Short answer: “AI in mortgage lending” is an umbrella term for several systems that process documents, verify income, screen for fraud, estimate property values, support underwriting, or assist with servicing. An automated finding or score is not automatically a final approval or denial, and a lender remains responsible for fair-lending and consumer-protection duties.

The sections below explain what each system does, when it can affect your application, what an adverse-action notice must contain, how bias is evaluated, and what the 2024 federal rule for automated valuation models actually covers.

What “AI in mortgage lending” actually means

There is no single technology called mortgage AI. Lenders may combine conventional rules, statistical models, machine-learning systems, optical character recognition, third-party data and human review. The same application can pass through several tools, each with a different purpose and legal scope.

System type Typical task Common inputs Typical output What it does not establish by itself
Automated underwriting Evaluate standardized application data against eligibility and risk criteria Income, assets, debts, credit and property data submitted in the standardized application Findings, conditions or a recommendation That the loan is finally approved; the lender still verifies information and applies its policies
Document and income tools Extract, reconcile or verify information Pay statements, tax documents, bank records and third-party employment or asset data Structured fields, matched records, exceptions or verification results That an extracted value is correct when the source document is unclear or inconsistent
Fraud screening Identify unusual patterns or possible misrepresentation Application data, transaction patterns, identity signals and third-party risk scores Risk score, alert or referral for investigation That fraud occurred; a person must resolve an alert and the lender must follow applicable law
Automated valuation model (AVM) Estimate a property’s value Property characteristics, comparable-sales data and other market or location information Estimated value and sometimes a confidence or risk indicator That the estimate is an appraisal, is error-free or controls every lending decision
Servicing and customer-support automation Handle payments, inquiries, loss mitigation or routing after origination Account records, payment history and customer communications Classification, next action or response draft That consumer-protection rules stop applying after closing

Fannie Mae’s 2023 lender survey identified appraisal automation, income and employment verification, data and document reconciliation, and compliance management as areas executives considered promising. Those are examples of use or interest, not proof that every lender has deployed them.

How automated underwriting fits into a mortgage decision

Automated underwriting systems compare a standardized dataset with a lender’s or investor’s eligibility requirements. Fannie Mae’s Desktop Underwriter and Freddie Mac’s Loan Product Advisor are commonly discussed in the context of the standardized Uniform Residential Loan Application (URLA) and its corresponding dataset. Fannie Mae’s FAQ says its answers were current as of October 15, 2025.

What the system returns

A system can return an accept, refer, ineligible or similar finding, together with conditions such as proof of funds, a clarification of income or a review of liabilities. The exact labels and workflow vary by lender and loan program. A finding is a component of the underwriting record, not a universal legal definition of approval.

Why a human may still be involved

Loan staff may need to verify documents, resolve conflicting data, evaluate circumstances the model cannot represent, check program overlays or decide whether an exception is permitted. The sources available for this guide do not establish any particular lender’s internal sequence or how much discretion an underwriter has, so borrowers should ask their lender who reviews a finding and what remains outstanding.

Can AI deny your mortgage?

It can influence a denial, but the phrase “AI denied me” is usually too broad. A model may flag risk, produce an ineligible finding or identify missing information. The creditor then takes the adverse credit action under its underwriting process. The lender—not the software—remains responsible for compliance with fair-lending and consumer-protection requirements.

The Consumer Financial Protection Bureau (CFPB) said in a September 19, 2023 announcement that “There is no special exemption for artificial intelligence.” The same announcement states: “Creditors must be able to specifically explain their reasons for denial.” These statements mean that using a complex or proprietary model does not remove the obligation to give an accurate explanation.

What a borrower should do after an AI-assisted denial

  1. Read the adverse-action notice. It should identify the specific principal reasons for the denial or other adverse action, along with any other disclosures required for your situation.
  2. Check whether the reasons match your file. Compare the notice with your income, debts, credit information, property details and documents. Look for a data-entry error, stale report or document that was misread.
  3. Ask for clarification using the notice’s contact instructions. Request that the lender explain how the stated reasons relate to your application. A generic checklist category is not enough when it does not reflect the actual decision basis.
  4. Use the lender’s dispute or correction process. Provide evidence of inaccurate information and keep copies of documents and communications. A correction may trigger a new review, but no source establishes that it must change the outcome.
  5. Escalate a suspected legal violation. If you believe the action involved prohibited discrimination or an inaccurate explanation, consider speaking with a qualified housing or consumer-law professional or contacting the appropriate regulator. The notice itself should identify available rights and contact channels.

The CFPB’s statement does not establish a right to receive source code, every model parameter or a complete technical description of a proprietary system. The practical entitlement is an accurate, specific statement of the reasons for the creditor’s action.

Is AI mortgage lending biased?

It can be, but fairness cannot be decided by looking only at whether a model contains a protected characteristic. Data, proxy variables, labels, business rules, human overrides and the way a score is used can all affect outcomes.

Two core fair-lending concepts

The Office of the Comptroller of the Currency (OCC) describes disparate treatment as treating an applicant differently because of a prohibited basis. Disparate impact concerns a facially neutral practice that disproportionately burdens people on a prohibited basis. The distinction matters because removing race, sex or another protected attribute from a dataset does not automatically eliminate proxy effects or unequal results.

