A demand order describes the resulting liability recorded for payment and recovery. In practice, the same proceeding can produce a detailed order-in-original (the adjudication order) and an electronic FORM GST DRC-07 summary (the demand entry). DRC-07 is important for recovery, but it should not be read without the show-cause notice (SCN) and the full speaking order.
The document flow in a GST demand case
A disputed GST liability normally moves through a defined sequence. The labels can overlap because the officer’s adjudication decision creates the liability that the portal later records as a demand.

- Issue identified: The proper officer identifies unpaid or short-paid tax, an erroneous refund, or input tax credit that was wrongly availed or utilised.
- Show-cause notice: For a non-fraud case, the notice is generally issued under section 73 of the CGST Act. Where fraud, wilful misstatement or suppression of facts to evade tax is alleged, section 74 is used. The notice proposes tax, section 50 interest and any applicable penalty.
- Reply and hearing: The taxpayer submits a representation and may request a personal hearing. Section 75(4) requires a hearing when it is requested in writing or when an adverse decision is contemplated.
- Adjudication: The officer considers the notice, reply, evidence and hearing submissions and issues a reasoned order.
- Electronic summary: Rule 142 requires portal summaries: DRC-01 for the SCN, DRC-06 for the taxpayer’s representation and DRC-07 for the order. DRC-07 states the tax, interest and penalty and is treated as the notice for recovery.
- Payment, recovery or appeal: The taxpayer may pay, seek correction where legally available, or file an appeal in FORM GST APL-01 within the statutory period.
In shorthand, the flow is:
SCN (DRC-01) → reply/hearing (DRC-06) → adjudication order → DRC-07 demand summary → payment, recovery or appeal.

What an adjudication order means
It is the decision-making document
An adjudication order records how the adjudicating or proper officer resolved the allegations in the SCN. It should identify the relevant facts, examine the taxpayer’s response, address evidence and explain the legal and factual reasons for accepting or rejecting the proposed demand. This is why it is often called a speaking order or, in many files, an order-in-original.

Section 75(6) states: “The proper officer shall, in his order, set out the relevant facts and the basis of his decision.” A document that merely states an amount without explaining the issues, evidence and reasoning may not satisfy that requirement.
What the order should cover
- The GST registration, tax period and transactions or returns under examination.
- The statutory provision invoked and the allegation made in the SCN.
- The tax, interest and penalty proposed, together with the calculation method.
- The taxpayer’s written reply and any documents or explanations submitted.
- The hearing request, hearing date and submissions made at the hearing, where applicable.
- Findings on each material issue and the reasons for confirming, reducing or dropping the proposal.
- The final amounts payable and directions for payment or other statutory consequences.
Why the underlying order matters
An appeal challenges the officer’s determination, not just a number displayed on the portal. The full order reveals whether the officer dealt with the SCN, considered the reply, followed the correct provision and stayed within the notice. It also provides the factual and legal grounds needed to prepare an appeal.
What a demand order means
It describes the liability recorded for payment and recovery
“Demand order” is commonly used to describe the outcome that records tax, interest and penalty as payable. The emphasis is on the amount due and the ability of the administration to recover it. In a GST portal file, a taxpayer may encounter the demand through a DRC-07 entry even when the detailed reasoning appears in a separate order-in-original.

The demand is therefore the financial consequence of the adjudication. It is not necessarily a different proceeding or a different officer’s decision. One adjudication can generate one demand record.
DRC-07 is a summary, not a replacement for the order
Rule 142 requires the proper officer to upload an electronic summary of the order in DRC-07. The summary specifies tax, interest and penalty, and the rule treats the order as the notice for recovery. That makes DRC-07 operationally important: it can trigger the portal’s demand and recovery workflow.
However, DRC-07 is a summary. It may not contain the full facts, evidence analysis or reasons. Before paying or appealing, obtain and read the SCN, the complete adjudication order and the corresponding DRC-07. If a rectification is issued, obtain FORM GST DRC-08 as well.

