GST Audit vs Assessment vs Investigation in India: Key Differences for Businesses

By Freedom251 Team · · 12 min read

Assessment determines tax liability, an audit verifies whether a registered business’s records and returns support its GST positions, and an investigation gathers evidence where an officer suspects evasion or another contravention. They can occur in sequence, but they are not interchangeable. An audit observation is not automatically a demand order; an investigation is not simply a broader audit; and an assessment can arise even without either of them.

The governing framework is the Central Goods and Services Tax Act, 2017 (CGST Act), together with the rules and forms issued by the Central Board of Indirect Taxes and Customs (CBIC). The section and form printed on a notice tell you which process you are actually facing.

The difference at a glance

Point of comparison Assessment Audit Investigation
Primary purpose Determine tax liability, refund or other amount payable under a statutory assessment route. Verify books, returns and GST positions of a registered person. Establish facts and preserve evidence where evasion or another contravention is suspected.
Typical trigger Return filing, uncertainty about value or rate, non-filing, unregistered activity or an urgent risk to revenue. Selection and authorisation by the Commissioner or an authorised officer. Recorded reasons to believe that transactions, stock, input tax credit or records have been concealed or manipulated in a way likely to cause evasion.
Main material examined Returns and particulars relevant to the statutory assessment. Books, invoices, returns, turnover, rates, exemptions, deductions, input tax credit and refunds. Records, electronic devices, goods, statements and documents obtained through inspection, search, seizure or summons.
Notice or authority The form depends on the section and type of assessment; scrutiny commonly uses ASMT forms. ADT-01 is used for the audit notice and ADT-02 for the findings under the CBIC rules. Inspection, search or seizure requires written authorisation under section 67; a summons is issued under section 70.
Timing highlighted by the law Examples include a 90-day period for a provisional-assessment order and five-year windows for some best-judgment assessments; the applicable deadline depends on the section. At least 15 working days’ notice; normally completion within three months of commencement, with a written-reason extension of up to six months; findings are communicated within 30 days after conclusion. The cited provisions do not set one general completion period. Rules governing seizure, custody and return of material still apply.
Possible result An assessment order or determination of tax, interest, refund or another statutory amount. Documented findings and, if a discrepancy is established, a referral into a tax-determination process. Statements and seized evidence that may support a notice, demand, penalty, prosecution or arrest in a qualifying case.

A letter’s heading alone can be misleading. Read the cited section, form number, tax period and requested action before deciding how to respond.

What a GST assessment does

Assessment is the tax-liability determination function. Section 59 places the first responsibility on the taxpayer: “Every registered person shall self-assess the taxes payable under this Act and furnish a return for each tax period as specified under section 39.” This sentence is from the Central Goods and Services Tax Act, 2017, section 59, India Code.

  • Read Before You Buy — No Video Output: These adapters support charging and USB 2.0 data transfer, but cannot transmit video signals. Except for standard USB webcams (which use USB data only), they are not compatible with HDMI/DisplayPort cables, video-capable USB-C hubs, or docking stations with video output.
  • Convert USB-A Ports to USB-C: Designed to connect USB-C earphones, cables, flash drives, card readers, and other USB-C accessories to standard USB-A ports. Plug-and-play with no drivers or software required.
  • Aluminum Alloy Housing: Built with a sturdy aluminum alloy shell that aids in heat dissipation and protects against daily wear and scratches. Designed to maintain a stable and secure connection.
  • Compact & Travel-Friendly: The ultra-compact design allows the adapter to stay plugged into your device without blocking adjacent ports or adding bulk, reducing wear and tear on your original USB ports.
  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.

Self-assessment is therefore not an informal estimate. The registered person calculates the tax for each period, reports it in the required return and pays the amount due. The Act also gives officers specific assessment routes when the normal return is incomplete, uncertain or absent.

Provisional assessment

When a taxpayer cannot determine the value of a supply or the applicable rate, the taxpayer can seek a provisional assessment. The final liability is settled when the relevant facts and rate are established. The applicable statutory timing example is a 90-day period for a provisional-assessment order; the exact clock and conditions must be checked against the notice and applicable rule.

