The GST Council and GST standing committees are different levels of India’s GST decision system. The Council is a constitutional Centre–State body created by Article 279A. It makes recommendations to the Union and the States on GST coverage, exemptions, model laws, rates, thresholds and related principles. Standing committees are working groups created under the Council’s administrative framework. They examine assigned subjects, coordinate implementation and prepare recommendations or operational solutions; they do not have the Council’s constitutional status.

The distinction matters when you are trying to answer who decides GST rates, who drafts rules, who handles implementation problems and whether an old committee name still describes a current body. The constitutional Council is a continuing institution. Committee names, membership and remits can be changed, so older committee records must be read as dated documents.

GST Council and standing committees at a glance

Point of comparison GST Council Standing or other committees
Legal position Constitutional body established under Article 279A. Committees constituted through Council decisions and official administrative records; they are not the Council itself.
Main job Recommend GST policy to the Union and States on matters listed in Article 279A. Examine, coordinate or support work in a defined subject area.
Typical subjects Tax coverage, exemptions, model laws, levy and place-of-supply principles, thresholds, rates and special provisions. Legal drafting, information technology, taxpayer interface, rate fitment, implementation, grievance handling and coordination.
Decision authority Acts through the constitutional voting and quorum rules in Article 279A. Works under the authority and remit assigned by the Council or Secretariat. A committee cannot be treated as an independent constitutional decision-maker from its name alone.
Stability over time Its constitutional basis remains unless the Constitution is amended. Names, composition and responsibilities may be modified. The 2017 rollout framework should not automatically be treated as the current structure.

What is the GST Council?

Article 279A of the Constitution, inserted through the 101st Constitution Amendment Act, 2016, establishes the Goods and Services Tax Council. It is a joint forum for the Union and the States rather than a department of either government. Its constitutional function is to make recommendations to the Union and the States on specified GST matters.

Who sits on the Council?

The Council is chaired by the Union Finance Minister. Its membership also includes the Union Minister of State in charge of Revenue or Finance and a minister nominated by each State Government. The constitutional design therefore combines Union representation with State representation in one body.

  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.

This membership explains why the Council is the central forum for issues that affect both levels of government. A committee may contain officials and specialists working on a narrow subject, but it does not replace the Union–State composition prescribed for the Council.

What does the Council recommend?

Article 279A(4) gives the Council a broad, defined recommendation remit. It includes recommendations on:

  • which central, State or local taxes, cesses and surcharges may be subsumed into GST;
  • which goods and services should be subject to GST and which should be exempt;
  • model GST laws, including the structure that the Union and States can use in their legislation;
  • the principles governing levy and the place of supply;
  • the threshold below which goods or services may be exempt from GST;
  • GST rates, including floor rates with bands where applicable;
  • special rates for a specified period to raise resources during a natural calamity or disaster; and
  • special provisions for specified States.

The wording is important: the Council makes recommendations. It is not the Parliament, a State legislature or a tax department. Recommendations must be taken into the relevant legislative, rule-making or administrative process before they become applicable law or an operational requirement.

How are Council decisions made?

Article 279A sets procedural thresholds that are different from an ordinary meeting vote. One-half of the Council’s total membership constitutes a quorum. A decision requires at least three-fourths of the weighted votes of members present and voting.

The weighting is deliberately shared between the two levels of government:

  • the Union Government’s vote carries one-third of the total weighted vote; and
  • all State Governments together carry two-thirds.

These figures are constitutional procedural rules, not statistics about GST performance. They determine when the Council can transact business and the level of weighted support required for a decision.

What is a GST standing committee?

A GST standing committee is a specialist working body created to handle a defined area of GST policy or implementation. The committee structure helps turn a complex subject into material that can be examined, coordinated and presented to the Council or the administration. A committee may analyse legal wording, work through technology readiness, examine rate classification or resolve implementation coordination, depending on its assigned remit.

The committee is not a second GST Council. It does not acquire Article 279A status merely because an official record calls it a “standing committee”. Its authority comes from the decision that constituted it and from any delegation made by the Council or Secretariat.

The dated 2017 rollout framework

An official GST Council record dated 29 May 2017 described the constitution of the GST Implementation Committee, standing committees and sectoral groups for the smooth rollout of GST. The record of the Council’s 14th meeting listed eight proposed standing committees:

  1. Law and Rules Committee
  2. IT Committee
  3. Single Interface Committee
  4. Fitment Committee
  5. Publicity and Outreach Committee
  6. Capacity Building and Facilitation Committee
  7. Fund Settlement Committee
  8. Guidance Notes Committee

That list is evidence of the framework proposed for the 2017 implementation period. It should be labelled as historical when used today. The continued availability of the record does not establish that every committee still exists under the same name, has the same membership or retains the same responsibilities.

Documented responsibilities in the 2017 record

Committee in the 2017 framework Work described in the official record
Law and Rules Committee Finalising rules; drafting non-tariff notifications; troubleshooting and simplifying business-process design; and examining trade representations on legal issues.
IT Committee Monitoring GST Network and Centre/State information-technology preparedness and network linkages.
Single Interface Committee Handling migration and verification of past credit; developing single-interface rules with the Law Committee; coordinating taxpayer assignment; and addressing State-level administrative issues.
Fitment Committee Recommending tax rates for commodities and services, interest rates under sections and rules, and composition rates.

The record gives defined responsibility areas; it does not give these committees the Council’s constitutional identity. It also does not justify claiming that a committee independently enacted a law or finally set a binding rate.

GST Council vs. standing committees: the practical difference

Constitutional forum versus delegated work

The Council exists because the Constitution creates it. A committee exists because the Council or the administrative machinery establishes it for a particular purpose. The Council is therefore the institution to which Article 279A assigns the recommendation role. Committees support that role by doing the detailed examination and coordination needed before or after a Council meeting.