Demand order and adjudication order compared
| Point of comparison | Adjudication order | Demand order or DRC-07 entry |
|---|---|---|
| Primary focus | The officer’s legal and factual determination. | The tax, interest and penalty recorded as payable and recoverable. |
| Content | Facts, SCN allegations, reply, hearing, evidence, findings and reasons. | Electronic summary and computation of the resulting liability. |
| Typical document | Detailed order-in-original or speaking order. | FORM GST DRC-07 summary on the GST portal. |
| Relationship | Creates or determines the liability after adjudication. | Records the liability for payment and recovery; it normally reflects the adjudication order. |
| What to test | Jurisdiction, notice compliance, evidence, reasoning, hearing and computation. | Whether the figures and dates match the underlying order and whether the demand has been correctly posted. |
| Remedy | Appeal the adjudicating authority’s decision. | Use the underlying decision and communication date when filing the appeal; do not treat the summary alone as the complete record. |
Calling the whole file a “demand order” is common shorthand. Legally and practically, the reasoning remains in the adjudication order while DRC-07 communicates the operative demand electronically.

1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteHow sections 73 and 74 affect the order
Section 73: non-fraud cases
Section 73 is used when tax is unpaid or short-paid, an erroneous refund has been made, or input tax credit has been wrongly availed or utilised without the fraud-related allegation described in section 74. The SCN identifies the proposed tax, section 50 interest and applicable penalty. The adjudication order must decide the proposal on the material in that notice and the taxpayer’s response.
Section 74: fraud, wilful misstatement or suppression alleged
Section 74 applies where the notice alleges fraud, wilful misstatement or suppression of facts to evade tax. That allegation is not a cosmetic label: it affects the statutory route and penalty exposure. Check whether the order actually addresses the elements alleged and whether the findings support the provision invoked.
Other provisions
A file may instead cite another provision, such as section 74A, section 76, section 129 or section 130, depending on the type of liability or enforcement action. Do not assume that every portal demand follows the section 73 or 74 timetable. Read the provision stated in the SCN and order, because it determines the applicable procedure and remedy.
Notice limits and natural-justice safeguards
The final order cannot exceed the SCN
The statute bars an order that demands more tax than the notice specifies or confirms a demand on grounds outside the notice. Compare the SCN and order line by line:
- tax period and registration details;
- nature of the alleged supply, refund or credit issue;
- legal provision and factual grounds;
- taxable value, tax rate and computation; and
- interest and penalty proposed.
A changed figure can be lawful only if it remains within the statutory and notice framework. A new allegation or a larger tax demand is a distinct issue to raise in an appeal.

Hearing and reasons
Section 75(4) requires a personal hearing when the taxpayer requests one in writing or when the officer proposes an adverse decision. Keep the written request, acknowledgment and any record of the hearing. The order should identify the submissions and explain why they were accepted or rejected. An unexplained conclusion, failure to consider a material reply or lack of an offered hearing can become a procedural ground in further proceedings.
Service and communication
Preserve proof of how and when the SCN, hearing notice and order were communicated. The date the decision or order is communicated is important because it normally starts the ordinary first-appeal period. A portal status, email, physical delivery or other prescribed mode may create different evidence of communication; retain the actual notice and metadata available to you.
Is DRC-07 the final order?
DRC-07 is the electronic summary of an order under Rule 142 and is treated as the notice for recovery. It is therefore a formal and consequential portal document, not an informal calculation. But it is not a substitute for the detailed adjudication order. The safest interpretation is:
- Yes, operationally: DRC-07 communicates the tax, interest and penalty that the system treats as due and supports recovery action.
- No, as a complete record: DRC-07 does not replace the reasoning, evidence analysis and procedural history in the underlying order.
If you can see DRC-07 but not the order, request the complete order from the proper officer or through the applicable portal process before deciding whether to pay or appeal. If the figures differ, preserve screenshots and downloaded files and identify which document was communicated and on what date.
Can a GST demand order be appealed?
First appeal: FORM GST APL-01
A taxpayer or an unregistered person aggrieved by a decision of an adjudicating authority may file an appeal in FORM GST APL-01. The GST Portal FAQ states that the ordinary period is three months from the date the decision or order is communicated. The appellate authority may condone a delay of up to one additional month when sufficient cause is shown.
Section 107 is the statutory appeal provision. Filing an appeal does not erase the order; it invokes review by the appellate authority subject to the statutory pre-deposit and applicable stay or recovery rules.

