GST ITC on Employee Travel, Food, and Accommodation: What Businesses Can Claim

Short answer: GST charged on an employee-related expense does not automatically become the employer’s input tax credit (ITC). Food, beverages and outdoor catering are specifically covered by the blocked-credit rule in section 17(5)(b) of the CGST Act, subject to statutory exceptions. Vacation travel benefits are expressly listed as blocked. Ordinary work travel and employee lodging require a transaction-by-transaction review because the official material does not create a blanket approval or denial for every airfare, taxi, hotel stay or reimbursement.

The decisive questions are what was actually supplied, whether the trip was vacation or business travel, which GST-registered entity is named on the invoice, whether a section 17(5) exception applies, and whether business, exempt or non-business use requires attribution or reversal.

At a glance: how the main expense categories differ

Expense What the statutory material says Practical review point
Food, beverages and outdoor catering Included in section 17(5)(b)(i) blocked credit, subject to the same-category outward-supply exception and the employer-obligation proviso. Identify whether the business is making an outward taxable supply of the same category, or whether a legal obligation requires the employer to provide the item.
Vacation travel benefit Section 17(5)(b)(iii) expressly refers to travel benefits extended to employees on vacation, including leave travel concession and home travel concession. Do not expand this wording into an automatic rule for every business trip.
Ordinary work travel The official material reviewed does not give a categorical answer for every airfare, rail fare, taxi, or reimbursed journey. Analyse the actual passenger-transport supply, invoice recipient, business purpose, registration and place-of-supply facts.
Hotel accommodation Hotel accommodation is identified as a GST service category, but that classification does not settle the recipient’s ITC entitlement. Review lodging separately from food or restaurant charges and test the employer’s recipient-side eligibility.

This table separates two questions that are often confused: the supplier’s obligation to charge GST and the customer’s right to claim that GST as ITC. A valid tax invoice proves tax was charged; it does not override a blocked-credit provision.

What section 17(5) means for employee expenses

Section 17(5) of the Central Goods and Services Tax Act, 2017 removes specified inward supplies from normal ITC eligibility. For employee expenses, clause (b) is the key provision. It names food and beverages, outdoor catering and certain travel benefits. The restriction operates at the recipient’s end: the employer may receive a GST invoice and still be unable to credit the tax.

The provision contains exceptions. An inward supply can remain eligible where it is used to make an outward taxable supply of the same category, or where it is an element of a taxable composite or mixed supply. Those exceptions are tied to the nature of the business’s outward supply; simply describing an expense as “for business” is not enough.

All other applicable Chapter V conditions continue to matter. The team must establish the business purpose, retain the relevant invoice and determine whether the amount is attributable to blocked, exempt or non-business use. A review that stops at the GST rate printed on the invoice is incomplete.

Food, beverages and outdoor catering

The default position is blocked credit

Food and beverages and outdoor catering are expressly included in section 17(5)(b)(i). Therefore, GST on an employee meal, cafeteria arrangement, delivered food or catered event normally falls within the blocked-credit rule. The fact that the meal was consumed during working hours, at an office, on a business trip or at a meeting does not by itself create a credit entitlement.

When the same-category exception can matter

The statute preserves credit for an inward supply used to make an outward taxable supply of the same category, or as an element of a taxable composite or mixed supply. This is aimed at businesses whose own taxable output involves those goods or services. The accounting file should connect the purchase to the outward taxable supply and preserve the supporting contract, work order or cost allocation.

A company that merely buys meals for its staff should not describe itself as satisfying this exception unless its outward taxable supply actually has the required connection. A general statement that food helped employees work more effectively is not the statutory test.

The employer-obligation proviso

The blocked-credit clause also contains a proviso for cases where it is obligatory for an employer to provide the goods or services to employees under a law in force. CBIC Circular 172/04/2022-GST explains that this proviso applies to the whole of clause (b), not only to the subclause that mentions vacation travel.

This is a legal-obligation test. An internal policy, employee handbook, offer letter or commercial promise should not be presented as equivalent to an obligation imposed by legislation without authority supporting that conclusion. The file should identify the particular law, the employees covered and the goods or services the law requires the employer to provide.

