or in relation to employment is outside GST in India: the CGST Act treats those employee services as neither a supply of goods nor a supply of services. Working overseas does not, by itself, turn wages into an export of services. If the seafarer is an independent contractor, GST and export rules need a separate, fact-specific review. Provident-fund coverage is a distinct question under the applicable Seamen’s Provident Fund rules.

Does GST apply to a seafarer’s salary?

Generally, no—where the seafarer is an employee and the payment is for services in the course of or in relation to that employment. Schedule III of the CGST Act states that “Services by an employee to the employer in the course of or in relation to his employment” are neither a supply of goods nor a supply of services. This rule concerns the employment relationship, not every payment to a person who works aboard a ship. Calling remuneration “salary” or describing someone as a contractor does not settle their legal status.

Is the seafarer an employee or an independent contractor?

Employment status is the first decision point. The Schedule III exclusion applies to services supplied by an employee to an employer in the course of or in relation to employment. It is not a blanket exclusion for independent services.

Review the agreement and the working arrangement, including who employs the seafarer, who receives the services, who pays the remuneration, how it is determined, and whether a recruiting or placement intermediary is involved. The label in a contract is relevant but should not be treated as conclusive on its own.

If the seafarer is genuinely engaged as an independent contractor, the employee rule may not cover the payment. The applicable GST classification, registration, place-of-supply and, where relevant, export rules then require separate analysis. The available official material does not establish one universal GST result for every contractor arrangement involving a seafarer. CGST Act, Schedule III CBIC GST FAQ

Does working overseas make seafarer wages an export of services?

No—not automatically. First determine whether the payment is for employment services. If it is employee salary covered by Schedule III, it is outside the concept of supply; it is not necessary to recast it as an export merely because the seafarer, ship or work is abroad. CGST Act, Schedule III

For an independent service arrangement, whether a service qualifies as an export depends on the relevant statutory conditions and the parties’ locations and roles. Place-of-supply rules also make the specific location facts important. Overseas work alone is not enough to determine the result. Is provident fund deducted from overseas seafarer salary?

GST treatment and provident-fund coverage are separate questions. Government maritime materials identify the Seamen’s Provident Fund Act, 1966 and the Seamen’s Provident Fund Scheme, 1966. The Seamen’s Provident Fund Organisation describes a contributory scheme involving employer contributions and matching contributions, and DGS describes SPFO’s role in collecting contributions from shipping companies and administering benefits under applicable rules. These general descriptions do not establish that every seafarer working overseas is covered, or what contribution terms apply to a particular person. Do not assume a universal contribution percentage from an overview page: check the current scheme terms, the worker’s category and the employment circumstances.

Official maritime material also indicates that employment and social-security responsibilities can depend on matters such as the ship’s flag, the employer and the use of a recruiting or placement intermediary. Historical or draft discussions about those issues should not be mistaken for a binding universal rule. DGS material on seafarer employment Maritime meeting material

What facts should you check?

For an individual answer, assemble the documents and details that determine the employment relationship, GST treatment and possible fund coverage:

  • The seafarer employment agreement and any amendments.
  • The legal identity and location of the employer, shipowner and payroll payer.
  • Any recruiting, hiring or placement intermediary and its role.
  • Whether the agreement and actual working arrangement indicate employment or independent service provision.
  • The vessel’s flag and relevant engagement details.
  • The fund under which the seafarer is covered and the current scheme provisions governing contributions.
  • Whether the question concerns GST, income tax, withholding or provident-fund eligibility; these are separate issues.

For an employee in an employment relationship, the general GST treatment of salary is clear. Contractor status and fund coverage depend on the particular facts and applicable current rules.