Scrutiny of returns

Section 61 permits scrutiny of a filed return and related particulars. The officer identifies an apparent discrepancy and gives the taxpayer an opportunity to explain it or accept the difference. Under the CBIC forms:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • ASMT-10: notice communicating discrepancies found in scrutiny.
  • ASMT-11: the taxpayer’s reply, including acceptance of the discrepancy where appropriate.
  • ASMT-12: communication when the officer accepts the explanation.

A scrutiny notice is not the same thing as an audit notice. It normally starts with a defined discrepancy in the return material, so the response should address each cited mismatch with a reconciliation and supporting documents.

Best-judgment assessment of a non-filer

Section 62 covers assessment of a person who fails to furnish a required return. The officer uses the information available to make a best-judgment assessment. If the taxpayer later files the prescribed return within the statutory opportunity, the legal effect of that filing and any interest or other amount must be checked against the relevant provision and order.

The applicable provisions provide five-year windows for some best-judgment assessment situations. That is not a universal deadline for every assessment: the notice’s section and tax period control.

Assessment of an unregistered person

Section 63 enables assessment of a person who should have registered but did not. The officer determines the liability using available information. A business that receives such a notice should first establish whether its activities crossed the registration threshold or otherwise triggered compulsory registration for the period alleged.

Summary assessment to protect revenue

Section 64 provides a summary-assessment route when delay may adversely affect revenue. It is an exceptional, expedited mechanism rather than the ordinary way every return is assessed. The order and any subsequent remedy depend on the statutory conditions and the form served.

Other assessment forms

CBIC rules assign ASMT-13 through ASMT-18 to specified assessment cases. The form number should be read with the section cited in the body of the notice; a form label by itself does not tell you the amount ultimately payable or the available response.

What a GST audit does

An audit under section 65 is a records-and-return verification exercise for a registered person. The Commissioner or an authorised officer may conduct it at the business premises or at the tax office. The audit period is a financial year or multiples of a financial year under the CBIC rules.

Notice, duration and findings

  • The business must receive at least 15 working days’ notice.
  • The audit normally must be completed within three months from commencement.
  • The Commissioner may extend it by up to six months when written reasons are recorded.
  • Within 30 days after conclusion, the officer must communicate the findings, the business’s rights and obligations, and the reasons for the findings.

CBIC’s prescribed notice is ADT-01. Findings are communicated in ADT-02. During the exercise, the officer can require facilities, books and information needed to verify the GST position.

What the officer can examine

The audit scope can include turnover, exemptions, deductions, tax rates, input tax credit, refunds and related issues. In practical terms, the officer may trace a figure from the return to the sales register, invoice, e-way or e-invoice record, bank or ledger entry, and then test whether the tax treatment and credit documentation agree.

How to respond to audit observations

The business may reply to audit observations before the findings are finalised. A useful response is point-by-point rather than narrative:

  1. Copy the observation and identify the exact tax period, return table and transaction population involved.
  2. Reconcile the officer’s figure to the general ledger, sales and purchase registers, tax invoices, credit notes and payment records.
  3. Explain differences caused by timing, amendments, exempt or non-GST supplies, place-of-supply treatment, or credit reversals, attaching the document that proves the explanation.
  4. Where an amount is genuinely payable, separate the undisputed amount from disputed items and state what action has been taken.
  5. Keep a submission index and proof of delivery, and retain the working papers used to produce every total.

Does an audit itself create a demand?

No. Section 65(7) says that when an audit detects unpaid or short-paid tax, an erroneous refund, or input tax credit wrongly availed or utilised, the proper officer may initiate action under section 73, section 74 or section 74A. The audit finding is evidence and an administrative trigger; the tax demand arises only through the applicable determination and order process, with the notice, reply and adjudication steps required by that provision.