How to document a meal claim

  • Describe the actual supply: food, beverages, outdoor catering or a bundled event service.
  • Separate food from room hire, entertainment or other line items where the invoice does so.
  • Record whether the business is reselling or incorporating the supply into an outward taxable supply.
  • Identify any law that makes provision obligatory; do not rely only on policy language.
  • Mark blocked amounts before the return-preparation or expense-import process.

Employee travel: vacation benefits versus work trips

Vacation, leave travel and home travel concession

Section 17(5)(b)(iii) expressly refers to travel benefits extended to employees on vacation, including leave travel concession and home travel concession. That wording is specific. A reimbursement for an employee’s holiday or home visit should be tested against this provision rather than treated as ordinary business travel merely because the employer paid it.

Ordinary business travel is not automatically resolved

The official material available for this article does not establish a universal rule for every work-related airfare, rail ticket, taxi ride, car hire or employee reimbursement. It is therefore unsafe to publish either “all work travel is creditable” or “all employee travel is blocked.” The result depends on the precise supply and the recipient’s facts.

For a work trip, identify whether the invoice is for passenger transport, a travel-agent booking service, a bundled package or a reimbursement of an employee’s purchase. Confirm which GST-registered entity is named as recipient and whether the supplier’s place-of-supply treatment matches the transaction. Then test the expense against section 17(5), the normal Chapter V conditions and any required attribution.

Booking paid by the company versus employee reimbursement

Payment method does not decide ITC. A corporate card charge, an advance, an employee reimbursement and a travel-agent invoice can represent different supplies and different invoice recipients. The accounting record should tie the claim to the supplier’s tax invoice and show the legal entity that is attempting to take credit.

If a travel arranger issues one consolidated document for several services, obtain the underlying tax invoices or a compliant breakdown where possible. Do not infer eligibility for airfare, lodging or meals from the fact that a single booking confirmation shows one total.

Accommodation and hotel bills

GST classification is not an ITC ruling

CBIC’s rate listing includes hotel accommodation as a GST service category. That classification helps explain what the hotel supplied and which rate may have been charged; it does not determine whether an employer can claim the tax. Recipient-side restrictions, invoice details, business use and place-of-supply rules still have to be checked.

Separate lodging from food supplied by the hotel

A hotel folio may contain room charges, restaurant meals, minibar items, laundry, conference facilities and other services. Treating the entire folio as one creditable “travel expense” can hide a blocked food component or a service used for a different purpose. Use the line-item description and supporting documents to separate the supplies before applying the ITC analysis.

Questions to resolve before crediting a stay

  • What service was supplied: accommodation, restaurant service, banquet catering, conference facilities or a combination?
  • Which GST registration and legal entity appear as the recipient?
  • Was the stay for a documented business assignment, and does any part relate to a personal or vacation benefit?
  • Are the supplier’s place-of-supply details and invoice particulars consistent with the transaction?
  • Does any section 17(5) restriction, statutory exception or attribution requirement apply to a component?

Because the sources do not provide a conclusive universal answer for business lodging, a lodging policy should route unusual or bundled cases to a transaction-specific tax review rather than promise automatic credit.

Why CBIC Circular 172/04/2022-GST matters

The circular addresses a common misreading of the proviso after section 17(5)(b)(iii). Its clarification is:

“Accordingly, it is clarified that the proviso after sub-clause (iii) of clause (b) of sub-section (5) of section 17 of the CGST Act is applicable to the whole of clause (b) of sub-section (5) of section 17 of the CGST Act.”

In practical terms, the employer-obligation route is not limited to vacation travel. It can be relevant to another item in clause (b), including food or catering, when a law in force makes provision obligatory. The circular does not turn every employee benefit into eligible ITC: the statutory obligation must still be demonstrated, and the other ITC conditions remain relevant.

Invoice, attribution and record controls

Keep an invoice-level audit trail

CBIC’s ITC rules describe invoice-level attribution for amounts connected with section 17(5) blocked supplies, non-business use and exempt supplies. Expense systems should therefore preserve more than a ledger total. Retain the tax invoice, supplier GST details, recipient registration, service description, date, amount, tax component, traveller or cost centre and the business purpose.

Split mixed or common expenses

If one invoice contains creditable and blocked items, allocate by line or by a documented reasonable method. Do not mark the whole invoice as eligible simply because one line relates to a business meeting. Likewise, do not claim a common service in full where part of its use is exempt or non-business; perform the relevant attribution and reversal analysis.