Broad policy choices versus subject-level analysis

The Council considers the Union–State policy question: whether a category should be taxed or exempt, how thresholds should be framed, what rate structure should be recommended and what model law or special provision should be pursued. A committee may then work through classification, drafting, systems readiness, taxpayer migration or other technical consequences within the assigned subject.

Recommendation versus enactment

A Council recommendation is not the same thing as an Act of Parliament, a State GST law, a rule or a notification. Committee analysis is further removed from enactment. Treating a committee note or recommendation as if it were a tax charge can lead to incorrect compliance conclusions. For the operative position, consult the applicable Act, rules, notification and circular issued by the competent authority.

Stable constitutional procedure versus changeable organisation

The quorum and weighted-vote rules are in Article 279A. Committee structures are organisational arrangements and can be revised. A current committee page may supersede, rename or reorganise an older group without changing the constitutional text.

How a GST issue moves through the system

The exact route depends on the subject, but the institutional sequence can be understood as a series of distinct jobs:

  1. Issue identification: A tax, legal, technology, taxpayer-service or implementation issue is identified by governments, officials, taxpayers or other stakeholders.
  2. Subject examination: The relevant committee or administrative group studies the issue within its assigned remit. For example, a legal question may go to the Law Committee, while classification and rate questions may be examined by the Fitment Committee.
  3. Coordination and drafting: Officials develop options, draft language or implementation arrangements and identify effects on the Union and States. The 2017 records specifically describe troubleshooting, process simplification, IT preparedness and taxpayer-interface work as committee responsibilities.
  4. Secretariat processing: The GST Council Secretariat prepares agenda notes and meeting material, records proceedings and processes representations concerning GST laws, rules and rates.
  5. Council consideration: The Council considers the matter within its Article 279A remit and, where appropriate, makes a recommendation under its constitutional procedure.
  6. Legal or administrative action: The Union and States use the appropriate legislative, rule-making, notification or administrative channel to give effect to the decision. The resulting instrument, not the committee label, determines the enforceable requirement.
  7. Follow-up: The Secretariat follows up implementation, while implementation and coordination bodies may address operational issues within the authority delegated to them.

This sequence prevents two common errors: assuming that a committee’s technical recommendation is already law, and assuming that every operational decision must wait for a full Council meeting.

What does the GST Secretariat do?

The Secretariat is the administrative support structure for the Council. Its described functions include organising Council meetings, drawing up agenda notes, preparing minutes, following up implementation of Council decisions, processing representations about GST laws, rules and rates, and organising national coordination meetings.

The Secretariat’s work is different from the Council’s recommendation role. It keeps the decision process organised and tracks implementation; it does not become the constitutional Council by performing those tasks.

The GST Implementation Committee’s delegated role

The Secretariat’s institutional description states that the Council delegated powers to the GST Implementation Committee to decide issues of an urgent and procedural nature in the period between two Council meetings. This is a delegation for a defined category of matters. It should not be read as a transfer of the Council’s entire Article 279A remit or as authority for the committee to rewrite the constitutional voting rules.

Which committees are listed today?

The GST Council’s current committee directory lists bodies including the Fitment Committee, Law Committee, GST Implementation Committee, Grievances Redressal Committee, State Coordination Committee, All India Coordination Committee and IT-GRC, along with other groups. The directory demonstrates that committee structures continue to be maintained and updated.

It does not, by itself, establish the full current remit or membership of every listed body. The Law Committee page includes a modification record dated 10 February 2025, which is a useful reminder to check the date and revision history of a committee page before relying on an older description.

For a current question, use the latest Council listing and the underlying order or terms of reference where available. Use the 2017 records to understand the rollout framework, not to assume that all eight original names remain current.

Who decides GST rates in India?

The constitutional answer is that the GST Council recommends rates to the Union and the States under Article 279A. The Fitment Committee’s documented role is to examine and recommend tax rates for commodities and services, along with interest and composition rates, within the 2017 framework. That makes the committee an analytical and preparatory body, not the constitutional rate-setting forum.

A rate becomes an operative tax requirement through the applicable legal and administrative instruments issued by the competent Union or State authorities. When checking a rate for a transaction, product or service, rely on the current law, notification or circular rather than a committee proposal, meeting discussion or outdated table.

Common misunderstandings

“The standing committee is the GST Council.”

No. The Council is the constitutional Centre–State institution. A standing committee is a supporting body with a defined assignment.

“A committee can impose a new GST rate.”

The documented committee role is examination and recommendation. The Council makes recommendations under Article 279A, while the legal effect comes through the relevant legislative or administrative instrument.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The eight committees from 2017 are still the complete list.”

No conclusion that broad is justified. The 2017 record describes a rollout framework, while the current Council directory lists a different and expanded set of bodies and records later modifications.

“Any committee page proves its full current powers.”

Not necessarily. A directory confirms that a body is listed, but its current remit, membership and delegated authority should be checked against the latest order or terms of reference.

“The Secretariat and the Council perform the same job.”

The Secretariat organises meetings, prepares records, processes representations and follows up decisions. The Council is the constitutional body that makes recommendations on the matters listed in Article 279A.

Where to verify the legal position

For the constitutional framework, consult the 101st Constitution Amendment Act, 2016, which reproduces Article 279A, including the Council’s membership, recommendation subjects, quorum and weighted voting rules. For committee history, consult the GST Council’s 2017 constitution and 14th-meeting records. For current committee names and modification dates, use the Council’s committee directory and the relevant committee page.

For operative GST law, the Central Board of Indirect Taxes and Customs legal-resources collection lists the CGST Act, rules, notifications and circulars. Those instruments are the appropriate place to verify what currently applies to a transaction; a committee description alone is not a substitute for the law.
