Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Short answer: A union game studio has a collective-bargaining agreement (CBA) that can set enforceable wage floors, raises, overtime rules, benefits, safety standards, grievance procedures and, for some performers, limits on artificial-intelligence uses of their voice or likeness. A nonunion studio still must follow baseline labor law, but pay, benefits, workload, layoff terms and dispute procedures are mostly set by the employer and individual contracts.
The comparison depends on the bargaining unit, occupation, project and country. In the United States, the clearest current game example is the performer-focused SAG-AFTRA 2025 Interactive Media Agreement. It does not automatically cover programmers, artists, designers, producers or quality-assurance staff.

What “union” means in a game studio
A union is a workers’ organization that represents a defined bargaining unit. The unit might include voice actors on a project, performance-capture performers, or employees in several occupations at a particular employer. Once workers choose a union and it is recognized or certified, the employer and union must bargain in good faith over mandatory subjects such as wages, hours, vacation, insurance and safety. Neither side is required to agree to a particular proposal.
The resulting CBA is an enforceable contract. It can replace ad hoc individual negotiations with published rates, scheduled increases, eligibility rules and a process for challenging violations. A union does not make every studio job identical, and it does not guarantee that every demand will be won. Coverage is limited to the unit and contract that were negotiated.

What “nonunion” means
Nonunion means there is no recognized collective-bargaining representative for that job or unit. It does not mean workers have no rights. Most private-sector employees in the United States are protected by the National Labor Relations Act (NLRA), including workers at nonunion studios who act together to improve pay or working conditions. The protection can cover group discussions, petitions and other concerted activity.
In a nonunion workplace, however, there is no automatic CBA, union representative or contractual grievance system. Salary, bonuses, paid time off, insurance, remote-work rules, overtime practices and severance usually come from an offer letter, handbook, individual negotiation or employer policy, subject to applicable law.
Pay: does a union studio pay more?
There is no general, occupation-by-occupation wage study in the supplied evidence proving that unionized game developers earn more than nonunion developers. A CBA can improve the minimum and predictability of compensation, but the actual result depends on bargaining strength, the employer, the role and the market.

|---|---|---|
| Base rates | May include contractual minimums or rate schedules for the bargaining unit. | Usually set by the employer and individual negotiation; no union-created industry floor. |
| Raises | Can be scheduled in the CBA and enforceable if the employer signs the agreement. | Raises are discretionary unless promised in an individual contract or policy. |
| Overtime | Can specify premium rates, qualifying hours and approval procedures, in addition to statutory requirements. | Depends on law, classification and employer policy. |
| Bonuses and residuals | May be negotiated for the unit, but are not automatic in every agreement. | Usually governed by the offer letter or employer plan. |
| Current game-specific example | SAG-AFTRA’s 2025 Interactive Media Agreement gave covered performers a 15.17% compensation increase when ratified, followed by compounded 3% increases in November 2025, November 2026 and November 2027. | No comparable industry-wide figure was established for nonunion game employees. |
The SAG-AFTRA figures apply to covered performers working for named signatory companies under that agreement. They should not be presented as a raise for every person at a unionized game company or as a market-wide developer salary benchmark.
Why a contract can matter even when the headline salary is similar
Two employees can have the same nominal salary but different effective compensation. A CBA may guarantee overtime premiums, minimum call lengths, paid preparation time, pension or health contributions, and payment schedules. It can also prevent an employer from quietly changing a rate during a project. A nonunion employee might negotiate an equally favorable package, but the terms are normally individual rather than collectively enforceable.
Benefits: what can a union provide?
Benefits are mandatory bargaining subjects under U.S. labor law, but a union does not come with one universal benefits package. The CBA determines eligibility, contribution rates, waiting periods and whether the benefit is provided directly by the employer or through a union plan.

Health and retirement contributions
For the SAG-AFTRA performer agreement, AFTRA Retirement Fund health and retirement contributions rise from 16.5% to 17%, and then to 17.5% in October 2026. Those percentages describe the negotiated contribution structure for covered performers; they are not a standard for programmers or other game occupations.

