An advocacy group may educate workers, build solidarity, run public campaigns, or help employees organize, but its name alone does not give it authority to bargain or sign a binding labor contract.
The practical difference depends on the organization’s governing structure, who it represents, whether workers have formed a legally recognized bargaining unit, and which country’s labor rules apply. A grassroots advocacy group can help create a union, and a union can campaign publicly; the categories overlap in activity but not necessarily in legal power.

What each term means
Game-studio union
A union is a worker-controlled organization whose central labor role is collective representation. The Communications Workers of America (CWA) describes it as “a group of workers who organized together for representation and collective bargaining rights.” Workers generally choose representatives, establish membership and governance rules, and act together in negotiations with an employer.

In the United States, a successful organizing process can create a duty for the employer to bargain with the workers’ representative under applicable law. A negotiated agreement that workers and the employer approve becomes binding for the covered unit. The exact recognition, election, certification, bargaining and enforcement steps vary by jurisdiction, employer type and facts. Canadian provinces and federal workplaces use different statutes and procedures, and a union’s rights in one country should not be assumed to apply identically in another.

Employee advocacy group
“Employee advocacy group” is descriptive rather than a single legal category. It can refer to an informal group inside a studio, a nonprofit or campaign network, a professional association, a worker center, or a movement that supports organizing across several employers. Such a group might publish research, run a harassment or pay-transparency campaign, provide legal referrals, collect worker testimony, or help employees plan a union drive.
The label does not answer the questions that determine bargaining power: Is the group incorporated? Who can join? Does it have elected worker officers? Is it affiliated with a labor union? Has a defined group of employees selected it as their representative? Has an employer recognized it or has a labor authority certified it? Without those facts, “advocacy group” says what people are trying to do, not what the organization is legally entitled to do.
Union versus advocacy group: the key differences
| Comparison point | Employee advocacy group | Game-studio union |
|---|---|---|
| Primary purpose | Education, solidarity, public campaigns, mutual support or organizing assistance. Some groups focus on a single issue; others work across the industry. | Collective representation of workers and negotiation of employment terms, alongside advocacy and member services. |
| Who may participate | Rules range from an open supporter network to a group limited to workers in a particular occupation, studio or region. The name does not establish eligibility. | Membership and voting rights are set by the union’s constitution and applicable law. A bargaining unit normally consists of employees sharing an appropriate community of interest. |
| Union affiliation | May be independent, union-supported, or a project that later affiliates with a union. Affiliation must be verified rather than inferred. | Is itself a labor organization or operates as a local, council or other unit of one. The precise legal form differs by union and jurisdiction. |
| Bargaining-unit status | Usually does not represent a legally recognized bargaining unit merely because workers participate in its campaigns. | May represent a certified or voluntarily recognized unit at a particular employer. Industry-wide membership does not automatically create a studio-level bargaining unit. |
| Contract authority | Can propose changes or negotiate informally if an employer agrees, but the label alone creates no right to compel bargaining or make a binding collective agreement. | Once recognized under the relevant process, can bargain for a collective agreement covering the represented workers. The agreement’s scope and enforcement depend on its text and governing law. |
| Geographic and occupational scope | Could be local, national, international, cross-company or limited to a role such as performers, artists or programmers. | May cover one studio, several employers, a craft, or a broad industry membership program. Scope must be read from the organization’s rules and recognition documents. |
| Legal framework | No single labor-law status applies to every advocacy group. | Labor-relations statutes, recognition rules, elections, certification and bargaining obligations apply where the organization acts as a union. |
These distinctions are not a claim that advocacy is less effective. Public pressure and worker education can change policies before a union exists, and campaigns can make later organizing possible. They simply prevent a reader from treating every worker-led organization as if it already had the legal authority of a bargaining representative.
Can an employee advocacy group negotiate with management?
It can ask, propose and sometimes reach a voluntary agreement, but “advocacy group” by itself does not compel management to bargain. An employer may meet with a staff coalition, sign a memorandum with a nonprofit, or adopt a policy after a public campaign. Those arrangements can be useful, yet they are not automatically collective bargaining contracts and may not carry the enforcement rights of a union agreement.
A group has a stronger claim to negotiate as workers’ representative when the workers have selected it through a recognized process and the organization is authorized under the applicable labor law. Check whether the employer has formally recognized the group, whether a labor board or other authority certified it, and which employees are covered. A union can also negotiate with management voluntarily before certification, but the parties should state whether the result is intended to be a binding collective agreement and who may enforce it.