Pre-deposit and recovery status
The GST Portal FAQ states that at least 10% of the disputed tax must be paid as pre-deposit. Once an appeal is admitted, the portal flags the balance disputed amount as non-recoverable. Interest and undisputed portions can still require separate attention, and the exact recovery effect depends on the statutory provisions and the status of the appeal.

Appeal documents
The appeal rules provide for an APL-02 final acknowledgment and an APL-04 summary of the appellate order and final demand. Keep the APL-01 filing, APL-02 acknowledgment, APL-04 order summary, pre-deposit proof and every attachment in one file. A portal acknowledgment is evidence of filing, but it does not by itself prove that every document or ground was correctly uploaded.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to collect before deciding whether to pay or appeal
- Download the SCN and DRC-01. Confirm the section, tax period, proposed tax, interest, penalty and factual allegations.
- Retrieve your reply and DRC-06. Check that the complete representation and supporting documents were considered.
- Retrieve the hearing record. Keep the written hearing request, notice of hearing, attendance or video record and written submissions made at the hearing.
- Obtain the full adjudication order. Read the findings and computation, not only the concluding paragraph.
- Download DRC-07 and reconcile the numbers. Compare tax, interest and penalty with the detailed order.
- Check for DRC-08. A rectification summary can alter the portal demand; preserve both the original and corrected records.
- Record the communication date. This date controls the ordinary appeal deadline unless a specific rule provides otherwise.
- Separate disputed and undisputed amounts. The appeal pre-deposit is based on disputed tax, while undisputed tax, interest or other amounts may remain payable.
Common problems and how to analyse them
Only DRC-07 is visible
Do not infer the complete reasoning from the summary. Request the order and SCN, then compare the portal amount with the signed or digitally issued document. Note the date each item was communicated.
The order introduces a new ground
Highlight the new allegation and compare it with the SCN. Section 75 does not permit confirmation on grounds outside the notice. Raise the mismatch as a specific appellate ground rather than arguing only that the amount is high.

The amount in DRC-07 is different from the order
Check whether a DRC-08 rectification or a later communication changed the figures. If no lawful correction explains the difference, preserve both documents and seek correction or appellate relief. Do not delete the earlier portal download.
Best Value
No hearing despite a written request
Produce the written request and proof of delivery. Section 75(4) makes the hearing requirement significant where it was requested in writing or an adverse decision was contemplated. Explain how the omission prevented a fair presentation of the case.
The order ignores a material reply
Mark the exact paragraph and supporting document that was omitted. A speaking order must set out relevant facts and the basis of decision; an appeal can ask the appellate authority to address the ignored evidence or set aside the order for procedural failure.
The appeal deadline is close or has passed
Calculate three months from communication, not from the date printed on an unrelated internal note. If the ordinary period has expired, an appeal may still be admitted within the additional one-month condonable period when sufficient cause is established, according to the GST Portal FAQ. Assemble evidence of the cause and file without further delay.
A practical decision framework
Pay promptly when the record is accepted
If the SCN, hearing and order are procedurally sound, the computation is correct and you do not intend to challenge the liability, use the payment instructions linked to the demand. Keep proof of payment and verify that the portal demand is updated.
Seek correction when the issue is an obvious record error
A typographical or arithmetic mistake may call for rectification under the applicable GST procedure. Obtain the corrected communication and DRC-08, and confirm that the portal reflects the correction. Rectification is not a substitute for an appeal on disputed interpretation or evidence.
Appeal when liability, procedure or computation is disputed
Prepare grounds tied to the record: wrong provision, demand beyond the SCN, failure to consider evidence, denial of a requested hearing, incorrect tax period, arithmetic error or unsupported fraud allegation. File APL-01 within the time limit, make the required pre-deposit and retain all acknowledgments.
Quick Recap
Key takeaways
- An adjudication order is the reasoned determination; a demand order describes the payable and recoverable liability produced by that determination.
- DRC-07 is the electronic summary of the order and is treated as the recovery notice under Rule 142, but it does not replace the full order or SCN.
- Sections 73 and 74 differ principally in whether fraud, wilful misstatement or suppression to evade tax is alleged.
- Section 75 requires hearing safeguards, relevant facts and reasons, and prevents a final demand beyond the notice’s amount or grounds.
- The ordinary first appeal is APL-01 within three months of communication, with limited additional condonation and the statutory pre-deposit.
