Use a GST appeal when you say the order is wrong on its merits—law, facts, evidence, reasoning or the tax outcome. Consider rectification only for a narrow error that is apparent from the existing record, such as an obvious transcription or arithmetic mistake. Under the Central Goods and Services Tax (CGST) Act, an appeal under section 107 and rectification under section 161 have different decision-makers, deadlines and financial requirements. A rectification request is not a general substitute for an appeal, and you should not assume it pauses the appeal limitation period.
Before choosing, identify the issuing authority, the provision under which the order was made, the date and method of communication, the exact defect and any applicable State GST, Union territory or special-notification procedure. The following is a general procedural guide; the live portal instructions and the law applicable to the particular order should be checked before filing.

Appeal and rectification at a glance
| Question | Appeal under CGST Act section 107 | Rectification under CGST Act section 161 |
|---|---|---|
| What it addresses | Challenges to an adjudicating authority’s decision or order, including the legal interpretation, factual findings, evidence assessment, reasoning or substantive demand. | A confined correction of an error “apparent on the face of record” in a decision, order, notice, certificate or other document. |
| Who decides | The Appellate Authority prescribed for the relevant matter. | The authority that passed or issued the document. |
| Ordinary time limit | Three months from communication of the decision or order. A further period of up to one month may be allowed where sufficient cause for delay is shown. | The affected person should bring the error to the issuing authority’s notice within three months from issue. Rectification generally cannot be made after six months from issue, except for a purely clerical or arithmetical error arising from an accidental slip or omission. |
| Payment requirement | For the appeal described in section 107, pay admitted dues in full and 10% of the remaining disputed tax. Confirm the calculation and any order-specific amendment or notification. | Section 161 specifies no comparable appeal pre-deposit. |
| Typical filing route | FORM GST APL-01, with the order and supporting documents in accordance with current electronic or other directions. | An application or representation to the authority that issued the document, identifying the patent error and the record showing it. |
The distinction follows the statutory scope of the two provisions. Section 107 gives an appellate authority power to examine the challenged decision; section 161 gives the original authority a limited power to correct an error visible from the record itself. Neither provision creates a universal right to relitigate an order through whichever route is more convenient.
What an appeal can and cannot do
An appeal is the merits route
Choose section 107 when your complaint is that the adjudicating authority reached the wrong result or got there for the wrong reason. Examples include an incorrect interpretation of a GST provision, rejection of evidence, a finding that a supply occurred when it did not, an incorrect classification or valuation, denial of credit on disputed facts, or a demand calculated from a contested legal premise.

The Appellate Authority may make further inquiry and may confirm, modify or annul the decision. Its written order must state the points for determination, the decision on those points and the reasons. That structure is designed for a substantive challenge, not merely for correcting a typographical character.
Standing and forum still matter
Section 107 is available to a person aggrieved by the relevant decision or order. Confirm that the document is appealable under the provision cited, identify the prescribed Appellate Authority and check whether a subsequent appellate or revisional order has changed the available route. State GST and Union territory legislation generally operate alongside the CGST framework, but the exact authority and filing directions can differ.
What an appeal does not automatically provide
Filing an appeal is not permission to ignore the limitation period or the statutory payment condition. It also does not guarantee that every issue will be reheard without a properly stated ground and supporting material. The appeal should identify each disputed finding, the legal or evidentiary reason it is wrong and the relief requested.
Do these 3 things before closing this tab:

The error must be apparent from the record
Section 161 states that an authority that has passed or issued “any decision or order or notice or certificate or any other document” may rectify an error “which is apparent on the face of record.” In practical terms, the mistake should be discoverable from the document and the material already forming part of the record, without a fresh merits investigation or a choice between competing interpretations.
Typical candidates are a transposed registration number, a total that does not add up, a tax period copied incorrectly, or an accidental omission where the intended entry is unambiguous from the record. The provision is not a general power to reconsider whether the officer assessed the evidence correctly or applied the law correctly.
When an argument is probably too wide for rectification
If proving the point requires new evidence, cross-checking disputed books, reinterpreting an ambiguous notification, deciding between two plausible legal views or reweighing witness or documentary evidence, treat it as a merits dispute and protect the appeal route. The Act does not provide an exhaustive catalogue of “apparent” errors, so the classification depends on the actual order and record.
Natural justice applies to an adverse correction
Where a proposed rectification adversely affects a person, section 161 requires compliance with the principles of natural justice. The affected person should have an opportunity to address the proposed change before an adverse rectified document is issued.

