A GST notice proposes a liability and gives the business a chance to respond. A GST demand order records the proper officer’s determination after considering the response, and its electronic summary can trigger recovery consequences. The label on an email or portal alert is not enough: identify the statutory section, tax period, service or communication date, document contents and form number.
The practical sequence is usually proposal, representation, determination and then appeal or recovery. A DRC-01A communication may come before a formal notice; a notice summary may appear in DRC-01 or DRC-02; a representation is generally uploaded in DRC-06; and an order summary is issued in DRC-07. These forms help identify where the case stands, but the underlying notice or order controls the facts and reasoning.

The short answer: proposal versus determination
A GST notice is a procedural document. It tells the registered person what liability the officer proposes to impose, why the officer believes tax, interest or penalty may be payable, and how to make a representation. Sections 73 and 74 of the Central Goods and Services Tax Act, 2017 describe this notice-and-determination process.

It determines the amount payable rather than merely proposing it. The order may confirm, reduce or otherwise determine the proposed liability. Its summary in DRC-07 states tax, interest and penalty payable; Rule 142 says the order referred to in that rule is treated as the notice for recovery.

Therefore, receiving a notice is not the same as already owing a finally determined demand. Receiving an order is a different stage: the business must examine recovery consequences and the appeal route without assuming that a later informal explanation will stop statutory time limits.
How a notice and an order differ
| Point of comparison | GST notice | GST demand order |
|---|---|---|
| Procedural stage | Proposed liability; the business is invited to show cause or make a representation. | Determination after the officer considers the response and material on record. |
| What to read first | Cited section, allegations, tax period, proposed tax, interest, penalty and reply instructions. | Findings, confirmed amounts, reasons, tax period, communication date and payment or appeal instructions. |
| Typical electronic summary | DRC-01 for specified notices, or DRC-02 for specified statements. A pre-notice intimation can appear in Part A of DRC-01A. |
DRC-07 order summary showing tax, interest and penalty payable. |
| Business response | Submit the representation in DRC-06 when the notice summary has been uploaded in DRC-01, and follow the notice’s hearing or submission directions. |
Consider payment, correction options available under the governing law, or an appeal. Section 107 ordinarily provides three months from communication of the decision or order to appeal to the Appellate Authority, subject to the applicable law and facts. |
| Recovery position | A proposal by itself is not the same as a determined demand, although other statutory consequences can arise from the case and the document’s wording. | The Rule 142 order summary is treated as the notice for recovery. Treat recovery and appeal issues as time-sensitive. |
| What the form proves | A form number identifies the procedural communication; it does not replace the complete notice or establish that the proposed amount is correct. | DRC-07 is a summary. It does not necessarily contain every fact, calculation or reasoning in the underlying order. |
This comparison is an orientation tool, not a decision on the merits of a particular demand. The exact section, period, service record and contents control.
Identify the statutory section before judging the demand
Section 73: matters other than alleged fraud
Section 73 addresses tax or input-tax-credit matters “for any reason, other than the reason of fraud or any wilful-misstatement or suppression of facts to evade tax”. A notice under this route still requires a careful factual response. An error in classification, a return mismatch or a disputed credit can involve substantial amounts without amount alone deciding the applicable section.
Section 74: allegations involving fraud or wilful misstatement
Section 74 concerns tax or input-tax-credit matters alleged to arise “by reason of fraud or any wilful-misstatement or suppression of facts”. The allegation itself matters because it changes the statutory route and the potential exposure. Do not infer that section 74 applies merely because the proposed amount is large, or that section 73 applies because the amount is small. Read the notice’s stated grounds, the period covered and the evidence cited.
Sections 75 and 107
Section 75 contains general determination provisions that operate with the demand procedure. Section 107 provides the appeal route to the Appellate Authority. The ordinary appeal period is three months from communication of the decision or order, but a live case must be checked against the consolidated legislation, amendments, transitional rules and the actual service record. A portal upload date, an email date and the date on which an authorised person actually received a document may require separate analysis.

What the GST forms mean in the sequence
DRC-01A: possible pre-notice intimation
Rule 142 permits the officer to communicate an ascertained liability before issuing a notice in Part A of DRC-01A. This is a possible pre-notice communication, not the notice itself. Treat it as an opportunity to investigate and, where appropriate, respond before the formal notice stage. Do not describe DRC-01A as proof that a final demand has already been determined.
DRC-01 and DRC-02: summaries connected with notices or statements
Rule 142 calls for an electronic summary in DRC-01 with specified notices and in DRC-02 with specified statements. The summary can be the first item visible in the portal, but it should be read with the complete notice, annexures and calculations. Check whether the tax period, registration number, legal provision, proposed tax, interest and penalty match the detailed document.

