GST registration and filing are not decided by turnover alone. For a small business or online seller in India, the answer can also depend on the type and location of supplies, whether a compulsory-registration rule or notified exception applies, the role of a marketplace, and whether the seller uses the regular or composition scheme. Use the questions below to identify what to check; confirm the current rule for your exact situation before acting.

Do small businesses need GST registration?

It depends on the seller’s aggregate turnover, supplies, locations and whether a compulsory-registration category applies. The CGST Act provides for compulsory registration in specified cases and also allows the government to notify exemptions. That means a turnover figure by itself may not settle the question.

CBIC’s FAQ pages include answers that refer to historical thresholds. Do not treat those figures as universally current: check the applicable provisions and notifications for the seller’s circumstances using the CBIC registration rules, the CGST Act text and the CBIC FAQs.

Check the facts that can change the result

  • Turnover: Establish the relevant aggregate turnover rather than looking only at one product, sales channel or marketplace account.
  • Supply: Identify whether you sell goods or services, and whether the supplies are taxable or exempt.
  • Location: Check where the supplier and customers are, including whether sales are within one state or cross state boundaries.
  • Registration category: Check whether a compulsory-registration provision applies or a current notified exception covers the seller.

These are decision factors, not a substitute for applying the current law to the business. If more than one factor is involved, a GST practitioner can help assess the specific facts.

Does selling through an e-commerce marketplace require GST registration?

Not automatically in every case, and not safely answered with a blanket yes or no. The CGST Act addresses suppliers using an e-commerce operator that is required to collect tax at source (TCS), while also allowing notified exemptions. The marketplace’s role and the seller’s eligibility under any applicable notification matter.

Before relying on an exemption, verify the current notification and conditions against the seller’s turnover, type and location of supplies, marketplace arrangement and any applicable enrollment requirements. The CBIC Sectoral FAQs discuss the general issue, but the current eligibility details should be checked against the applicable official notification or portal instruction. The available official guidance does not establish a precise current eligibility route for every small seller, so do not assume that simply having low turnover settles marketplace registration.

Direct sales and marketplace sales are not interchangeable

A seller taking orders through its own website or social-media page should not assume that the rules for a marketplace operator apply identically. Conversely, selling through an operator that collects TCS can bring a specific registration provision into the analysis. Determine who operates the channel, who collects consideration and whether the operator is required to collect TCS.

Does one GST registration cover sales in every state?

Do not assume that one registration automatically covers every state or transaction. CBIC’s registration guidance asks applicants for state or Union Territory details, and the CGST Act describes a state-specific registration structure. A business operating in more than one state should check its registration position for each relevant location and supply.

Start with the CBIC registration rules and the CGST Act text. The answer can also depend on the nature of the supply and where it takes place; do not infer registration coverage solely from having a GST identification number.

What is the difference between regular and composition scheme compliance?

The scheme a seller uses affects compliance obligations. In particular, the GST Portal’s GSTR-1 guidance excludes composition taxpayers from the GSTR-1 requirement described for regular taxpayers in scope. Do not select a scheme based on a general online summary: first confirm eligibility and the consequences for the seller’s supplies and customers under current rules.

Can you opt out of the composition scheme later?

CBIC’s FAQ page addresses opting out, but a seller should verify the current procedure, timing and consequences before changing schemes. See the CBIC FAQs and applicable current rules rather than treating an older FAQ response as a complete description of today’s process.

What returns does a registered seller file?

For regular taxpayers within its scope, the GST Portal says GSTR-1 is an electronic return for reporting outward supplies. The portal also says a nil GSTR-1 is required for a period with no business activity. Its guidance excludes composition taxpayers and specified categories, so the requirement does not apply identically to every registered person.

Check the current GST Portal GSTR-1 guidance for the seller’s category and workflow. Return forms and filing frequency depend on the taxpayer’s applicable category and current portal rules; confirm those details rather than assuming every seller follows the same monthly or quarterly process.

What if there was no business activity in the period?

If the seller is a regular taxpayer covered by the GSTR-1 requirement, no activity does not by itself remove the nil-return obligation described by the GST Portal. Check whether the seller falls within an excluded category before applying that guidance.

What should a GST invoice or bill of supply include?

The document depends on the seller’s status and the transaction. CBIC distinguishes a tax invoice from a bill of supply; a bill of supply applies in certain cases, including for composition taxpayers or exempt supplies. The applicable current rules determine which document is appropriate.

CBIC’s invoice rules list particulars that can include the supplier’s and recipient’s details where applicable, invoice number and date, description of the goods or services, taxable value, tax rate and tax amount, and the supplier’s signature or digital signature. Check the current CBIC invoice rules for the requirements that apply to the supply. The CBIC Sectoral FAQs also discuss invoicing questions; a single generic invoice template may not suit every seller or transaction.

How should a small seller check GST compliance before starting or changing a sales channel?

  1. Map the business: List the goods or services sold, whether supplies are taxable or exempt, the relevant locations, and each sales channel.
  2. Check registration: Apply the turnover rules, compulsory-registration provisions and any current notified exception to those facts. For marketplace sales, include the operator’s TCS role and verify any applicable enrollment conditions.
  3. Confirm the registration structure: Check which state or Union Territory registrations are relevant instead of assuming one registration covers all operations.
  4. Confirm the scheme and returns: Establish whether the seller is under the regular or composition scheme and then verify the applicable return forms and filing frequency on the GST Portal.
  5. Use the right document: Check whether the transaction calls for a tax invoice or bill of supply and follow the applicable current invoice rules.
  6. Recheck when facts change: A new state, supply type, marketplace arrangement or turnover position can change the compliance analysis. Review current law, notifications and portal instructions when that happens.

GST registration applications and return workflows are online. The GST Portal registration manual explains the normal-taxpayer application workflow, while the portal’s GSTR-1 guide covers outward-supply reporting for taxpayers within scope. For multiple states, mixed supplies or uncertain marketplace eligibility, individualized advice from a qualified GST practitioner may be useful.
