Short answer: A construction product needs a FRAND licence when it implements a communications or other technical standard covered by someone else’s valid, in-force standard-essential patent (SEP), and the relevant patent holder has made a licensing commitment under the standard-setting organisation’s rules. The obligation usually follows the technology inside a product—such as 5G, NB-IoT, Wi-Fi, Bluetooth, Zigbee or Ethernet—not the fact that the product is used on a building site. BIM data standards are a separate interoperability layer and should not be treated as FRAND-encumbered merely because they are called standards.
FRAND means fair, reasonable and non-discriminatory. It is a framework for negotiating a licence, not a published tariff or a guarantee of a royalty-free right to use a standard. A declaration that a patent is essential is a lead for investigation, not proof that the patent is essential, valid or infringed.

What FRAND and SEP mean in a construction context
A standard-essential patent is about technical necessity
WIPO defines an SEP as a patent protecting an invention essential to implementing a particular technology standard. In practical terms, a product cannot comply with a mandatory part of that standard without using the claimed invention, assuming the patent claim is valid and enforceable in the relevant country. A patent that merely improves performance, saves power or makes a proprietary add-on easier is not automatically essential.

A declaration in an industry database does not establish the legal result. WIPO’s FRAND economics material expressly cautions that “an essentiality declaration, however, does not by itself establish that a patent is in fact essential.” The same declaration also does not prove validity, ownership, current term or infringement by a particular product.

FRAND is a licensing commitment, not a price list
When a company declares an SEP to a standards body, it may commit to offer licences on fair, reasonable and non-discriminatory terms under that body’s intellectual-property policy. ETSI describes the commercial consequence plainly: “Specific licensing terms and negotiations are commercial matters between the companies.” The commitment does not set one global rate for every device, territory, licensee or supply-chain level.
A FRAND assessment can consider comparable licences, the strength and size of a portfolio, the portion of the standard actually implemented, geographic coverage, remaining patent term, the royalty base and the aggregate burden on a product. Two offers can therefore differ without one automatically being discriminatory; the parties must be able to explain the difference using objective factors rather than bargaining power or retaliation.
Why construction companies encounter SEPs indirectly
The construction buyer often purchases a sensor, controller, gateway, lift-monitoring unit, security panel or machine telematics module. The SEP owner, however, may hold patents in a cellular, wireless or networking standard used by a chipset or communications module inside that product. The building contractor may never negotiate directly with a telecommunications patent owner, yet licensing terms can still affect the product’s price, warranty, supply contract or ability to be sold in a country.

Responsibility depends on the licence chain and on national law. A component maker may have a licence covering its module, while an end-product maker may need its own licence for additional implementation, integration or distribution activities. Contracts should state who is licensed, for which products and territories, and whether downstream sales are covered.

Where standard-essential exposure appears in construction technology
| Technology or standard family | Construction use | SEP question to ask | Typical affected product |
|---|---|---|---|
| 5G and other cellular standards | Connected cranes, autonomous equipment, private-campus networks, building gateways and remote monitoring | Which cellular releases and optional features are implemented, and which patent portfolios cover them? | 5G modem, router, gateway or machine controller |
| NB-IoT | Low-power meters, environmental sensors, leak detection and distributed asset monitoring | Does the module implement the declared NB-IoT features, and is the module or finished device licensed? | Battery sensor, meter or embedded communications board |
| Wi-Fi | Building automation, cameras, access control, worker communications and commissioning tools | Which Wi-Fi generation and mandatory modes are used, and are licences passed through the supply chain? | Access point, camera, controller or handheld terminal |
| Bluetooth and Zigbee | Lighting controls, occupancy sensors, commissioning and short-range building networks | Is the implementation limited to unprotected profiles, or does it use patented mandatory radio functions? | Lighting node, sensor, actuator or commissioning device |
| Ethernet and related networking | Fixed building networks, industrial controllers, safety systems and backhaul | Which physical-layer and protocol features are implemented, and in which jurisdictions are patents in force? | Switch, controller, safety gateway or industrial computer |
| BIM and data-interoperability standards | Exchange of object properties, dictionaries and project information | Is there a specifically identified patent claim essential to the adopted requirement, rather than simply a standards-compliance obligation? | BIM authoring, coordination or data-management software |
UK government guidance identifies 5G, NB-IoT, Wi-Fi, Bluetooth, Zigbee and Ethernet as areas where SEPs can arise. That does not mean every implementation infringes a declared patent. The relevant standard release, optional features and product claim chart still have to be examined.
BIM standards are a different licensing layer
ISO 23386:2020 establishes rules for defining and maintaining properties in interconnected data dictionaries used for BIM sharing. The ISO page records that this edition was reviewed and confirmed in 2025. Its subject is information structure and interoperability; the available evidence does not identify an SEP pool or a FRAND licensing programme attached to the standard.
China’s GB/T 45393.1-2025 is a national standard setting general requirements for BIM software. China’s State Administration for Market Regulation published it on 25 April 2025, and it took effect on 1 November 2025. Compliance with that software standard is not, by itself, evidence that a product uses a patented communications invention or that a FRAND royalty is due.

