GST Council’s Shipping Tax Proposals and Seafarers’ Provident Fund: What’s Known

There is no verified single GST Council package linking tax relief for foreign shipping lines with provident-fund coverage for Indian seafarers. The issues are separate: Council material considered changes to GST on ocean freight and ship repairs, while a 2023 draft proposed extending seafarer benefits to Indian crew on foreign-flagged ships. The available official records establish recommendations and a draft, not that every measure has taken effect.

Are GST relief and seafarers’ provident fund part of one proposal?

No connection between the two policy threads is established in the available official material. GST Council records address tax treatment of particular shipping transactions. The provident-fund proposal concerns employment benefits for Indian seafarers working aboard foreign-flagged ships. They should be assessed separately.

What GST changes have been discussed for shipping?

The Council material covers different transactions and mechanisms. In particular, the ocean-freight discussion concerns reverse-charge liability on an Indian importer; ship maintenance, repair and overhaul (MRO) concerns the GST rate and place of supply for a service; and a separate recommendation concerns IGST when certain vessels temporarily switch to coastal operation.

Issue Policy position in the official record What that does—and does not—establish
Ocean freight paid to a foreign shipping line The agenda for the 52nd GST Council meeting discussed proposed notification amendments to remove reverse-charge liability on importers for specified ocean freight. It described that liability as redundant after the Supreme Court’s Mohit Minerals judgment and changes made by the Finance Act, 2023. (GST Council, 52nd meeting agenda) This is an agenda discussion of proposed amendments, not by itself proof of an operative notification or its effective date. It concerns the importer’s reverse-charge liability for specified freight, not every GST obligation of a foreign shipping line.
Ship and vessel MRO services In 2021, the 43rd GST Council meeting recommended reducing the GST rate on ship and vessel MRO services from 18% to 5%, and changing the place of supply for B2B ship MRO to the recipient’s location. (PIB, 43rd GST Council recommendations) This records a Council recommendation. It should not be treated as confirmation of the current rate or operative place-of-supply rule without checking the relevant notification and its effective date.
Foreign-flag, foreign-going vessel temporarily used for coastal operation A separate recommendation from the 53rd GST Council meeting exempted qualifying vessels from 5% IGST on temporary conversion to coastal operation, provided they reconverted within six months. Duties on stores and fuel continued. (PIB, 53rd GST Council recommendations, 2024) This is a vessel-conversion measure, not a change to ocean-freight service GST or a provident-fund rule. The recommendation’s conditions and implementation should be distinguished from the other shipping measures.

Why the ocean-freight proposal matters to importers

Reverse charge shifts responsibility for accounting for tax from the supplier to the recipient in specified cases. The 52nd-meeting agenda’s rationale was that the identified importer liability had become redundant after the Mohit Minerals judgment and the Finance Act, 2023. The agenda’s discussion alone does not establish whether, when, or in what final form a notification amended the relevant rules.

Why MRO treatment is a different question

The MRO recommendation addresses a repair or maintenance service and, for B2B work, where the service is treated as supplied. It is not a tax exemption for foreign shipping lines generally. The Council’s 2021 recommendation states the proposed rate and place-of-supply change, but the recommendation should not be substituted for the operative notification when determining tax due on a particular job.

Would Indian seafarers on foreign ships receive provident fund and gratuity?

A 2023 draft amendment proposed applying the Seamen’s Provident Fund Act to foreign-flagged ships employing Indian seafarers. It also proposed annuity and gratuity schemes. The draft was circulated for stakeholder comments; that circulation is not enactment, and it does not establish that foreign shipowners currently have contribution obligations under the proposal. The Seamen’s Provident Fund Office says the Seamen’s Provident Fund Scheme was introduced retrospectively from 1 July 1964 to provide old-age retirement benefits for seamen and their families. That background describes the existing scheme’s history and purpose; it does not, on its own, establish that the proposed foreign-flag extension has become law. (SPFO scheme background)

What the 2025 minutes say about coverage

National Shipping Board meeting minutes from 2025 record a stakeholder statement that nearly 80% of Indian seafarers work on foreign-flagged vessels. This is an estimate attributed to the discussion recorded in those minutes, not a verified census or an independently validated workforce statistic. The minutes also record the amendment as an issue still under discussion at that time. (Directorate General of Shipping, National Shipping Board minutes, 2025)

What should employers, importers and seafarers check?

  • Importers: For ocean freight, check the operative GST notification and effective date applicable to the transaction rather than relying solely on the Council agenda.
  • Ship repair businesses and customers: Confirm the currently applicable MRO rate and place-of-supply rule against the relevant notification, contract and transaction facts.
  • Seafarers and employers: Do not treat the 2023 draft as a current entitlement or contribution requirement. Confirm whether legislation or a Gazette notification has since implemented an extension and what workers, employers and contribution arrangements it covers.
  • Vessel operators: Keep the six-month reconversion condition and the treatment of stores and fuel distinct from the freight and MRO measures when assessing the temporary coastal-operation recommendation.

The cited official records do not establish the current notification status of the GST recommendations or whether the proposed provident-fund amendments were enacted after the 2025 minutes. A specific tax or employment-benefit decision therefore requires checking the operative legislation and notifications for the relevant date and circumstances.
