GST Classification and HSN Code Decisions in India: A Practical Guide for Businesses

Use HSN or tariff classification for goods and the applicable service classification code (Accounting Code/SAC) for services. The correct code is determined by the supply’s real composition, construction, function, processing and use, then checked against the tariff notes and the current GST rate entry. A portal search result is only a candidate; it is not, by itself, a legal classification or a complete rate answer.

This guide gives Indian businesses a repeatable way to classify supplies, select an invoice code, verify the applicable rate and conditions, and document or escalate an uncertain decision.

What GST classification does—and does not—decide

GST classification places a supply in the tariff or service-classification structure used for registration, invoicing, returns and rate notifications. For goods, this normally means an HSN-based heading, sub-heading or tariff item. For services, it means the relevant service classification and its Accounting Code. Classification is therefore a legal and factual exercise, not a branding exercise.

The same commercial name can cover products made from different materials, supplied in different forms or designed for different uses. Those differences can move an item to another heading or to a different rate entry. The description printed on a catalogue, marketplace listing or internal item master is evidence of what the business calls the item; it is not a substitute for the tariff wording, section and chapter notes, interpretation rules, exclusions or the applicable GST notification.

GST rates are published in schedules organised by Chapter, Heading, Sub-heading or Tariff item for goods and by the service classification scheme for services. Each entry can carry its own description, provisos, exclusions, conditions and effective date. Read the complete entry in the CBIC GST goods and services rate schedules, including amendments, rather than assuming that a code lookup supplies the rate.

A defensible classification file should allow another person to reproduce the decision from the product or service facts, the candidate headings considered, the legal notes consulted and the notification in force for the relevant tax period.

Keep the goods and services code systems separate

Question Goods Services
Classification family HSN/tariff classification based on the Customs Tariff structure Service classification scheme and Accounting Code (often called SAC)

The GST registration tutorial has separate goods and services tabs and permits up to five goods and five services to be added in that registration workflow. If a business deals in more, the tutorial instructs it to enter the top five. That is a registration-screen instruction, not a limit on the codes that may be needed for invoices, returns or an item master. See the GST portal registration tutorial for the current screen labels.

Do not force a service into an HSN simply because a software or catalogue search returns a familiar product code. Conversely, a physical product remains goods even when it is sold with installation, training or support; analyse the complete supply and any bundled elements before deciding whether separate or combined treatment is appropriate.

A repeatable classification workflow

Use the following sequence for each material product or service. It is a practical control process built on the tariff and invoice framework; the final legal result remains fact-specific.

  1. Freeze the facts at the transaction date. Save the technical data sheet, drawings, photographs, bill of materials, packaging, purchase and sales descriptions, contract, statement of work and any customer-use information that affects the analysis.
  2. Decide whether the supply is goods, services or a combination requiring separate analysis. Record what is transferred, what work is performed and whether one element changes the character of another. Keep the goods and service code searches separate.
  3. Write a neutral description. Describe the thing or activity without using a conclusion such as “premium appliance” or “consulting package.” Include constituent materials, degree of completion, dimensions or form where relevant, operating principle, intended and actual use, processing and presentation.
  4. Find candidate wording. Search the portal by a precise commodity or service description and search the tariff or service list for matching terms. Preserve every plausible heading, not just the first result, with the date and source used.
  5. Apply the legal tariff framework. Read the heading with the relevant section notes, chapter notes, exclusions, inclusive language and General Rules for Interpretation. The First Schedule to the Customs Tariff Act and its interpretation framework are part of this analysis; a marketing label alone is not.
  6. Compare the candidates on the facts. Test composition, construction, form, function, processing and principal use against the exact wording and notes. For a service, compare the actual activity and deliverables with the service heading and all rate-entry conditions.
  7. Map the surviving heading to the current GST entry. Open the matching goods or services schedule entry and the notification that gives it effect. Confirm the complete description, rate, provisos, exclusions, conditions, exemptions and effective date.
  8. Check invoice and reporting requirements independently. Determine which code and how many digits the applicable notification requires for this supplier, supply type and tax period. Do not infer the current requirement from an old turnover table or a historical presentation.
  9. Approve, record and monitor. Have an appropriate reviewer sign off the reasoning, store the evidence and set a review trigger for a product change, tariff amendment, rate notification or change in the way the supply is bundled.

