What the lawsuit alleges
Hall & Lampros announced the class action on October 9, 2026. The case, Murkerson v. Flock Group, Inc., et al., is identified as case number 3:26-cv-00223-LMM in the U.S. District Court for the Northern District of Georgia, Newnan Division. The defendants named in the announcement are Flock Group, Inc. (doing business as Flock Safety), Coweta County, Sheriff Lenn Wood, and Coweta County sheriff’s deputies. Counsel describes the claims as involving civil rights, privacy, and alleged misuse of automated license-plate reader (ALPR) technology.

As described by plaintiff’s counsel and Now Georgia, the complaint alleges that deputies used the Flock camera network to surveil Murkerson’s vehicle while his earlier lawsuit was pending, without tying the surveillance to a specific investigation. It alleges that the activity was retaliation for that earlier case. These are allegations by the plaintiff, not findings about what happened or why.
Counsel says the earlier case concerned an alleged use of force and arrest in a gas-station parking lot over a seatbelt allegation. The firm says the criminal charges were dismissed in June 2023 and the civil-rights case was resolved in 2026. The available account does not provide the earlier case docket or explain how it was resolved.

What the reported audit figures mean
Plaintiff’s counsel says audit records attributed 197 days of camera surveillance of Murkerson’s vehicle to the period at issue. Counsel also reports five searches attributed to the Coweta County Sheriff’s Office, which it says spanned more than 6,000 agency camera networks nationwide. The underlying audit files are not available in the reviewed accounts, so the figures should be understood as counsel’s description of records, not independently verified measurements.
A search and a hot-list alert are not the same thing. A search is an inquiry into available plate-reader records; a hot list can cause a system to generate repeated alerts when a listed plate is detected. The law firm says the complaint alleges, “on information and belief,” that Murkerson’s vehicle may have been placed on a hot list. That qualified allegation does not establish that it happened.

Counsel says audit entries gave the search justifications as “info” and “37.” The complaint, as the firm describes it, challenges a platform that accepted such free-text entries rather than requiring a specific case number or investigation identifier. The records and platform settings have not been independently examined in the available reporting.
Alleged encounters and impact
The law firm also says the complaint describes deputies appearing near Murkerson’s home, commute, and business, as well as roadblocks. Counsel says Murkerson ended a business relationship with a neighboring police department because he felt unsafe. These descriptions of physical events and their impact are plaintiff-side allegations, not independently verified findings.

Attorney Christopher B. Hall, a co-founder and partner at Hall & Lampros, called the case a first of its kind in the firm’s October 9 announcement, saying: “We believe this case is the first to allege actual retaliatory animus intended to punish someone for advocating for his own constitutional rights by using Flock cameras to illegally surveil him, invade his privacy, and harass him in clear violation of the law.” That is counsel’s characterization of the lawsuit, not a court’s conclusion.

In a company post dated August 13, 2026, Flock CEO Garrett Langley announced several policy and product changes for law-enforcement customers. The company described them as safeguards and rollout commitments; the announcement does not establish which controls were active during the period alleged in Murkerson’s case.

Langley also wrote, “An alert is a lead, not a conclusion, which should be confirmed by an officer.” That expresses the vendor’s stated view of how its alerts should be used. Flock says customers own and control their data and describes security and access controls, but those company representations do not independently rule out the alleged misuse.
