GST Notice Response Checklist for Businesses in India (2026)

Responding to a GST notice starts with the notice itself, not a generic template. Save the complete notice and proof of service, identify its section and form, record the tax period and stated deadline, then answer each allegation with a calculation and indexed evidence. Use the form and portal route specified for that proceeding, and preserve the filed reply, acknowledgement and any payment record.

1. Secure the notice before doing anything else

A GST notice can arrive through the GST portal, email or another formally recorded service channel. Preserve the version that was actually served, including every annexure and the service evidence. A later downloaded copy may not show the same date, attachments or reference number.

Save an authenticated record

  • Download the notice, all annexures and any statement of discrepancy or calculation.
  • Save the portal service record, email, envelope or other delivery evidence showing when and how it was served.
  • Record the reference number, document identification number or other identifier exactly as displayed.
  • Keep an unedited original file and work from a separate copy so the source record remains intact.

Extract the controlling facts

Make a one-page cover sheet with the GSTIN, registered legal name, issuing authority, statutory section, form number, tax period, date of notice, date and mode of service, amount or discrepancy, requested action and response deadline. Note whether the document asks for an explanation, payment, records, attendance at a hearing or a correction. Do not calculate a generic deadline from the day somebody first opened an email; check the service language and the provision cited in the notice.

This article addresses central-GST procedures in India. State or Union Territory administration, later amendments, notification extensions and case-specific directions can change the applicable route. The notice and current official text control.

2. Classify the proceeding and its form

Classification determines the reply form, deadline and whether payment is merely an option or part of a statutory demand process. Use the notice’s section and description, not just a familiar-looking form number.

Notice or workflow What it generally concerns Likely taxpayer action Official reference
ASMT-10 Return-scrutiny discrepancy under section 61 Explain the discrepancy using the form and instructions presented for the case; the forms index identifies ASMT-11 as the taxpayer reply form. GST forms index; CBIC assessment rules
DRC-01 with a demand notice A summary uploaded with specified demand proceedings under Rule 142 Read the full notice and, where the Rule 142 route applies, furnish the representation in DRC-06. CGST Rules, Rule 142
DRC-01B Specialized GSTR-1 and GSTR-3B liability mismatch workflow Review Part A, then use the Part B response and any related DRC-03 process exactly as the portal FAQ requires. GST Portal DRC-01B FAQ
Other GST notices Audit, registration, detention, recovery, appeal-related and other proceedings Follow the section, form, deadline and filing channel stated in that particular notice; do not substitute DRC-06 by default. GST forms index

The forms index establishes distinct form families, but it is not an exhaustive current deadline table for every proceeding. If several documents are attached, classify each one separately and link it to its own deadline and requested outcome.

3. Handle deadlines without relying on a universal rule

Section 61 scrutiny and ASMT-10

Two official formulations must be kept distinct. The CBIC assessment-rules page says an ASMT-10 notice seeks an explanation within the period stated in the notice, not exceeding 15 days from service. Section 61 of the CGST Act states that the taxpayer is to be informed of the discrepancies and allowed 30 days from being informed, or a further period permitted by the proper officer. Because these texts use different formulations, do not promise yourself or a client a single “GST notice deadline.” Use the date printed in the notice, verify the currently applicable provision and request an extension before expiry if the officer’s procedure permits one.

Keep proof of an extension request and never assume that silence, an email or an unacknowledged upload extends time. If an ASMT-10 is followed by another communication, calendar the later response separately.

Demand proceedings summarized in DRC-01

Rule 142 describes DRC-01 as a summary served with listed demand notices and identifies DRC-06 for a representation in the covered route. The full notice, statutory section, service date and any hearing direction determine what must be done and by when. A DRC-01 upload by itself is not a reason to reuse a response prepared for a scrutiny discrepancy.

DRC-01B mismatch workflow

DRC-01B is a specialized return-liability mismatch process. The GST Portal FAQ describes Part A and Part B and states that a related DRC-03 ARN must be for the same GSTIN and tax period, filed on or after issuance of Part A and use the stated payment cause. Monthly and QRMP filers follow their respective return frequency. Those conditions make DRC-01B unsuitable as a generic answer to every DRC-01 or GST notice.

Every other notice

Registration, audit, detention, recovery, appeal and state-specific communications can use different forms, service rules and periods. Read the statutory section and the “reply by” or hearing instruction in the served document. If the date is unclear, contact the issuing authority through an official channel promptly and preserve the enquiry and response.