Where discrimination can occur

The Department of Housing and Urban Development (HUD) explains that the Fair Housing Act applies throughout the mortgage lifecycle, including advertising, broker services, underwriting, approval or denial, loan terms, appraisals, servicing and loan-modification assistance. A lender therefore needs controls beyond the initial credit decision.

What testing should examine

CFPB guidance says fair-lending review should look for both disparate treatment and disparate impact and consider less discriminatory alternatives. A meaningful program can examine approval rates, pricing, documentation burdens, appraisal outcomes, exception handling, fraud referrals and servicing results across relevant protected groups, while accounting for legitimate risk factors and data quality. Testing should also cover vendors and third-party scores rather than assuming an outside model transfers responsibility away from the lender.

What recent oversight does—and does not—show

In its 2025 annual report describing supervision during calendar year 2024, CFPB said mortgage-origination work included potential discrimination in underwriting and pricing, weaknesses in fair-lending compliance-management systems, appraisal-service-provider risks and HMDA data-integrity and validation issues. This is an oversight snapshot for the covered work; it is not a finding against every lender and does not establish a universal 2026 enforcement priority.

Does AI decide your home’s value?

An AVM can produce an estimated value that a lender uses for a particular transaction. It may reduce manual work or help determine whether a traditional appraisal is needed, but an estimate is not automatically a physical inspection or a guarantee of market value.

What the 2024 federal AVM rule covers

On July 17, 2024, the CFPB, Federal Deposit Insurance Corporation, Federal Housing Finance Agency, Federal Reserve Board, National Credit Union Administration and OCC announced a final rule establishing quality-control standards for AVMs used by mortgage originators and secondary-market issuers in certain transactions secured by a consumer’s principal dwelling.

The rule calls for policies, practices, procedures and control systems designed to produce credible and reliable estimates and to comply with applicable nondiscrimination laws. It is an AVM-specific rule with defined coverage. It is not a general law governing every AI tool, every property-analytics use or every valuation outside the covered transactions.

Questions to ask about a valuation

  • Was an AVM used, and for what purpose?
  • Was a licensed appraisal or another valuation method also required?
  • What property data or comparable sales were missing or unusual?
  • How can you provide corrections if the public record or property facts are wrong?

The answer to these questions depends on the lender, loan program and transaction. The federal rule does not promise a borrower a particular valuation method or a detailed disclosure of a model’s internal formula.

How lenders should govern AI systems

A responsible program treats a model as part of a controlled process rather than as an autonomous decision-maker. At minimum, governance should address:

  • Fair-lending analysis: evaluate disparate treatment and disparate impact, investigate disparities and assess less discriminatory alternatives.
  • Human controls: set escalation rules, override permissions, quality checks and monitoring for exceptions or drift.
  • Explanation and records: retain enough decision information to produce accurate adverse-action reasons and to investigate complaints.
  • Vendor oversight: impose contractual, testing and audit requirements on third-party providers and do not assume a vendor’s “black box” eliminates the creditor’s duties.
  • Security and privacy: limit access, protect sensitive borrower information and control how data is reused.

How to compare two mortgage AI systems

Marketing labels are less useful than the system’s role and controls. For any comparison, ask these six questions:

  1. What task does it perform? Underwriting, document processing, fraud screening, valuation and servicing have different risks.
  2. What data does it use? Identify the fields, source, age, consent status and method used to resolve conflicts.
  3. What is the output? A recommendation, risk score, alert, value estimate or binding decision has different consequences.
  4. How is it validated? Ask about accuracy testing, monitoring, error rates, recalibration and fair-lending analysis.
  5. What explanation reaches the borrower? A lender must be able to state accurate adverse-action reasons even if the underlying model is complex.
  6. What rules apply? The AVM quality-control rule, fair-lending laws, HMDA obligations and other requirements may apply differently depending on the function and transaction.

What borrowers should ask their lender

  • Which parts of my application were automated, and which were reviewed by a person?
  • Did an automated underwriting finding, fraud alert or valuation estimate create a condition or delay?
  • What information should I correct if the system used an inaccurate document or public record?
  • If my application is denied, how will the adverse-action reasons be determined?
  • Who can review an exception or disputed data point?
  • Was a third-party model involved, and which lender team is responsible for the final decision?

A lender may not disclose proprietary code or every model feature, but it should be able to explain the process at a level that lets you identify factual errors and understand the stated reason for an adverse action.

How widespread is AI in mortgage lending?

There is no current market-wide AI-adoption percentage established by the cited sources. Fannie Mae’s 2023 Mortgage Lender Sentiment Survey reported responses from 219 senior executives at Fannie Mae lending-institution customers. Its online survey describes application areas and executive views; it is not a census of all lenders and does not measure universal deployment.

Consequently, one lender may automate document extraction while another uses a vendor score only for fraud review, and a third may rely mainly on rules and manual underwriting. Claims that “all lenders use AI” or that one model decides every mortgage go beyond the available evidence.

Key takeaways for a mortgage application

  • AI is a category of tools, not a single mortgage decision-maker.
  • Automated underwriting findings, fraud alerts and AVM estimates can influence a file without being final approval or denial on their own.
  • Lenders remain responsible for fair-lending, consumer-protection and explanation requirements.
  • Protected-attribute removal does not by itself prove a model is fair; outcomes and less discriminatory alternatives require testing.
  • The July 17, 2024 federal rule addresses quality controls for covered AVM uses, not every AI application.
  • If you receive an adverse-action notice, focus first on whether its specific reasons accurately describe what happened in your file.