How to choose the route: a decision process
- Identify the document. Record the issuing authority, statutory provision, order or document number, order date, issue date, communication date and method of communication. Note whether an appeal, review or revision has already produced a later order.
- Write the defect in one sentence. If the sentence says “the officer’s conclusion, interpretation, factual finding or treatment of evidence is wrong,” it points toward an appeal. If it says “the number, name, date or arithmetic is plainly wrong on the face of the record,” rectification may be appropriate.
- Locate the proof. For rectification, cite the exact page, table, annexure or electronic record that reveals the mistake. For an appeal, assemble the statutory provisions, documents and explanations needed to challenge the reasoning or outcome.
- Calculate both clocks. Section 107 ordinarily runs for three months from communication. Section 161 uses the issue date: notify the error within three months, with a general six-month outer period for the authority, subject to the clerical or arithmetical accidental-slip exception. Do not use the later rectification date as a substitute for calculating the appeal deadline.
- Plan the appeal payment. For the section 107 appeal covered by the cited text, pay admitted dues in full and 10% of the remaining disputed tax. Verify the amount, any current amendment or notification and the payment reference before submitting the appeal.
- Check the live procedure. Confirm the current GST portal workflow, jurisdictional directions, document format, prescribed authority and any State GST, Union territory or special-notification rule that applies to the order.
Section 107 appeal: filing and consequences
Limitation starts with communication
The ordinary period is three months from communication of the decision or order. The Appellate Authority may allow up to one additional month when sufficient cause for the delay is shown. Because the extra month is discretionary, calculate and act on the original three-month deadline rather than planning to seek condonation.
Keep evidence of when and how the order was communicated, such as the portal record, electronic message or acknowledged delivery. The communication date is not necessarily the date printed on the order, and confusing those dates can produce a defective limitation calculation.
Pre-deposit and recovery protection
Section 107(6), as described in the cited statutory text, requires payment in full of admitted dues plus 10% of the remaining disputed tax for the appeal described there. Section 107(7) provides that recovery of the balance is deemed to be stayed once that payment is made. Confirm whether a later amendment, notification, special category or order-specific cap changes the calculation before relying on it.
FORM GST APL-01 and supporting documents
The CBIC appeal rules describe filing the appeal to the Appellate Authority in FORM GST APL-01. Prepare the challenged order, payment proof, statement of facts, grounds of appeal, requested relief and documents supporting each ground. Follow the current portal instructions for uploading or submitting the certified order copy and annexures.

It also explains when the filing date is treated as the provisional acknowledgement date or a later document-submission date, and states that the appeal is treated as filed when the final acknowledgement bearing the appeal number is issued. Portal configuration and notified directions can change, so preserve every acknowledgement and verify the current workflow immediately before filing.
Build grounds that the Appellate Authority can decide
- Identify the precise finding or demand component challenged.
- Quote or reference the applicable statutory provision, notification or rule.
- Explain why the authority’s interpretation, factual finding or evidence treatment is unsustainable.
- Attach the record that supports the ground and distinguish any material the authority overlooked.
- State the exact relief sought, such as annulling a demand, modifying a quantification or remanding a defined issue.
Section 161 rectification: preparing a narrow request
Address the issuing authority
Send the request to the authority that passed or issued the decision, order, notice, certificate or other document. Identify the document and the statutory basis, then describe one error at a time. A request that simply repeats all the grounds of a rejected reply resembles an appeal and may not fit section 161.
Show the error without a merits rehearing
Use a short comparison: reproduce the incorrect entry, point to the correct entry in the existing record and explain why the correction follows mechanically. Include the relevant return, annexure, order paragraph or calculation already before the authority. Avoid introducing a new factual dispute that requires investigation.

Respect the issue-date windows
Bring the error to the authority’s notice within three months from issue. Rectification generally cannot be made after six months from issue. The six-month limit does not apply to a purely clerical or arithmetical error arising from an accidental slip or omission. Because the statutory language and the classification of an error are fact-sensitive, document when the request was made and why the exception, if claimed, fits the record.

