A GST adjudication order is the original decision made by the proper officer after a show-cause notice and hearing. A GST appeal order is the Appellate Authority’s written review of that decision under section 107 of the CGST Act. The first order creates the dispute; the second examines whether that order should be confirmed, modified or annulled.
The distinction matters because the two orders have different issuing authorities, deadlines, payment consequences, records, and next steps. Treating an adjudication order as if it were an appeal order can cause a missed limitation date or an incorrectly calculated pre-deposit.

What is a GST adjudication order?
An adjudication order is the determination issued by the officer who originally examined the tax issue. In practical terms, it is the first reasoned decision after the department has issued a show-cause notice and given the person chargeable with tax, interest or penalty an opportunity to respond.
The adjudicating or proper officer decides the matter within the framework of the notice. The order should explain the relevant facts, the basis for the decision and the amount, if any, that is confirmed. It is not an internal preliminary note: it is the order that a taxpayer may challenge in the first statutory appeal.

How the adjudication stage works
- Show-cause notice: The department sets out the proposed tax, interest, penalty or other adverse action and the grounds relied on.
- Written response: The taxpayer can submit explanations, documents, reconciliations and legal objections within the time allowed in the notice.
- Hearing: Section 75(4) requires a hearing when the person chargeable with tax or penalty requests one in writing or when an adverse decision is contemplated. The hearing opportunity should be preserved in the record.
- Decision: The officer considers the notice, the response, the hearing and the available evidence, then issues the adjudication order.
Limits on what the officer may confirm
The adjudication order cannot lawfully confirm more tax or a different ground than the show-cause notice supports. Compare each confirmed amount and every reason in the order with the notice. A mismatch may be an important ground of appeal, especially where the taxpayer had no opportunity to answer the new basis.
What is a GST appeal order?
A GST appeal order is the written decision of the Appellate Authority on a challenge to an adjudication order. Section 107 gives a person aggrieved by an order passed by an adjudicating authority the right to appeal to the prescribed Appellate Authority.
The Appellate Authority is not issuing the original demand. It reviews the challenged decision, the grounds of appeal, the record from adjudication and the submissions made in the appeal. Its order must be in writing and must state the points for determination, the decision on those points and the reasons for that decision.

- Confirm: The Appellate Authority leaves the appealed order in place.
- Modify: It changes the order, such as by altering the amount or another part of the decision within its statutory power.
- Annul: It sets aside the appealed order.
The operative portion should be read together with the reasoning. A reference to a taxpayer’s submission is not the same as allowing that ground; the result is determined by the decision on each point and the final directions.
Adjudication order vs appeal order: side-by-side comparison
| Comparison point | Adjudication order | Appeal order |
|---|---|---|
| Issuing authority | The proper or adjudicating officer who decides the original tax proceeding. | The Appellate Authority hearing a challenge under section 107. |
| Procedural stage | First determination after show-cause notice, response and hearing opportunity. | Review stage after an aggrieved person files an appeal against the adjudication order. |
| Primary record | Show-cause notice, taxpayer’s reply, hearing record and material considered by the officer. | Appeal memorandum, challenged order, adjudication record and submissions before the Appellate Authority. |
| Notice-ground constraint | The officer must state relevant facts and the basis of decision and cannot confirm more tax or a different ground than the notice. | The authority decides the points raised and recorded for determination in the appeal and must give reasons. |
| Taxpayer deadline | There is no “appeal deadline” for issuing the order itself; the critical deadline begins when the order is communicated. | A first appeal is generally due within three months from communication of the adjudication order, with a possible further one-month extension for sufficient cause. |
| Payment before appeal | The order may create the amount that is admitted or disputed and may trigger payment or recovery procedures. | Section 107(6) requires payment of admitted dues and the statutory disputed-tax pre-deposit for admission of the appeal. |
| Recovery workflow | The original demand is the amount challenged or accepted in the appeal. | According to the GST Portal FAQ, after an appeal is admitted, the balance disputed amount is flagged as non-recoverable in the portal workflow. |
| Available outcome | Original determination of liability, interest or penalty within the notice and hearing framework. | Confirm, modify or annul the appealed order, with points for determination, decision and reasons in writing. |
| Next forum | First appeal to the prescribed Appellate Authority. | Further appeal to the GST Appellate Tribunal is provided for against an order under section 107 or section 108, subject to the statutory and notified timing framework. |
How much time do you have to appeal a GST adjudication order?
Section 107(1) states that a person aggrieved by a decision or order of an adjudicating authority may appeal within three months from the date on which that decision or order is communicated to the person. The communication date, rather than merely the date printed on the order, is therefore a key limitation entry.