4. Find and verify notices on the GST portal

The GST Portal functionality material places DRC-01 summaries in the logged-in portal under Services > User Services > Additional Notices & Orders. Labels can change, so use the current case link and instructions shown after login.

  1. Sign in to the correct GSTIN rather than a group entity’s account.
  2. Open the notices or orders area and search by reference number, date or tax period.
  3. Open the document and every attachment; do not rely on a notification email’s short description.
  4. Check that the GSTIN, legal name, issuing office and tax period match the business records.
  5. Download the notice and capture the displayed service or issuance details before beginning the reply.
  6. Record whether the portal offers a reply button, a payment link, a hearing request or a separate form workflow.

The portal copy is useful evidence, but it does not replace reading the full statutory notice. If the document appears under the wrong GSTIN or has missing annexures, preserve screenshots and raise the issue through the proper official channel without waiting for the deadline.

5. Build an allegation-to-evidence schedule

A point-by-point schedule prevents a response from becoming a general denial. Create one row for every allegation, figure or document request.

Column What to enter
Notice point Quote or precisely paraphrase the allegation, paragraph and page reference.
Business position Admit, partly accept, or contest the point; state why in one clear sentence.
Calculation Show the tax, interest or difference calculation, period, rate or ledger source and any reconciliation adjustment.
Evidence index Assign an attachment number and identify the exact invoice, return, ledger line or page supporting the position.
Requested outcome State the correction, dropping of the point, acceptance of the explanation, time to provide records or hearing requested.

Records that may be relevant

The correct evidence depends on the allegation. Potential records include filed returns, tax invoices, debit and credit notes, sales and purchase ledgers, bank or payment records, contracts, e-way bills, e-invoice data, reconciliation statements, prior correspondence and earlier orders. This is a practical organization list, not a universal attachment requirement. Attach only material that supports a specific point and label confidential or sensitive records appropriately.

Reconcile numbers and periods

  • Match the notice’s tax period to the period in the books and filed returns.
  • Recalculate the amount independently and identify whether the notice uses gross, net, taxable or tax-inclusive figures.
  • Explain timing differences, amendments, credit notes, reverse-charge entries and duplicate records instead of hiding them in a total.
  • Label the source of every figure so an officer can reproduce the reconciliation.
  • Do not admit liability or pay solely to meet a date before evaluating the legal, interest and penalty consequences.

6. Draft a response that an officer can verify

  1. Identify the case. Put the GSTIN, legal name, notice number, section, form, tax period and service date in the heading.
  2. State the relief sought. Say whether the business asks that the discrepancy be accepted as explained, the proposed demand be dropped or corrected, additional time be allowed, or a hearing be fixed.
  3. Answer in the notice’s order. Use numbered headings matching each allegation and cite the notice paragraph or annexure.
  4. Show the working. Include concise tables for return-to-ledger, invoice-to-e-way-bill or tax-period reconciliations and explain every difference.
  5. Cross-reference evidence. Refer to “Attachment 3, pages 4–6,” not merely “records enclosed.”
  6. Address adverse facts. If an entry is wrong or incomplete, state the correction and its effect rather than making an unsupported denial.
  7. Request a hearing where appropriate. Explain why oral clarification is needed and follow any hearing format or date in the notice.

Use plain, professional language. A response should be complete enough to decide the allegation without forcing the officer to infer the calculation from a folder of unlabelled files.

7. Use the correct form and route

ASMT-10 scrutiny

For a scrutiny discrepancy, check the portal’s form selector and the current forms index, which lists ASMT-11 as the taxpayer reply form. Attach the reconciliation and records requested by the notice, then confirm that the submission is linked to the ASMT-10 case. Do not upload a free-form letter in a different menu if the case provides a designated reply workflow.

Rule 142 demand route

Where Rule 142 applies and the summary is uploaded in DRC-01, the representation is furnished in DRC-06. Read the underlying notice for the legal section, proposed tax, interest and penalty and any hearing instruction. DRC-06 is not a universal form for all GST communications.

DRC-03, DRC-04 and DRC-05

Rule 142 describes DRC-03 for payment intimation, DRC-04 as an acknowledgement and DRC-05 as an order concluding proceedings in specified qualifying-payment circumstances. The existence of these forms does not mean that paying is always appropriate or that every notice ends after payment. Match the form to the statutory option and retain the resulting reference.