1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteDRC-06: representation to a notice
When a notice summary has been uploaded in DRC-01, Rule 142 identifies DRC-06 for furnishing the representation. Follow the notice for the permitted format, attachments, hearing request and deadline. A short portal entry that says only “disagree” is not a substitute for a reasoned response supported by reconciliations and source records.
DRC-07: order summary
Rule 142 provides for an order summary in DRC-07 stating tax, interest and penalty payable. The rule also says the referenced order is treated as the notice for recovery. Download both the DRC-07 summary and the underlying speaking order, if separately available. Compare every figure with the order’s workings; the summary alone may not reveal how the officer reached the result.
APL-01 and APL-04: appeal records
CBIC’s appeal rules material describes filing materials for APL-01 and order summaries in APL-04. If the communication is an order and you intend to challenge it, preserve the complete order, DRC-07, proof of communication, the original notice, your DRC-06 response and the appeal filing record. Use the applicable portal instructions and current rules rather than relying on an old form screenshot.

What to do when a GST communication arrives
- Save the original communication. Download the notice or order, every annexure, portal acknowledgment and email. Preserve the envelope or courier record where one exists, along with the date and method of service. Do not rely on a later portal view that could change or become unavailable.
- Classify the document. Decide whether it is a pre-notice intimation, show-cause notice, statement or order. Record the form number, reference number, issuing authority and the document’s own date.
- Match the section and period. Check whether the document cites section 73, section 74 or another provision, and list every financial year, return period or transaction period covered. A mismatch between the portal summary and the attachment should be raised expressly in the response.
- Build an amount schedule. Separate principal tax, interest, penalty and any other component shown. Recalculate totals from the transaction-level workings. Mark figures that are admitted, disputed, unsupported or already paid.
- Reconcile the allegation to records. Pull the relevant GST returns, invoices, e-way or shipping records where relevant, purchase and sales ledgers, input-tax-credit workings, payment challans, correspondence and contracts. Map each alleged discrepancy to a document and explain missing records instead of leaving a blank assertion.
- Check the procedural directions. Note the response date, hearing date, permitted attachment size or format, named officer and submission channel. A statutory deadline should be calculated from the legally relevant communication date, not from memory or a calendar reminder created from an informal phone call.
- Prepare the representation. Use
DRC-06where Rule 142 and the notice require it. Start with a numbered response to each allegation, then provide a period-wise reconciliation, legal grounds, document index and a precise request for dropping or reducing the proposed amount. If facts are incomplete, identify what is missing and ask for the specific clarification or relied-upon material needed. - Request and attend a hearing when appropriate. Follow the notice’s hearing procedure and keep proof of attendance, adjournment request or non-availability of the officer. Do not assume that an oral discussion replaces a written submission.
- Track the result. After submission, monitor the portal and official communication channels for an order. If an order appears, download the full text and
DRC-07immediately; do not treat the absence of a fresh email as proof that no order was issued. - Escalate promptly if it is an order. Decide whether to pay, seek a legally available correction or file an appeal. For an appeal under section 107, ordinarily count three months from communication of the decision or order, then verify the current consolidated law, any condonation rules and filing requirements before relying on that calculation.
How to test the figures and reasoning
Tax or input-tax-credit base
Identify the exact transactions used to calculate the proposed or confirmed tax. A portal mismatch can arise from a timing difference, amendment, credit-note treatment, duplicate reporting, place-of-supply issue or a supplier-side reporting difference. The response should show the return period, invoice or document reference, amount in books, amount reported in returns and the explanation for any variance.
Interest
Interest should be checked separately from tax. Confirm the period used, the principal on which it is calculated and the payment or credit dates adopted by the officer. If the notice provides a calculation sheet, reproduce it in your own schedule and identify each date that changes the result.
Penalty
Do not treat a penalty figure as an automatic percentage of tax without reading the cited provision and allegations. The section, conduct alleged, period and procedural stage can affect the analysis. A response should address the factual basis for the penalty as well as the tax calculation.
Already-paid or already-adjudicated amounts
Match challans, electronic-ledger entries, earlier orders and prior correspondence to the demand. If an amount was paid under a previous proceeding or adjusted elsewhere, provide the reference and ledger evidence rather than simply stating that it was paid.
Recovery, payment and appeal after an order
An order changes the risk profile because Rule 142 treats the referenced order as the notice for recovery. A business should therefore run two workstreams at once: verify whether the order is legally and factually defensible, and protect against missed recovery or appeal actions.