How to test whether a declared SEP is really essential
Start with the claim and the correct standard version
Obtain the complete patent claims, prosecution history where relevant, legal status and the exact normative text of the standard release implemented by the product. Map every claim limitation to a mandatory requirement or unavoidable implementation step. If a claim limitation can be omitted while the product still complies, the patent may not be essential to that implementation.
Use declarations as discovery tools
WIPO PATENTSCOPE now marks declared SEPs from ETSI, IEEE and ITU; the announcement was dated 30 April 2025. ETSI also maintains its own IPR database and tells potential licensees to contact the declarant before relying on a declaration. Search both the declaration record and the standard-setting organisation’s documents, then verify the patent family and current owner.
Check legal status and infringement separately
Confirm expiration, maintenance, ownership transfers, geographic coverage and any validity decisions in each target jurisdiction. A patent can be declared essential yet expired, abandoned, invalidated or never infringed by the product configuration. Essentiality, validity and infringement are separate questions and should appear as separate columns in an internal claim chart.

WIPO notes that sampling may be appropriate for a large portfolio. The sample should be designed for the decision being made: settlement valuation, an injunction response, a validity challenge or an audit of a supplier’s licence. Record the sampling method, confidence limits and assumptions; do not present a sample result as proof that every portfolio patent is essential.

Who pays a FRAND royalty?
There is no universal rule that makes the building owner, general contractor or component maker pay. The answer follows the product placed on the market, the licensing programme and the contract chain. A purchaser should request written confirmation of the licensed level instead of assuming that a chip or module licence covers every downstream use.
| Supply-chain position | Questions to resolve in the contract | Typical risk if unclear |
|---|---|---|
| Chip or module supplier | Does its licence cover the relevant standard releases, territories and module sales? | Supplier may pass through a charge or exclude finished-product uses. |
| Equipment or device maker | Is the complete product licensed, including software, antennas and optional modes? | Separate demand from an SEP owner, audit exposure or sales restrictions. |
| System integrator | Does integration create a new implementing product or merely resell a licensed device? | Unclear responsibility for configuration, updates and private-network deployment. |
| Contractor or building operator | Are licence costs and indemnities allocated in procurement documents? | Unexpected cost, replacement demand or project delay if a supplier’s licence is limited. |
For a smart-building sensor, for example, the manufacturer may license its cellular module, while the sensor brand negotiates coverage for the finished device and the integrator confirms that deployment in each country is permitted. The construction customer should obtain a licence statement and indemnity that match the actual sales territory and product configuration.
An eight-step FRAND diligence workflow
- Define the product and markets. List each model, radio or network function, software-controlled option, target country and planned sales date. Record the standard name, release and profile actually implemented.
- Search declaration records. Check WIPO PATENTSCOPE, the ETSI IPR database and the relevant standards body’s records. Save the declaration date, declared claims or family members, owner and standard version. Treat each result as a lead.
- Build a claim chart. Map every limitation of each candidate claim to the normative standard text and to the product’s real implementation. Note alternatives, optional features and configuration switches.
- Verify legal status. Check priority, expiry, assignments, maintenance, jurisdiction and known validity decisions. A declaration without a live, enforceable patent in the sales country may have no royalty consequence there.
- Request a substantiated offer. Ask for the portfolio list, essentiality explanation, proposed royalty base, comparable licences, pool terms and identification of the licensed supply-chain level. Ask which products and territories are excluded.
- Evaluate a pool, if offered. Compare its members, covered standards and releases, allocation method, rates, audit rights and territorial reach. A pool does not necessarily include every relevant SEP or every patent family declared to a standards body.
- Exchange offers in good faith. Put proposals, counteroffers, information requests and response deadlines in writing. Use confidentiality controls and competition-law advice when exchanging sensitive commercial information or discussing aggregate rates with competitors.
- Choose a resolution path. Compare a negotiated licence with mediation, arbitration or litigation. Model injunction exposure, security requirements, product redesign, replacement suppliers and the cost of essentiality or validity challenges in each country.
How to compare competing FRAND proposals
| Comparison axis | What to examine |
|---|---|
| Standard and version | Named releases, mandatory versus optional features, and whether future updates are included. |
| Essentiality evidence | Claim charts, independent assessments, sampling method and treatment of disputed patents. |
| Validity and term | Live patents, expiry dates, prosecution or opposition history and remaining term by country. |
| Geography | Countries covered, sales and use rights, export treatment and changes when a product is deployed across borders. |
| Royalty base | Chip, module, device or another economic unit; treatment of software, updates, accessories and replacement parts. |
| Aggregate burden | Existing licences, pool payments and the total burden on the product rather than one portfolio viewed in isolation. |
| Supply-chain coverage | Rights and indemnities for suppliers, component makers, integrators and finished-product manufacturers. |
| Administration | Reporting frequency, audit scope, records retention, currency, tax and treatment of confidential data. |
| Disputes and remedies | Forum, governing law, mediation or arbitration, security, injunction language and continued supply during a dispute. |
Why there is no single “fair FRAND rate” for 5G, Wi-Fi or IoT
No authoritative source identified a construction-specific FRAND royalty rate. A credible rate analysis must account for the value of the patented contribution, the number and strength of relevant patents, comparable licences, the product’s selling level, geographic scope and the total royalty burden from all standard families. A 5G-enabled gateway, a low-cost NB-IoT sensor and a high-value industrial controller can therefore produce different outcomes even when they operate in the same building.
Ask whether a quoted figure is recurring or one-time, per unit or percentage-based, worldwide or country-specific, and calculated on a module, component or finished product. Confirm currency, minimum payments, reporting periods, caps, back royalties and treatment of discontinued models. A headline percentage without its base and assumptions is not a usable FRAND comparison.