Services used across states

The official sectoral FAQ discusses business-use input services under Chapter V and appropriate invoicing or Input Service Distributor (ISD) distribution for certain consolidated services used across states. A central travel or facilities team should therefore confirm which registration received the service and whether an inter-state allocation mechanism is required. A cost-centre label alone does not transfer ITC to another registration.

A practical review workflow for finance and travel teams

  1. Capture the source document. Obtain the supplier’s tax invoice, not only a card slip, itinerary or hotel booking confirmation.
  2. Describe the supply. Code the line as meal, outdoor catering, passenger transport, accommodation, travel-agent service or another actual category.
  3. Classify the journey. Mark travel as vacation-related, work-related or mixed, with the business purpose and dates.
  4. Check section 17(5). Test whether the supply is expressly blocked and whether the same-category outward-supply exception could apply.
  5. Test the legal-obligation proviso. If the employer says provision was mandatory, identify the law in force and retain the supporting reference.
  6. Verify the recipient. Confirm the GST-registered legal entity on the invoice and the relevant place-of-supply facts.
  7. Allocate and reverse where required. Separate blocked, exempt and non-business portions at invoice level and apply the applicable attribution process.
  8. Approve with an evidence trail. Record the conclusion, reviewer, source documents and any uncertainty so the same fact pattern is handled consistently later.

Illustrative fact patterns

Employee lunch at a training day

The invoice is for food or catering, so section 17(5)(b)(i) is the starting point. The finance team should look for a same-category outward taxable supply or a legal obligation to provide the meal. A training schedule or management approval demonstrates business purpose but does not, by itself, satisfy either statutory route.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Airfare for a customer-site visit

The journey is described as work travel rather than vacation travel. That avoids automatically applying the express vacation-benefit wording, but it does not prove eligibility. The team must analyse the passenger-transport supply, invoice recipient, registration and other Chapter V conditions.

Hotel folio with room and restaurant charges

Split the room and restaurant lines. Hotel accommodation’s GST classification does not answer the employer’s ITC question, and the food component must be tested separately under section 17(5)(b)(i). Preserve the traveller’s assignment and the entity named on the invoice.

Company-mandated provision required by law

If a statute or binding rule in force requires the employer to provide a particular good or service, document that legal requirement and map it to the relevant clause in section 17(5)(b). The CBIC circular confirms that the proviso can apply across clause (b), but the evidence must show an actual legal obligation rather than a voluntary benefit.

Common errors that create exposure

  • Claiming every employee expense because it carries a GST number and tax amount.
  • Calling all travel “business travel” without checking whether the benefit is vacation-related.
  • Treating a hotel’s GST rate or service code as proof of recipient ITC.
  • Using an HR policy as evidence of a statutory obligation.
  • Uploading a consolidated travel bill without separating meals, lodging and transport.
  • Ignoring the GST registration that actually received the service.
  • Leaving blocked, exempt and non-business portions in a single creditable ledger code.
  • Assuming a conclusion for one invoice applies to every supplier, state, booking format or employee benefit.

Keeping the policy current

The statutory source used for this framework is the CGST Act text identified as amended through 1 January 2022, and the clarification is CBIC Circular 172/04/2022-GST. The current-source layer for this article was checked on 13 October 2026 UTC. GST rules, circulars, rates and court interpretations can change, so businesses should verify later amendments and binding decisions before applying this framework to a high-value or unusual transaction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a routine claim, the safest policy is not a blanket “credit” or “no credit” label. Require the expense owner to identify the supply, purpose, recipient registration and supporting invoice, then route blocked or uncertain items for tax review before the return is filed.

Conclusion

Food, beverages and outdoor catering start from a statutory blocked-credit position, subject to the specific exceptions in section 17(5)(b) and the legal-obligation proviso clarified by CBIC. Vacation travel benefits are expressly named; ordinary work travel is not settled by that wording alone. Hotel accommodation must be analysed as the supplied service, separate from any restaurant or catering component, and the supplier’s GST classification cannot substitute for an employer-side ITC analysis. A defensible claim is built invoice by invoice, with the business purpose, recipient registration, place-of-supply facts, statutory exception and attribution treatment recorded.
