The residential promoter option is stricter: the effective 1% affordable-housing rate and 5% rate for other specified residential projects are available without ITC. A project’s commencement date, selected rate notification, completion-certificate status and promoter role therefore determine the answer for each invoice.
The decision in one view
GST credit is not decided by the label on a supplier’s invoice or by the fact that a cost is connected with construction. For every inward supply, classify the project and the invoice together. The key questions are whether the developer is registered, whether the goods or services are used or intended for business, whether the evidence required by section 16 exists, whether section 17(5) blocks the credit, and whether the project is using the residential rate option that expressly removes ITC.

| Question | Why it changes the result |
|---|---|
| Which output is being supplied? | A taxable outward supply before completion may keep an input in the GST chain; a completed immovable-property sale is outside that chain under the policy rationale for the blocked-credit rules. |
| Is the cost own-account construction? | Works-contract services and goods or services used to construct an immovable property on the taxable person’s own account are generally blocked by section 17(5), subject to the statutory exceptions. |
| Is the item plant and machinery? | Plant and machinery is outside the immovable-property exclusion, but land, buildings, civil structures, telecommunication towers and pipelines outside factory premises are expressly excluded from that definition. |
| Did the promoter select the residential scheme? | The specified 1% and 5% residential rates operate with no ITC and add an 80% registered-supplier compliance requirement. |
| Is the person a developer-promoter or landowner-promoter? | A landowner-promoter has a specific route to use tax charged on construction received from the developer, but only when the prescribed onward-supply and output-tax conditions are met. |
Section 16: the starting entitlement
Business use is necessary, not sufficient
Section 16 of the CGST Act states: “Every registered person shall … be entitled to take credit of input tax charged on any supply of goods or services or both to him which are used or intended to be used in the course or furtherance of his business.” For a developer, that normally brings construction inputs, professional services, site services and other business purchases into the initial review. It does not override a specific restriction elsewhere in the Act.

The credit must also follow the procedure in section 49 and the prescribed conditions. The purchase should be mapped to the registered person and the relevant project, and the business should be able to show how it was used or intended to be used. A cost that has no defensible connection with the developer’s business fails before the blocked-credit analysis is even reached.

Evidence that must be retained
The input-tax rules require prescribed evidence. Depending on the transaction, that can include a supplier tax invoice, debit note, bill of entry or an eligible input-service-distributor document. Keep the document with the supplier’s registration details, tax amount, project allocation and accounting entry. Reconcile supplier-reported data and investigate mismatches rather than relying on an invoice that cannot be matched to the underlying supply.
Section 16 entitlement is therefore a gateway. A valid invoice can establish the documentary gateway, but the credit still has to survive section 17(5), the selected project rate and any business-use or taxable-use apportionment.
Section 17(5): the construction costs that are blocked
Works-contract services for construction
Section 17(5)(c) lists “Works contract services when supplied for construction of an immovable property …” among supplies for which ITC is unavailable. The exception is important: credit can remain available when the works-contract service is itself an input for a further supply of works-contract service. A developer should therefore record both the service received and the outward supply it supports, rather than treating every contractor bill alike.
For a promoter hiring a contractor to build apartments that the promoter will sell, the service ordinarily supports the promoter’s own immovable-property construction. That is the classic blocked-credit case. A business supplying works-contract service onward may have a different result if the statutory exception genuinely applies.

Construction on the taxable person’s own account
Section 17(5)(d) blocks goods or services received for construction of an immovable property, other than plant and machinery, on the taxable person’s own account, even when the property is used in business. “Construction” for these clauses includes reconstruction, renovation, additions, alterations and repairs to the extent the cost is capitalised.
This rule catches more than the original build. A capitalised extension, structural alteration or major repair can remain blocked if it is construction of an immovable property on the developer’s own account. The accounting treatment and the physical nature of the work should therefore be documented together.
Plant and machinery is a narrow boundary
The plant-and-machinery explanation does not include land, buildings or other civil structures. It also excludes telecommunication towers and pipelines laid outside factory premises. An item should not be called plant and machinery merely because it is expensive, permanently installed or useful to the project. Keep technical descriptions, installation records and the reason the item is machinery rather than a civil structure before taking credit.

The residential promoter rates: 1% and 5% without ITC
What the two rates cover
CBIC’s 2019 real-estate summary records an effective 5% GST rate for residential property outside the affordable segment and 1% for affordable housing under the specified promoter option. “Affordable housing” in that summary means a home of up to 90 square metres in a non-metropolitan city or 60 square metres in a metropolitan city, with a value up to ₹45 lakh. The listed metropolitan areas are Bengaluru, Chennai, Delhi NCR (limited to Delhi, Noida, Greater Noida, Ghaziabad, Gurgaon and Faridabad), Hyderabad, Kolkata and Mumbai MMR.

Under this new residential rate option, CBIC states: “Input tax credit shall not be available.” The no-ITC condition is part of the rate choice; it is not a decision that can be reversed invoice by invoice. A promoter selecting the option must price and account for construction purchases on that basis.
| Residential category | Effective rate recorded by CBIC (2019) | ITC under the option | Affordable-housing limits in the CBIC summary |
|---|---|---|---|
| Affordable residential property | 1% | Not available | Up to 90 sq m in non-metropolitan cities or 60 sq m in metropolitan cities, and value up to ₹45 lakh |
| Residential property outside the affordable segment | 5% | Not available | Not applicable |
The rates and definitions above are tied to the CBIC summary and the applicable notifications. Confirm the project’s commencement date, booking position and notification before applying them, particularly where a project contains multiple components or straddles a regulatory change.
The 80% registered-supplier requirement
For the specified promoter scheme, at least 80% of the value of relevant inputs and input services must come from registered suppliers. Inputs subject to reverse charge count as purchases from a registered person for this calculation. The rule is measured project-wise, so a group-level percentage cannot substitute for a schedule that identifies each project and its inward supplies.