A CBA can define vacation accrual, holidays, sick leave, parental leave, travel allowances, meal periods, rest breaks and reimbursement rules. It can also establish eligibility across projects or employers where the relevant union plan allows it. A nonunion studio may offer better benefits than a union studio, but the employee must rely on the written policy or contract and applicable statutory protections.
Before comparing offers, ask for the complete benefits summary. Check employee premiums, deductibles, retirement vesting, eligibility dates, paid-leave accrual, overtime treatment and what happens to coverage when a project ends. “Union” alone does not answer any of those questions.
Workplace protections and enforcement
The largest structural difference is who can enforce the terms. In a union studio, a worker can normally raise a CBA violation through a steward, union representative or grievance procedure. Many agreements end unresolved disputes in arbitration. The exact deadlines and remedies are contract-specific.
In a nonunion studio, an employee may complain to management, use an internal hotline, pursue a statutory claim or rely on an individual contract. There is no automatic representative with a duty to process a grievance. That can make a dispute more dependent on the worker’s time, money and willingness to act alone.
Rights that exist in both settings
The NLRA protects most private-sector employees who act together to improve terms and conditions of employment. The National Labor Relations Board states that employers may not interfere with, restrain or coerce employees exercising rights to organize, join or assist a labor organization, work together to improve employment conditions, or refrain from such activity.

Those protections apply in a nonunion workplace as well as during an organizing campaign. An employer generally may not threaten, punish, transfer, lay off or terminate workers because of protected organizing or concerted activity. The law has exceptions and jurisdictional limits, so a specific dispute may require advice from the NLRB, a labor attorney or a union.
Rights created only by a negotiated contract
Statutory protection against retaliation does not create a wage schedule, guaranteed severance, seniority system, staffing minimum, formal safety committee or arbitration procedure. Those are examples of rights a CBA may add. A contract can also give workers access to information and representation during a disciplinary meeting, depending on its language.
Layoffs and job security
Unionization does not prevent layoffs. The available evidence supports no claim that union studios have immunity from reductions in force. A game company can still cancel a project, close a team or become insolvent.
| Layoff question | Union studio | Nonunion studio |
|---|---|---|
| Advance notice | A CBA may require notice, consultation or a specific process. | Depends on law, the individual contract and company policy. |
| Selection criteria | May use seniority, role definitions or negotiated criteria, subject to the agreement. | Usually determined by management, subject to anti-discrimination and other laws. |
| Severance | Can be negotiated, but is not guaranteed merely because a studio is unionized. | Depends on the offer, policy or applicable law. |
| Challenge to a decision | A grievance may be available if the employer violated the CBA. | Usually requires an internal complaint, agency claim or individual legal action. |
The GDC 2025 survey illustrates why job security is a major concern, not proof of a union effect. Among more than 3,000 developers surveyed across 86 countries, 11% said they had been laid off in the previous 12 months and 41% said they had been affected by layoffs. The survey had a margin of error of plus or minus two percentage points and was weighted toward the United States, where 58% of respondents lived.
Crunch, hours and safety
A union can bargain over hours, overtime, rest periods, staffing, travel, safety procedures and penalties for violations. Enforcement depends on clear language and a functioning grievance process. A CBA may reduce an employer’s discretion, but it cannot guarantee that every project will have a normal schedule.
Crunch remains widespread in the industry. In the GDC 2025 survey, 51% of respondents reported working more than 50 hours in at least one week, while 28% worked more than 60 hours. Those figures describe developer experience internationally; they do not establish that unionization caused or would cure long hours.

What to look for in a contract
- Definition of the regular workweek and required rest periods.
- Overtime thresholds, premium rates and whether approval is required.
- Meal, travel and turnaround rules for recording or performance work.
- Safety authority, incident reporting and the right to stop unsafe work.
- Consequences when the employer violates hours or safety provisions.
Nonunion employees remain protected by wage-and-hour, health-and-safety and anti-retaliation laws that apply to their classification and location. A contract can add protections, but it cannot lawfully waive statutory minimums.

Artificial intelligence, voice and likeness protections
The 2025 SAG-AFTRA Interactive Media Agreement is especially significant because it addresses digital replicas. Ratified on July 9, 2025, by 95.04% of voting members, it took effect immediately for covered performers working for signatory companies.
The agreement adds consent, disclosure, usage-report and safety provisions concerning artificial-intelligence digital replicas. In practical terms, a covered performer can receive contractual information about proposed digital-replica uses, consent requirements and records of use. The agreement also includes strike-related protections established through bargaining.
These protections are role- and contract-specific. They should not be generalized to a programmer’s code, an artist’s portfolio, a designer’s ideas or a QA tester’s identity. For nonunion workers, AI and likeness rights generally come from the individual employment contract, a project release, employer policy or another applicable law. Read the language covering training, cloning, reuse, sublicensing, publicity and post-termination use before signing.