DRC-01B Part A and Part B

Open the mismatch intimation, verify the return period and GSTIN, and follow the Part B choices and payment-cause wording shown by the portal. If a DRC-03 ARN is required, verify the same-GSTIN, same-period and post-Part-A conditions before submitting it. A DRC-01B response should not be presented as a DRC-06 representation unless the notice separately invokes that route.

8. Treat payment as a separate legal and financial decision

Separate the question “What does the notice allege?” from “Should the business pay now?” Check the proposed tax, interest and penalty, the statutory section, available waiver or settlement mechanism, effect on input tax credit or returns, and whether payment would be treated as an admission. A voluntary payment can have consequences that differ from a payment made under a specific Rule 142 option.

If payment is chosen, use the designated portal form, enter the correct tax period and cause, verify the challan or debit details and save the DRC-03 reference and any DRC-04 or DRC-05 document. If payment is disputed, explain the objection and preserve the right procedural step instead of making an unexplained partial payment.

9. Submit early and preserve filing proof

  1. Confirm that the authorized signatory or other required authentication is available and valid.
  2. Check permitted file types, size limits, page orientation and legibility for every attachment.
  3. Open each final PDF or spreadsheet after export to ensure it is complete and not password-protected unless the portal permits it.
  4. Submit through the case-specific reply button or prescribed form, not an unrelated general upload area.
  5. Wait for the portal’s success message and record the ARN, acknowledgement or reference number.
  6. Download the filed response exactly as submitted, including attachments and the submission timestamp.
  7. Store the notice, working papers, final reply, acknowledgement, extension requests, correspondence and payment evidence in a read-only case folder.

A browser message saying “submitted” without an ARN or receipt is not enough to assume filing succeeded. Reopen the case and confirm that the reply status changed.

10. What to do when the portal fails

  • Capture dated screenshots showing the GSTIN, case, error message, time and attempted action.
  • Save the completed reply and attachments without changing their contents.
  • Try the official portal again after checking browser, authentication and file-size requirements, but do not repeatedly alter the response just to force an upload.
  • Use the official help or jurisdictional contact route and describe the case reference and deadline.
  • Request an extension or alternative filing direction before the deadline where available, attaching the error evidence.
  • Keep every ticket, email and acknowledgement. A screenshot alone may not constitute a valid filing.

11. Know when to obtain professional review

Prompt review by a qualified GST practitioner or tax lawyer is sensible when the notice alleges fraud or suppression, proposes substantial tax, interest or penalty, disputes input-tax-credit eligibility or classification, covers multiple periods, or may lead to a hearing, appeal or urgent payment choice. Sections 73 and 74 create different legal contexts; a serious notice should not be treated as a routine mismatch merely because it arrived in the same portal inbox.

Professional review is also useful when records conflict, the service date is disputed, a limitation issue may apply, several GSTINs are involved or the proposed response could affect other periods. Give the adviser the original notice, service evidence, complete schedule and filing history rather than a summary alone.

12. Use a tracker when more than one notice is open

Field Entry to maintain
Case identity GSTIN, notice/reference number, section, form and issuing office
Service control Mode, date of service, evidence location and stated deadline
Issue Tax period, allegation, amount and requested action
Response route Portal menu, reply form, hearing requirement and signatory
Status Drafting, evidence pending, submitted, acknowledgement received or follow-up due
Financial action Payment considered, DRC-03 ARN if used, acknowledgement and outstanding balance
Next control Extension date, hearing date, order date, appeal deadline or adviser follow-up

Review the tracker daily while a deadline is open. A business with several periods can otherwise answer one notice and miss a separately served document involving the same underlying transaction.

13. Final pre-submission checklist

  • The notice and every annexure are saved, and the service date is evidenced.
  • The statutory section, form, tax period, GSTIN, amount and deadline are verified.
  • Each allegation has a direct answer, calculation, evidence index and requested outcome.
  • The selected form and portal route match the proceeding: ASMT-11 for the applicable ASMT-10 reply workflow, DRC-06 where the Rule 142 representation route applies, or the specialized DRC-01B process where relevant.
  • Payment, if any, was evaluated separately and entered under the correct cause and period.
  • Authentication, attachment format and file size have been checked.
  • The final submission produced an ARN, acknowledgement or other portal reference, which has been downloaded and stored.
  • Any hearing, extension, appeal or professional-review date is on the business calendar.

The safest GST-notice response is a timely, case-specific record: preserve the served document, classify the legal route, reconcile every figure, answer every point with indexed evidence and retain proof of what was filed.