If the amount is accepted
Use the current GST portal payment instructions and confirm that the payment is posted to the correct electronic liability or cash ledger. Save the challan, debit entry, acknowledgment and any order-linked payment reference. If the amount is only partly accepted, document the admitted and disputed portions separately and obtain professional advice on the effect of any payment on the appeal position.
If the amount is disputed
Assemble the appeal record before the deadline: the order, DRC-07, original notice and summaries, DRC-06 response, hearing papers, evidence index and proof of communication. Section 107 ordinarily allows three months from communication to appeal to the Appellate Authority. The exact filing mechanics, statutory deposits, condonation and later-stage remedies depend on the current law and the case; verify them rather than importing figures from an unrelated year or jurisdiction.
If the order appears incomplete
A DRC-07 summary may omit detailed reasoning. Obtain the underlying order and compare it with the notice and your reply. If the order does not address a material submission, uses a different period or contains an unexplained calculation, record that issue in the legally available application or appeal. Do not assume that a portal summary can be challenged effectively without the complete order.
Common mistakes and how to avoid them
- Calling every communication a “demand notice”. The phrase is used casually, but the legal stage may be a pre-notice intimation, notice, statement or order. Use the document’s section and form number.
- Treating
DRC-01Aas a final notice. Rule 142 describes Part A as a possible pre-notice communication. - Replying only to the portal summary. The summary may not include annexures, transaction lists or the officer’s full reasoning. Download and answer the complete document.
- Ignoring the allegation language. The distinction between section 73 and section 74 turns on the stated grounds, including allegations of fraud, wilful misstatement or suppression to evade tax; the amount alone does not decide it.
- Using the upload date without checking service. Preserve all service evidence and determine which date the applicable law treats as communication.
- Submitting an unindexed bundle. Give every attachment a number, description, period and page range, and cite it next to the corresponding allegation.
- Assuming payment ends the dispute automatically. Payment, ledger posting, recovery and appeal consequences are distinct questions. Record what was paid, why and under which reference.
- Using an old deadline or form instruction. The CGST Act and Rule 142 materials available in published compilations can be amended. Check the consolidated law and amendments applicable to the financial year and proceeding.
Worked examples of the distinction
Example 1: pre-notice mismatch
A business receives Part A of DRC-01A alleging that reported outward supplies do not match another record. At this point, the communication is a possible pre-notice intimation. The business should reconcile the period, explain timing or amendment differences and preserve the submission. It should not describe the communication as a final demand order.

Example 2: notice followed by representation
A DRC-01 summary accompanies a section 73 notice proposing tax, interest and penalty for a stated period. The business files a period-wise explanation and evidence in DRC-06. The proposal remains under determination until the officer issues an order; the proposed figure is not automatically the final payable amount.
Example 3: order and DRC-07
After considering the reply, the officer issues an order and uploads DRC-07. The business compares the summary with the full order, checks the communication date and decides whether to pay or appeal. Because Rule 142 treats the order for recovery purposes as the notice, waiting for another document before taking action can create avoidable risk.
Which records to keep for the life of the case
Create one read-only case folder containing the original notice or order, all portal downloads, service proof, return files, ledgers, invoices, credit and debit notes, payment records, reconciliations, correspondence, hearing notes, representations, acknowledgments and appeal papers. Keep a chronology with the event, date, source and action taken. This prevents a later appeal from depending on a screenshot or recollection that cannot establish what was served.
For each disputed line item, retain a compact evidence record containing the transaction identifier, tax period, accounting entry, GST return reference, payment status, explanation and attachment number. A clear index often exposes whether the disagreement is factual, computational or legal before a hearing begins.

How to read current-law qualifications
The CBIC page containing sections 73, 74, 75 and 107 is an official source, but a page’s consolidated status for every later amendment is not always apparent from a search result. The official Rule 142 compilation dated 1 January 2022 supports the form sequence described above, but later amendments may apply to a live proceeding. For a current case, verify the consolidated legislation, notifications, circulars, transitional provisions, financial year and notice itself.
That qualification does not make the notice-versus-order distinction uncertain. It means that deadlines, form instructions, recovery mechanics and available remedies must be applied to the law in force for the particular proceeding. A GST practitioner, chartered accountant or tax lawyer can help when the amount, allegation, records or deadline is material.