Questions to ask before relying on a deal
- Who signed the document: the employer and a certified union, an employee committee, or an outside advocacy organization?
- Which workers and locations are covered?
- Does the document contain enforceable grievance, arbitration, term, renewal and enforcement provisions?
- Can workers vote to ratify, amend or reject it?
- What law governs disputes, and where can a worker file a complaint?
How game-worker organizations can evolve from advocacy to union representation
Worker organizing often develops in stages. Employees may begin with a private chat, a public campaign or a mutual-aid network. They can then create membership rules, collect authorization cards, affiliate with an established union, seek voluntary recognition or pursue an election. The path is not automatic: an advocacy network may remain an advocacy network, while a union may emerge from it or operate alongside it.
Game Workers Unite and the CODE-CWA connection
CWA’s March 20, 2025 announcement described Game Workers Unite as part of the grassroots mobilization that helped lead to CODE-CWA and later to United Videogame Workers-CWA. That history illustrates a relationship, not an identity. A grassroots group can supply education, community and organizing experience without being the same legal entity as the union that eventually represents workers.
CWA also reported that CODE-CWA had helped more than 6,500 technology and video-game workers organize to join the union since 2020. This is CWA’s own reported total for that period, not an independently audited industry statistic. It should be presented with that attribution and timeframe.
CODE-CWA
CODE-CWA describes itself as a union movement for workers in technology, games and digital industries in the United States and Canada. Its campaigns can involve large or small companies, studios, publishers, nonprofits and other workplaces, including issues involving working conditions and ethical use of labor. A movement with a broad public agenda can still contain separate bargaining units; participation in a campaign does not prove that every participant is covered by one employer-specific contract.
What UVW-CWA’s launch does—and does not—mean
CWA announced United Videogame Workers-CWA Local 9433 (UVW-CWA) on March 20, 2025, in partnership with the American Federation of Musicians. CWA presented it as a direct-join, industry-wide union for game workers in the United States and Canada. The announced scope includes freelancers, independent developers, unemployed workers and people already organizing a workplace, as well as workers employed by studios.

That direct-join model is designed to let workers build power across the industry and act on concerns that extend beyond one studio. Its mission statement, quoted in CWA’s announcement, says: “We are the ones that make the games, so we must be the ones that set the terms of how we work.”

Membership in an industry-wide union should not be casually described as coverage by a studio collective-bargaining agreement. A member may join the union for solidarity, education, organizing support or industry-wide campaigns while working at an employer that has no recognized bargaining unit with the union. To determine contract coverage, look for the specific employer, bargaining unit, recognition or certification record, and agreement that apply to the worker.
Why occupation matters in the game industry
“Game worker” covers substantially different jobs and legal relationships. A performer may work under a talent agreement; a programmer may be an employee in a studio bargaining unit; an independent developer may be self-employed; and a freelancer may have a contract that does not create an employment relationship. The organization’s scope must be checked before assuming that a campaign or contract covers everyone who contributes to a game.
SAG-AFTRA as an occupational example
SAG-AFTRA’s August 13, 2024 guidance concerns members performing video-game work and the union agreements that apply to that work. Its guidance states that Global Rule One requires members to work under a union contract, while specified interim or tiered-budget agreements can permit continued work in defined circumstances. This is an occupationally focused example involving performers; it should not be treated as interchangeable with an all-industry game-worker organizing body.
Strike, interim-agreement and membership details can change. Anyone making a current work decision should check the latest guidance from the relevant union and the actual agreement offered for the project.