Shortfall and cement consequences
If the registered-supplier percentage falls short, the shortfall generally attracts 18% tax under reverse charge. Cement bought from an unregistered supplier has a separate reverse-charge payment at the applicable rate; it should not be hidden inside the general 80% shortfall working.
Maintain project-wise inward-supply accounts, calculate the shortfall at the end of the financial year or at the earlier project endpoint where required, and report the liability through the prescribed return process. The working should show the denominator, every excluded item, reverse-charge purchases treated as registered, and the tax paid on the shortfall.

- Identify the regime. Record the project’s commencement date, state registration, outward-supply type and whether the promoter selected the 1% or 5% no-ITC residential option.
- Build a project register. For every invoice, capture project, supplier GST registration status, invoice type, tax amount, accounting code, capitalisation status and intended outward supply.
- Apply section 17(5). Mark works-contract services for own-account construction, capitalised civil construction and other blocked items. Separately document why an item is qualifying plant and machinery or why a further-supply-of-works-contract exception applies.
- Validate the document. Retain the tax invoice, debit note, bill of entry or eligible ISD document and reconcile the supplier-reported details. Resolve duplicate, cancelled or incorrectly addressed documents before credit is taken.
- Test the residential rule. If the promoter scheme applies, exclude ITC, calculate the 80% registered-supplier ratio and identify any reverse-charge exposure, including unregistered cement.
- Apportion common inputs. Where an input serves taxable and exempt, non-business or multiple projects, perform the Rule 42/43-style allocation and record the annual true-up before the statutory deadline.
- Report and retain. Report eligible credit, ineligible credit, reversals and reverse-charge tax in the applicable GST returns. Keep project-wise workings, contracts, completion evidence and management approvals ready for audit.
Common inputs and apportionment
An input used across projects cannot automatically be assigned to the project with the largest tax liability. Separate direct costs first. For genuinely common inputs, apply the Rule 42/43-style business-use and taxable-use apportionment, reverse the ineligible portion and perform the annual true-up. The file should explain the allocation key, the period covered, the taxable and exempt or non-business uses, and any later adjustment.

This exercise is distinct from the 80% registered-supplier test. Apportionment decides how much otherwise eligible common credit can be retained; the 80% rule determines a promoter-scheme compliance percentage and any shortfall tax. Keep the calculations in separate schedules.

Landowner-promoter: when construction tax can be used
In the landowner-promoter structure, the developer-promoter constructs or converts a building into apartments or develops a plot for sale. The landowner-promoter transfers land, development rights or FSI to the developer-promoter and receives constructed apartments. The landowner then sells those apartments independently.
CBIC states that the landowner-promoter can use the tax charged by the developer-promoter on construction of those apartments only when the landowner further supplies the apartments before the completion certificate or first occupation, whichever is relevant under the applicable rule, and pays output tax meeting the prescribed comparison condition. The condition is not satisfied merely because construction tax appears on the developer’s invoice.
Contracts should therefore identify the parties’ promoter roles, the apartments allocated to the landowner, the date of onward booking or supply, the completion-certificate or first-occupation evidence, and the output-tax computation. Because the comparison condition is notification-specific, verify the exact wording applicable to the project before claiming the credit.
Completion status changes the analysis
Before completion certificate or first occupation, a qualifying outward supply can remain within the taxable chain, subject to the other conditions. After completion, the policy rationale for sections 17(5)(c) and (d) becomes decisive: credit is restricted where the inputs culminate in the sale of immovable property outside GST. Do not use a single treatment for bookings, construction milestones and completed-unit sales without checking the relevant dates and supply documents.
Frequent errors and how to correct them
- Claiming every material invoice. Reclassify cement, steel, contractor bills and professional services by their actual use; section 16 business use does not defeat section 17(5).
- Calling a building component machinery. Obtain engineering evidence and test the statutory exclusions. Civil structures and buildings remain outside plant and machinery.
- Mixing rate options. Keep a signed project decision showing whether the 1% or 5% promoter option was selected. Do not claim ITC while applying the no-ITC option.
- Ignoring unregistered purchases. Track the 80% ratio continuously and separately flag unregistered cement for its own reverse-charge payment.
- Using a group percentage. Prepare one inward-supply ledger and one 80% computation for each project.
- Leaving landowner credit undocumented. Link the developer’s construction invoice to the specific apartments, onward supply before completion or first occupation, and the prescribed output-tax comparison.
- Skipping the annual true-up. Recalculate common-input apportionment and the promoter-scheme shortfall at the required year-end or earlier project endpoint.
Information needed before a definitive computation
A reliable project-level answer requires the commencement date, booking status, state registration, selected rate notification, completion-certificate or first-occupation date, promoter role, outward-supply contracts, supplier registration status and capitalisation policy. Rates, notifications, return forms, court decisions and interpretations can change. Where any of those facts is missing, treat the result as a classification framework rather than a final tax opinion.
Bottom line
Start with section 16, then eliminate section 17(5) blocks, test the project’s residential rate choice and complete the separate 80% and reverse-charge workings where the promoter scheme applies. A developer’s strongest file is project-wise: every invoice has a supplier-status check, a construction-versus-machinery classification, a documented outward-supply link, and an apportionment or reversal calculation where common use exists.
