Fox News’ October 8, 2026, AI newsletter reports that voters in California, Florida, Illinois, Kansas, Nevada, Ohio and Wisconsin face 34 data-center-related ballot measures ahead of November’s midterm elections. Ohio accounts for 20 of them across 17 jurisdictions. The votes put local decisions about data-center development into the broader debate over the economic promise and community costs of the technology boom.

Which states have data-center measures on the ballot?

The newsletter names seven states: California, Florida, Illinois, Kansas, Nevada, Ohio and Wisconsin. It reports 34 measures in total, but does not provide a complete measure-by-measure list or explain the legal effect of every proposal.

That distinction matters: “data-center-related” does not mean all voters are considering the same kind of measure. The measures may concern different local decisions, and the newsletter’s summary alone is not enough to establish whether a particular vote would affect siting, permitting, taxation, construction or facility operations.

Why Ohio stands out

Ohio is the largest concentration in the report, with 20 measures spread across 17 jurisdictions. That is more than half of the 34 measures cited. The count indicates a substantial number of local contests, not a single statewide vote on one uniform data-center policy.

The Fox News report frames the conflict as a tension between the potential economic gains from development and local concerns about where facilities are built and how they affect communities. At a campaign appearance for Sen. Jon Husted, President Donald Trump said of Ohio data centers: “Look, there’s so much money to be made for Ohio, you can’t just turn them off.” The statement is an argument for the economic opportunity; it does not by itself establish the costs, benefits or likely effects of any specific measure.

What the reported poll says about local support

Fox News reports that its national poll found 71% opposed building AI data centers in their area, including 46% who were strongly opposed. By contrast, 52% supported building them in remote locations. The same poll report says 60% viewed AI negatively and 37% positively.

Those figures are attributed to the Fox News poll as reported by Fox News. The available account does not state the poll’s sample, field dates, methodology or exact question wording, so the percentages should not be treated as a complete or independently verified measure of public opinion. The contrast between responses about a respondent’s area and remote locations suggests that views about AI infrastructure may depend on where development occurs, but the poll figures alone do not explain why respondents answered as they did.

What voters should check about an individual measure

The statewide list and aggregate count are a starting point, not a guide to what a particular ballot item would change. For a local decision, voters need the official ballot text and jurisdiction-specific information. Useful questions include:

  • What is the measure’s legal effect? Determine whether it changes siting rules, permits, taxes, operating requirements or another local policy.
  • Which jurisdiction is covered? A measure in one city, county or other local area should not be assumed to apply statewide.
  • What benefits are being claimed? Look for the proposal’s stated economic case and the evidence offered to support it.
  • What local concerns are documented? Consider claims about land, electricity, water or noise only when they are supported by information specific to the proposal and location.

The newsletter summary does not establish the text, official status or effect of all 34 measures. Without those details, it is not possible to compare the proposals reliably or say what a particular vote would authorize or prevent.

Other AI stories in the newsletter are separate from the ballot count

The newsletter also groups the election story with briefs on AI-enabled scams, workforce demand, AI safety, AI at work and other developments. Those items provide broader context about the technology, but they are not evidence about the content or effects of the state and local ballot measures.

Among the separate topics are AI-related demand for semiconductors, servers and materials; data-center construction and operations jobs; uneven benefits from AI in workplace use; assurances about AI-agent safety; and warnings about scams, including a California voice-cloning allegation. The newsletter also mentions a Memphis debate over a proposed yearlong moratorium and claims by a Department of War official about foreign influence in anti-data-center activism. These are distinct reports and claims, not findings that resolve what any local measure would do.
