Received a GST demand? The usual path is to answer the department before adjudication, then file a first appeal in FORM GST APL-01 under section 107 of the Central Goods and Services Tax (CGST) Act if a final order is adverse. The general limitation is three months from communication of the order. A further statutory appeal to the GST Appellate Tribunal uses APL-05 and generally also has a three-month limit. The exact forum, deadline, pre-deposit and recovery position depend on the order, tax period, applicable State GST law and current amendments.
This guide explains the process for Indian businesses and finance teams. It is general information, not a substitute for advice on a specific notice or order. Check the live GST portal and the law in force on the date you file.

What GST adjudication and an appeal mean
GST adjudication is the department’s formal decision-making process on a tax issue. A proper officer examines a proceeding and issues an adjudication order determining matters such as tax, interest and penalty. A person aggrieved by that decision can generally use the first-appeal mechanism in section 107 of the CGST Act. The Act is available from the Central Board of Indirect Taxes and Customs (CBIC).

First, identify exactly what you received
Before preparing a response or appeal, make a one-page record of the communication. These details determine what you can do next:
- the issuing authority and designation;
- the statutory provision cited;
- the tax period and financial year;
- the date on the order and the date it was communicated or served;
- tax, interest, penalty and any other amount shown separately;
- the amount you admit, if any, and the amount you dispute;
- the deadline stated in the communication; and
- the portal reference number and every annexure.
Keep the notice, order and annexures in their original form. Assemble the relevant returns, electronic liability ledger extracts, invoices, credit notes, purchase and sales registers, reconciliations, contracts, payment evidence, correspondence and proof of service. This is a practical preparation checklist rather than a universal evidentiary list prescribed for every case.
How do I appeal a GST demand order?
Step 1: Confirm that an appealable order exists
Separate the pre-adjudication stage from the appeal stage. If you have only received a show-cause notice, the immediate task is usually to submit a reply and attend any hearing offered in the notice. The first appeal described in the official portal instructions is for an order that has been passed. Do not treat a notice proposing a demand as if it were already an appealable order.
Step 2: Read the order for its reasoning
Mark each issue the officer decided, the facts relied on, the legal provisions applied, the calculation of tax, interest and penalty, and any amount treated as admitted. Note whether the order addresses your written reply and documents. The Appellate Authority’s own disposal order must be written and must state the points for determination, the decision on those points and the reasons. Section 107(12) expresses the rule this way: “The order of the Appellate Authority disposing of the appeal shall be in writing and shall state the points for determination, the decision thereon and the reasons for such decision.”
Step 3: Calculate the limitation period
Section 107 generally gives the aggrieved person three months from communication of the decision or order to file the first appeal. The communication date, the manner of service, statutory exclusions and any request to condone delay can affect the calculation. Record evidence of when and how the order reached you, and have a GST professional verify the limitation computation rather than counting from the date printed on the order automatically.
Step 4: Use the GST portal’s APL-01 route
The portal FAQ describes this navigation for a demand-order appeal:

Step 5: Address the pre-deposit before relying on filing
Section 107 contains a pre-deposit condition. In broad terms, an appellant must pay the admitted amount in full and the prescribed percentage of the remaining disputed tax, subject to statutory caps and other provisions that may apply. The operative percentage, cap, treatment of different components and any amendment in force must be checked against the current notified law for your order. Do not use an old consolidated-text percentage without checking its effective date.
The 55th GST Council press release records a recommendation to reduce the first-appeal pre-deposit to 10% for orders involving only penalty. A council recommendation is not, by itself, proof that an amendment has been enacted and commenced. Verify the relevant notification and the portal’s calculation before paying. The press release is available at CBIC/GST Council 55th meeting press release.
Step 6: Keep proof that the filing is complete
Retain the final submitted form, acknowledgement, payment challans, attachments, digital signature or electronic verification record, and any defect or deficiency communication. The Appeal Rules describe supporting documents and acknowledgement procedures, but a draft, saved application or provisional portal message does not necessarily establish that a complete appeal was validly filed. Read the acknowledgement wording and respond to any portal or departmental deficiency notice promptly. The rules are published at CBIC Appeal Rules.
What happens after the first appeal is filed?
Admission and recovery flags
The official portal FAQ says that, when a taxpayer’s appeal is admitted, the portal flags the balance disputed amount as non-recoverable. That is a description of the portal’s functionality in the FAQ’s stated context; it is not a blanket statement that every amount becomes immune from recovery in every proceeding. Continue to monitor the electronic liability ledger, notices and any separate recovery communication.