The Appellate Authority may allow a further period of one month when it is satisfied that sufficient cause prevented filing within the initial three months. This is a limited condonable period, not an automatic extra month. A late filer should document the specific reason for delay and the dates on which the impediment existed.
How to calculate and protect the deadline
- Record the date and method by which the order was communicated.
- Count the three-month period immediately and enter an internal filing date several days earlier.
- Keep evidence of the communication, such as the portal record or other official delivery record.
- If filing will be late, prepare the sufficient-cause explanation and supporting documents with the appeal rather than assuming the extension will be granted.
Do not wait for a later recovery notice to start counting. The appeal period is tied to communication of the adjudication decision.

What pre-deposit is needed for a GST first appeal?
Section 107(6) requires two categories of payment before the first appeal is admitted: the amount of tax, interest or other dues that the appellant admits, and the statutory pre-deposit relating to the disputed tax. The exact calculation must be made using the version of the CGST Act, applicable rules and current GST Portal instructions in force when the appeal is filed.
No single universal percentage or monetary ceiling for every case is established. Do not substitute a remembered figure from an older article for the amount shown by the current law and portal workflow. Separate the admitted portion from the genuinely disputed tax and retain the payment challans.
Why the distinction between admitted and disputed amounts matters
- Admitted dues: Amounts the taxpayer accepts must be paid as required for the appeal process.
- Disputed tax: The statutory pre-deposit is calculated on the disputed tax component under the applicable provision.
- Interest and penalty: Check how the current law and portal treat each component; do not assume that every line in the order is included in the same base.
- Proof: Save challans, electronic payment references and the appeal acknowledgement.
What happens to recovery after the appeal is admitted?
The GST Portal FAQ states that once the appeal is admitted, the balance disputed amount is flagged as non-recoverable in the portal workflow. That status is connected to the admitted appeal and the required payments; it should not be read as cancellation of the demand or as a decision that the taxpayer has won.

Keep the admission acknowledgement and payment evidence together with the order. If the portal continues to show a disputed balance as recoverable after admission, compare the acknowledgement, payment entries and order details before raising a technical or administrative query.