Does a game-studio union represent every game worker?
No. Representation is determined by scope, not by the word “game” in an organization’s name. A union may cover employees at one studio, a craft across several employers, performers under a production agreement, or members who have joined an industry-wide organization without an employer-specific bargaining relationship.
Representation usually turns on four separate questions:
- Who is the worker? Employee, freelancer, contractor, independent developer, performer and unemployed worker can have different eligibility and legal rights.
- Which organization is involved? Confirm the union, local, advocacy network or coalition named in the membership and governing documents.
- What is the work and location? A contract may cover a particular occupation, production, studio, country, province or state.
- What formal relationship exists with the employer? Look for voluntary recognition, certification, an election result or a signed agreement naming the employer and bargaining unit.
How to identify what an organization can actually do
Use the following verification process before describing a group to colleagues, journalists or management as a union or bargaining representative.
- Read the governing documents. Find the constitution, bylaws, membership terms and officer-election rules. Note whether workers control decisions and how dues or contributions are handled.
- Check membership eligibility. Determine whether the organization accepts employees only, or also freelancers, students, unemployed workers, independent developers and supporters. Eligibility does not by itself establish contract coverage.
- Verify affiliation. An organization may be independent, affiliated with a larger union, or merely cooperating with one. Confirm the relationship from official organizational statements.
- Locate the bargaining-unit record. Search the relevant labor authority’s recognition, certification or election records, or ask the union for the employer and unit description. If no employer-specific record exists, do not imply that a certified unit exists.
- Read the contract itself. Identify covered classifications, locations, term dates, wages, benefits, discipline rules, grievance procedure and who may enforce each provision.
- Separate campaign claims from legal status. A slogan, petition or public demand demonstrates organizing activity, not necessarily bargaining authority.
- Check the date and jurisdiction. Membership numbers, agreements, strike status and recognition can change. Confirm current information for the country, state or province involved.
Common misunderstandings and how to avoid them
“Everyone in the group is covered by a contract.”
Not necessarily. A union may have members outside any employer-specific unit, and an advocacy campaign may include supporters who are not employees. Coverage requires a defined unit and an applicable agreement or legal recognition.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors“An advocacy group has no leverage.”
That is also too broad. Coordinated workers can win policy changes, public commitments, severance improvements or safety measures without a certified union. The distinction is that those gains arise from persuasion, collective action or a voluntary deal rather than an automatic statutory duty to bargain.
Best Value
“Every union is certified in the same way.”
Recognition and certification rules differ among countries, public and private sectors, and types of workers. Avoid presenting one procedure as universal. Identify the governing labor authority and the process used for the particular workplace.
“A union must already have a contract.”
A union can exist and organize before winning a first agreement. Conversely, a group can negotiate a voluntary statement or policy without being a recognized union. Organization, recognition and contract status are separate questions.
Choosing the right description in a game-studio dispute
Use “union” when the organization identifies itself as a labor organization and the relevant facts support that description. Add the necessary qualifier—such as “industry-wide membership union,” “union organizing a bargaining unit,” or “certified representative of employees at a named studio.” Use “employee advocacy group” when the organization’s documented role is education, campaigning, mutual support or organizing assistance and no stronger legal status has been established.

What workers should do next
If you are considering joining an advocacy group
- Ask what services and campaigns membership provides.
- Find out whether the group is affiliated with a union and whether joining creates any union membership or dues obligation.
- Ask how confidential organizing information is protected.
- Request a clear explanation of whether the group can represent you in a grievance or bargain with your employer.
If you are considering joining a union
- Read the constitution, dues schedule and membership eligibility rules.
- Ask whether your workplace already has a recognized unit or is still organizing.
- Identify the proposed bargaining unit and which roles may be excluded under applicable law.
- Review how officers are elected, how contracts are ratified and how disputes are handled.
- Obtain current legal advice for your jurisdiction if retaliation, classification or immigration concerns are involved.
If management asks who represents employees
Request the organization’s formal name, the employees it claims to represent, the recognition or certification basis, and any proposed agreement. Do not rely on a social-media description or campaign slogan to determine bargaining obligations.
Bottom line for game workers
A union is defined by collective representation and the capacity—once the applicable legal or voluntary recognition requirements are met—to bargain for workers. An employee advocacy group is a broader organizing and campaigning form whose legal powers depend on its actual structure and relationship with workers and employers. The two can cooperate, and an advocacy movement can help build a union, but neither the label “advocacy group” nor the word “union” answers the coverage question by itself. For any game worker, the decisive evidence is the organization’s rules, the worker’s occupation and location, the named employer, the bargaining-unit status and the contract or legal process that applies.