How to describe a supply so the code can be tested

For physical goods

  • Composition: identify the principal and secondary materials, coatings, alloys, chemicals or ingredients, and their relative significance.
  • Construction: note whether the item is assembled, moulded, woven, laminated, filled, insulated, machined or otherwise processed.
  • Condition and form: distinguish raw material, semi-finished article, finished article, kit, set, spare part, component, concentrate, solution or retail pack.
  • Function and operating principle: explain what the item does and the mechanism by which it does it.
  • Use: record the ordinary or principal use and any industry-specific design, without treating a single customer’s unusual use as automatically decisive.
  • Presentation: document packaging, accessories and whether items are supplied together as a set.

For services

  • State the work actually performed rather than the broad department name used internally.
  • List deliverables, personnel activities, software access, licences, maintenance, training, data processing and other elements supplied under the contract.
  • Explain which element the customer is paying for and whether the contract presents several elements as one bundled supply or as separately identifiable supplies.
  • Keep the statement of work, acceptance criteria, invoices and customer correspondence aligned; inconsistent descriptions make a classification decision difficult to defend.

Reading the tariff instead of stopping at a search result

A search tool is useful for locating language, but classification normally requires a hierarchy of checks:

  1. Exact heading text: read the entire heading and any sub-heading or tariff-item wording, including qualifiers such as “parts,” “other,” “whether or not,” “for…,” or specified forms.
  2. Section and chapter notes: these can include legal definitions, inclusions, exclusions and rules that override an intuitive commercial description.
  3. General Rules for Interpretation: apply the rules in their prescribed order rather than selecting the heading that merely sounds closest.
  4. General explanatory material: use explanatory notes and official interpretive material to understand scope, while checking that the material is current and relevant to the Indian tariff.
  5. Product facts: connect each conclusion to evidence in the specification, sample, drawing, contract or photograph.

The GST Council’s invoice-rules agenda material discusses the interpretation framework and tariff-based reporting history. It is useful context, but it is not a replacement for the operative tariff, notification or current return instruction. Consult the GST Council invoice-rules agenda material and the 42nd meeting material only as background, then verify the rule currently in force.

Comparing two plausible headings

When two headings appear possible, use a written comparison rather than an intuition-based choice.

Comparison axis Questions to answer Evidence to retain
Wording Which heading describes the article or activity more precisely? Are qualifiers, “other” categories or specified forms relevant? Full heading, sub-heading and tariff-item text
Notes and exclusions Do section or chapter notes include, exclude or legally define the item? Applicable notes with the version or date checked

Form and condition Is it raw, unfinished, finished, a part, a set, a kit or a retail presentation? Packaging specification and commercial presentation
Function and use What is the item’s principal function and ordinary use? Does a rule give use a specific role? Technical specification, instructions and customer-use evidence
Interpretation rules Which General Rule for Interpretation resolves the conflict, and why does it apply before another rule? A short reasoning paragraph tied to the rule
GST entry Does the corresponding rate entry include conditions, exclusions or a date different from the other candidate? Complete schedule entry and notification in force for the supply date

CBIC’s published GST rate FAQs contain item-level examples in which constituent material or product form affects the result. Treat those examples as illustrations of fact-sensitive analysis, not as blanket rulings for every product with a similar name. Read the examples at the CBIC GST rates FAQ alongside the actual tariff entry and the facts of your supply.

Checking the GST rate and its conditions

After choosing the best-supported heading, open the current CBIC schedule and identify the matching entry. Check all of the following before loading a rate into accounting software:

  • the chapter, heading, sub-heading or tariff item (for goods), or service classification (for services);
  • the complete description, including words that limit the entry to a material, use, customer, packaging or form;
  • any proviso, exemption, exclusion, threshold, end-use requirement or other condition;
  • the effective date and every amending notification relevant to the invoice period;
  • whether the entry is conditional on a separate fact, such as how the supply is presented or what it contains.