A rectification request does not, on the cited provisions, create a general tolling or extension rule for the section 107 limitation period. If an appeal may be needed, calculate its communication-based deadline independently and obtain case-specific advice on filing both proceedings or sequencing them. Do not wait for a rectification decision if doing so would let the appeal period expire.
Deadlines and payments to put on one calendar
| Event | What to record | Why it matters |
|---|---|---|
| Order issued | Date printed or recorded as issue date | Starts the section 161 three-month notice period and the general six-month rectification period. |
| Order communicated | Date, method and proof of communication | Starts the ordinary three-month section 107 appeal period. |
| Appeal payment | Admitted dues and 10% of remaining disputed tax, with payment references | Section 107(6) payment condition and section 107(7) recovery-stay consequence. |
| Rectification request | Submission date, acknowledgement and cited record entry | Shows that the request was made within the applicable issue-date window. |
| APL-01 documents | Upload receipts, certified order copy and final acknowledgement number | Supports the filing date under the applicable appeal procedure. |
When both routes appear relevant
An order can contain an obvious arithmetic mistake and also raise a disputed legal issue. Treat those as separate questions rather than assuming one filing cures the other. A narrowly drafted section 161 request may ask the issuing authority to correct the patent mistake, while a section 107 appeal protects the challenge to the substantive findings. Whether both are procedurally available, and how they should be coordinated, depends on the order, the forum and the current rules.
The safe administrative approach is to preserve evidence of communication, calculate the appeal deadline immediately, prepare the statutory payment and obtain advice before the deadline. The absence of an express tolling rule in the cited ordinary provisions means a taxpayer should not rely on a pending rectification request to suspend or extend the appeal clock.
Special route for certain retrospective input-tax-credit demands
CBIC Circular 237/31/2024-GST describes a special procedure for specified demands involving input-tax credit affected by the retrospective changes in section 16(5) or section 16(6). It concerns certain orders confirming denial of credit under section 16(4), where the credit may become available under the newer provisions.

Fix: Reframe the substantive challenge as appeal grounds and reserve rectification for a record-visible mistake.
Counting from the wrong date
Problem: The taxpayer counts section 107 from the order date or section 161 from the communication date.
Fix: Maintain two entries: communication date for appeal limitation and issue date for rectification timing.
Assuming rectification extends appeal time
Problem: The taxpayer waits for the issuing authority’s response and misses the three-month appeal period.
Fix: Calculate and protect the appeal deadline independently; seek advice on parallel or coordinated filings.
Underpaying the appeal pre-deposit
Problem: The payment excludes admitted dues or uses the wrong disputed-tax base.

Worked examples
Example: appeal is the appropriate primary route
An adjudicating authority treats a transaction as taxable and rejects the taxpayer’s explanation of the underlying documents. The taxpayer says the classification rule was misapplied and that the evidence was misunderstood. Those are legal and factual merits grounds. The taxpayer should calculate three months from communication, make the section 107 payment and file the appeal with a structured statement of facts and grounds.
Example: rectification may fit
An order’s summary correctly records the tax period as April, but the operative table accidentally carries “May” into one line and the return and annexure already in the record show April throughout. If the mistake is mechanically demonstrable from the existing record, a focused section 161 request identifying the line and the supporting page may be appropriate.
Example: both issues in one order
An order contains a total that is visibly added incorrectly and also rejects a disputed input-tax-credit claim on an interpretation of the law. The arithmetic issue can be presented separately to the issuing authority; the interpretation and credit dispute require an appeal. The two limitation calculations must still be tracked independently.
Final pre-filing checklist
- Have you identified the issuing authority, statutory provision and correct appellate forum?
- Have you recorded both the issue date and the communication date with proof?
- Is the alleged error visible from the existing record, or does it require a merits review?
- Have you calculated the section 107 admitted-dues and disputed-tax payment?
- Have you prepared the order, grounds, evidence and requested relief?
- Have you checked the current APL-01, document-submission and acknowledgement requirements?
- Have you checked State GST, Union territory, notification and order-specific directions?
- If relying on the retrospective ITC procedure, does the order satisfy its exact conditions?
- Have you protected the appeal deadline without assuming that rectification pauses it?
What to verify before filing
GST procedure changes through amendments, notifications, rules, portal configuration and jurisdiction-specific directions. Confirm the governing version on the filing date, the authority empowered to hear the matter, the current form and document requirements, the applicable payment calculation and any special procedure. This guide explains the statutory distinction; it does not determine limitation or the correct remedy for a particular order.