Hearing and written decision
The Appellate Authority may confirm, modify or annul the appealed decision, subject to the Act’s safeguards and notice requirements. A change that would adversely affect the appellant is not supposed to be made without the procedural protections required by the statute. The final disposal order must state the issues, conclusions and reasons in writing.

The CGST Act says appeals should, where possible, be heard and decided within one year. This is an administrative objective qualified by “where possible,” not a guaranteed deadline by which every appeal will be decided. Keep updating your address, authorised representative details and contact information so hearing notices are not missed.
How much must I pay before filing?
The answer has two parts: the amount you admit and the disputed-tax pre-deposit prescribed by the law applicable on the filing date. The admitted amount is generally payable in full for a section 107 appeal. The additional disputed-tax component is calculated under the statutory percentage and cap then in force; interest and penalty treatment can differ from the tax calculation.
Because the CGST Act has been amended and proposals may have different commencement dates, obtain the current text and notification before making a payment. Ask the person handling the appeal to document:
- how the admitted amount was identified;
- which part of the order is disputed tax rather than interest or penalty;
- the percentage and statutory ceiling applied;
- the effective date of the provision used; and
- the challan and ledger entry proving payment.
If the order contains only a penalty, check specifically whether a newly commenced provision applies; do not assume the 10% figure mentioned in the 55th Council press release is already operative.
What if the GST Appellate Authority rejects my appeal?
A rejection or adverse disposal order is not necessarily the end of the statutory route. Section 112 provides for a further appeal to the GST Appellate Tribunal, generally within three months from communication of the appealable order. The prescribed form is GST APL-05. The statute and rules address limitation, pre-deposit, cross-objections and related procedure.
Before filing, verify the current Tribunal rules, notified forms, bench jurisdiction, electronic or physical filing method, fee and pre-deposit requirements for the relevant date. Operational details such as which benches are functioning and the exact local filing arrangements can change; do not assume a particular bench is accepting filings without a current official notice. The CBIC rules page remains a starting point for the statutory forms and rules, but location-specific instructions should be checked separately.