A code can be correct while the rate is wrong if the business selects a neighbouring entry, misses an exclusion or uses a notification that was amended before the invoice date. Save a copy or stable reference to the entry reviewed and record the “as at” date in the classification file.

HSN digits and invoice fields: the safe way to decide

The tax-invoice rules include “HSN code of goods or Accounting Code of services” among the particulars of a tax invoice. They also provide for notification of the number of HSN digits required for classes of registered persons and for classes that need not mention a code. The stable principle is that an applicable invoice code must be reported under the rules; the digit count and exceptions are notification-dependent.

Before configuring an invoice template, verify the notification and current return or e-invoice instructions that apply to the supplier, the type of supply and the relevant tax period. The CBIC tax invoice rules are the starting point for the invoice particulars and the notification mechanism.

Do not copy a historical two-, four-, six- or eight-digit threshold from an old presentation and call it a universal current requirement. GST Council agenda papers record how reporting proposals and thresholds changed over time; those historical materials explain the evolution but do not replace an operative notification. If your software asks for a fixed number of digits, make the configuration follow the current legal requirement rather than the software’s default.

Separate classification from invoice configuration

Maintain the full classification used in your item master even when an invoice or return requires a particular digit length. Restricting the display to fewer digits for a specific notification should not erase the underlying heading, notes, evidence or rate decision. For services, store the service description and Accounting Code separately from a goods HSN field.

Worked fact patterns without guessing a code

Example: a manufactured consumer article

Assume a business sells an insulated drinking vessel marketed as an “eco bottle.” The classification file should not begin with that slogan. It should record the body material, liner, insulation, lid, whether the article is complete or supplied as a set, manufacturing process, retail presentation and ordinary use. The team would then:

  2. read the relevant section and chapter notes and apply the interpretation rules;
  3. compare headings that turn on material, construction or form;
  4. check the complete GST entry and conditions for the selected heading; and
  5. record why the selected wording fits the documented facts better than the alternatives.

No code should be assigned from the product name alone. A change from one material, form or bundled presentation to another can require a fresh review.

Example: implementation with continuing support

Suppose a supplier signs one statement of work covering system configuration, data migration, user training and monthly support. The classification record should describe each activity, the deliverables, the contract’s pricing and whether the customer is buying a principal implementation outcome, separately priced services or access to software. Search the service classification using those actual activities, compare the candidate service descriptions and read every rate-entry condition. If the commercial model changes, revisit the classification rather than reusing the old code because the internal department name is unchanged.

Build an audit-ready classification record

A short decision memo is more useful than a code copied into a spreadsheet. Include these fields for each material supply:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Record section What to capture
Supply identity Internal item or service ID, supplier and customer descriptions, launch or change date, and the entity making the decision
Facts Composition, construction, processing, form, function, use, packaging, contract scope and bundled elements
Candidate headings Every plausible heading or service classification, with the search date and source
Legal analysis Relevant section and chapter notes, exclusions, interpretation rules and explanatory material, with the reasoning applied to the facts
Rate verification Current CBIC schedule entry, notification, rate, conditions, exclusions and effective date
Invoice decision HSN or Accounting Code, required digit treatment under the operative notification, and any exception relied on
Approval and review Reviewer, approval date, unresolved assumptions, triggers for reassessment and links or saved copies of sources

Version the record when a formulation, bill of materials, packaging, service scope or customer use changes. A code that was reasonable for the original supply may become wrong after a redesign or a new bundled offering.

Common failure modes and fixes

Choosing the first portal result

Why it fails: keyword search does not apply legal notes or distinguish similar materials and forms.

Fix: retain candidate headings, read the notes and write a fact-to-wording comparison before approval.

Using the marketing category as the classification

Why it fails: names such as “kit,” “professional,” “smart” or “eco” may have no tariff significance.

Assuming the HSN alone gives the GST rate

Why it fails: schedule entries can contain conditions, exclusions, provisos and effective dates.

