Short answer: An emulator and a game ROM are different things, and owning a game does not automatically make every copy or download lawful. In the United States, the legality of emulator software, how you obtain or make a game copy, whether you share it, and whether you bypass access controls are separate questions. The rules also vary by country.
Emulation and ROMs are not the same thing
What an emulator does
An emulator is software that imitates enough of one system for software designed for that system to run on another device. Nintendo UK describes emulators in similar terms. That technical function does not, by itself, establish whether a game file used with the emulator was lawfully obtained. Nintendo UK’s explanation reflects the company’s position as a rights holder; it is not a court ruling. Nintendo also says some unauthorized emulators circumvent security measures, a claim that should be attributed to Nintendo rather than treated as a universal legal finding.

What a ROM is
“ROM” commonly refers to a digital copy or image of a game program. Making, obtaining, hosting, or sharing that copy raises copyright questions distinct from the legality of the emulator itself. An emulator does not authorize a ROM, and a lawful emulator does not make an unauthorized game file lawful. WIPO discusses ROM hosting and downloading as conduct that can implicate copyright reproduction and distribution rights. WIPO’s analysis also summarizes enforcement against ROM-hosting sites.
Does owning a game make its ROM legal?
Not automatically. Ownership of a physical cartridge or disc is not the same as owning unrestricted rights to reproduce the game software. The answer depends on the country, the terms under which the game was acquired, how the copy was made or obtained, whether it is distributed, and whether access controls were bypassed. In particular, having a retail copy does not by itself establish that downloading a ROM from an unauthorized site is permitted.

Separate these questions when assessing a particular situation:
- Jurisdiction: Which country’s copyright and anti-circumvention rules apply?
- Acquisition: Was the game copy lawfully obtained or licensed?
- Copying: Did you make or obtain a new copy, and what rules govern that act?
- Sharing: Did you upload, host, or otherwise distribute copies?
- Access controls: Did the process bypass a technological measure that controls access?
- Exceptions: Does a specific statutory exemption apply to the exact activity and circumstances?
What U.S. law says about circumvention and exemptions
DMCA Section 1201 is a separate issue
U.S. copyright law generally prohibits circumventing technological measures that control access to copyrighted works. The U.S. Copyright Office explains that the law also provides a rulemaking for limited exemptions: “Section 1201, however, also directs the Librarian of Congress, upon the recommendation of the Register of Copyrights following a rulemaking proceeding, to determine whether the prohibition on circumvention is having, or is likely to have, an adverse effect on users’ ability to make noninfringing uses of particular classes of copyrighted works.” The Copyright Office’s Section 1201 materials describe this process.

These exemptions are limited and temporary. The 2024 rulemaking produced a final rule dated October 28, 2024. The Copyright Office’s current overview says the tenth triennial proceeding is underway and describes renewals for October 2027 through October 2030. Check the current proceeding and rule text for any later changes before relying on an exemption.
Video-game preservation exemptions are narrowly defined
Current 37 CFR § 201.40 includes specified video-game circumstances, not a general personal ROM-download exception. Among them are certain uses of lawfully acquired complete games when required server authentication has ceased, for local gameplay, and defined preservation activity by eligible libraries, archives, or museums. Other provisions address preservation by eligible institutions of certain lawfully acquired games that are no longer reasonably available commercially. The regulation sets conditions for server status, institutional eligibility, and access. Read the current text of 37 CFR § 201.40.

An exemption from Section 1201’s circumvention prohibition does not itself authorize copyright infringement under other parts of copyright law. The copying and distribution questions remain separate.
The interoperability provision is not a general copying license
17 U.S.C. § 1201(f) allows limited circumvention in specified circumstances to identify and analyze elements needed for interoperability with an independently created program, where the person lawfully obtained the right to use the computer program and the acts do not constitute infringement. It is not a blanket consumer permission to dump game cartridges or download ROMs. See 17 U.S.C. § 1201.

Why unauthorized ROM distribution carries particular risk
WIPO recounts the U.S. RomUniverse litigation, in which a court found the site operator liable for directly infringing by uploading Nintendo game ROMs, contributing to infringement by facilitating downloads, and vicarious infringement in connection with financial benefit and the ability to prevent infringement. That case concerned the operator’s distribution activity. It does not decide every question about private emulation or a copy made from a game someone owns, but it illustrates why hosting and sharing unauthorized ROMs are materially different from merely running emulator software.
Why the answer differs outside the United States
U.S. rules should not be treated as worldwide advice. For example, Canada’s Copyright Act § 30.6 allows certain adaptation or backup acts for computer programs when statutory conditions are met, including personal use and destroying the adaptation or backup when the person ceases to own or hold a licence for the copy. That provision is a jurisdictional contrast, not a complete answer to every Canadian video-game or technological-protection-measure issue. Read Canada’s Copyright Act § 30.6.
A practical way to think about a game you want to play
For a specific title, first identify the country whose law applies and the source of the game copy. Then ask whether you are making or obtaining a copy, sharing it, or bypassing access controls, and whether a clearly applicable exception covers those acts. A licensed re-release or other authorized version, if currently available under terms that permit your intended use, avoids relying on an uncertain copying exception.