A strong first appeal starts with a line-by-line comparison, not a general statement that the order is unfair. Build a working file containing:
- The complete adjudication order, including annexures and computation sheets.
- The show-cause notice and every relied-on document referred to in it.
- The taxpayer’s written reply, supporting invoices, returns, reconciliations and legal submissions.
- Proof that a requested hearing was sought and any hearing notice, attendance record or written submissions filed at the hearing.
- Portal communication evidence showing when the order was delivered.
- A calculation separating admitted dues, disputed tax and other components.
Questions to ask during the comparison
- Does every amount in the order correspond to a proposal in the show-cause notice?
- Does the order rely on a new factual or legal ground that was never put to the taxpayer?
- Did the officer address the material documents and explanations submitted?
- Was a written hearing request made, and if so, is the opportunity reflected in the record?
- Are the tax period, registration details, return figures and arithmetic correct?
- Which findings are accepted, and which findings are challenged with evidence?
Step-by-step: filing the first GST appeal
- Identify the decision: Confirm that the document is an adjudication order, identify the statutory section, note the issuing authority and record the communication date.
- Map the grounds: Create a schedule matching each demand or finding to the show-cause notice, your response and the evidence that contradicts it.
- Set the limitation date: Calendar the three-month period under section 107 and assess immediately whether a sufficient-cause request could be needed for a delay of up to one additional month.
- Compute the payment: Determine admitted dues and the required disputed-tax pre-deposit under the current Act and GST Portal instructions.
- Prepare the appeal: State the facts, grounds, relief requested and the documents relied on. Explain procedural defects, such as a notice-ground mismatch or failure to consider a material submission, separately from factual disputes.
- Pay and submit: Complete the prescribed GST Portal process, make the required payments and upload the order, grounds and supporting evidence in the requested format.
- Preserve proof: Download the acknowledgement, payment challans, uploaded files and any system-generated reference number.
- Monitor the proceeding: Respond to deficiency messages, hearing notices or requests for clarification and retain proof of every submission.
How to read an appeal order
Start with the headings or paragraphs that identify the points for determination. Then read the findings and reasons attached to each point. Finally, locate the operative part: whether the original order is confirmed, modified or annulled, and what directions follow.
Check that the result actually disposes of each ground raised. A favourable discussion in the reasoning does not necessarily change the operative demand unless the final decision does so. Conversely, a modification may require a fresh computation rather than complete cancellation.
Immediate actions after receiving the appeal order
- Save the complete signed or electronically issued order and note its communication date.
- Recalculate the liability using the operative result, not the original adjudication figure.
- Check the portal ledger and recovery status against the order and prior payments.
- Identify whether any direction requires a separate compliance step.
- If the result is adverse, obtain advice promptly on the section 112 Tribunal route and the current notified filing date.
What is the next appeal after the Appellate Authority?
Section 112 provides for a further appeal to the GST Appellate Tribunal against an order under section 107 or section 108. The timing and procedural requirements are subject to the statutory and notified framework applicable when the appeal is filed.

Do not assume that the first-appeal deadline, payment structure or filing form automatically carries over to the Tribunal stage. Treat the appeal order’s communication date as a new critical date, verify the current notification and rules, and obtain the Tribunal-specific payment and filing requirements before the deadline.
Common mistakes and how to avoid them
Counting from the order date instead of communication
The section 107 period runs from communication of the decision or order. Preserve the official delivery record and calculate from that date.
Using the wrong document as the appeal target
Ensure the appeal identifies the adjudication order being challenged, its date, issuing authority and statutory provision. A later summary, recovery message or portal entry is not necessarily the order that must be appealed.
Ignoring notice-ground limits
Compare the notice and order side by side. If the officer confirmed more tax or relied on a different ground, identify the discrepancy precisely and explain why the taxpayer lacked an opportunity to answer it.

Best Value
Paying without separating admitted and disputed amounts
Prepare a component-wise schedule before making payment. The appeal admission requirements distinguish admitted dues from the statutory disputed-tax pre-deposit.
Assuming admission decides the merits
Admission and the portal’s non-recoverable flag for the balance disputed amount are procedural consequences. They do not establish that the appeal will succeed.
Missing the Tribunal window
After an adverse appeal order, calendar the communication date immediately and verify the current section 112 procedure instead of waiting for a recovery reminder.
Practical checklist
- Order type and statutory section identified.
- Issuing authority confirmed.
- Communication date evidenced.
- Three-month section 107 deadline entered in the calendar.
- Sufficient-cause material prepared if the filing may be late.
- Notice, reply, hearing record and relied-on documents assembled.
- Order-to-notice comparison completed.
- Admitted dues and disputed-tax pre-deposit calculated under current instructions.
- Payment challans and portal acknowledgement retained.
- Appeal order reviewed for points, reasons and operative result.
- Section 112 Tribunal option assessed promptly if the result is adverse.
What the available evidence does not establish
No directly relevant published statistic in official material establishes a GST appeal success rate or a reliable proportion of orders confirmed, modified or annulled. Decisions depend on the notice, evidence, statutory provisions and reasoning in the individual case. A percentage quoted without a defined jurisdiction, period and dataset should not be used to predict the result of a particular appeal.
