GST Late Fees, Interest and Penalties: What Applies to Common Filing Mistakes

For Indian GST, a late fee, interest and a penalty are different consequences with different triggers. A late fee may apply when a specified return or statement is filed late; interest may apply when tax remains unpaid after its due date; and a penalty depends on the kind and seriousness of the breach. A delayed return can therefore attract both a late fee and interest, but not every late filing does.

The amount depends on the return, tax period, payment and filing dates, applicable notifications, and facts behind any tax or input tax credit (ITC) error. Check your GST Portal liability and the rules for the exact period rather than relying on a general fee figure.

Late fee, interest and penalty: what each one means

Charge Typical trigger What to check
Late fee Delayed furnishing of a return or statement covered by the law. The form, tax period, taxpayer category and any applicable notification or waiver.
Interest Tax remaining unpaid past its prescribed payment date. Tax due, payment or offset date, applicable rules and relevant ledger balance.
Penalty A breach such as tax not paid or short paid, an erroneous refund, or wrongly availed or used ITC. The tax effect, conduct, severity, intent and statutory route involved.

These distinctions follow sections 47, 50, 73, 74 and 126 of the CGST Act. A charge should not be treated as a substitute for another: paying a late fee does not by itself settle interest on unpaid tax or resolve an underlying tax or ITC issue.

When can a late fee apply?

Section 47 provides for a late fee when specified returns or statements are furnished after the prescribed time. It does not establish one current amount that applies to every GST return. CBIC’s central tax notification index includes later fee rationalizations and conditional waivers affecting particular forms, periods and taxpayer classes. An old rate table—or a waiver announced for a particular period—may not describe your liability.

Confirm the return type, period and your eligibility for any notification or waiver, then check the liability shown on the GST Portal. The Portal’s GSTR-1 user guide covers return filing; the amount applicable to an individual case must be checked against the relevant notification and portal liability.

When does interest apply?

Section 50 concerns tax that remains unpaid past its prescribed payment period. Interest is tied to the period of non-payment, so a delayed filing does not automatically mean interest is due on the entire tax reported in the return. The amount depends on the tax period, when tax was paid or offset, applicable law and relevant ledger facts. The Act sets a statutory ceiling for the rate to be notified; use the rate and rules applicable to your case, not an assumed universal figure.

GSTR-3B interest from the January 2026 tax period

For GSTR-3B from the January 2026 tax period, GSTN says the portal’s enhanced calculation considers the minimum balance available in the Electronic Cash Ledger between the due date and the date tax is paid (offset), in line with Rule 88B(1). GSTN also says system-populated interest is a minimum: taxpayers remain responsible for self-assessing the correct amount. See the GSTN advisory on interest collection and related GSTR-3B enhancements.

When can a penalty apply?

A penalty is not another name for late fee or interest. Sections 73 and 74 address matters including tax not paid or short paid, erroneous refunds, and wrongly availed or utilised ITC. They distinguish cases other than fraud from cases involving fraud, wilful misstatement or suppression. The relevant provision and consequences depend on the facts and applicable law.

Section 126 requires penalties to reflect the facts and severity of the breach. It directs that a penalty should not be imposed for a minor breach or easily rectifiable documentation error absent fraudulent intent or gross negligence. That is not a blanket exemption: a mistake with a tax or ITC effect, the taxpayer’s conduct and any notice still matter.

What may apply to common filing mistakes?

Return filed late, but tax was paid on time or none was due

A late fee may apply because the return was delayed. Interest depends on whether tax remained unpaid past its prescribed date, so do not infer interest solely from the filing delay. Check the form, dates and portal liability.

Return filed late and tax paid late

A late fee may apply to delayed furnishing, while interest may apply for the period tax remained unpaid. Assess the two separately using the applicable notification and interest rules; the relevant cash-ledger balance may affect GSTR-3B interest from the January 2026 tax period.

Invoice or documentation error that can be corrected

First establish whether the issue is a rectifiable documentation mistake or has caused tax to be short paid or ITC to be wrongly claimed. Section 126’s treatment of minor, easily rectifiable breaches is relevant, but it does not establish that every correction is penalty-free.

Excess ITC claim or underreported tax

This may go beyond a routine filing delay and involve demand and penalty provisions. Whether the issue falls under the route for cases other than fraud or the route involving fraud, wilful misstatement or suppression depends on the facts and applicable law.

Portal interest appears incorrect

Open the system-generated GSTR-3B PDF and, if applicable to your return, use “RE-COMPUTE INTEREST” as described in GSTN’s March 6, 2026 advisory. The system calculation does not remove your responsibility to self-assess interest.

How to check what you owe

  1. Identify the filing: note the return or statement, tax period and applicable due date.
  2. Write down the dates: record the actual filing date and, if tax was due, when it was paid or offset.
  3. Classify the issue: determine whether it is delayed filing, delayed tax payment, incorrect tax or ITC reporting, or more than one of these.
  4. Review portal calculations: check the portal-generated liability and, for GSTR-3B, the system-generated return PDF. For the January 2026 tax period onward, account for GSTN’s enhanced interest calculation and self-assessment requirement.
  5. Verify the fee rule: check the notification for the exact return, taxpayer category and period before quoting or paying a late-fee amount.

Under CBIC’s payment rules, interest, penalties, fees and other amounts under the Acts are paid by debiting the Electronic Cash Ledger.

When to get professional help

Consider advice from a qualified GST practitioner or chartered accountant if you have received a notice, face a substantial tax shortfall, dispute an ITC claim, or have been accused of fraud or suppression. The correct treatment can turn on the amount, records, conduct and statutory provision; a portal figure alone may not resolve a dispute.