Build the Tribunal record from the first appeal
Preserve the original adjudication order, APL-01, statement of facts, grounds, written submissions, hearing records, evidence of service, pre-deposit proof and the Appellate Authority’s reasoned order. Identify whether the proposed Tribunal grounds challenge jurisdiction, limitation, classification, valuation, input-tax credit, evidence, natural justice, computation or the interpretation of a specific provision. A Tribunal appeal is not a chance to ignore the first order’s reasoning; it should show precisely why the appellate decision is legally or factually wrong.
Choosing the right procedural route
| Situation | Likely route | What to verify |
|---|---|---|
| Only a show-cause notice or pre-order communication | Reply to the notice and participate in the adjudication process | Reply deadline, hearing date, authority, proposed section and supporting evidence |
| Final adjudication order, first appeal available | Section 107 appeal in APL-01 to the Appellate Authority | Communication date, three-month limitation, admitted amount, current pre-deposit and portal acknowledgement |
| Adverse appealable order from the Appellate Authority | Section 112 appeal in APL-05 to the GST Appellate Tribunal | Three-month limitation, Tribunal jurisdiction, current bench and filing arrangements, pre-deposit and cross-objection rules |
| Older section 73 demand for FY 2017-18, 2018-19 or 2019-20 | Check whether the transitional section 128A conditions could have applied | Whether the statutory conditions were met and whether the historical payment deadline has passed |
| Clerical or apparent error in an order | Consider the specific rectification or correction mechanism available under the applicable provision | Scope, time limit and whether correction is a substitute for an appeal |
This table is a decision aid, not a determination of the remedy in an individual case. State GST legislation, the type of tax, the issuing authority and later amendments can change the route.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Special historical relief under section 128A
Section 128A created a conditional waiver route for specified section 73 demands relating to financial years 2017-18, 2018-19 and 2019-20. CBIC Circular No. 238/32/2024-GST explains implementation from 1 November 2024 and the procedure and forms under Rule 164. It identified 31 March 2025 as the notified date by which tax had to be paid to seek the stated waiver of interest and penalty.
That date had elapsed by October 2026. Section 128A should therefore be treated as a time-limited historical measure, not an open route for new claims. Anyone examining an old demand should read the circular and the current statutory text, check whether a later official extension or order exists, and obtain professional advice before assuming eligibility. The circular is available at CBIC Circular No. 238/32/2024-GST.
Documents and controls that prevent avoidable mistakes
Create a limitation file
- Save the order and every annexure exactly as received.
- Record the portal download date, email date, physical delivery date and any service reference.
- Calculate the three-month period independently and have a second person review it.
- Set internal reminders well before the legal deadline.
Create an issue-and-amount schedule
- List each paragraph of the order and the corresponding tax period.
- Separate tax, interest, penalty and any other fee.
- Mark each amount as admitted, partly disputed or fully disputed.
- Link every factual assertion to an invoice, return, ledger, contract or correspondence record.
Control the portal submission
- Use consistent file names and retain the exact uploaded versions.
- Check that the authorised signatory or representative is valid for the taxpayer.
- Confirm that payment entries appear in the correct ledger before submission.
- Download the final acknowledgement instead of relying on a browser confirmation screen.
Common failure points and practical fixes
Filing against a notice instead of an order
Problem: The business selects the appeal route while the matter is still at the show-cause stage. Fix: Reply to the notice, attend the offered hearing and wait for the appealable order unless a different statutory remedy clearly applies.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesCounting from the wrong date
Problem: The team counts three months from the order’s signing date, an internal email or a later download. Fix: Preserve service evidence and have the limitation date calculated under the applicable statute and facts.

- Transfer Files in Seconds: Move files to and from your laptop at speeds of up to 5 Gbps via the USB-C and USB-A data ports. Note: The USB C 5Gbps Data port does not support video output.
- HD Display: Connect to the HDMI port to stream or mirror content to an external monitor in resolutions of up to 4K@30Hz. Note: The USB-C ports do not support video output.
- What You Get: Anker 332 USB-C Hub (5-in-1), welcome guide, our worry-free 18-month warranty, and friendly customer service.
Using an obsolete pre-deposit figure
Problem: A spreadsheet uses a percentage copied from an old article or older Act text. Fix: Check the current notified provision, commencement date, cap and the portal’s calculation; document the source used.
Assuming a saved draft is a filed appeal
Problem: The team has a draft number but no final acknowledgement. Fix: Confirm submission status, authentication, payment and acknowledgement, then respond to any deficiency message.
Ignoring State-specific or changing procedure
Problem: A central-law checklist is applied without checking the relevant State GST law, local instructions or a new amendment. Fix: Match the order to the governing legislation and verify live instructions on the filing date.
Keeping the law in front of the team
A current printed CGST Act and rules reference can be useful for reading sections 107 and 112 alongside the portal process. Treat any book as a convenience, not the final authority: check amendments, commencement notifications, circulars and the live GST portal before relying on a provision or deadline. The official CBIC Act and rules pages linked above are the appropriate baseline for that check.
When to obtain professional help
Escalate promptly to a GST practitioner or tax lawyer when the amount is material, limitation is close, the order raises several tax periods, records are incomplete, the authority has rejected evidence, the order changes the basis of demand, or a Tribunal appeal may be required. Give the adviser the complete limitation file, issue-and-amount schedule, payment proof and portal history. A professional can then assess the merits and the correct remedy under the law actually in force.