Fix: read the complete current rate entry and matching notification for the invoice date.

Copying an old digit threshold

Why it fails: digit requirements and exemptions are set or changed through notifications.

Fix: verify the operative notification and return or e-invoice instruction for the supplier and period.

Confusing portal registration limits with invoice limits

Why it fails: the registration tutorial’s five-goods/five-services instruction is a screen workflow, not a general coding ceiling.

Fix: maintain the complete item and service coding structure needed for actual supplies and reporting.

Reusing a service code after the contract changes

Why it fails: a new deliverable, licence element, support arrangement or bundle can change what is actually supplied.

Relying on an FAQ example as a universal rule

Why it fails: official examples are tied to their stated facts.

Fix: use the example to identify the relevant distinction, then prove that your product or service has the same material, form, construction and use.

When to obtain a second review or advance ruling

Escalate when two headings remain plausible, the rate difference is material, a classification affects many past invoices, the facts are novel, or a product or service is being redesigned. A qualified indirect-tax professional can review the technical evidence, tariff notes, candidate headings and current notification. Verify the professional’s credentials and scope; no adviser is automatically endorsed by this guide.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Section 97(2) of the CGST Act includes classification of goods or services among the questions on which an advance ruling may be sought. The statutory route is not an automatic answer for every taxpayer or hypothetical dispute: confirm applicant eligibility, jurisdiction, procedure, fees, the facts presented and the legal effect of the ruling. Read the current CGST Act text and applicable rules before filing.

An advance-ruling application should be built from the same evidence as the internal memo: precise facts, candidate classifications, the legal notes relied on, the rate entries considered and the specific question presented. Keep issuing invoices under the best-supported current position while obtaining advice on any interim treatment required for your circumstances.

A practical control checklist before publishing an invoice

  • Is the supply clearly identified as goods, services or a combination requiring separate analysis?
  • Does the description state real materials, construction, form, function, processing, use and bundled elements?
  • Were plausible headings searched and compared rather than accepting the first result?
  • Were section and chapter notes, exclusions and interpretation rules read?
  • Was the complete current CBIC rate entry checked for conditions and effective date?
  • Was the invoice code field selected correctly—HSN for goods or Accounting Code for services?
  • Was the current digit requirement and any exception verified for this supplier and tax period?
  • Are the source links, documents, assumptions, reviewer and review date saved?
  • Is there a trigger to revisit the decision after a formulation, packaging, contract, tariff or notification change?
  • Has a material unresolved issue been escalated to a qualified adviser or considered for an advance ruling?

Bottom line for finance and tax teams

Start with what the business actually supplies, not the name used to sell it. Separate goods HSN analysis from service classification, compare the legal tariff wording with the documented facts, then verify the full GST schedule entry and notification in force on the supply date. Treat invoice digit counts as notification-based, keep registration-screen limits in their proper context, and preserve the reasoning. That workflow turns a code lookup into a classification decision that can be explained, reviewed and updated.

Frequently Asked Questions

What should I do if the GST portal search returns several possible codes?

Save each plausible result, then compare the complete heading wording, section and chapter notes, interpretation rules and the product or service facts. Select the heading that is legally and factually best supported, and record why the alternatives were rejected; do not choose solely by keyword ranking.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can an old GST Council table be used to set the HSN digit count on invoices?

No. Historical Council material can show how reporting practices evolved, but the operative digit requirement and exemptions come from the current notification and applicable return or e-invoice instructions. Verify those for the supplier and tax period.

Does entering a code during GST registration mean the same code must be used for every invoice?

The registration tutorial’s goods and services fields and its instruction to add up to five entries are registration-screen guidance. Invoice coding must reflect the actual goods or services supplied and the current invoice rules; registration entry limits are not a universal invoice-code limit.

When is an advance ruling worth considering?

Consider it when competing classifications remain plausible, the rate or exposure is material, or the supply is novel or frequently sold. Classification is listed among the advance-ruling questions in CGST Act section 97(2), but eligibility, jurisdiction, procedure and the ruling’s legal effect must be checked for the specific applicant and facts.