What a GST investigation does

Investigation is an enforcement inquiry generally associated with suspected evasion or another contravention. It is designed to establish facts and secure evidence, not merely to check whether a return adds correctly.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When section 67 powers can be used

Under section 67, a Joint Commissioner or higher proper officer must have recorded reasons to believe that transactions or stock have been suppressed, input tax credit has been overclaimed, goods have escaped tax, or accounts or goods have been kept in a manner likely to cause evasion. On that basis, the officer may authorise inspection, search and seizure of goods, books, documents or things useful for proceedings.

The law allows premises, almirahs or electronic devices to be sealed or broken open when access is denied. A search can therefore affect physical records, computers, phones, storage media and inventory, not only the files initially mentioned in a conversation.

Summons under section 70

Section 70 gives the proper officer power to summon a person to give evidence or produce documents. A summoned person must attend as directed and either state the truth or produce what is required. The response should distinguish personal knowledge from information obtained from another employee, and it should never guess at an answer that can be verified from the records.

Where permitted, an authorised representative can attend with the business. The summoned person should still read every statement carefully, correct factual errors before signing and keep a copy or an accurate record of what was submitted.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Arrest and prosecution risk

Section 69 permits arrest in specified offences under section 132 when the Commissioner has reasons to believe the offence was committed. Arrest is therefore tied to the statutory offence and the Commissioner’s recorded belief; an ordinary discrepancy or every audit disagreement does not automatically meet that threshold.

CBIC’s investigation index identifies guidance on summons, arrest and bail (17 August 2022), prosecution (1 September 2022), and deposits during search, inspection or investigation (25 May 2022). If a notice or visit alleges fraud, wilful misstatement, suppression, an arrest-level offence or a proposed prosecution, obtain professional advice immediately rather than treating it as routine return correspondence.

What happens to seized material

Ask for an inventory and receipts for every seized item, note serial numbers and storage media identifiers, and keep a custody log. The business has a statutory opportunity to copy or extract documents when doing so will not prejudice the investigation. Make the request in writing and preserve the resulting copy securely.

How assessment, audit and investigation can connect

These processes are separate legal tools but can form a sequence:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. A return is filed and selected for scrutiny under section 61; an ASMT-10 discrepancy notice is issued.
  2. The explanation is inadequate or the issue is broader than the return mismatch, so the department may select the registered person for an ADT-01 audit or another statutory proceeding.
  3. An audit or scrutiny reveals indicators such as concealed turnover, circular invoices or unsupported credit. The proper officer may then move to inspection, search or summons under the investigation provisions.
  4. Evidence from any of those steps can support a show-cause notice and a determination under the applicable demand section, with penalty or prosecution where the legal requirements are met.

The sequence is not automatic. A scrutiny notice does not guarantee an audit, and an audit does not prove fraud. The department must still use the power and procedure that match the allegation.

What to do when a notice arrives

1. Identify the legal route

Record the section, form, issuing authority, tax period, deadline, place of attendance and documents requested. ASMT-10 points to scrutiny; ADT-01 points to audit; a section 70 summons demands attendance or production; a section 67 authorisation signals inspection, search or seizure. Do not infer the route from an informal email or telephone description.

2. Preserve the complete record

Place a litigation hold on paper and electronic data for the period under review. Preserve filed returns, ledgers, trial balances, invoices, credit and debit notes, e-way and e-invoice records, input-tax-credit support, refund files, contracts, bank reconciliations and relevant emails or accounting exports. Do not alter, delete or back-date a record after receiving notice.

3. Build a reconciliation pack

Prepare a period-wise bridge from books to returns: outward turnover, taxable and exempt supplies, tax rates, output tax, input tax credit claimed and reversed, refunds and payments. List every reconciling item with its document reference. This prevents a genuine timing or classification difference from appearing as unexplained suppression.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Meet the deadline and preserve proof

Submit the reply through the channel specified in the notice, retain the acknowledgement and keep the exact version of every attachment. If more time is needed, request it before the deadline and explain the concrete reason; never assume that an unanswered notice is harmless.

5. Handle attendance and statements carefully

For a summons, bring the requested records in an indexed form and confirm who is authorised to represent the business. Answer the question asked, distinguish facts from estimates and request time to verify a figure rather than speculating. Read the recorded statement line by line before signing.