Coverage is often narrower than the word “unionized” suggests. A studio may have a union agreement for performers while its engineering, art, design, production and QA employees remain nonunion. A project may be a signatory to one agreement while another project from the same company is not.

Best Value
- Which union represents the workers?
- What occupations and job titles are in the bargaining unit?
- Which employer, subsidiary or production entity signed the agreement?
- Does the agreement cover this project, sequel, localization or downloadable content?
- What are the contract’s effective and expiration dates?
- Are freelancers, temporary workers and contractors included or excluded?
For programmers, artists, designers, production staff and QA testers, do not assume SAG-AFTRA coverage. Verify recognition status and the actual CBA with the studio or union.
Dues, fees and what workers trade for collective representation
Union representation usually involves dues, although the amount, timing and legal treatment vary by union, contract and state. Some jurisdictions have right-to-work rules that affect whether nonmembers can be required to pay certain fees. Workers should obtain the union’s current dues schedule and understand initiation fees, recurring dues, strike assessments and eligibility rules before voting or accepting coverage.
The trade-off is not simply “dues versus free representation.” A union can provide bargaining leverage, a published contract, representatives and a grievance process. In exchange, individual workers may have less freedom to negotiate terms that conflict with the CBA, and changes may require collective bargaining rather than an immediate personal request. A strong individual negotiator may prefer flexibility; a worker facing opaque pay, unpredictable hours or weak dispute procedures may value enforceable group standards more.

- Discuss shared workplace concerns. Workers may lawfully act together around pay, scheduling, safety or staffing, including in a nonunion studio.
- Identify the proposed bargaining unit. The group defines which employees share a community of interest and which roles are excluded by law or agreement.
- Seek recognition or hold an election. The employer may voluntarily recognize the union, or workers may pursue an NLRB election where the law applies.
- Bargain the first CBA. The parties exchange proposals on wages, hours, benefits, safety, discipline, layoffs and other mandatory subjects.
- Ratify and administer the agreement. Once approved, the CBA sets the rules for its term. Workers use the grievance process when they believe the employer violated it.
Bargaining can take time, and the law requires good-faith meetings rather than a guaranteed settlement. Until a first agreement is reached, organizing does not automatically create new wage rates or benefits.
How much unionization do game workers want?
In the GDC 2025 survey, 58% of respondents said game-industry workers should unionize, 10% said they should not, and 31% answered “maybe” or “do not know.” The survey included respondents from the United States, United Kingdom, Canada, Australia and other countries, so the result is an industry snapshot rather than a vote at any particular studio.
The split reflects the real decision: collective leverage may improve enforceability, while dues, bargaining limits and the uncertainty of negotiations are genuine costs. Neither a pro-union nor anti-union slogan can substitute for reading the proposed unit and contract.
A practical checklist for comparing a union and nonunion offer
If the job is union-covered
- Request the complete CBA and current rate sheet.
- Confirm that your title, project and employer entity are in the bargaining unit.
- Calculate base pay plus employer health, retirement, overtime and other contributions.
- Read layoff, severance, seniority, discipline and arbitration clauses.
- Check AI, voice, likeness, publicity and post-project usage language.
- Ask the union how dues, assessments, eligibility gaps and disputes are handled.
If the job is nonunion
- Get salary, bonus, equity, overtime classification and review timing in writing.
- Verify insurance premiums, deductibles, retirement matching, leave and vesting dates.
- Ask how crunch is approved, paid and recorded, and who can raise safety concerns.
- Read termination, notice, severance, confidentiality, invention-assignment and AI clauses.
- Learn which complaints go to HR, an ethics channel or a government agency.
- Remember that protected concerted activity can exist even without a union.
Bottom line for developers and performers
Choose based on the actual contract, not the label on the studio. A union CBA can turn promises about pay, benefits, hours, safety, layoffs and digital likeness into enforceable group rights, but it cannot guarantee high salaries, prevent layoffs or eliminate crunch. Nonunion employment can offer more individual flexibility and sometimes excellent benefits, yet the worker usually carries more responsibility for negotiating and enforcing the terms.
For performers, the 2025 SAG-AFTRA Interactive Media Agreement demonstrates what a modern game-specific contract can deliver: immediate 15.17% compensation growth, three later compounded 3% increases, higher health and retirement contributions and AI-related consent and disclosure rules. For every other occupation, verify the bargaining unit and agreement before applying those figures. In the United States, union and nonunion workers both retain core NLRA protections, but only a negotiated CBA supplies collective representation and the additional contractual guarantees written into it.