Negotiation, injunction and competition-law risk
Courts and regulators examine conduct as well as numbers. A prospective licensee that ignores a detailed offer, withholds essential sales information or delays without explanation can weaken its position. A patent owner that refuses to identify the relevant claims, demands terms unrelated to its portfolio or seeks inconsistent treatment of similarly situated licensees can face its own scrutiny.
Maintain a dated file of notices, claim charts, information requests, offers, counteroffers and reasons for rejection. Separate technical essentiality work from commercial valuation, and restrict access to competitors’ sensitive information. If an injunction is threatened, obtain jurisdiction-specific advice immediately; available remedies, security rules and approaches to willing-licensee conduct differ among countries.
Questions to ask before buying a connected construction product
- Which communications standards and release versions does the product implement?
- Which supplier or manufacturer holds the relevant licences, and at what supply-chain level?
- Are licences worldwide or limited to named countries and deployment types?
- Does the price include recurring SEP royalties, pool fees and future-standard updates?
- What indemnity applies if a patent owner alleges infringement after installation?
- Can the supplier provide a declaration search, claim-chart summary or independent essentiality assessment?
- What happens to service, firmware updates and replacement units during a licensing dispute?
Current reference points
WIPO’s SEP Case Law Collection page, described in 2026 as containing more than 100 rulings, is useful for seeing how courts address essentiality, FRAND conduct and remedies. WIPO PATENTSCOPE’s 30 April 2025 update added declared SEP information from ETSI, IEEE and ITU. ETSI’s IPR database remains the organisation’s principal declaration record. These databases support diligence; they do not replace claim analysis or legal advice.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsFor BIM, ISO 23386:2020 remains the relevant property-and-data-dictionary reference noted above, with its edition reviewed and confirmed in 2025. GB/T 45393.1-2025 governs general BIM software requirements in China from 1 November 2025. Neither fact establishes a FRAND royalty for BIM software or construction projects.
Practical conclusion for construction buyers
Treat FRAND as a documented, evidence-based licensing process. Identify the exact standard implementation, trace declarations to live patent claims, verify validity and territory, establish which supply-chain party is licensed, and compare offers on a defined royalty base and total burden. For connected building equipment, the communications standard is usually the exposure point; for BIM, standardisation and patent essentiality must be analysed separately. A careful record and a written allocation of licence responsibility are the most effective protections against surprise royalties, disrupted supply and avoidable injunction risk.
