Decrypt reported on October 5, 2026, that Anthropic’s systems flagged a Florida woman’s Claude conversations, a human review team escalated them, and the company referred them to law enforcement. The account concerns an arrest and a charge—not a conviction. Anthropic’s published policies allow safety review of flagged conversations and describe an emergency exception to its usual requirement for valid legal process before disclosing user information to authorities.
What has been reported about the Florida arrest
Decrypt reported that investigators alleged Carli Michelle Heller, of Bonita Springs, Florida, wrote in a Claude conversation on September 26, 2026, that she would attack the Lee County Sheriff’s Office. The following day, she allegedly said she had a new gun. Decrypt attributed those details to an arrest report.

According to the report, Anthropic’s automated systems flagged the entries, a human review team escalated them, and the company reported them to law enforcement. Deputies detained Heller without incident, and she faced a written-threat charge. Those are allegations and reported events, not proof of guilt; the details available here are Decrypt’s account of an arrest report, not a court finding.

Decrypt said a court date was set for November 2026. As of October 7, 2026, that date was still in the future, and no later disposition is established. The charge should not be described as a conviction.

Can Anthropic review Claude conversations?
Yes, in certain circumstances described in its consumer guidance. Anthropic says conversations flagged for safety review may be used or analyzed to improve detection and enforcement of its Usage Policy, including training models for its Safeguards team. This describes a possible use of flagged conversations; it does not establish that Heller’s chat was used to train a model.
That policy does not mean that every conversation is routinely read by a person. The reported case describes an automated flag followed by human escalation, but it does not establish how often that happens or what happened to other users’ chats.

Can Claude conversations be disclosed to police?
Anthropic’s government-request guidance says the company generally discloses customer or end-user information in response to valid legal process, such as a validly issued subpoena or warrant. It also states an emergency exception:
“We will make an exception to this policy if we believe there is an emergency that may result in imminent physical harm or death, and providing such information without delay may avert that emergency.”
This is Anthropic’s stated policy. It does not establish whether the company relied on legal process, the emergency exception, or another basis in Heller’s case. The public account does not specify which mechanism, if any, was involved.
Is a Claude chat a private diary?
It is safer not to treat a hosted AI conversation as confidential in the way someone might treat a private diary or a protected communication with a lawyer, doctor, or therapist. Anthropic’s published guidance allows flagged chats to be reviewed for safety enforcement and permits disclosure in the stated emergency circumstances. That is not the same as saying all chats are routinely reviewed or routinely sent to law enforcement.

What Anthropic’s guidance says about model improvement and retention
Anthropic’s privacy update describes consumer chat use for model improvement as something users may choose to allow. It also lists five-year retention for data used to improve Claude. That period applies to the data identified for model improvement; it should not be read as a general retention period for every consumer chat.
The privacy information available for this account does not verify Decrypt’s assertion that opting out results in a three-month retention period, nor does it establish the exact policy version in effect on September 26 and 27, 2026. Users making a decision about a current account should consult Anthropic’s dated privacy terms and settings rather than assume a particular opt-out period.

What users should take from the case
- A reported arrest is not a finding of guilt; the reported November court date had not yet arrived as of October 7, 2026.
- Anthropic’s consumer guidance allows safety-flagged conversations to be analyzed for policy detection and enforcement, including possible Safeguards-team training.
- Anthropic’s government-request policy describes valid legal process as the general route for disclosure and an exception for emergencies involving imminent physical harm or death.
- Do not assume a chat service is an appropriate place for information that must remain confidential. Check the provider’s current, dated policies and account controls before sharing sensitive material.