6. Manage a search or seizure

Cooperate with lawful directions without obstructing officers. Ask for the written authorisation where applicable, an inventory and receipts, and a note of any sealed location or device. Record who took each item and when. Request copies or extracts where doing so will not prejudice the investigation, and arrange secure business continuity for essential systems.

7. Escalate high-risk allegations

Obtain specialist tax advice promptly when the notice alleges fraud, wilful misstatement, suppression, wrongful availment or utilisation of credit, an arrest-level offence, prosecution, or a large proposed demand. Early advice helps preserve privilege, coordinate statements and decide whether a voluntary payment, rectification or substantive defence is appropriate.

Choosing the right response by notice type

If the document says… Immediate focus Common mistake to avoid
ASMT-10, section 61 Reconcile each stated return discrepancy and answer in ASMT-11 or the channel specified. Sending a general explanation without tying it to the officer’s figures.
ASMT-12 Retain the acceptance communication with the filed return and supporting reconciliation. Treating acceptance of one explanation as clearance of unrelated periods or issues.
ASMT-13 to ASMT-18 Read the cited assessment section, deadline and factual basis; prepare the documents that section requires. Assuming every ASMT form is a scrutiny notice.
ADT-01, section 65 Organise books, invoices, returns, ITC and refund support; nominate a response team and track the audit timetable. Providing unindexed data that cannot be reconciled to the return.
ADT-02 Check each finding, submit the available response and prepare for any separate section 73, 74 or 74A proceeding. Assuming the findings document is itself the final demand order.
Section 70 summons Attend or arrange an authorised representative where permitted, bring the requested records and verify every statement. Ignoring the summons or answering from memory when records can establish the fact.
Section 67 authorisation Cooperate, secure an inventory and receipts, preserve copies and maintain a custody log. Deleting, moving or concealing records after officers arrive.

Records that make any GST proceeding easier

  • Filed returns and payment challans for every period in scope.
  • General ledger, trial balance, sales and purchase registers, and chart of accounts.
  • Tax invoices, debit and credit notes, delivery evidence, e-way bills and e-invoices.
  • Input-tax-credit eligibility files, supplier reconciliations and reversal calculations.
  • Exemption, deduction, rate and place-of-supply working papers.
  • Refund applications, sanction or rejection orders and supporting export or supply records.
  • Bank statements, payment reconciliations and inter-company or related-party agreements.
  • Accounting-system backups, electronic correspondence and an access log for relevant devices.
  • A notice register showing the section, form, due date, response, acknowledgement and open issue.

Common misconceptions

“An audit notice means the department has proved a short payment.”

An audit is a verification exercise. The officer may find no discrepancy, accept the explanation, or refer a supported discrepancy into the statutory determination route. Proof of a final liability comes from the applicable order, not from the existence of ADT-01.

“A scrutiny reply is the same as an assessment order.”

A reply to ASMT-10 addresses an identified discrepancy. Depending on the explanation and the statutory route, the matter may close, continue into another proceeding or result in a determination. Keep the reply and its evidence even when the immediate discrepancy appears resolved.

“Investigation powers are limited to paper invoices.”

Section 67 covers goods, books, documents and things useful to proceedings, including electronic devices in circumstances covered by the law. Section 70 separately supports compulsory production of documents and evidence through a summons.

“Every GST dispute can be solved by paying immediately.”

Payment may be appropriate for an admitted liability, but the consequences depend on the section, timing, interest, penalty and the allegation. A payment decision should be made after identifying the legal route and preserving the factual record, especially where fraud or suppression is alleged.

Bottom line for a business

Use the section and form to classify the proceeding before responding. Assessment answers “how much tax is legally due”; audit tests whether the registered person’s books and returns support the reported GST position; investigation gathers evidence when the department has recorded reasons to suspect evasion or another contravention. Respond with a dated, indexed reconciliation, preserve every relevant electronic and paper record, document what is inspected or seized, and obtain prompt professional advice when the matter moves beyond an ordinary discrepancy.
